Title search companies don't really let people know about all the easements 100% of the time. Their work tends to be fairly sloppy. People find out afterwards. 3) It could have a public health impact. If the system fails & surfaces, it surfaces on the neighbor's lot, and affects the neighbor & his/her health & that of his/her kids. If the neighbor has to sue the owner to get him/her to fix the septic system, it is a health threat while the suit is in process. 2) is a mound built up aabove the flood plain no longer in thg floodplain? It is no longer in the floodplain if it is raised high enough, but it has to be built up so that there was a 4' separation to a level 1' above the 100 yr flood elevation. i.e. the base of the mound would have to be 5' above the 100 -yr -flood level. Setback to river not helped - i.e. the 50' setback from the river's high water line still has to be met. From: Mary Engelmann, Environmental Health Officer co Through: Lee Cassin, Assistant Environmental Health Director Date: March 4, 1996 Re: .Smeins 1041 Hazard Review Parcel ID # 2649-213-01-006 The Aspen/Pitkin Environmental Health Department has reviewed the details of the Smeins' application under the authority of the Pitkin County Code,Title II, land Use Code and has the following comments. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-170 and 3-110.4: "it is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fireprotection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if service is available." The Smeins currently have a well for the existing home on the property. We have no record in our files in regard -to the quality and quantity of their water. This Department requires information that the well has performed sufficiently in the past in regards to supply and quality of water. The applicant must ensure that the water quality is acceptable by having it tested by a lab such as the Snowmass Water and Sanitation District or Aspen Consolidated Sanitation District. The well is located outside of the building envelope on the proposed building site. Pitkin County Land Use Code requires that the well site be within the building envelope.. We assume that since the well - already exists, it doesn't have to be Located within the new building envelope. Another option would be increasing, the size of the building envelope to include the well. It is recommended that low water landscaping'(xeriscaping) be used and that the timing of any- sprinkler systems be decreased for low water plants. The Colorado State University Cooperative Extension office can be contacted for more information on .xeriscaping. (> A condition of approval for this application is the receipt of information documenting that the location of the well(s) meet setback requirements from the sewage disposal system. Also that quantity/quality of the well water are adequate. Without meeting these requirements a septic permit (if necessary) and building permit can not be issued. rill SEWAGE TREATMENT AND COLLECTION: Sections 2-180 and 3-110.5: "It is the policy of the County to ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System Regulation." The home currently on the site has an individual sewage disposal system, however we have no record of this system in our files, nor any related soil information (perc rate, ground water present, type of soil, etc.). It is not possible for us to determine the size or design of the. system that is present, nor to verify that all setbacks have been met without this information. A particular concern is the distance of the existing leachfield to the existing well. It does not appear to meet the setback requirements of the current regulation. The minimum distance a leachfield can be from a well is 100 feet, and depending on the size of the home; it may be required to be farther than 100 feet from the well. The Smeins will need to have a contractor dig the corners of the leachfield up so that we can determine the size, type of system installed.- If any addition must be made to the leachfield, and the current leachfield and well are within 100 feet of each other, additions may only be made to the other side of the leachfield, sous not to lessen the distances between the two any further. All other setbacks must still be maintained, and it.would be very important to make sure that the addition to the leachfield not encroach on a neighbor's well. It is also very likely,that the size of the existing individual sewage disposal system would not be adequate to accommodate the new home at the site. This depends on the size of the home, the number of bedrooms, and the types of rooms in the'new house (this have not yet been determined). If this is the case, the leachfield would need to be enlarged and probably the tank capacity increased. There is a chance that a completely new system would be required to be installed. [neither case, the Smeins would need to submit an individual sewage disposal application and pay a,$160.00 fee. All setbacks would need to be maintained. The Aspen/Pitkin Environmental Health Department will design the system. for the applicant as part of the permit fee, if an engineered system is not required. We will do a site visit, advise the applicant about the best location for the system or where to add on to the existing system, and provide a system design. We will determine if an engineered system is needed based on soil test results. An engineered system is required if any one of the following conditions exists: a percolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of the groundwater table or bedrock less than four feet below the bottom of the proposed absorption system; or a slope in excess of 30/0. Prior to initiating any tests at the site, the applicant should contact this'office. It probably be impossible to locate the sewage disposal system within the building envelope. The well permit states that the sewage disposal system must be of the non -evaporative type where the water is returned to the same stream system in which the well is located. This Department recommends that nonpoint sources of discharge must be retained on the property of origin which can be accomplished through landscaping, drainage patterns, detention ponds, and dry wells for water runoff from buildings. Surface water and groundwater contamination can also be caused by inadequate setback distances from sewage disposal systems to proximate wells, rivers, creeks, ponds, and reservoirs. Minimum horizontal distances between components of a sewage disposal system and physical features must be in accordance with the Pitkin County Sewage Regulation. This Department reserves the right to require water quality sampling at the homeowner's expense. A condition of approval for this application is that all setbacks be maintained.
