One 1000 -gallon septic tank had been installed in series lA ith the existing 1250 -gallon tank and 45 Infiltrator units had been installed in a bed absorption system, but no backfilling had taken place. The inspection wells, effluent line and distribution laterals were on site, but had not been installed. Otherwise, the installation of the system was in conformance with the intent of the design. Margaret E. Weitz Revocable Trust, Britta B. Harris, Redstone Investment Company, William G. Argeros ("Applicant") have applied to the Board of County Commissioners of Pitkin County, Colorado (`BOCC"), for approval of a Subdivision Exemption for a Major Plat Amendment pursuant to the Pitkin County Land Use Code. 2. The subject property is located south of Redstone and is known as the Riverside Park Subdivision. 3. The Planning and Zoning Commission reviewed this application on September 1, 1998, and directed staff to forward a recommendation of approval to the BOCC. 4. The BOCC heard this application at a regularly scheduled public hearing on December 2, 1998, at which time evidence and testimony were presented with respect to this application. 5. The BOCC determined that the proposed activity meets the applicable criteria established in the Land Use Code, provided the conditions listed in this resolution are adhered to. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado, that it does hereby grant approval of the Weitz Subdivision Exemption for a Major Plat Amendment, subject to the following conditions which shall run with the land and be binding on all successors: 1. The Applicant shall prepare a final plat in accordance with Land Use Code Section 5- 40-020. The plat shall be recorded prior to submission of any building permit applications. The plat shall be identified as the " First Amended Plat of the Riverside Park Subdivision." The plat shall also be submitted in a digital format for integration into the County Geographic Information System. 2. All material representations made by the Applicant in the application shall be adhered to and considered conditions of approval. 3. From: Mary Wood, Environmental Health Specialist Through: Lee Cassin, Assistant Environmental Health Director Date: November 12, 1997 Re: Weitz Major Plat Amendment Parcel ID # 2729-203-06-012 The Aspen/Pitkin Environmental Health Department has reviewed he details of the Weitz Major Plat Amendment application under the authority of the Pitkin County Code Title II, Land Use Code. The Aspen/Pitkin Environmental Health Department has some concerns in regard to the area, however, those concerns do not appear to be related to this application. The concerns are that it appears that it would be difficult for anyone to be able to build on the remaining undeveloped lots in the Riverside Park Sub -Division if individual sewage disposal systems would be needed to treat wastewater. Things would be further complicated if wells were the only means to supply homes with potable water. Some of the previously platted parcels are now partially owned by Weitz and Harris. Portions of the original parcels that remain available, now.also have a road through them cutting the available land for development even further down in size. It may be possible to build on some lots if they are serviced by Redstone Water and Sanitation for potable water supply and wastewater treatment. Pertaining to this application, the Aspen/Pitkin Environmental Health Department has no concerns with Weitz combining all of the existing Weitz -owned properties to make one large parcel, and Harris combining all of the existing Harris -owned properties to make a second large parcel. Lots 4-7 would not be able to be built on if individual sewage disposal systems and wells are to be used. All sewage disposal systems and wells must be on the same lot as.the dwelling(s) that they serve. All minimum horizontal setback distances must be maintained between pertinent physical features and sewage disposal system components. It is a flat level area, good sun exposure, meets the setback from the river, is high above the river so there are no ground water contamination concerns, and has no steep slopes in the area.
