Hi Rick!!
I just got that ISDS application for Paul Markham with the failed septic
system in Crystal River Park Subdivision. If you recall, I'd asked you
about getting the 1041 done so that the septic system will be on the same
lot as the house. Since it was a failed system, I'd asked if it would be
ok with you all that if the application and fee was submitted, and you felt
ok with the info. in the submission, if I could issue a septic permit. Have
you gotten that application? Are you comfortable with the information that
you've gotten? May I issue the septic system permit?
Thanks, Rick... I think everyone will feel better knowing that the failed
system is being replaced as quickly as possible and I appreciate your
understanding in this case.

To date, I have not received the required information requested by staff from Mr. Paul Markham
in order for the County to determine the legality of the duplex on the property. The lot line
adjustment application that was submitted on July 7, 1997 was closed on September 9, 1998. The
duplex issue was and has not been resolved. Mr. Markham will need to reapply for a lot line
adjustment once the legality of the duplex is determined.

Dear Mr. & .Mrs. Markham:
A permit for an individual sewage disposal system (I5D5) was issued for the above noted property on 7/9/97.
This was an "emergency" permit because your old system had failed. The I5D5 regulations state that a system
must be installed on the lot that the home is existing on. In order for you to be able to install a system and be
able to meet ail necessary setbacks, the system had to be installed on your vacant lot adjacent to the lot that
your house was built on. Because of the requirement that the system and home be on the same property, you
had to apply to Pitkin County Community Development for a lot line adjustment. You had complied with this
requirement and Community Development gave us the OK to issue your emergency permit. However, the lot line
adjustment_ application was never followed through to completion and has since expired. We cannot "final" your
I5D5 permit without being notified by Community Development that you have completed the lot line
adjustment combining the two lots. A final inspection of the system was conducted on 7/11/97. Please be
advised that your I5D5 is not considered to be completed even though the final inspection has been conducted
and the installation found to be satisfactory.
Our efforts to work with you to bring this I5D5 permit to completion have failed. We must receive
documentation that you have re -started the lot line adjustment process by March 15, 2000, and the lot
line adjustment be completed by May 15, 2000 (We've been informed that it usually only takes
approximately 4-6 weeks for the process to be completed). If you do not comply with these criteria, we
will record a copy of this letter against your properties as public notice of non-compliance. If you start
the process, but are held up for some reason and will not meet the deadline, you should contact Environmental
Health, and we will determine if we will delay attaching this letter to your deed.
In addition, because there are public health concerns due to your lack of compliance, we may also seek
injunctive relief through the courts.
Should you have questions regarding this issue, please don't hesitate to contact this department.

The deadline date has since passed, and Pitkin County Environmental Health has not
received the requested information to date. Therefore, we are sending you this letter to
notify you that a copy of the attached letter has been recorded against your property
deed(s).
When Pitkin County Environmental Health receives documentation that the requested

COMMUNITY DEVELOPMENT DEPARTMENT
It is the policy of the Community Development Department to close land use files which have been
inactive for more than one year. Your application was submitted to our department on July 3, 1997.
During the review of your application, it was determined that additional information regarding the
legality of your duplex is required. In a letter from Joanna Schaffner, Zoning Officer, dated December 9,
1996 (copy attached); it was determined that your residence has always been assessed as single family
dwelling unt and that the building permit issued for the garage in 1995 indicates that the existing
residence is singe -family. In addition, although two meters have been in existence since 1971, there is
no indication that these meters are for separate dwellings. As indicated by Ms. Schaffner, if
documentation could be provide verifying that the duplex existed prior to 1971, the duplex would be
considered legal, but non -conforming and your lot line adjustment application can be processed.
If I do not hear from you within the next fifteen days, no further review of the lot line adjustment will be
conducted and your application will be closed. The Environmental Health Department has indicated that
the final sign -off of your individual sewage disposal system permit has not occurred and will not happen
until land use approval is granted. If you need any further information, I can be contacted at 970-920-

The Aspen/Pitkin Environmental Health Department has reviewed the details of the Markham Lot Line
Adjustment application under the authority of the Pitkin County Code Title II, Land Use Code and has the
following comments.
Lots in the Crystal River Park subdivision are served by individual sewage disposal systems. All such systems
installed within Pitkin County require septic permits issued by the Environmental Health Department, and must
comply with the County's sewage disposal system regulations.
The Markham property has a failed cesspool which must be replaced with an approved system in accordance
with the current regulations. Cesspools are no longer allowed in the state of Colorado and must be replaced
regardless of whether or not they are still functioning. Failed systems must be repaired or replaced as quickly as
possible to protect public health from health hazards associated with human waste.
The Markhams own lots 30 and 31 which are adjacent to one another. The existing home and failed cesspool
are located on lot 30. A new sewage disposal system would not be able to be placed on lot 30 and still be able to
meet current regulation setback requirements. Lot 31 provides a suitable site for a new sewage disposal system.
State requirements are that the home and sewage disposal system be located on the same lot, hence the reason
for the lot line adjustment.
It has already been determined that lot 31 can provide a suitable site for the replacement system, and since a
failed system is involved, a permit has already been issued and a new system installed, inspected and is in
operation. All setback distances have been maintained, with particular attention paid to proximity of waterlines
and property lines. The area of crossing of the water line and effluent line has been encased in accordance with
the regulation, as well as effluent lines that will be driven over are of Schedule 40 strength. Final sign -off of the
sewage disposal system permit will not occur until approval of this application is granted.

I think we should wait until they are approved by Planning Director before

as no record of it has yet been found.

Dear Annette and Paul,
As requested, Nelson Environmental and Wastewater Solutions, Ltd., performed a soils
study and percolation tests to provide information for possible designs for a replacement
septic system for the existing residence. We conducted this study according to Article 5 of
the Pitkin County Individual Sewage Disposal System Regulation on June 26, 1997. We
have based our recommendations on the subsurface conditions encountered at that time.
We will furnish this letter, a copy of your permit application, and a copy of the enclosed
data sheets to the Aspen/Pitkin Environmental Health Department as soon as possible so
that you may obtain a permit to construct this individual sewage system.'' .
Existing Construction and Lots
The existing two-story house, built in the late 1960's, consists of a two-bedroom, one
bathroom residence on the second floor with a total of approximately 1050 square feet of
living area The first floor contains a small apartment with one bedroom and one bath and
two garages. The first floor apartment is less than 600 square feet in size. The existing
septic system consists of two cesspools, covered with redwood ties, to the south of the
house and about forty feet from the leaking subdivision water line in the road. Water to the
residence is supplied from the Redstone Water and Sanitation treatment plant. The main
water line to the lot is in the road to the East of the property. �-
=.Tf The house location is on two subdivision lots, 30 and 31, totaling approximately one half
acre in size.
The house is located on property with mature landscaping and lawn with a gently rolling
topography, sloping at'less than a 12°x6 grade toward the East Southeast.. The surrounding
undisturbed areas, and typical of lots in this subdivision, consists of aspen trees and a few
pine and spruce trees with an undercover of native grasses and shrubs. .

A soil profile, within the p 8p�osed absorption area and downhill of the house, was
excavated to a depth of almost twelve feet. The excavation revealed that there was no
groundwater apparent or bedrock present to this depth from the surface of the ground.

The soils consisted of 16 to 26 inches of dark gray sandy loam topsoil. The subsoil was a
red, loamy sand of relatively uniform consistency. There were a few rocks and flagstone
fragments in the subsoils, some to twelve inches in diameter.
The subsurface soil conditions were evaluated with the standard percolation test
procedures at the approximate locations shown on Figure 1. The proposed drywell test
holes were excavated to varying depths and placed at the bottom of the backhoe pit using
hand tools. Before presoaking was begun, the sidewalls were scraped and three inches of
gravel were placed in each of the test holes to prevent the scouring of loose soils on the
sidewalls when water was added.
Percolation Testin
Percolation testing was performed on Lot 31 in the proposed absorption pit and in an area
Northeast of the existing residence on Lot 30. This testing was performed in holes dug to
varying depths and at the bottom of the backhoe excavation. The bottom of the deepest
test hole was located at a total depth of 142 inches below the ground surface, and the
others at depths of 62 inches and 97 inches. An initial filling of the percolation test holes
was done by adding approximately 6 gallons of water to the test hole the evening before
the percolation test was scheduled. The percolation holes were then further pre-soaked by
adding water to refill the test holes to a depth of fourteen inches above the bottom about
every two hours during an eight hour period before beginning the percolation test
measurements.
The results of the percolation testing are presented in Table I. These results indicate the
loamy sands have an average percolation rate of 22 minutes per inch, a satisfactory
percolation rate under Pitkin County criteria. These results and the minimum setback
distances required for horizontal separations from the water lines in the Pitkin County
Individual Sewage Disposal System Regulation seem to dictate a septic system absorption
area with a seepage pit or drywell configuration.
Limitations: This report has been prepared according to generally accepted practices in
this area for use for sewage disposal design purposes. The conclusions and
recommendations submitted in this report are based upon data obtained from our site visits
at the location indicated. There is some possibility that the nature and extent of variations
in the subsurface soils across the site may not have been evident at the time of this
investigation, and may need additional evaluation, if further excavation reveals conditions

different from those described. This office should be advised of any unusual situations as
soon as possible so that we may reevaluate our recommendations.
