Dear Mr. Broughton,
You asked about the intended use of the kitchen in the central unit of the new retreat
house. We anticipate the use of this facility will be the same as the use of the kitchen in
the present ranch house retreat facility, that is the monastery itself will not provide any
food service for the retreatants. The groups that are on retreat bring their own food and
prepare it and serve it themselves. We simply provide the facilities and equipment such
as refrigerator, stoves, etc.
If you have any further questions about the use of the retreat house kitchen, please do
not hesitate to call me.

From our meeting on 11-4-92 the topic of the retreat center acting as a food service
establishment, or not was presented to Father Joseph Boyle of the monastery.
His response is indicated in a letter addressed to me dated 11-4-92. This letter seems
to satisfy the issues that it will not be operated by the Monks as a food service
establishment, and will not act as a food storage area. I have included this letter for
your files.
I hope that this information is enough to establish water and waste calculations in
order to satisfy the requirements of water usage defined as 1300 gallons per day.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITRIN COUNTY, COLORADO GRANTING SPECIAL REVIEW APPROVAL
FOR THE ST. BENEDICT'S MONASTERY RETREAT CENTER
Resolution # 92- 552
RECITALS
1. St. Benedict's Monastery (hereinafter "Applicant"), has
applied to Pitkin County to request special review approval
to construct a retreat center not to exceed 11,000 square
feet, pursuant to GMQS Exemption Section 5-510.2(f), Special
Review 3-6 and 1041 Hazard Review Section 5-400 of the Land
Use Code; and
2. The Monastery retreat center is to be located in Section
16, Township 9 South, Range 86 West of the 6th PM; and
3. The Applicants' request was considered before the
Planning and Zoning Commission on August 4, 1992 at which time
the Commission recommended approval of the applicant's request
with conditions; and
4. The application was considered at a duly noticed public
hearing before the Board of County Commissioners on September
29, 1992 at which time the Board has found that the
Applicants' request meets the requirements of the Land Use
Code; and
5. The Retreat Center has been granted a fee waiver by the
Board because it is a non-profit, non -denominational essential
community facility.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Resolution # 92 -

Commissioners of Pitkin County, Colorado that it hereby grants
Special Review approval for the St. Benedict's Monastery Retreat
Center subject to the following conditions:
1. To comply with the requirements of the County Engineer
the applicant shall:
a. Submit a site plan with right-of-ways accurately
shown. Easements shall be dedicated to the County
for Capitol.Creek Road.
b. An erosion and drainage plan shall be submitted to
and approved by the County Engineer, prior to
issuance of a building permit.
C. The roadway to the Retreat Center shall be the
minimum width acceptable to provide emergency access
while meeting County Road Standards.
2. To comply with the requirements of the Division of
Wildlife the applicant shall:
a. Prohibit dogs at the Retreat Center.
k�. All new fencing the entire parcel shall be limited
to a maximum of 42 inches, four strand/rail or less,
with a minimum of 12 inch kick space provided
between the top and second strand/rail. Hay storage
fences, garden fences and sheep pasture fences
approved by the Division of Wildlife are permitted,
although they may exceed this requirement.
C. No vegetation manipulation is permitted outside of
the building envelope.
3. The applicant shall submit a housing analysis report to
the Housing Office once the full time equivalent (FTE)
employees of the Retreat Center at the Monastery exceeds
three (3) FTE's. This analysis shall be evaluated by the
Housing Office to determine the increase in hired
employees and any necessary mitigation requirements. The
analysis will be forwarded to the BOCC for consideration.
4. The applicant shall revise the site plan to provide a
total of 23 parking spaces for the Retreat Center.
Parking spaces may be unimproved.

Prior to issuance of a building permit, the applicant
shall meet the requirements of the Environmental Health
Department with regard to the water supply. An agreement
between the State Forest Service, Environmental Health
Department, and Basalt Fire Protection District shall be
made to determine the adequate size of a water storage
tank for the Retreat Center.
C6`.,1 Prior to issuance of a building permit, the applicant
shall provide septic systems which meet the requirements
of the Environmental Health Department. The total
average daily flow from the building may not exceed 1,300
gallons per day. The applicant shall take the following
measures to limit water consumption for the Retreat
Center:
a. Low flow toilets using less than 1.5 gallons per
flush.
b. Low flow shower heads using less than 1.5 gallons
per minute.
7. The applicant shall provide a 1041 Hazard Review site
plan for approval by the Planning Office, County Engineer
and County Attorney, prior to issuance of a building
permit. The following 1041 Hazard Review warning and
disclaimer shall be placed on the plat:
"The provisions of these regulations do not in anyway
assure or imply that areas outside of designated hazard
areas will be free from hazards, or that approved
mitigation measures will guarantee the safety of any
property."
8. The applicant shall provide an annual report to the
Planning•Office within thirty (30) days prior to each
anniversary of the initial granting of the permit by the
Board, attesting to the continued conformance of the use
to the conditions of the permit.
9. All material representations made by the applicant in the
application and during public meetings shall be adhered
to.
10 The structures shall be constructed with a non-
combustible roof material including, but not limited to,
tile, asphalt or metal roof material or Class B Certi-
Guard (registered brand name) Red Label shakes and
shingles or other roof material utilizing Class B
construction techniques (1/2" minimum solid sheathing)

or better, space shall be required for all new structures
on the site.
11. The applicant shall apply for and receive an initial
building permit within three (3) years and have vested
rights for full buildout for a period of ten (10) years
from the date of the Board of County Commissioners
resolution approving the Retreat Center.
12. Prior to issuance of a Certificate of Occupancy for the
final building of the Retreat Center, the accommodations
in the gate house, old school house, ranch house, barn
room and Stanley place shall be converted into non-
public spaces to be used solely as accommodations
incident to the direct operation of the Monastery.
13. The following conditions are to mitigate potential
wildfire hazards on the parcel:
a. The areas around proposed structures shall
incorporate landscaping with wildfire defensible
space considerations as follows:
1. Brush, debris and non -ornamental vegetation
shall be removed and a minimum 10' perimeter
around the structure(s) shall be maintained.
2. Vegetation shall be reduced and maintained
where necessary to break up the vertical and
horizontal continuity of the fuels a minimum
of 30' perimeter around the structure built on
flat ground. (for increased slopes ref. CSFS
Safety Zone chart pg. 13 Wildfire Safety
Guidelines For Rural Homeowners)
3. Crown spacing between clumps of brush or stand
separation within the 30' perimeter shall be
a minimum of two times the height of the fuel.
4. Pruning all branches from trees and brush
within the 30' perimeter to a height of 10'
above the ground and removal of ladder fuels
from around trees and brush.
5. Trim all branches which extend over the roof
eaves and remove branches within 15' of the
chimney.
6. Reduce the density of fuels within a 100'
perimeter of the structure(s) where natural

reduction has not already occurred.
b. Any additional proposed buildings within the
building envelopes shall incorporate the above
wildfire hazard mitigation measures.
4] 14f Prior to issuance of any building permits, the applicant
shall obtain an approved legal water supply.
15. At the time the Monastery sells the property or the
Retreat Center is no longer operated by the Monastery,
a new GMQS and special review shall be required for the
Retreat Center.

Re: St. Benedict's Monastery Legal Water Supply Plan (0304A)
Dear Ms. Schaffner:
At the request of Timothy McFlynn, Esq., counsel for St.
Benedict's Monastery, we have reviewed the water rights associated
with the Monastery property and find that a legal water supply
presently exists for the proposed and approved uses set forth in
the Resolution presently being circulated for signature by the
Board of County Commissioners. A list of water rights purportedly
owned by the St. Benedict's Monastery are attached as Exhibit "A"
to this correspondence. Inclusive within the list is the St.
Benedict's Monastery Pipeline and Tank's water right originally
accorded Structure No. 566 and Water District Priority No. 780.
This water right was decreed in Civil Action No. 5884, Garfield
County District Court, on November 5, 1971, with an appropriation
date of April 29, 1961, for 0.10 cfs, absolute, with the right to
construct storage tanks to a capacity of 0.0145 a.f. The decreed
uses for this water right encompass domestic, fire protection and
irrigation of lawns "about the buildings" of the St. Benedict's
Monastery.
The improvements to be constructed upon the property consist
of a retreat center complex to accommodate uses and people that
already exist upon the property. In other words, additional water
consuming demand is not contemplated by the Applicant. We have
engaged in a limited review of the hydrologic regime of Lower
Capital Creek and Snowmass Creek and find that a 1971 water right
should be able to provide an adequate legal water supply in all
years. Moreover, since the water right was decreed in 1971 as an
absolute water right, the water right is a beneficiary of Senate
Document 80, Act of August 9, 1937, 50 Stat. 564 authorizing the
construction and operation of Green Mountain Reservoir, a federal
reservoir and component of the Colorado Big Thompson Project. As
such, releases will be made by exchange for the benefit of the
subject water right to avoid administrative curtailment by a water
right on the mainstem of the Colorado River.

We have received additional information related to the above referenced proposal
to establish a monastery retreat center on a 3200 acre parcel. Although no information
on water requirements was presented, the applicants attorney has stated that water would
be supplied under the Saint Benedict's Pipeline and Tanks, which were decreed for a
diversion rate 0.10 CFS or 45 gallons per minute, and 0.0145 acre feet or 4,725 gallons
of storage for the tanks. In Water Court Case Number 83CW357, 0.0156 CFS or 7 gallons
per minute of divE!rsion was moved to the Saint Benedicts Well, operating under permit
number 134601. With 24 hour pumping this well could produce 10,080 gallons per day.
We have no objection to the proposal contingent upon the applicant providing to the
County antot s office, documentation indicating that their estimated water requirements
will not exceed the suDDly available from the well.
