HAZARD REVIEW AMENDMENT
Administrative Decision No.5A-2004
RECITALS
1. Parvenir Company LLC ("Applicant") has applied to the Pitkin County Community Development
Director ("Director") for 1041 Hazard Review to add an activity envelope to accommodate mitigation for
potential geologic hazards. The proposed activity envelope is located between the approved building
envelope and the property boundary on the west (uphill) side.
2. The parcel is located east of Aspen near Difficult campground, and is more specifically described in
Cxhibi- A.
The parcel contains approximately 2 acres and is a non-confonning size parcel in the AFR-10 zone
district.
4. The Hearing Officer granted 1041 hazard review, conceptual submission, scenic overlay, special
review app -oval and GMQS exemption, pursuant to Determination No. 039-2001. The 1041 site plan was
recorded in Plat Book 63 at Page 60. The Community Development Director approved an amendment to
the 10� 1 sire plan to add accessory envelopes for the septic system and well pursuant to Administrative
Decision No. 17-2004; the amended site plan was recorded in Plat Book 68 at Page 85. A building permit
for the new residence has been issued (Permit #0414.2004).
5. Rockfall and debris flow were identified as potential hazards during the original 1041 review, and
condition 412 of Determination No. 039-2001 provides for mitigation. Further analysis by an Engineering
Geologist determined that site grading should channelize and direct surface drainage around and away from
the residence. The proposed grading cannot be accommodated within the approved building envelope.
6. Thi Director finds that the activity envelope will not create additional impacts on 1041 hazard areas
and is located on slopes of less than 30%.
THE DIRECTOR DOES HEREBY APPROVE the Parvenir Company LLC 1041 Hazard
Review Amendment, subject to the following conditions, which shall run with the land and be binding on all
successors in interest.
1) The conditions of Hearing Officer Determination 039-2001 and Administrative Decision No. 17-2004
shall remain in full force and effect, except as amended herein.
2) Prior to issuance of any earthmoving, access or building permit applications and/or within 30 days of
the date of this approval, the Applicant shall submit an amended 1041 Hazard Review Site Plan to the
Community Development Department for approval and recordation. The mylar copy of the site plan
mist be signed by the owners prior to submittal for recording. The site plan shall include notes stating
the purpose of the amendment and specifying that the activity envelope shall only accommodate site
grLding and channelization to direct surface drainage around and away from the residence.

3) The Applicant shall submit a mitigation plan that demonstrates that drainage and debris/mudflow will
be directed around and away from the residence, for review and approval by the County Engineer prior
to issuance of a Certificate of Occupancy for the residence.
4) The Applicant shall adhere to all material representations made in the application or in public
meetings or hearings.

The recommendation to extend the concrete foundation walls 3 to 4 feet above finished exterior grade
applies to the Batista residence and residences below Batista to the east and north. We do not belive it is
necessary for the Parvenir Residence to have the foundation walls extend 3 to 4 feet above finished
exterior grade.

Good morning, Suzanne.
I can respond to your note.
Yes, we will (and have) extended our foundation walls up on Batista, and the
areas within the concrete will not have any openings. Our directive in the
letter is to mitigate the debris flow through the use of berming (8'-0" I
think). The concrete is only intended to protect the house from
water/moisture and small amounts of cast-off from the berm/channelization.
(3-4' wall) I can get Liv to clarify if you would like.
On Parvenir, the same chanelization holds true (without a berm requirement
to the extent of Batista) for surface drainage (no debris mitigation), but
only normal concrete heights apply (12" above grade, etc.), although in most
places our concrete is higher. Again, this is for normal surface water
protection.
What Liv has eliminated is the original directive from Collins for the
concrete to withstand a pressure calculation, which he says is not
necessary.
I have copied Liv on this, and maybe he can elaborate in a response,
especially if my response is not complete.

Dear Suzanne,
The Parvenir Company, LLC property currently is entitled to develop an 8,250 square
foot residence, pursuant to Hearing Officer Determination #39-2001. The parcel is
located west of the Roaring Fork River, approximately 3.5 miles east of Aspen,
Colorado (see Attachment E -vicinity map/site plan).
Parvenir Company, LLC, hereinafter "the Applicant", is requesting Pitkin County
approval of an activity envelope to accommodate rockfall and debris flow mitigation
required by Determination #39-2001. A letter from CTL Thompson is attached which
describes the mitigation techniques being considered for this development. The
proposed activity envelope is approximately 2,500 square feet in size and contains
slopes of approximately 20%.
In response to Section 3-200-080- Minor Amendment to a Development Permit, the
Applicant believes that this amendment is consistent with action taken during the
review of the original development and does not constitute a new development
activity.

Dear Suzanne,
On behalf of the owner's of the Parvenir and Batista parcels, we would like to request the
addition of activity envelopes for each property, as detailed in the enclosed drawings.
As part of this request, we have included a letter from CTL/Thompson Inc., describing
the existing geologic conditions of the site, and associated recommendations for design
and control. The CTL/Thompson report -is consistent with previous geologic reports
prepared by Dr. Bruce Collins, although more site-specific in our opinion.
-he two sites have been determined to fall within a debris/mudflow hazard (Batista), and
a drainage discharge area (Parvenir). Both sites will require mitigation for each of these
hazards on the uphill sides of the future structures, effectively west and southwest on the
properties. The mitigation will require at a minimum some site grading and
channelization, and, in the case of Batista, a- diversio>a/containrnent structure, while
possibly raising the foundation walls of each structure(s).
While the land use approvals have determined the development area of both lots, no
provision was made for these mitigations outside the building envelopes. We are
proposing to add 15'-0" — 20'-0" wide activity areas on the uphill sides of each lot for the
roquired mitigation measures. As a note, both proposed areas will also be disturbed due
to wildfire mitigation as part of land use approvals.

We were asked to provide engineering geologic consultation to address
debris/mud flow hazards at Morningstar Preserve southeast of Aspen, Colorado.
Information presented in this letter is based on a review of geologic maps and
literature, an evaluation of stereo adrial photography, field observations and our
experience. The following paragraphs provide descriptions of existing site conditions
and proposed land use and present our recommendations for mitigation of potential
debris/mud flows.
Morningstar Preserve is located west of State Highway 82, approximately 2.5
miles southeast of the City of Aspen in Pitkin County, Colorado. The property is
located on the Roaring Fork Valley floor and the transition zone to the lower mountain
slopes of the valley sides. Ground surfaces slope down to the northeast at grades of
up to about 30 percent at the southwest part of the site, flattening to about 10 percent
at the northeast part of the site. Vegetation consists of aspen forest with a mix of old
growth conifer trees and an undergrowth of brush, grasses and weeds. Existing
access drives to several residences and cabins dating back to the 1940's are at the
sire.
Plans are to improve the existing access drives and develop six building
envelopes for single-family residential use. We anticipate one to two story, wood -
frame structures with walkout lower leveil4s or full basements. Garages, either
at:acl ed or free standing are likely.
Morningstar Preserve is situated on an alluvial fan on the southwest side of the
Roaring Fork River Valley at its' confluence with McFarlane Creek. The alluvial fan is
ccmprised of from debrislmudflows from McFarlane Creek to the west, with lesser
ccntributions from smaller side hill drainages above the site. Poorly consolidated
glacial drift deposits on the slopes above the site provide source material for
debrislmudflows. The discharge from McFarlane Creek is to the northwest of,

and away from, the site. Morningstar Preserve is on the inactive side of the fan and
does not appear to be subject to flooding or debrislmudflow from McFarlane Creek in
the context of 100 -year events.
Three side hill drainages on the valley side to the southwest of the site direct
drainage onto Morningstar Preserve. The drainages are generally parallel to each
other. Taken from the south portion of the site, one drainage discharges onto the
southeast part (McFarlane building envelope), a middle drainage discharges onto the
area of the Parvenir building envelope and the third (northern), drainage discharges to
the west of the site in the area of the Batista building envelope. In our opinion the
southeast and middle drainages are associated with storm water run-off/site-drainage
and do not constitute debrislmudflow hazards. We believe it is appropriate for site
gradirg in areas below the southeast and middle drainages to channelize and direct
surface drainage around and away from structures at Morningstar Preserve.
The drainage just south of McFarlane Creek that impinges on the Batista parcel
presents a debrislmudflow hazard to the west parts of the site. This drainage
produ ped a geologically recent debris flow. Evidence shows that event produced a
channel on the order of 4 feet deep with lateral berms of approximately 4 vertical feet
for a total catchment of approximately 8 vertical feet. The debris flow contained
boulders up to approximately 6 to 8 feet in diameter. Old growth conifer trees
(diameters greater than 24 inches) appear to have been deformed by the event,
indicating the debris flow is likely to have occurred over 100 years ago. We estimate
the debris flow event occurred 150 to 200 years before present. A 100 -year event is
the ncrm in the locale for engineering geologic analysis and basis for mitigation
design.
In our opinion, the most efficient and effective wayto mitigate debris/mud flow
hazards for the site would be to channelize and direct debrislmudflow down, around
and away from the existing and planned buildings. We believe the following
alternatives would provide appropriate mitigation:
1. Clean, grub and increase the depth of the existing debris flow channel
west of the Batista residence. We recommend increasing the
debrislmudflow channel catchment by approximately 30 percent (2.5
vertical feet) by increasing the channel depth. The channel should be
aligned such that the flow is directed away from the site and maintains
confinement and gradient so that discharge is conveyed to an elevation
below the Batista residence. We would need to delineate the section of
channel to modify and alignment in the field.
As an alternative to increasing the existing channel catchment a
diversionlcontainment structure between the existing debris flow
channel and the Batista residence could be constructed. The
dive rsionlcontainment structure can be constructed by excavating,
berming, constructing a concrete wall or Brugg fence ora combination of
the above. The alternate structure would neer} to be sized to contain a
flow of the same size and volume as the capacity of the existing channel

(approximately 8 vertical feet). The structure should begin in the valley
side above the planned Batista residence and extend downhill across the
fan to an elevation equal to or lower than the downhill side of the
residence. Actual location and alignment of the diversion/containment
structure should be based on actual building plans.
We recommend using a bulking factor of 0.5 (50% by volume sediment loading) to
determine size and energy requirements of the mitigation method(s) decided on. As a
minirrum, the hydrology study for debris flow analysis should be based on a 100 -year
storm event.
Building envelopes on the west part of Morningstar Preserve below the Batista
residence will benefit from mitigation discussed above. In addition, site grading for
buildings sited below the Batista residence should provide channelization and
direction of debris/mudflow around and awayfrom buildings. In addition to the above
alternatives we recommend the Batista residence and other buildings in the west part
of Mornigstar Preserve be designed such that the foundation walls on the uphill side
of the buildings extend approximately 3 to 4 feet above finished exterior grade and be
free of openings such as windows, doors, etc.
We should work with the civil engineer and architect to provide engineering
input to develop mitigation plans. We will need to delineate alignments in the field for
mitigation channels, diversion walls, etc.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 018-2004 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or _resent sufficient information to the Planning Commission and/or Board of County
