In regards to the high bacteria count for the well, Jason from Aspen Consoladated Water and
Sewage has suggested a shock treatment for the well. He also says that sometimes it takes a period
of 3 months to clear up a well. So I will go ahead with the shock treatment and over the next two
months see if I can clear up the well as to the bacteria count.
If this fails I have the options of putting in a clorination system that will kill the bacteria , or a UV
light treatment that does the same thing.

the Regan property on Shield -O -Mesa. The following information
was obtained;

Subject: Soils Evaluation and Percolation Test for Individual Sewage System Design for a 3 -acre
Parcel of Land, Lot 6B, Shield -O' -Terrace Subdivision, numbered as 0203 Old Pond Way
Dear Mark,
As requested, Nelson Environmental and Wastewater Solutions, Ltd., performed a soils study and
percolation tests on the subject property to design a septic system for the proposed residence.
We conducted this study according to Section 5-1 through 5-5 of Pitkin County Individual
Sewage Disposal System Regulation (Revised May 1995) on Tuesday, May 16, 1995. We have
based our recommendations on the subsurface conditions encountered. Please furnish this letter
and an individual sewage disposal system permit application to the Aspen/Pitkin Environmental
Health Department at your earliest opportunity so that you may obtain a permit to construct this
sewage system.
Proposed Construction:
The planned residence is a four bedroom, four bathroom, two-story frame house with a walk -out
finished basement. The total living area of the house is calculated to be 2172 square feet.
The property is to be served by a drilled well domestic water supply.
Site Conditions:
The site is a lot in the Shield -O' -Terrace Subdivision. Typical of the lots in this portion of the
subdivision, the building site is located in an area covered with oak brush and sagebrush and
grasses.
The ground surface, which appears natural in the proposed area of the proposed absorption field,
slopes rather gently to the Southeast at a 10% to 15% grade. There are no irrigation ditches or
streams in the immediate area.
Subsurface Conditions:
A soil profile pit, within an area considered suitable for an on-site wastewater disposal system
absorption field, was excavated.. The excavation revealed that no groundwater or bedrock
present within seven feet of the surface of the ground.

The soils on the property consisted of 23 to 28 inches of very dark gray loam topsoil overlaying a
lighter tan clay loam grading to a sandy clay loam with some gravel and cobble fragments, three
or four inches in diameter to over two feet in diameter encountered below a depth of four feet.
The subsoil was relatively more sandy and gravelly toward the bottom of the profile pit
excavation.
Percolation Testing:
The subsurface soil conditions were evaluated with the standard percolation test procedures at the
approximate location shown on Figure 1. The subsoil, in which the percolation testing was done,
consisted of a sandy clay loam. These tan soils were very moist and well consolidated, and
showed little tendency to swell. The test holes were prepared by hand -digging a small hole in the
bottom of a forty inch deep backhoe excavation. Three inches of gravel were placed in each test
hole after all loose soil had been removed and the test hole sidewalls roughened. The test hole
preparation avoided smearing the surfaces.
Percolation testing was performed in the proposed absorption area location. The percolation
holes were pre-soaked by adding water to a depth of ten inches above the gravel layer at regular
intervals throughout the day. An initial filling of approximately eighteen gallons was done the
morning the test was conducted. When the test began, the test holes contained about 4 inches of
water from the last a refilling occurring about an hour before and were refilled to a depth of
fourteen inches above the bottom of each test hole.
The results of the percolation testing are presented in Table I. These results indicate the sandy
clay loam soils have an average percolation rate of 9 minutes per inch and are acceptable for a
conventional infiltration design for the on-site sewage system. We attribute the rapid rate of Test
Hole #3 to the soil structure and peds evident at this location and depth.
Limitations: This report has been prepared according to generally accepted practices in this area
for use for sewage disposal design purposes. The conclusions and recommendations submitted in
this report are based upon data obtained from our site visits at the location indicated. There is
some possibility that the nature and extent of variations in the subsurface soils across the site may
not have been evident at the time of this investigation, and may need additional evaluation, if
further excavation reveals conditions different from those described. This office should be
advised of any unusual situations as soon as possible so that we may reevaluate our
recommendations.

The Aspen/Pitkin Environmental Health Department has reviewed the
details of the Regan application under the authority of the
Pitkin County Land Use Code and has the following comments.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-17 and 3-1104:
"It is the policy of the County to insure the availability of a water supply of adequate quality, quantity,
pressure and dependability for fire protection and support of a proposed land use prior to approval of the
use. The County shall require land uses to hook up to existing public systems if service is available."
This Department has information on the quantity and the quality
of the well on-site which will serve the main house and attached
caretaker unit. Samuelson Pump Co. Inc. conducted a test on
6/2/95 which indicated the production of the well is greater than
5 gpm. Snow -mass Water & Sanitation District conducted a water
quality test which indicated that coliform bacteria are present .
Mark Regan is aware of the measures required to kill the bacteria
(see attached letter). A condition of the septic application is
that by the time of the Certificate of Occupancy, the applicant
needs to provide proof of good quality water. This information
is a condition of approval for this application as well.
A condition of approval for this application is the receipt
by the Environmental Health Department, by the time of the
Certificate of occupancy, of proof of good quality water.
SEWAGE TREATMENT AND COLLECTION: Sections 2-18 and 3-1105: "Itis
the policy of the County to ensure that adequate sewage treatment facilities are available to serve existing
and new developments. Public and private sewage disposal systems and connections to such systems shall
comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System Regulation."
Lots in the area are served by individual septic systems. The
Regans have been issued a septic permit for a system large enough
to service the main house and the caretaker unit,'a total of four
bedrooms.
A condition of approval for this application is: NONE

"It is the policy of the County to preserve and protect its present water resources. To this end it is the
Policy of the County that no land use be initiated which would adversely affect the quantity, quality, or
accessibility of the County's water resources; or which would occur at the expense of established water -
dependent agricultural activities; or which would result in increased salinization of water resources, loss
of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or
redistribute major water resources. It is also the policy of the County to maintain a natural vegetative
buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon
by land uses or other human activities which could cause deterioration of water quality or impair the
natural treatment processes provided by meadows and wetlands.,,
The Environmental Health Department will be addressing water
quality impacts on down stream water quality. This application is
not expected to impact down stream water quality if the minimum
horizontal distances between components of the system and
physical features are in accordance with the Pitkin County Sewage
Regulations.
A condition of approval for this application is: NONE
AIR QUALITY: Sections 2-13 and 3-602:
"Only that development is permitted which will not contribute significantly to degradation of air quality in
Pitkin County. Developments may not constitute an indirect or direct air pollution source under Federal,
State or County regulations."
This project is not expected to contribute significantly to
degradation of air quality in Pitkin County.
The applicant has filed a fireplace/woodstove permit with the
Environmental Health Department indicating one certified
woodstove in the living room of the main house and no
fireplace/woodstove in the caretaker unit.
The less densely populated parts of the county like Shield
O`Terrace may have one wood burning fireplace and one department
certified device or two department certified devices per
building. In addition, unlimited numbers of decorative gas
appliances are allowed. Coal may not be burned in any device. No
wood burning device may be installed in barns or agricultural
buildings.

PRESCRIBED IN THE INSTALLATION INSTRUCTIONS: THE PLACEMENT BY BUYER OF IMPROPER
MATERIALS INTO BUYER'S SYSTEM; OR ANY OTHER EVENT NOT CAUSED BY THE COMPANY.
FURTHERMORE, IN NO EVENT SHALL THE COMPANY BE RESPONSIBLE FOR ANY LOSS OR
DAMAGE TO THE BUYER, THE UNITS OR ANY THIRD PARTY RESULTING FROM ITS INSTALLATION
OR SHIPMENT. BUYER SHALL BE SOLELY RESPONSIBLE FOR ENSURING THAT INSTALLATION OF
THE SYSTEM IS COMPLETED IN ACCORDANCE WITH ALL APPLICABLE LAWS, CODES, RULES
AND REGULATIONS.
c. NO REPRESENTATIVE OF THE COMPANY HAS THE AUTHORITY TO CHANGE THIS WARRANTY
