RECITALS
Very[ Brunton (hereafter "Applicant's) has applied to the Pitkin County Hearin4o Officer (hereafter
"Hearing Officer=") for 1041 Hazard Review approval to establish a building envelope for a single-
family residence. 4
The property is located on Beaver Drive, and is described as Lot A-5, Redstone Ranch Acres
Subdivision.
The property is zoned AFR-10 and contains 0.4 acres.
4. The Hearing Officer heard this application at a public hearing on August 17, 2004, at which time
evidence and testimony were presented with respect to this application.
5. The Hearing Officer finds that the proposal is in compliance with the applicable Standards of the
Pitkin County Land Use Code.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Hearing Officer that approval is
hereby granted to the Brunton 1041 Hazard Review subject to the following conditions, which shall run
with the land and be binding on all successors in interest:
The Applicant shall adhere to all conditions and material representations made in the application
and public meetings except as amended herein.
2. Prior to submittal for any building permits, the Applicant shall record a 24 X 36 inch molar 1041
Hazard Review Site Plan and Plat Amendment in accordance with Sections 5-70-040, 5-40 and 5-
60-040 of the Land Use Code. A building envelope shall be depicted on the site plan encompassing-
all
ncompassingall proposed development. Community Development shall approve the site plan prior to
recordation.
The Applicants shall obtain an access permit from the County Engineer prior to commencement
of construction for the driveway. The driveway shall meet the standards of the Pitkin County
Asset Management Plan.
The Applicants shall comply with the following landscaping and wildfire defensible space
mitigation standards as can be accomplished within the boundaries of the property:
A. Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 foot
perimeter around the structure.
B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a
minimum of a 30 -foot perimeter around the structure (or to the property boundary). Aspen
trees may remain.
C. Existing and installed tree crown separation within a 30' perimeter shall have a minimum
of 10' between the edges of the crowns. except for aspen trees. where crown spacing may

be ". However, no aspen trees may be within l 0' of the proposed structures. New or
installed coniferous trees may not be within 12' (as measured from the edge of the crown)
of the proposed structures
D. Al l branches from trees and brush within the 30 -foot perimeter shall be pruned to a height
of 10 feet above the ground and ladder fuels from around trees and brush shall be removed.
E. All thinned snowberry, serviceberry, or chokecherry stumps must be painted with Garlon®
(or equivalent) herbicide to prevent aggressive re -sprouting.
F. All branches which extend over the roof eaves shall be trimmed and all branches within 15
feet of the chimnevs shall be removed.
G. From the 30' around the house, out to the 70' perimeter (or the property boundaries), brush
and shrubs shall he thinned to I times the height of the fuels.
H. All deadfall within the 100 foot perimeter shall be removed.
1. The property owner shall be responsible for the continued maintenance of the defensible
space vegetation requirements.
The Applicants shall comply with the following additional wildfire mitigation standards:
A. Roofing: New roofs shall have a Class A roof covering or a Class A roof assembly. Wood
shake/shingle roof coverings are prohibited. Flat roofs (up to a 3:12 pitch) are prohibited
unless they comply with the following:
I . All roof coverings shall be non-combustible Class A materials as defined
in the Uniform Building Code (UBC) 1997 Section 1504 (wood
shake/shingle roof coverings are prohibited) and installed on a Class A
roof assembly.
2. All roof coverings shall have a surface that shall facilitate the natural
process of clearing the roof.
3. All roof designs shall facilitate the natural process of clearing roof debris.
Protrusions above the rootline, such as parapets, shall be prohibited.
4. Roofs shall be installed as required by UBC 1997 Chapter 15 and shall
have a 111inimum slope of 1:48.
5. All roof designs, coverings or equivalent assemblies shall be specifically
approved by the Fire Marshall priorto submittal ofa building permit
application.
B. Projections: "
1. For projections below the roof line (including, but not limited to: exterior
balconies, decks, porches, cantilevered floor projections, and bay windows
which extend over a flat or sloped surface) the open space bctween grade
and the underside of projections below the roofline shall be enclosed by
solid, vertical walls. These walls shall be constructed with materials
approved for one-hour fire -resistive constructioll on the exterior side of the
wall and shall extend from the top of grade to the underside of the floor
decking or walls of the projection. OR:
2. Any porch or deck or projection shall be void of vegetation below it, and
areas below such projections shall be protected from accumulation of
vegetation materials by placement of a vegetation barrier covered with
rocks or gravel, or by coverage with Concrete or stone. Walls Underneath
projections shall be constructed v rith materials approved for one-hour fire -
resistive construction on the exterior of the side of the wall. Pillars or

columns shal I be of non-flammable materials, or if wood, made out of
heavy log construction and treated with a fire retardant. The underside of
any porch, deck or projection shall be sheathed in 1 -hour fire resistive
materials, or with tire -retarded.
An alternative for a deck or porch is use of non-flammable hardscaping
that is at least 10 wide. Some planters can be in this area, but cannot
contain trees.
C. Vents shall be screened with corrosive resistant wire mesh with ntesh 'A inch maximum
D. Roofs and gutters shall be kept clear of debris.
E. Yards shall be Dept clear of all litter, slash, and flammable debris,
F. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away
from any structure.
G. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more
than 6 inches.
H. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away
from the structure.
1. Swimming pools shall be accessible to Fire Department vehicles.
J. Fences shall be kept clear of brush and debris.
K. Wood fences shall not connect to the structure.
L. Any outbuildin-s or additional structures shall adhere to the same standards as structures.
M. Fuel tanks shall be installed underground with an approved container.
P. Propane tanks shall be installed according to NFPA 48 standards and on a contour away
from the structure with standard defensible space vegetation mitigation around any above-
ground tank. Any wood enclosure around the tank shall be constructed with materials
approved for 2 hour fire -resistive construction on the exterior side of the walls.
Q. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher
placed in a visible and accessible location.
R. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible
and installed on a non-combustible post.
S. New utility lines shall be buried.
No development, includinggrading, excavation, fill placement, benning. landscaping, entry or
ranch nates. and vegetation removal or disturbance shall occur outside of the approved building
[and/or] development envelope except for access and 'wildfire mitigation. Construction, staging,
parking, utility and driveway extension and maintenance shall occur within approved building
envelope, or access driveway.
Prior to submission of any new building permits for new development, the Applicants shall submit a
mitigation report from an engineer or geologist licensed in the State of Colorado. The report shall
demonstrate that the site can be engineered in such a way that there is no hazard posed, and shall
show the area of disturbed slopes. any re -grading required and the size and location of all mitigation
devices. Any new development shall be conditioned upon compliance with the report.
Prior to commencement of any earthmoving or construction activity. the Applicants shall stake
the corners of the building envelope and install construction fencing around the perimeter of the
building envelope. The fencing shall remain in place until issuance of Certificate of Occupancy.
No vegetation shall be damaged or removed outside the building envelope.

9. Prior to application for building permit the applicant shall provide for review to the County
Engineer a trip generation and construction trip generation study for any free market residential
structure exceeding 5,000 square feet.
l0. Fruit -bearing trees and shrubs should be avoided in any landscaping due to the high level of
black bear activity in this area.
H. The Applicant shall comply with the 2001 Wildlife Protection Ordinance No. 010-2001 for waste
storage. Compliance with the condition shall be verified by the Pitkin County Wildlife Biologist
prior to issuance of a certificate of occupancy.
12. Pursuant to Ordinance No. 022-2000, the Applicants are subject to the Fair Share Requirements
and shall pay a road impact fee.
13. Prior to commencement of any earthmoving or construction activity, the Applicants shall stake
the corners of the building envelope and install construction fencing around the perimeter of the
Building envelope. The fencing sliall remain in place until issuance of Certificate of Occupancy.
No vegetation shall be damaged or removed outside the building envelope.
14. A Drainage and Erosion Control Plan shall be submitted by the Applicants and approved by the
County Engineer prior to building permit submission.
15. Any areas disturbed outside the building envelope must be revegetated with native vegetation
according to a revegetation plan submitted by the App] icants and approved by the County prior
to issuance of a Certificate of Occupancy.
16. Dogs shall be kenneled.
17. Floor area shall be limited to 5,750 square feet exempt from growth management or use ofTDRs.
18. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin
County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin
County Land Use Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted
herein shall expire on August 17, 2007.

DATE: August 17, 2004
REQUEST: The Applicant requests 1041 Hazard Review approval to establish a building envelope. The
subject parcel is part of the Redstone Ranch Acres Subdivision located up the Crystal, south of Redstone.
The lot is heavily wooded with mature conifers and some Aspen trees, along with heavy undergrowth, and
is flanked on the west and north sides by Beaver Drive and Elk Lane respectively. To the south, there is a
steep hill that is heavily wooded, however the toe of the slope is not on the subject lot.
The parcel was created as part of the Redstone Ranch Acres Subdivision in 1962, preceding the County's
adopted Subdivision regulations.

ZONINGILOT SIZE: The parcel is zoned AFR-10 and contains 0.4 acres, thus making it non -conforming.
REFERRAL COMMENTS: The Wildlife Biologist, Crystal River Caucus and the Redstone Ranch
Acres Homeowner's Association were referred, but no comments were received.
1041 HAZARD REVIEW (SECTION 3-80):
Geologic (Section 3-80-050): The lot is essentially Flat with a couple of very minor slope anomalies, and
the overall slope within the building envelope does not exceed 15%. The lot is less than a'/2 -acre, and the
building envelope is drawn to meet the setbacks.
The Applicant addresses the Avalanche section, however there is virtually no potential hazard on this site.
The entire site is mapped as alluvial fan, and there are some unusual drainage patterns on the site, and Staff
is recommending that an engineering report be provided at time of building permit.
Wildfire: The building envelope is located within a "Moderate: Trees" rated wildfire area. The Applicant
will comply with the conditions set forth by Eric Petterson's report (contained in the application).
Wildlife: The lot is located within mapped Elk Winter Range, however it is surrounded by existing
development. The County's Wildlife Biologist provided no comments, and Staff is recommending that a
condition of approval be that dogs are kenneled on site as required by the Code. Additionally there are a
number of mature conifers on site, however Staff notes that almost all of them are located within the
setbacks, and outside the building envelope.
ACCESS: Access will be taken off of Beaver Drive, and should not require a variance as it is flat and open
coming off of Beaver Drive.
RECOMMENDATION: Staff recommends approval of the Brunton 1441 Hazard Review subject to the
conditions of the attached draft Hearing Officer Determination.

The property subject to this application is an unimproved, subdivided lot known as Lot
A-5 in Redstone Ranch Acres located approximately one mile south of Redstone, It is
located at the Northern end of the development.
The purpose of the application is to establish a building envelope for construction of a
single-family residence.

LAND USE CODE SECTIONS
Section 3-60: Environmental and Aesthetic Standards
Subsection 3-60-050: Scenic Quality
The site has numerous mature spruce and cottonwood trees that the applicant would like
to preserve as much as possible. These trees and other vegetation offer a natural
screening from other properties in the area and from the interior roadways. This issue will
be discussed with the County approved wildfire expert.
Power and phone are at the lot line and the applicant intends to bury these utilities to the
home. Any lighting and satellite dishes will comply with the County Landscape
Guidelines.
Section 3-80: Areas of Local and State Interest11041 Environmental Hazard Areas
Subsection 3-80-050(A) — Avalanche Areas
There is a steep slope bordering the back of the lot but is away from the building
envelope. The slope is covered with large evergreen trees and attendant undergrowth and
shows no evidence of avalanche scouring, bent foliage or debris at the foot of the slope.
Indeed, there are two homes built very close to this slope and the owners have reported
no avalanche activity, Bluffing or any other signs of snow movement in the 35 plus years
these homes have been in existence, The slope is about 65 to 80 feet high and then
becomes a gently sloping meadow running into an aspen forest. This meadow has
approval for a home as it is another home site in the development and already has water
and septic installed.
Nevertheless, the applicant intends to build well away from the hillside within the
building envelope.
Subsection 3-80-050(C)(1)(c): Potentially Unstable Slopes
As described above the slope near the back of the lot is covered with mature vegetation
and presents no sign of unstability. There are no gulleys, debris piles or evidence of
erosion on the hillside. Again, it is only 65 to 80 feet high with no active water sources
above. The applicant will be building well away from the hillside.
Subsection 3-80-050(E): Alluvial Fans
The property is located approximately 200 to 400 feet from Hawk Creek depending
where one is on the lot. Hawk Creek hugs the North side of the canyon while Lot A-5 is
on the opposite, or South side of the canyon at it's opening to the rest of Redstone Ranch
Acres. Hawk Creek is a year-round stream contained in a fairly deep channel ultimately
flowing into the Crystal River. There are three homes built on the banks of Hawk Creek
of which two are Iocated above the subject lot and another home built just east of the
subject lot. These four homes were built in the early 1970's and there is no evidence of
recent flows from Hawk Creek.
There is an old drainage or irrigation ditch on the back of the property that the applicant
intends to leave to accommodate any potential runoff from above the site, Redstone
Ranch Acres used to be a working dairy farm with attendant pastures and a sizeable lake.
The farm used water from both Hawk Creek and Kline Creek for their agricultural and
domestic needs.
Subsection 3-80-070: Wildfire Hazard Areas
The applicant has consulted with one of the County's approved wildfire experts and will
comply with the recommendations of his report. See letter attached to this application.
Subsection 3-80-080: Wildlife Habitat Areas
Although mapped as elk winter range and close to a winter concentration area, the elk
population has, for the most part, moved elsewhere. Redstone Ranch Acres is
approximately 90% built out and with the attendant human and dog populations; elk tend
to avoid the area except in small, isolated incidents. They are still fairly prevalent in the
upper reaches of the subdivision where the lots are much larger and the human activity is
greatly reduced.
Just one lot removed from the subject is an owner who has a full sled -dog team on his
property and has had these dogs for many years, It would appear that at least 50% or
more of the residents have pets. The applicant would like the option of having pets also
and will comply with the County Wildlife Officer's recommendations concerning
kenneling and fencing.
IMPROVEMENTS AND SERVICES
Water — domestic water will be supplied by a well, to be drilled at a future date
Sewage — a county approved septic tank and leach field will be used
Phone — Qwest phone service is at the site
Power — Holy Cross Electric is at the site
Access — the property is bordered by both Elk Lane and Beaver Lane
OWNERSHIP
Attached please find Schedule A of a Title Commitment issued by Stewart Title showing
title to be vested in the name of Veryl Brunton. Mr. Brunton is deceased and the estate is
being handled by Amy Cadena, his daughter.
Recent inquiries of the Pitkin County Assessor show that Lot A-5 (Schedule# R007348)
is currently owned under the name of Very[ Brunton.

5. No branches shall be within 15' of chimneys.
6. From the 30' perimeter around the house, out to the 70' perimeter (or the property
boundaries), brush and shrubs shall be thinned to 1 times the height of the fuels.
7. All thinned snowberry, serviceberry, or chokecherry stumps must be painted with
GarionO (or equivalent) herbicide to prevent aggressive re -sprouting.
8. All deadfall within 100' perimeter of the structures shall be removed.
9. The property owner shall be responsible for the continued maintenance of the
defensible space vegetation requirements.
The following Structural Design and Construction Standards are recommended for
construction of a main house and any outbuildings:
I. Projections:
For projections below the roofline (including, but not limited to: exterior balconies,

retardant, The underside of any porch, deck or projection shall be sheathed in 1
hour fire resistive materials, or with fire -retardant treated wood.
3. An alternative for a deck or porch is use of non-flammable hardscaping (fiagstone,
cement pad, etc.) that is at least 10' wide. Some planters may be in this area, but
cannot contain trees (except aspen) or shrubby species.
II. Foundations and Stilt Construction
1. Foundations, skirting and crawl space openings shall be fully enclosed and
constructed with materials approved for on -hour fire -resistive construction on the
exterior side of the walls and shall extend from the top of grade to the underside of
the floor decking or walls.
2. Stilt foundations shall be fully enclosed and constructed with materials approved
for one-hour fire -resistive construction on the exterior side of the walls and shall
extend from the top of grade to the underside of the floor decking or walls (not
including porches, patios, etc.).
III. Roofing
1. Any new roofs shall be constructed with a Class A covering (see UBC 1997 Section
1504). Wood shake/shingle roof coverings are prohibited, even if treated with fire -
retardant chemicals. If roofs are desired to be less than 1:48 pitch, then roofs
must be surfaced with a non-combustible material, and must be constructed
on a Class A roof assembly.
2. All roof coverings shall have a surface
that shall facilitate the natural process of
cleaning the roof of debris. Protrusions
above the roofline, such as parapets,
shall be prohibited.
3. All roof designs, coverings or equivalent
assemblies shall be specifically approved
by the Fire Marshall prior to submittal of
a building permit application.
4. Vents shall be screened with corrosive
resistant wire mesh, with mesh '/a"
maximum on any new or existing roofs.
IV. Maintenance
1. Roofs and gutters shall be kept clear of
debris.
2. Yards shall be kept clear of all littler,

3. All flammable materials (including firewood) shall be stored on a parallel contour a
minimum of 20' from any structure, or within a separate structure.
4. Vegetation within the ten -foot perimeter shall be maintained to a height not more
than six inches, or if ornamental, shall be irrigated and kept free of dead materials.
V. Miscellaneous
Fences shall be kept clear of brush and debris, and must have at least a 3" gap
between the fence and the main structure. Non-flammable, or treated wood
fencing material is recommended within 20' of the house. Fences shall be kept
clear of vegetation.
2. Any outbuildings or additional structures shall adhere to the same standards as the
main house.
3. Each structure shall have a minimum of one ten -pound ABC fire extinguisher.
4. Addresses shall be clearly marked with 2" non-combustible letters and shall be
visible at the primary point of access from the public or common access road and
installed on a non-combustible surface.
5. Fuel tanks shall be installed underground with an approved container.
6. Propane tanks shall be installed according to NFPA 48 standards and on a contour
away from the structure with standard defensible space vegetation mitigation
around any aboveground tank. Any weed enclosure around the tank shall be
constructed with materials approved for two (2) hour fire -resistive construction on
the exterior side of the walls.
VI. Access
1. Thin shrubs (chokecherry, snowberry, serviceberry) and coniferous trees (Douglas -
fir) to 1 times height along the driveway. No shrubs or conifers are allowed within
10' of the driveway. Aspen are permitted within 10' of the driveway, but must be
pruned to 10' above the ground.
2. Low vegetation (grasses, forbs and low shrubs) shall be kept mowed to less than
6" within 10' of either side of the driveway.
VII, Water Supply
Any fire department recommendation for individual structure water supply and
storage shall be accessible to fire department vehicles from the exterior of the
structure through a Fire Department approved mechanism (such as a fire
hydrant). The amount of storage capacity shall be determined by the fire
protection district with a minimum of one thousand (1,000) gallon storage
capacity per structure.
2. All structures greater than 5,000 square feet in size shall be required to install
in-house sprinkler systems that meet the standards of the local fire protection
district and the UBC. At building permit submittal, the local fire protection
O -% district may require smaller structures to be sprinkled due to hazard

considerations, emergency access difficulties and lack of proximity to fire
protection services.
VIII. Utilities
1. Utility lines shall be buried.
IX. Review Process
1. All development shall be reviewed for compliance with this section. Along with a
building permit application, the property owner shall submit a site plan that shows
the mitigation set -backs detailed in this document, at the time of a building permit
submittal.
The above standards have been slightly modified from the Pitkin County Code 3-80-070
Wildfire Hazard Areas, for the situation at the Parks Property.
