Construction of the system will cons excavating a level basin in the area comprising the absorption field. The initial excavation shall hi , rrtinued to a depth of 48" at the up -hill (i.e_, northeast side) edge of the absorption field. Lots in the Coal Basin area are served by individual septic systems. All such systems installed within Pitkin County require septic permits issued by the Environmental Health Department, and must comply with the County septic regulations. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee with a completed Soil Data Form including perc test results and profile hole information. It must be possible to design an adequate septic system before a building permit can be issued. It also must be determined if a conventional system can be installed or if an engineered designed system is needed. An engineered system is required if any one of the following conditions occurs: a percolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of the groundwater table or bedrock less than four feet below the bottom of the proposed absorption system; or a slope in excess of 30%. Based on Nicholas Lampiris' geologic investigation report, we are confident that a septic system can be installed. However, site specific soil data will have to be obtained. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which should be no problem on this large parcel. The leach field will need to be located a minimum of 100 feet from any wells. The area for the leach field should be located in an area of no traffic, planted with dry land grass, and should not be watered. It is desireable to locate the system below the house so that the system can operate by gravity. Please refer to the Pitkin County Sewage Regulations for detailed information. A condition of approval for this application is the issuance of the septic permit by the Environmental Health Department before a building permit can be issued. This Department needs adequate information on the quality of water available. Included in the application packet is a copy of the Colorado Division of Water Resources permit for the existing well which documents that the well produces 15 GPM and is adequate to serve the two proposed cabins. The High Country Engineering drawing of the proposed building sites shows the locations of the septic sites. These proposed septic sites comply with the setback requirements in that the septic systems will be a minimum of 100 feet from the existing well and 50 feet from creeks and ditches. It is recommended that low water landscaping (xeriscap g) The he State used and that e tuning of any sprinkler systems be decreased for low water plants. Lots in the Coal Basin area are served by individual septic systems. All such systems installed within Pitkin County require septic permits issued by tlp_:; Environmental Health Department, and must comply with the County septic regulations. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee with a completed Soil Data Form including perc test results and profile hole information. It must be possible to design an adequate septic system before a building permit can be issued. It also must be determined if a conventional system can be installed or if an engineered designed system is needed. An engineered system is required if any one of the following conditions occurs: a percolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of the groundwater table or bedrock less than four feet below the bottom of the proposed absorption system; or a slope in excess df 30%. Based on Nicholas Lampiris' geologic investigation report, we are confident that a septic system can be installed. However, site specific soil data will have to be obtained. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which should be no problem on this large parcel. The leach field will need to be located a minimum of 100 feet from any wells. The area for the leach field should be located in an area of no traffic, planted with dry land grass, and should not be watered. It is desireable to locate the system below the house so that the system can operate by gravity. Please refer to the Pitkin County Sewage Regulations for detailed information. A condition of approval for this application is the issuance of the septic permit by the Environmental Health Department before a building permit can be issued. Bill and Patricia Thompson and Henry T. and Linda Willison (hereafter "Applicants") have requested that the Board of County Commissioners of Pitkin County (hereafter "Commission") grant 1041 Environmental Hazard and General Submission approval for two parcels generally located in the Coal Basin area and more specifically described in the attached "Exhibit All. 2. The subject properties are two 78.2 acre parcels, which were created via 35 acre subdivision exemption parcels pursuant to State Statute. The fathering parcel from which the subject properties were created, contained approximately 156.4 acres. 3. Access to the subject properties is provided via Coal Creek Road. The Applicant has demonstrated a legal right to use this roadway from Highway 133 to the subject property. 4. The Planning and Zoning Commission reviewed the applicant's request at regularly scheduled public meetings on August 2, and Resolution No. 952� Page 2 November 1, 1994, and found the Applicants' request to be inconsistent with the County's policies regarding "compatibility with adjacent or nearby public lands" and recommended denial of the application. S. The Board reviewed the Thompson/Willison application at a duly noticed public hearings on February 28th, June 14th, July 5th, August 23rd and October 11th 1995, at which time evidence and testimony was offered by the Applicants, Staff and members of the public. 6. The Board finds the applicant's request to be generally consistent with the applicable provisions of the Pitkin County Land Use Code provided the applicants adhere to the conditions outlined in this resolution. NOW, THEREFORE, BE IT RESOLVED by the Board that it does hereby approve the Thompson/Willison 1041 Environmental Hazard and General Submission application subject to the following conditions: 1. This approval is granted for one single-family dwelling of 1,500 to 2,000 square feet on each of the two lots. 2. The Applicant shall adhere to all material representations made in the application and in the public meetings. 3. The site plan shall include the following: a. The following 1041 Hazard Review Warning and Disclaimer language: "The provisions of these regulations do not in any way assure or imply that areas outside of designated hazard areas will be free from hazards, or that approved mitigation measures will guarantee the safety of any property." b. The following emergency service warning: WARNING: Emergency and firefighting vehicles and personnel may not be able to access the property and building site. Residents and visitors to this property should be prepared to self -rescue in an emergency situation. C . The building envelope shall on Parcel #1 shall be moved 120 feet to the northeast of and off of the alignmennt of the old railroad right of way. 4. The Applicants, their heirs, or successors shall maintain, to County driveway standards, its easement access necessary to reach the property. S. The Applicant shall comply with the recommendations of the DOW as follows: a. Maintain 100 foot setback from Porcupine Creek for any cabin construction. b. Revegetate any disturbed areas immediately following construction with native vegetation. C. All garbage shall be kept in bear -proof garbage cans/dumpster. The DOW can provide specifications for the trash containers upon request. d. Any rail fencing shall be 48", 3 rail or less with at least 18" between two of the rails. In addition to the above restrictions identified by the Colorado Division of Wildlife, dogs shall be prohibited on the properties. This dog restriction shall only be lifted upon construction of a kennel. Dogs shall be limited to one per lot. 6. Prior to issuance of a building permit, the Applicant shall provide documentation of an adequate domestic water supply. Quantity and quality of said supply shall meet the approval of the Environmental Health Department. 7. The septic system for the site shall meet the approval of the Environmental Health Department. The Applicant shall obtain a septic system permit from the EHD prior to the issuance of a building permit. 8. The Applicant shall obtain a fireplace /woods tove permit from the Environmental Health Department, prior to the issuance of a building permit (if necessary). 9. The Applicant shall prepare and implement a fugitive dust control plan for review and approval by the Environmental Health Department prior to building permit issuance. 10. Positive drainage shall be maintained around all habitable structures. A 4 -foot -high berm shall be constructed behind (to the northeast and northwest) the proposed cabin on Parcel #1. A 3 -foot -high berm shall be constructed behind (to the northeast and northwest) the cabin on Parcel #2. 11. Prior to building permit issuance,the applicants shall make payment of $10,000 into an escrow account to be used only for the purpose of constructing (not scoping or planning) an alternate trail around the east side of subject property (the alignment of which shall be determined by the U.S. Forest Service) to rejoin the Dexter Park Trail on the north side of the property. These funds shall be returned to the applicants or there successors, with interest, in the event that the alternate trail is not constructed within four years of the 392195 04/29/96 03:31 F' FSG 4 OF 8 Resolution No. 95 - Page 5 date of tender of funds by the applicant. The applicants shall also, by separate document to be delivered immediately prior to start of construction of the trail over the applicant's property, grant an easement over the northern portion of the property (see attached "Exhibit B")for trail construction and use if a trail alignment through that area is determined, by the U.S. Forest Service, to be necessary for the installation of the alternate trail. In exchange for the money, which is to be placed in escrow and the agreement to grant an easement for the alternate trail, the Board agrees not to pursue a condemnation action for an easement along the existing trail alignment for four years from the date of this approval. However, the Board reserves the right to pursue condemnation or purchase of the property, in its entirety, at any time. 12. No development, including grading and vegetation removal, shall occur outside of the building envelope other than the access road improvements, grazing, removal of standing dead trees and fencing meeting DOW standards. 13. The applicants shall pay all costs associated with the acquisition, reconstruction, and maintenance of the power line (from the wash plant site to the subject property) in accordance with the "line extension agreement" between the applicants and Holy Cross Electric Association. 14. Stream banks which have been disturbed as a result of the installation of the culvert shall be stabilized. Prior to issuance of a building permit, the area immediately around the culvert shall be stabilized with rip -rap. The rip -rap shall extend all the way to the bottom of the stream channel and shall cover an area 4 feet in diameter around the edge of the culvert on both the upstream and downstream side of the roadway. All other stream bank areas in the vicinity of the road improvements which were disturbed during construction or are otherwise void of vegetation shall be revegetated within one year of the date of this approval.
