Septic permit approved per compliance with the engineer design and specifications dated 5-24-05 and
Supplemental Design letter dated July 8, 2005. Any changes must be approved by this department and the
design engineer prior to them being made. Minimum horizontal distances between components of the system and
physical features shall conform to the Pitkin County ISDS regulations.

The design is based on a .95 LTAR and requires a 4666 -gallon two-compartment concrete septic tank with a duplex
pump biotube vault dosing system. Effluent is pressure dosed on alternating cycles to two 50.5 ft X 11 ft sand filter
absorption beds and distributed via lateral perforated pipe installed in 3 rows of 12 gravelless Quick 4 chambers per
bed. The 2 ft of sand must be 2 ft or more above the bedrock. The sand must conform to the intent of Section
6.28.670 A. of the Pitkin County ISDS regulations or conform to ISDS Policy 2005-001. An invoice to document the
type of sand material must be submitted.
This department does not endorse any brand of products. This permit must be kept on-site during installation.
The engineer must do a final inspection of the installation and submit an as -built letter to this department. This
department must also be called for an inspection with a minimum of 48 hours advanced notice.
"Revegetation over the area of the field is very important for the functioning of the system. Pitkin County has guidelines that must be
followed to assure the plants that are introduced are appropriate for the conditions of the area. The use of native plants is strongly
encouraged.

The fee for a ISDS application is $600 for a permit that takes 6 hours or less for the department to approve. If approval takes
longer than 6 hours, a rate of $100 per hour will be charged. The maximum fee is $1000. The basic fee of $600 is due at the
time of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second,
before final approval of the ISDS permit.

Dear Tim and Nancy:
Pursuant to requirements, this letter provides documentation that the new Onsite Wastewater System (OWS)
recently installed at the above referenced site is in general compliance with the permitted design. Sopris
Engineering inspected the excavations and the installation of system components at various times during
construction prior to final backfill. The system constructed on site was designed and built to serve the needs of a 3 -
bedroom house on the lot off of Chateau Way, in the Shield -O -Mesa Subdivision. Sopris Engineering performed
several visits to inspect and document the as built conditions of the constructed system. We have coordinated our
efforts with the contractor that built the system. The as built conditions and installation of the new OWS
components is in compliance with the permitted design specifications for the system.
The System was installed in accordance with Pitkin County Regulations; the design presented in the Sopris
Engineering Report and the design drawing, dated May 24, 2005. A 2000 -gallon dual compartment concrete septic
tank was installed with an appropriate inlet sanitary tee and an Orenco Systems Inc., duplex pump bio -tube vault
dosing assembly and associated piping and controls. The tank effluent discharges to two 50.5' x 11' partially
mounded sand filter/soil absorption bed systems. The beds utilize leaching chambers over a minimum 24 -inch deep
sand filter media and are pressured dosed on alternating cycles. The soil absorption system provides secondary
treatment of wastewater for infiltration into the ground. The partially mounded bed absorption system is installed
over the native soils and select import material. The system meets required setbacks and is installed within the
general locations indicated on the attached plan. Suitable pit run type material fill was placed as needed below the
sand filter to raise the level of the mounded beds to an appropriate height above the seasonal high ground water.
The Sand Filter/absorption beds were installed level. Inspection ports were installed at the terminal ends of the
chambers over the ball valve capped end of the 1.25" perforated distribution pipes. The average depth at the
top of the sand from existing ground is approximately 3 feet. The exposed soils after grubbing were suitable and
consistent across the field. An average 12 -inch layer of sandy pit run material was placed in the excavation below
the sand layer. Approximately 24 inches of pit run and excavated material was placed over a portion of the west
bed where the infiltrative surface appeared to be composed of fractured bedrock material. The chambers were
backfilled with sand and excavated material and covered with filter. A minimum of 12 inches of backfill was
placed over the chamber to the finish grades that have been shaped to provide drainage away from the beds.
Appropriate grading around the down gradient side of the mound was completed with approximate side slopes at
3:1 to daylight. The pump assembly and distribution piping has been installed according to the engineered design
plans. Additional observations of the soils within the field were performed during construction indicating that the
soils are consistent with the description in the geotechnical report.

OWS Operation and Maintenance
The re establishment of vegetative cover over the field and responsibility for inspection and maintenance of the
system will remain with the Lot Owner or the owners representative. All components of the engineered OWS shall
be inspected on a regular basis and be properly maintained. The system and responsibility for repair and
maintenance of the system will remain with the Owner.
The OWS should require minimal maintenance. Several factors influencing the need for maintenance include:
actual wastewater flows versus design flows, the volume of kitchen/domestic waste (excluding human waste and
toilet paper), excessive household chemicals and other toxic liquids. The tank, absorption field and other system
components should be visually inspected bi-annually for debris, damage, leaks, or other potential problems. In
general, for a properly utilized system, septic tanks should be pumped and inspected every 2 - 4 years. The effluent
filter should be cleaned every six months and at the time of pumping. Absorption fields should be maintained with
suitable vegetative cover and kept free of root invasive plants. Positive surface drainage away from the absorption
field should be maintained.

Dear Nancy:
Pursuant to your verbal request and your transmittal dated June 15, 2005, this letter provides supplemental
information in regard to the proposed OWS at the above referenced site.
In regard to the septic tank size we can install a 2000 -gallon tank that will provide approximately 638 gallons of
excess storage capacity. The current design calls for a 1500 -gallon tank that will provide approximately 188 gallons
of excess storage capacity based on the requited detention volume per deign flow. The standard rule of thumb for
upsizing tank capacity when utilizing a pump system is to increase the tank capacity by one size, assuming 250 -
gallon standard capacity increments. The design calls for the pump floats to be set to provide 3" of draw down that
equates to approximately 75 gallons. Therefore approximately 113 gallons of excess capacity is maintained over the
required 1312 gallons calculated for detention time in a 1500 -gallon tank. The dosing volume is slightly less since
there is a lag effect of draw down levels in the tank chambers and the pump basin. This effect results in the lowest
liquid level occurring :in the pump vault and the off float being tripped. We believe that the size of the tank is
adequate to provide effective detention of the effluent however I informed the owner that the tank will need to be
upsized to 2000 gallons since a 1750 -gallon tank is not available. Pursuant to this letter the design will include a
2000 -gallon tank or as an alternative we will install a separate pump vault. If your feel the larger tank is necessary
please include the aforementioned alternatives in the permit or allow the 1500 gallon tank if your comfortable with
my analysis. We will install in accordance with the conditions indicated on the permit.
Attached is the recent geotechnical report for your review with the results of the percolation tests. The test results
and observations are consistent with previous information and our assumptions. The results do not indicate that any
design modifications need to be made.
I performed a site visit today to inspect the staked out location of the field. The fields are to be located further up
gradient toward the house and are staked out over more consistent grades that will not exceed general design
standards. The fields will be within the building and septic envelopes.

Wastewater System Design, off of Chateau Way, Shield -O -Mesa,
Pursuant to your request, this letter presents our findings in regard to the feasibility of design and approval
of an engineered Onsite Wastewater System (OWS) for the above referenced Site. This design is based on
our evaluation of the site conditions with information provided by others for use in supporting your
application to Pitkin County. Our recommendations are in accordance with Pitkin County and the State of
Colorado ISDS Regulations. Pitkin County must permit any proposed improvement to the site. We have
reviewed the information forwarded to us, conducted a site visit, formulated an OWS design and created a
site plan with construction details as part of our scope of work.
Conclusions
Based on our findings we believe that the design and installation of an improved OWS system is feasible in
accordance with Pitkin County Regulations and the State of Colorado. The system will serve the needs of
a 3 -bedroom single-family home. Our design recommendations for an OWS include the installation of a
1500 -gallon concrete septic tank equipped with a duplex pump biotube vault dosing assembly and
associated piping and controls. The treated effluent will discharge to two 50.5' x 11' partially mounded
sand filter/soil absorption bed systems. The beds will utilize leaching chamber and will be pressured dosed
on alternating cycles. The soil absorption system will provide secondary treatment of wastewater for
infiltration into the ground. The partially mounded bed absorption system can be installed over the
native soils and select import material. The system will meet all required setbacks and be installed within
the general boundaries indicated on the plan. Our design is outlined below and delineated on the attached
site plan.
Site Location
The subject site is located off Chateau Way, in Shield -O -Mesa, in Pitkin County, Colorado. The site is
situated in Section 15, T 9 S, R 86 W of the 6`h P.M. The Site comprises approximately 57.7 acres. The
site is bounded by undeveloped mountainous rangelands with scattered single-family acreages.
Existing Site Conditions
The site is located near the crest of a southeast trending ridge near the top of Shield -O -Mesa. The building
envelope is on a relatively flat area moderately sloping to the southeast. The existing ground surface in

the proposed septic development area ranges from 8% to 15%. An exiting gravel driveway provides
access into the building envelope. The rest of the undeveloped site has limited vegetation consisting of
sparse clumps of grass, weeds, scattered scrub oak and sagebrush.
Proposed Site Conditions
It is our understanding that you intend to construct a new home with an attached garage to serve the needs
of a 3 -bedroom home. The proposed structure has a basement space that does not including any plumbing
or drain lines. The proposed improvements will include a new partially mounded absorption field and
septic tank with a pump dosing assembly. The proposed field location, grades and site conditions will be
further evaluated during construction to confirm assumptions made in the following design
recommendations. The new facilities are to be generally located as shown on the plan.
Subsurface Conditions
Attached herewith are the results of the subsurface investigation and percolation tests conducted on April
8, 2005 by Hepworth-Pawlak Geotechnical, Inc. The report is dated April 21, 2005. The subsoil
encountered at the site consists of/z to 1 foot of topsoil overlying 1-3 1/z feet of gravel and cobble size
shale fragments in a sandy clay matrix overlying claystone bedrock. The profile Pits were excavated to
backhoe refusal depths of 21/2 to41/2 feet. Groundwater was not encountered in the pits.
Percolation testing has not been preformed due to winter condition during the soil evaluation.
Based on the soil analysis and observation in the field we are assuming a loading rate for treated effluent to
be between 0.4 and 0.6 gallons per square foot per day.

Design Criteria
The proposed residence will be a 3 -bedroom house. The design flow is calculated as follows:

3600 S.F.

Use a double chamber concrete tank with a filtered dosing pump system and controls. The
tank must have appropriate access openings with watertight risers and lids. The septic tank,
risers and sewage lines must be watertight.
Mounded Absorption Field Design
A site plan is provided to detail the various components of the proposed sewage disposal system. The
location of the proposed absorption field system is down gradient of the proposed structure. A partially
mounded system needs to be built high enough to so that the treatment sand is above the native soil
infiltrative surface. We have designed the mound with the top approximately 1.5 feet above the existing
sloped grade on the up -gradient side of the beds. The bottom of the sand layer should be approximately 2
feet or more above the bedrock. The following information details the technical criteria utilized in design
of a proposed system.
Proposed Absorption System
Area required for treatment bed in mound system:
Long Term Acceptance Rate method (LTAR)
Using imported course sand media yields the minimum area:
LTAR maximum loading rate for 24" deep sand filter = 0.95gal/S.F./day
A=Q/LTAR = 1050/0.95 = 1105 sq. ft.
We recommend the use of two equally sized sand filter absorption beds utilizing pressure dosed leaching
chamber installed in a typical mounded bed configuration over the top of the sand layer. We recommend
the installation72 uick-4 Infiltrator chambers in two beds with 3 rows of 12 chamber units each.
Use: Minimum two 50.5'x 11' partially mounded sand/filter absorption beds underlying pressure
dosed leaching chambers.
The total perimeter area of placed sand in the partially mounded field is approximately 1900 S.F.
The chambers in each trench shall be installed at level grade. The bottom elevation of each trench may
vary to achieve a maximum depth of 36" inches to the trench bottom surface below the proposed grade.

The grade below the sand layer shall be filled level with suitable excavated material or 3" minus sandy pit
run material. Install with minimum 10" cover over top of chambers.
Inspection ports shall be installed at the terminal ends of the chambers over the ball valve capped end of
the 1.25" perforated distribution pipes. The vertical inspection ports shall be 4" SDR 35 or schedule 40
pipes extending at least 6" above the surface. This will allow for checking the performance of the system
and distribution pipe maintenance. The mound needs to be graded to prevent surface water runoff from
collecting on or around the mound.
Effluent Dosing Distribution System
The effluent from the septic tank will be pressured dosed to the field by an alternating duplex pump system
installed in the secondary compartment of the septic tank. A septic tank effluent will be pumped through
dual 1.5" transport line from the discharge assemblies to the distribution manifold header at the head of
each bed and be distributed through the individual 1.25" pressurized distribution laterals. The 1.25"
pressurized distribution laterals will be installed on the top of the sand layer and run the full length of the
chamber rows.
We recommend the use of an Orenco Systems BioTube pump vault system. The pump system shall
incorporate a duplex pump system to insure continuous operation and alternate dosing between the beds.
The controls shall provide for alternate operation of each pump. Automatic float switches including a high
water float with alarm shall be incorporated in the system. The pump assembly and dosing chamber will be
installed in the secondary compartment of the septic tank. The vault will utilize a maintainable effluent
filter. The effluent pumps are sized to pump at a minimum velocity of 4 ft/sec at approximately 47 gpm.
The dosing volume will be approximately 75 gallons. Install pumps assemblies, risers, electrical systems,
floats and discharge line per manufactures installation guidelines. Use an Orenco systems pump model
P5005-12dax2. The system shall be inspected by a qualified technician after installation.
An Orenco systems pump control panel shall be installed by a qualified installer in coordination with the
electrician. We recommend 230 volt electric service be provided to the pumps. The power supply for the
pumps and controls shall consist of (2) 20 amp circuits for the pumps and (1) 10 -amp circuit for controls.
Provide line of site disconnect with control box. The electrician or qualified installer shall install electrical
wires in conduit from the control panel to the pump assembly junction box in the riser over the pump
basin.
All installation and maintenance shall be performed by a qualified person in accordance with the
installation & maintenance guidelines for the Orenco systems bio -tube vault pump assembly.
The transport line from the dosing pump to the absorption field shall be schedule 40 PVC with a maximum
diameter of 1.5 inches. The transport line will be installed with a minimum 2% slope to insure complete
drainage into the beds. The perforated pipe will have 3/16" orifices oriented upward to spray against the
interior of the chambers. Two 3/16'' drain orifices oriented downward will be installed over splash plates
or orifice shields. A 4" inspection port will be installed on the end chambers over the ball valve capped
ends of the distribution laterals.

absorption field and other system components should be visually inspected bi-annually for debris, damage,
leaks, or other potential problems. In general, for a properly utilized system, septic tanks should be
pumped and inspected every 2 - 4 years. The effluent filters should be cleaned every six months and at the
time of pumping. Absorption fields should be maintained with suitable cover and kept free of root
invasive plants. Positive surface drainage away from the absorption field should be maintained.
Construction and Inspections
Prior to construction of the permitted system the engineer should be contacted by the contractor and owner
well in advance to provide adequate time to discuss the system components with the contractor, answer
questions, resolve any conflict issues and schedule inspection site visits based on construction progress.
County Regulations require that the Design Engineers of record perform site inspections of the permitted
system during construction and provide "As -Built" documentation of the installed system to the County
after construction is complete. The Regulations further require site inspections and approval by the County
Environmental Health Department of the exposed components of the system prior to backfilling.
Therefore the County Environmental Health Department should also be contacted and notified of the
construction schedule.
General Notes
1) All materials and installation practices shall conform to Pitkin County and the State of Colorado
Individual Sewage Disposal Regulations.
2) All sewer lines and distribution lines in the system shall be 4" Schedule 40 or SDR -35 PVC unless
specified otherwise on the plans.
3) Add a two-way clean out on the service line from the proposed house addition.
4) The contractor shall ensure that the concrete septic tank, risers and sewer lines are watertight.
5) The mounded bed area must be protected to prevent damage from vehicular or livestock traffic and
must be crowned to divert drainage runoff away from the bed.
6) A pressurized distribution manifold header pipe shall be installed at the head of the field to insure equal
distribution to individual 4" perforated distribution laterals.
7) The treatment sand shall be clean concrete sand with an effective size in the range of 0.25 mm and 0.75
mm is recommended, with a CU of 5.0 or less.
8) The infiltration chambers shall be installed level in each bed. The top of the backfill over the
chambers shall be covered with filter fabric to prevent the migration of fines from the overlying topsoil
layer. We recommend that sand be used to backfill the chambers to the top of the louvers.

9) A final cover of soil suitable for vegetation, a minimum 4" deep, shall be placed to the finished surface
grade. The mound shall be planted or seeded with mulch for suitable vegetative cover.
10) Fill utilized in constructing the mound and or bed base must be clean suitable 3 inch minus sandy pit
run or suitable native material. Fill materials to be approved by the engineer.
Our design and recommendations are based upon data supplied to us by others. If subsurface or site
conditions are found to be different from those presented in this report, we should be notified to evaluate
the effect it may have on the proposed ISDS. If the County Environmental Health Department requests
changes or modifications to this design, we should be contacted to evaluate the effect on the ISDS.

the flooding of our downstairs. Had to extract water and dry the walls through an insurance claim. Stored
furniture and previously stored items where I could. Everything is dry now. House work never seems to end, I will
continue my efforts forever.

I want to reconfirm our phone conversations on May 26th and June 13th and the outcome of our site
visit to this property on May 31.
We discussed that a larger septic tank is required because the dosing duplex pump replaces some of
the tank capacity and there must be additional capacity for the dosing when there is not a separate
dosing tank. I will need a letter from you indicating this change.
In addition, the application was incomplete because it did not include percolation test information.
was told that HPhad been contacted to do this. I have not received this information. It
appeared to me that the soil would pLr& okay, but our regulations do require 3 soil percolation tests
in the area where the absorption system is to be located. (Article 5: Soil Tests, 6.26.310). The
system design is for 2 ft of sand and we need to be assured that there is a total of 4 feet of suitable
soil to treat the effluent.
Because of the varying slopes and the small area for the house and septic components, I required that
the location of the house and septic beds (primarily the north bed) be staked to assure the setback
from the house could be met and that the beds could be positioned in the best areas due to the
slopes.
After receiving the percolation soil data, you and I were to go to the site to review the staking and
determine the final location of the beds.
At that, if everything is fine, I will be able to issue the septic permit.

OK, after discussions with both Paul and Tim, I said we could not release his permit until he had soil
testing done and he also staked the area of the field, per your request. Since they had people waiting on
site with equipment, I was wondering if there was a way to issue the foundation permit. My
conversation with Tim was that he had 2 options, either to wait for you to get back (monday) or to try to
get a foundation permit which would allow him to get started, but may cost quite a bit more. The last
message from Jim was that he had talked to Tim and was going to simply release the whole permit, but
with BIG, BOLD letters say that all EH issues need to be addressed within 1 month (July 8). That is
what I understood. Now, I confused and extremely busy, so I'm not sure if this is a battle I need to fight
or not. Can you take care of this when you get back? If there is a MAJOR reason that they should not
have their building permit (aside from the fact that this is not how the process works) - like there is not
enough room on the property, etc... call Jim right away.
Sorry to leave you with that mess, but I was unclear talking to Paul with his understanding and then
reading your notes - I couldn't put it all together.

Subject: Observation of Excavation and Percolation Testing, Proposed. Residence,
Off of Chateau Way, Shield -O -Mesa, Pitkin County, Colorado.
Dear Mr. Jenks:
As requested by, Hepworth - Pawlak Gcotecluiical, Inc., observed the excavation and
performed percolation testing at the subject site on June 30, 2005 to evaluate the materials
exposed for foundation support acid septic disposal design. We previously conducted a
subsoil study for design of foundations at the site and presented our findings in a report
dated April 21, 2005, Job No. 105 299.
The proposed residence will be a two story wood frame structure over a partial walkout
basement level and crawlspace. The attached garage and basement floors will be slab -on -
grade. Spread footings sized for an allowable bearing pressure of 2,000 psf were
recommended in the previous report for building support.
At the titre of our visit to the site, the foundation excavation was in progress and had
been cut in four levels from 3 to 9'/z feet below the adjacent ground surface. The
materials exposed in the bottom of the excavation consisted of gravel acid cobbles in a
sandy clay matrix (Weathered claystone/shale bedrock) in the shallower cuts and hard
claystone/shale in the deeper cuts. The upper soils and rocks were loose and disturbed
from the excavating equipment. In addition, there were some roots and organic soils in
the northeast portion of the excavation. We recommended via telephone that the loose
disturbed soils and rock, roots and organics be removed prior to forming footings and
placing concrete. No free water was encountered in the excavation and the soils and
bedrock materials were slightly moist.
The conditions exposed in the excavation arc consistent with those previously
encountered on the site and suitable For support of spread footings designed for the
recommended allowable bearing pressure of 2,000 psF. Other recommendations
presented in our previous report which arc applicable should also be observed.
Three percolation test holes had been hand dug and snaked by the client prior to our
wrival on site. The percolation test boles were located in the area. of the previous profile
pit excavated downbil) to the east of the residence at the locations shown on Figure 1.

Percolation testing was conducted on October 30, 2005, by a representative ofFlepworth -
Pawlak Geotechnical, Inc. The percolation test results are summarized on Table 1. The
Percolation test results indicate an infiltration rate between 6 and 16 minutes per inch with
an average of 6 minutes per inch. The soils exposed in the hest holes consisted of 3 to 4
inches of topsoil overlying gravel and cobbles in a sandy clay matrix (weathered
claystone/shale). The soils exposed in the Profile Pit previously excavated, consisted of
about 3 feet of gravel and cobbles in a sandy clay matrix overlying hard claystone/shale
bedrock to the refusal depth of 3'/, feet. Duc to the shallow bedrock in the area, a
professional civil engineer should design the septic disposal system.

Dear Mr. Jenks:
As requested, Hepworth-Pawlak Geotechnical, Inc. performed a subsoil study for design
of foundations at the subject site. The study was conducted in accordance with our
agreement for geotechnical engineering services to you dated April 7, 2005. The data
obtained and our recommendations based on the proposed construction and subsurface
conditions encountered are presented in this report. Evaluation of potential geologic
hazard impacts to the site are beyond the scope of this study.
Proposed Construction: The proposed residence will be a two story wood frame
structure over a partial basement level and crawlspace located on the site as shown on
Figure 1. The attached garage and basement floors will be slab -on -grade. Cut depths are
expected to range between about 4 to 8 feet. Foundation loadings for this type of
construction are assumed to be relatively light and typical of the proposed type of
construction.
If building conditions or foundation loadings are significantly different from those
described above, we should be notified to re-evaluate the recommendations presented in
this report.
Site Conditions: The site is located near the crest of a southeast trending ridge near the
top of Shield -O -Mesa. The site was vacant at the time of our field exploration. A
graveled driveway provides access into the building area. The ground surface in the
building area is relatively flat with a moderate slope down to the southeast at a grade of
about 8%. There is about 6 feet of elevation difference across the proposed building area.
The terrain becomes steep on the flanks of the ridge with slopes down to the southwest
and northeast at grades of about 30%. There is no vegetation in the proposed building
area. Vegetation on the slopes consists of scruboak, sagebrush, grass and weeds.
Subsurface Conditions: The subsurface conditions at the site were evaluated by
excavating three exploratory pits and a profile pit at the approximate locations shown on
Figure 1. The logs of the pits are presented on Figure 2. The subsoils encountered, below
about %Z to 1 foot of topsoil, generally consist of about 1 to 3% feet of medium dense,
gravel to cobble size shale fragments in a sandy clay matrix overlying hard claystone-

shale bedrock to the backhoe refusal depths of 21/z to 41/2 feet. Results of a gradation
analysis performed on a sample of clayey gravel (minus 6 inch fraction) obtained from
the site are presented on Figure 3. Atterberg limits testing indicates the clay matrix soils
have low plasticity. No free water was observed in the pits at the time of excavation and
the soils were slightly moist to moist. The bedrock was slightly moist.
Foundation Recommendations: Considering the subsurface conditions encountered in
the exploratory pits and the nature of the proposed construction, we recommend spread
footings placed on the undisturbed natural soil or bedrock materials designed for an
allowable bearing pressure of 2,000 psf for support of the proposed residence. Footings
should be a minimum width of 16 inches for continuous walls and 2 feet for columns.
Loose disturbed soils and rock encountered at the foundation bearing level within the
excavation should be removed and the footing bearing level extended down to the
undisturbed natural soils or bedrock materials. The cuts could encounter very hard
bedrock and require rock excavation techniques, such as blasting, chipping and splitting.
Exterior footings should be provided with adequate cover above their bearing elevations
for frost protection. Placement of footings at least 42 inches below the exterior grade is
typically used in this area. Continuous foundation walls should be reinforced top and
bottom to span local anomalies such as by assuming an unsupported length of at least 12
feet. Foundation walls acting as retaining structures should be designed to resist a lateral
earth pressure based on an equivalent fluid unit weight of at least 50 pcf for the on-site
soil as backfill, excluding topsoil and oversized rock. A sliding coefficient of 0.40 and a
passive earth pressure of 350 pcf, equivalent fluid unit weight for compacted backfill, can
be used to resist lateral loads on the foundation.
Floor Slabs: The natural on-site soils and bedrock, exclusive of topsoil, are suitable to
support lightly loaded slab -on -grade construction. To reduce the effects of some
differential movement, floor slabs should be separated from all bearing walls and
columns with expansion joints which allow unrestrained vertical movement. Floor slab
control joints should be used to reduce damage due to shrinkage cracking. The
requirements for joint spacing and slab reinforcement should be established by the
designer based on experience and the intended slab use. A minimum 4 inch layer of free -
draining gravel should be placed beneath basement level slabs to facilitate drainage. This
material should consist of minus 2 inch aggregate with less than 50% passing the No. 4
sieve and less than 2% passing the No. 200 sieve.
All fill materials for support of floor slabs should be compacted to at least 95% of
maximum standard Proctor density at a moisture content near optimum. Required fill can
consist of the on-site soils devoid of vegetation, topsoil and oversized rock.
Underdrain System: Although free water was not encountered during our exploration, it
has been our experience in the area and where bedrock is shallow that local perched
groundwater can develop during times of heavy precipitation or seasonal runoff. Frozen
ground during spring runoff can create a perched condition. We recommend below -grade
construction, such as retaining walls, crawlspace and basement areas, be protected from
wetting and hydrostatic pressure buildup by an underdrain system.

The drains should consist of drainpipe placed in the bottom of the wall backfill
surrounded above the invert level with free -draining granular material. The drain should
be placed at each level of excavation and at least 1 foot below lowest adjacent finish
grade and sloped at a minimum I% to a suitable gravity outlet. Free -draining granular
material used in the underdrain system should contain less than 2% passing the No. 200
sieve, less than 50% passing the No. 4 sieve and have a maximum size of 2 inches. The
drain gravel backfill should be at least 1'/z feet deep.
Surface Drainage: The following drainage precautions should be observed during
construction and maintained at all times after the residence.has been completed:
1) Inundation of the foundation excavations and underslab areas should be
avoided during construction.
2) Exterior backfill should be adjusted to near optimum moisture and
compacted to at least 95% of the maximum standard Proctor density in
pavement and slab areas and to at least 90% of the maximum standard
Proctor density in landscape areas. Free -draining wall backfill should be
capped with about 2 feet of the on-site, finer graded soils to reduce surface
water infiltration.
3) The ground surface surrounding the exterior of the building should be
sloped to drain away from the foundation in all directions. We
recommend a minimum slope of 12 inches in the first 10 feet in unpaved
areas and a minimum slope of 3 inches in the first 10 feet in pavement and
walkway areas.
4) Roof downspouts and drains should discharge well beyond the limits of all
backfill.
Percolation Testing: Percolation tests were not conducted due to Pitkin County's
requirements for performing percolation tests after April 15 and the relatively shallow
claystone bedrock encountered in the septic disposal area. The disposal system will likely
need to be engineered. The septic disposal system should be designed by a civil engineer.
We can assist the designer if percolation tests at shallow depth are needed.
Limitations: This study has been conducted in accordance with generally accepted
geotechnical engineering principles and practices in this area at this time. We make no
warranty either express or implied. The conclusions and recommendations submitted in
this report are based upon the data obtained from the exploratory pits excavated at the
locations indicated on Figure 1 and to the depths shown on Figure 2, the proposed type of
construction, and our experience in the area. Our services do not include determining the
presence, prevention or possibility of mold or other biological contaminants (MOBC)
developing in the future. If the client is concerned about MOBC, then a professional in
this special field of practice should be consulted. Our findings include interpolation and
extrapolation of the subsurface conditions identified at the exploratory pits and variations
in the subsurface conditions may not become evident until excavation is performed. If
conditions encountered during construction appear different from those described in this

report, we should be notified at once so re-evaluation of the recommendations may be
made.
This report has been prepared for the exclusive use by our client for design purposes. We
are not responsible for technical interpretations by others of our information. As the
project evolves, we should provide continued consultation and field services during
construction to review and monitor the implementation of our recommendations, and to
verify that the recommendations have been appropriately interpreted. Significant design
changes may require additional analysis or modifications to the recommendations
presented herein. We recommend on-site observation of excavations and foundation
bearing strata and testing of structural fill by a representative of the geotechnical
engineer.

March, 1978 between Martin J. Fiala, Robert —
berrttJ. Schuster,
R. C. Ashley and R. Elghammer and Thomas S. Gilbert,
WITNESSET Ii :
WHEREAS, Ralph C. Ashley, Richard Elghammer and
martin Fiala and Robert T. Schuster have drilled a water
well on the real property described on Exhibit "A"
attached hereto and incorporated herein; and
WHEREAS, Ralph C. Ashley and Richard Elghammer have
sold, conveyed and assigned all of their rights to said
real property to Thomas S. Gilbert, and,
WHEREAS Ailbert, Fiala and Schuster are desirous of
further defining the rights, obligations and duties regarding
the completion operation and maintenance of said well and
domestic water system pursuant to the previous agreements
made between the parties;
NOW, THEREFORE, in consideration of the mutual promises
made herein and other good and valuable consideration the
parties hereto agree as follows:
I.
GRANT OF EASEMENT
Gilbert hereby quit claims and convey= to Fiala and
Schuster a perpetual non-exclusive easement and right of
way over and across the following described real property:
See Exhibit "A" attached hereto and
incorporated herein.
The purposes of said easement shall be limited to the right
to excavate for, install, replace and maintain and use all
necessary equi.pmcnt and appurtenances for the operation of
the existing well and of a mutual domestic water system
for residential use. Gilbert further grants Fiala and

Schuster the i icjhL to bring electrical phone services
across the 57 acre tract owned by Gilbert and terminating in
the one acre easement described on Exhibit "A" attached
hereto and incorporated herein.
II.
MAINTENANCE AND EXPENSE SHARING
The parties agree to share equally the water from said
well for their respective single family residences. It
is agreed that Fiala, Schuster, Ashley and Elghammer
shall install, at their expense, a pump adequate to handle
the domestic needs of the parties no later than July 1,
1978. Subsequent to the installation of the well pump
the costs of maintenance, construction of necessary holding
tank facilities and other necessary improvements tur the
water system and repair of the well and power and phone
line installations shall be shared equally between Fiala,
Schuster and Gilbert PROVIDED, HOWEVER, that each of the
foregoing parties shall be responsible for the extension
of all water lines, phone and power lines from the well site
and easement area to their respective residences. With
regard to actual power necessary to operate the well pump,
this cost shall be shared equally by those parties who
have extended water lines from the well to their residences.
At such gime as each party extends his water line from the
well to his residence he shall assume his pro -rata share
of electrical expense necessary to operate said well.
Any charge or assessment shall be due and payable within
thirty (30) days from the receipt of statement from any party
to this agreement, his heirs, executors and assigns.

ADJUDICATION OF WELI,
Ashley and Elghammer agree that as soon as is practically
possible they shall file Z statement of beneficial use regarding
said well and take all necessary steps, pursuant to the applicable
statutes and regulations of the State of Colorado, to have said
well adjudicated in the names of Fiala, Schuster and Gilbert,
each having a one-third (1/3) interest in said well. The legal
costs and other expenses of said adjudication shall be borne
equally by Fiala, Schuster and Gilbert.
IV.
MISCFT,T,ANEOUS
Fiala and Schuster acknowledge that Gilbert intends
to construct a 1,600 square foot single family dwelling plus
a garage on the one acre easement tract attached hereto as
y Exhibit "A" and incorporated herein, and agree that the ease-
ment rights granted herein shall be exercised only i„ such a
manner as to not interfere with the construction of said house

It is understood that this agreement shall be binding
upon the parties hereto *and upon any and all of their heirs,
executors, personal representatives and assigns, who shall -
