The fee for a ISDS application is $330 for a permit that takes 6 hours or less for the department to approve. If approval takes
longer than 6 hours, a rate of $55 per hour will be charged. The maximum fee is $1000. The basic fee of $330 is due at the time
of application. The remainder, if any, will be due in two stages: first, at the time of issuance of the ISDS permit; second, before
final approval of the ISDS permit.
Application for an individual sewage disposal system is hereby submitted. I hereby certify that the above information is true and
accurate and that I have provided true and accurate information on locations of all existing and proposed wells, contour
intervals, buildings, property lines, ditches, slopes, waterlines, springs, suction or irrigation lines, drinking water cisterns, drain
tiles, irrigation ditches, lakes, water courses, streams, floodplains, dry gulches, and existing septic systems. I hereby certify
that any such features not shown on attached site map are not present. Issuance of the permit does not imply the approval of
any other permit required for construction pursuant to Pitkin County codes. No construction may be undertaken until all
approvals and permits have been obtained.
The Aspen/Pitkin Environmental Health Department, Pitkin County and employees of these agencies will be held harmless
should the individual sewage disposal system fail or malfunction. The permit to construct is issued on information submitted by
the applicant or his/her representatives. The owner assumes full responsibility in case of failure of the system.

On October 15, 1998 a final inspection of the Ely ISDS was performed by Jerome Gamba &
Associates, Inc.
The system as observed by Jerome Gamba & Associates, Inc., was found to be in
substantial conformance to the plans and specifications dated August 25, 1998, except for
the following field changes;
1.) The bed configuration was changed to have the bed with three rows on the
opposite side of the delivery pipe.
2.) The septic tank and the pump chamber area aligned with the center of the
leach bed area.

The following additional soil information for the Scott Ely ISDS, located at 11456 Highway 133 on
the Crystal River.
A soil profile, adjacent to the proposed absorption area was excavated. The excavation revealed
ground water present at approximately 5 feet. Excavation was stopped at approximately 6 feet.
Soil Classification is as follows:
0" to 6" Top Soil and Root Zone
6" to 60" River Alluvium
Percolation testing was performed in the area of the proposed septic system. The existing system is
currently operating and care was taken to ensure that the existing system was not disturbed or
service interrupted during the testing. Three percolation test holes were dug to a total depth of
approximately 30'. During pre-soaking it was discovered that the percolation test holes would not
hold water.

This report has been prepared according to generally accepted engineering practices for the design
of Individual Septic Disposal Systems within Pitkin County. The conclusions and recommendations
submitted in this report are based upon data obtained from our field investigations of the proposed
site. There is some possibility that the nature and extent of the subsurface soil across the site may
not have been discovered during our investigations and may require additional field work. If further
excavation reveals conditions different form those described, our office should be notified of these
findings as soon as possible.

OF PITKIN COUNTY, COLORADO, APPROVING A SUBDIVISION EXEMPTION FOR
A LOT LINE ADJUSTMENT
Pursuant to Section 3-190.30., Terry Kirk and Lee Copland have applied to the Community
Development Director of Pitkin County, Colorado, hereafter "Director," for a lot line
adjustment between Kirk's Parcel 8 and Copland's Parcel 3 of the Gesberg Tracts.
2. The applicant requests approval for the conveyance of a small strip of land from Parcel 3 to
Parcel 8 as represented in Attachment `A.'
3. The lots in question are both zoned RS30 PUD.
4. The Director finds that this request for a lot line adjustment is consistent with the
requirements of the Code Section 3-190.30.
THE DIRECTOR HEREBY APPROVES the Copland/Kirk Lot Line adjustment subject to the
following conditions:
1) Prior to the recording of this Administrative Determination, the applicant shall submit a
subdivision exemption plat for a lot line adjustment to the Director for approval and recording with
the Pitkin County Clerk and Recorders Office.
2) Before the plat can be signed by the Directror, the applicant shall submitt a disk of the plat in
digitized format to the Community Development Department.

Request: Applicant Proposes a lot line adjustment between Parcels 3 and 8 of the Gesberg
Tracts. Specifically, Copland, owner of Parcel 3 of the Gesberg Tracts would like to grant Kirk,
owner of Parcel 8 of the Gesberg Tracts a narrow strip of land. The purpose of this action is to give
Kirk more room around his existing residence.

Zoning: RS30 PUD
Lot Line Adjustment: The following is a summary review and analysis of the applicant's
proposal relative to the most applicable policies and standards of the Land Use Code.
A subdivision exemption for a lot line adjustment may be permitted subject to compliance with the
following six criteria of Section 3-190.30 of the Land Use Code.
1. Adjustment creates not more than the original number of lots or parcels.
Staff Comment: There are currently two parcels involved in this application and if this request is
approved, there will still be 2 parcels.
2. The purpose or effect of the lot line adjustment is not the creation of a new lot or parcel, nor
any increase in floor area ratio for a parcel which gains size, nor creation of a lot or parcel
substantially different in size for development or resale purposes.
Staff Comment: The purpose for this adjustment is so that Kirk, the owner of Parcel 8, can have
some room to get around the side of his house and access his backyard without encroaching on
Copland's property. While the Land Use Code limits floor area to 15000 sq. ft. without a Special
Review in all zone districts, there is not a Floor Area Ratio in the RS30 PUD zone.
3. In the case of conforming lots and parcels, any resulting lot or parcel shall conform to the
minimum requirements for area or width established by the provisions of the code.
Staff Comment: Neither of these lots currently conform to the minimum lot area requirements in
the RS30 PUD zone.

4. In the case of substandard sized lots or parcels, the resultant lots or parcels may increase in
nonconformity as to lot size so long as the other standards of the code continue to be met.
Staff Comment: The proposed adjustment meets other standards in this code section.
5. The applicant shall•prepare a subdivision exemption lot line adjustment map in compliance with
the standards in Land Use Code Section 5-60.
Staff Comment: The applicant intends to comply.
6. A lot line adjustment shall not be used to increase the floor area ratio for a parcel that increases
in size due to the adjustment. The floor area ratio will be reduced on a parcel that decreases in
size due to the adjustment. applications to add floor area ratio to a lot or parcel are to be major
amendments and shall be reviewed pursuant to Section 3-190.90.
Staff Comment: While the Land Use Code limits floor area to 15000 sq. ft. without a Special
Review in all zone districts, there is not a Floor Area Ratio in the RS' 0 PUD zone.
RECOMMENDATION AND CONDITIONS OF APPROVAL:
Staff recommends that the Community Development Director approve the proposed lot line
adjustment according to the condition s in the attached determination.
