RE: Throm 1041 Hazard Review
This office has completed a review of the water supply sewage
disposal and water quality impacts of the referenced proposal.
The spring should be properly developed and tested for bacteriol-
ogical and chemical quality, however, this should be possible.
There are no water rights presented in the application indicating
that the spring can be used for a domestic supply or that a well
can be drilled.
On-site wastewater disposal should be accomplished by a conventional
septic system. Soils in the general area are suitable and there
are no obvious pollution problems created by installing a septic
tank -absorption field.
The water quality of Snowmass Creek will be impacted during
bridge construction. This construction activity is covered by a
nationwide permit and a separate permit (404 from the U.S. Army
Corps of Engineers) required. This department would recommend
that the following construction practices be implemented to
minimize sediment loading into the stream. Soil disturbance on
• the banks should only occur during low flow periods in the fall.
All construction should be hydrologically isolated from earth
disturbance in the bridge area until soil stabilization by any of
the recommended procedures such as coffer dams, culverts and
other flow diversion structures.

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKI14 COUNTY, COLORADO, APPROVING THE
THROAT 1041 GEOLOGIC AND FLOODPLAIN HAZARD RLVIEW
Resolution No. 85-81
WHEREAS, Robert Throm (hereinafter "Applicant") is the owner of
35 acres of real property, more specifically described on the attached
Exhibit "A"; and
WHEREAS, the Applicant has requested approval of a 1041 Special
Review for geologic hazards, more-pecifically, geologic faults and
floodplains; and
'WHEREAS, a meeting was held before the Board of County Commis-
sioners of Pitkin County, Colorado (hereinafter "Board") on July 8,
1985, and a public hearing was held before the Pitkin County Planning
and Zoning Commission on June'4, 1985, at which time evidence and
testimony were presented with respect to said application.
NOW, THEREFORE, BE IT RESOLVED by the Board that it .does grant
1041 Special Review approval for the Throm 1041 Special Review with
respect to geologic faults and fJ nodplain hazards subject to the
following conditions:
1. The applicant shall mitigate any water quality problems
associated with the construction of the bridge as obtlined
by the Environmental Health Department memo dated 5/15/85.
2. The access road to the site shall be developed in accordance
with the suggestion made by Nick Lampiris in his letter
dated 3/18/85 (on file with the Aspen/Pitkin Planning
Office) and the attached map.
3. The dwelling shall be Located within the envelope as
indicated on the plat sub tted with the application.
4. Prior to the issuance of a building permit, a site specific
soils study shall be done by a professional engineer to
insure proper foundation design.
5. Prior to issuance of a building permit, the applicant shall
obtain a well permit (for the spring) from the Division of
Water Resources.
6. The applicant shall obtain a driveway access permit from.the
County Engineer prior to the issuance of building permit.

7. The applicant shall designate a fishing easement within the
water of Snowmass Creek and a minimum of 5 feet above high
water line. This easement shall be noted on the plat and
be submitted to the Planning Office prior to issuance of a
building permit.

I have completed my geologic investigation of the proposed
building site near the south central portion of your property
along Snowmass Creel::. I have also reviewed the 1972
geological reconnaissance of the area by Chen and Associates,
Inc.
The property lies almost entirely east of the Snowmass Creek:
Road well up the Snowmass Creek: valley, F'itl::in County,
Colorado. More specifically, it lies in Sections '4 ands,
T 9 S, R 86 W, 6th P.M. within the Highland Peak 7 112 minute
quadrangle.
The topography of the site, although it was viewed with
considerable snow cover, consists of an open meadow merging
with a linear ridge trending roughly north and south along
the east side of the physiographic floodplain of Snowmass
Creek. There is a steep hillside approximately 2� �i ) feet east
of the building site and a gentle swale leading to the
Snowmass Creel:: valley approximately 150 feet northeast of the
building site. There is a steep bank with approximately
twenty feet of relief leading down to the floodplain about
twenty feet west of the site.
The surficial geology of the site consists of lateral moraine
deposits which form the ridge that the proposed home will
rest on. These glacial deposits consist of unsorted silts,
sands, cobbles and boulders in an unconsolidated state. The
bedrock formations are not visible near this site but are
probably sandstones, siltstones and shales of the Jurassic or
Cretaceous formations of the area. These generally dip about
45 degrees to the northeast. There is a geologic fault
mapped by Bryant (1972) which trends along the valley floor
in this area.
From the standpoint of geology, this is an excellent site for
development of a single family dwelling. The aforementioned
-Fault g i ves no indication of having moved for thousands of
years, and therefore, is considered to be inactive and not a

threat to development. There are no other potentials for
geologic hazard associated with the site as described in the
field. The setback from the steep bank was indicated to be
(and should be) at least twenty feet. Natural drainage will
not approach the building site and is minor east of the site
in the vicinity of the swale. Obviously the site is well
above the 100 year floodplain of Snowmass Creek. The steep
hillside over 200 feet to the east cannot negatively impact
this site. Despite the excellent suitability of this site, a
soils engineering study should be performed at the site
specific level to insure proper foundation design.
It is my understanding that water for domestic use will be
available through the development of a spring on the
property. If a well is decided upon, sufficient quantities
of potable water should be available within 75 feet of the
surface' Waste disposal in the permeable soils of the site
should be achievable through the use of a standard septic
system with accompanying leach field, but the Pitkin county
Sanitation Engineer should be consulted for his specific
recommendations' Access to the site is not yet in, but can
be engineered with a bridge over Snowmass Creek and standard
techniques for road building across wetland areas. The road
as shown on the accompanying map could perhaps be better
aligned by swinging north around the glacial ridge and up the
swale as shown, thereby eliminating a cut and fill situation.

COLORADO, GRANTING APPROVAL TO THE ROBERT THROM DETACHED
CARETAKER DWELLING UNIT AND AMENDED
1041 HAZARD REVIEW PLAT

Robert and Phyllis Throm (":applicant") have applied to the Pitkin County Board of County
Commissioners ("BOCC"), for approval of a detached caretaker dwelling unit.
2. The property is located at 8998 Snowmass Creek Road and is described as a parcel of land being
situated in Section 34 and 35, Township 9 South, Range 86 West of the 6th P.M, Pitkin County,
Colorado.
3. The Applicant proposes to deed restrict the proposed caretaker dwelling unit pursuant to Section 3-
150.130(B), Caretaker Dwelling Units, and Section 3-210.10, Special Review, of the Pitkin County
Land Use Code ("Code").
4. The building envelope for the Caretaker Dwelling Unit is exempt from full 1041 review because
no 1041 hazards exist pursuant to Section 4-40.
The BOCC heard this application at its regularly scheduled meeting on December 2, 1998, at which
time evidence and testimony were presented with respect to the application.
6. The BOCC has determined that the detached caretaker dwelling unit meets the standards
established in Section 3-150-130 of the Code.
NOW, THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant approval for a detached caretaker dwelling unit, subject to the following
conditions which shall run with the land and be binding on all successors in interest:
1. Prior to application for a building permit, the Applicant shall record a 24 x 36 inch mylar an
amended 1041 Hazard Review Site Plan which meets the approval of the Community Development
and County Attorney. The site plan shall also be submitted in a digital format for integration into
the County Geographic Information System (GIS). The face of the site plan shall include the
following additional information:
A. The site plan shall be identified as "Throm Amended 1041 Hazard Review." The site plan
shall include a building envelope for the detached caretaker dwelling unit which meets all
appropriate setbacks, along with the building envelopes approved for the main residence and
detached garage with loft identified and approved during the original 1041 Hazard review.
B. The site plan shall include a vicinity map.
C. The site plan shall include the appropriate signature blocks.

D. The site plan shall identify the 100 -year flood plain for Snowmass Creek. All structures shall
be located outside of the 100 -year flood plain.
E. The site plan shall include the following 1041 Hazard Review Warning and Disclaimer:
"The applicant acknowledges that he/she has been informed by Pitkin County of the
existence of 1041 Environmental Hazard areas that might affect the property, any
improvements and the use and occupancy thereof. "
2. Prior to application for a building permit, a caretaker dwelling unit deed restriction shall be
accepted by and recorded with the Housing Office.
3. Prior to application for a building permit, the Applicant shall submit actual floor plans of the
proposed unit (calculating the net livable square footage) to the Housing Office for review.
4. Housing Office staff shall inspect the unit prior to issuance of a Certificate of Occupancy.
5. The kitchen unit shall contain at least a two -burner stove with oven, a standard sink, and no less
than a 6 cubic foot refrigerator plus freezer.
6. Should the Applicant decide to install a fireplace/woodstove, a fireplace application must be filed
with the Environmental Health Department.
7. Prior to application for a building permit, the Applicant shall obtain a septic permit from the
Environmental Health Department. All sewage disposal systems must be designed by a registered
professional engineer. Sewage disposal system shall be located within the approved building
envelope.
Prior to application for a building permit, the Applicant shall provide documentation of an
adequate domestic water supply on the property. Quantity and quality of said supply shall meet
the approval of the Environmental Health Department.
9. No development, including grading, entry or ranch gates, septic systems, landscaping (including
berming) and vegetation removal or disturbance shall occur outside of the designated building
envelope, except for utility and driveway extension and maintenance, and as may be necessary to
implement the wildfire mitigation measures required elsewhere in this document.
10. Landscaping and revegetation on the property shall utilize low water (xeriscaping) native plant
materials and concepts. The timing of any sprinkler systems shall be decreased for low water
plants.
11. The Applicant shall implement the following measures to mitigate impacts to wildlife:
A. Fencing should be avoided. If necessary, fencing shall comply with the amended Pitkin County
Fencing Guidelines. Fencing outside of the approved building envelope shall be prohibited.
B. Removal of native vegetation shall be prohibited outside of the approved building envelope.

C. All garbage must be kept indoors or in bear -proof containers.
12. The Applicant shall comply with the following landscaping and wildfire defensible space
mitigation standards:
A. The Applicant shall establish and maintain, for a distance of 10' around ail structures,
vegetation at 6" or less (i.e. mowed grass). Woody vegetation shall not be planted within this
perimeter.
B. Flammable material (i.e. firewood) shall not be prohibited.
C. For a distance of 30' around the structure, the existing mature spruce shall be thinned so that
the crowns are no closer than 10' between trees.
D. Lower limbs shall be removed to a height of 10' to eliminate ladder fuels.
13. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roof construction shall be Class A, non-combustible (no wood shake/shingles) material with
no flat roofs.
B. Roofs and gutters shall be kept clear of debris.
C. Yards shall be kept clear of all litter, slash, and flammable debris.
D. Fences shall be kept dear of brush and debris.
E. Wood fences shall not be connected to the structure.
F. The structure shall have a minimum of one 10 lb. ABC fire extinguisher.
G. All vents shall be screened with corrosive resistant wire mesh of one quarter inch maximum.
H. Utility lines shall be buried.
14. The structure shall comply with the codes and requirements of the Basalt and Rural Fire Protection
District.
15. The Applicant shall adhere to all material representations made in the application and public
meetings.
