Dear Tom:
We were in contact with your office the middle of May regarding applying for
a sewage disposal permit. A copy of the percolation test was sent to your
office and I believe the initial site inspection was made at about the same
time. We are now ready to proceed with the application.
Enclosed are the application, permit fees, percolation test results, and the plot
plan. I am also enclosing the stove permit application and the application
checklist.

Dear Mr. Lowery:
As requested by Bill Dorais, Chen -Northern, Inc. performed percolation testing on April 30,
1993 at the subject site.
At the time of our site visit, a profile pit and three percolation test pits had been excavated in
the area of the proposed leach field. The soils exposed in the profile pit consisted of 0 to 1.5
feet of topsoil over 1.5 feet of silty, clayey, sand and gravel overlying 5.5 feet of sandy silt clay
to a maximum depth excavated of 8.5 feet. Percolation test depths and results are presented on
Table I.
The upper silty clayey sand and gravel soil appears more suitable for a leach field system than
the lower sandy silt and clay soil. The percolation rates varied from 27 to 120 minutes/inch.

This letter is in response to your concerns about the site for a
septic system for the Judy Beth Lowry Trust, Lots. 37 & 38 in
Crystal River Park subdivision, Redstone, Colorado.
I reviewed the information in our file on this parcel and did a
site inspection on December 30, 1993. After reviewing the soil
data information on percolation test hole results and the profile
hole information, this department still has no concerns about the
suitability of either lot 37 or 38 for an adequate septic system.
We are concerned about water systems and the need to preserve the
integrity of the water quality. Individual sewage disposal system
components must be adequately separated from water supplies,
streams, buildings, property lines, etc to prevent contamination,
building settling, and other potential problems. As long as the
owners of lots 37 & 38 are in compliance with the regulations
concerning minimum distance setbacks of their septic system, their
system will not jeopardize the quality of the water system.
You brought to our attention problems with freezing and leaks of
the water ]_ine in front of lots 37 & 38 that serves your property.
Our recommendation is that the Crystal River Park Homeowners
Association reconstruct this line to a depth where it does not
freeze.

Dear Mrs. Mackenzie:
1. This letter will confirm our telephone conversation of
December 8, 1993, wherein I requested an onsite inspection by
someone from your Department of a proposed building to be erected
on Lot 38 of the Crystal River Park Subdivision which is adjacent
to my property for the following reasons.
2. First, I would like to quote Par. 3 of my August 30, 1993,
letter to Joanna Schaffner relative to this matter:
"Lots 38 to 30 incl. are all uphill in descending
order, Lot 30 being the highest and Lot 38 the lowest.
Mr. Boncher who previously owned Lot 37 and Lot 38
had perk tests conducted and told me that he had to
build on Lot 37 and use Lot 38 for a leaching field
which makes sense since Lot 37 is higher than Lot 38."
3. Mr. Boncher owned only Lot 38 at that time and bought
Lot 37 to accomplish this purpose. What I cannot understand is
that now birs. Judy Lowry had bben given permission to build on
Lot 38 which will mean putting her leaching field in a southerly
direction and apparently in Lot 37. There has never been a perk
test conducted on Lot 37.
4. There is a water line passing in front of Lots 37
and 38 that was installed in 1968 to service my property. This
line runs under a ditch leading to a culvert under the road.
Dr. Bushey who was a resident here at that time told me this
line was buried very shallow in this area and that is why it
must be bled to keep from freezing. Furthermore, it has been dug
up three times at the foot of my driveway in order to be patched
because of leaks.
5. It seems to me that under the present plans we are
creating a serious potential for pollution to our water supply
which would be obviated under the arrangement that was arrived
at with I,lr. Boncher.
6.. Since there is no one available today that knows the
full particulars of this water line, it is very important that
no further construction be allowed until this matter is resolved
to the satisfaction of all parties concerned.
