Permit Conditions:
This OWTS Construction Permit is approved on the condition of compliance with the engineer design as submitted with the application and the specifications
cited above. Changes must be approved by this Department and the engineer prior to construction.
This design calls for one 1500 gallon two compartment tank along with an AX -20 Advantex Unit. A drywell will serve as
the absorption area. Depth below the inlet must be 12 feet. The drywell will be 12 feet long and 8 feet wide. The drywell
shall be filled with clean, graded rock that may range in size from Y to 2 Y inches in diameter. The rock shall extend from
the bottom of the well to at least 2" above the inlet pipe. At least one 4" perforated vertical stand pipe shall be attached
to the end of the distribution pipe with a tee fitting. A 30 mil PVC liner will be placed on the downhill side of the drywell.
This Permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this
Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for
the final inspection with a minimum of 48 hours notice.
Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS
Regulation.
This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in
accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation.
THIS PERMIT IS EXPRESSLY CONDITIONED UPON COMPLIANCE WITH ALL REQUIREMENTS OF THE PITKIN
COUNTY OWTS REGULATION, INCLUDING BUT NOT LIMITED TO THOSE CONDITIONS SPECIFIED ABOVE.
Plans and specifications for the proposed OWTS have been reviewed and are considered satisfactory. Permission is hereby
given to the property owner(s) to perform the work indicated in accordance with the Pitkin County OWTS Regulation. This
Permit will expire 1 year from the date of issuance unless construction on the system has commenced. An "as -built" drawing
must be submitted and approved by EH/NR before final approval of the system will be issued.

ALL SERVICE septic, LLC performed installation observations for the onsite wastewater treatment
system (OWTS) on April 16th and 22nd 2009 for the subject property.
The installation included a 1500 -gallon, two-compartment concrete septic tank (re -circulation tank)
and an AX -20 AdvantexTM unit, followed by a 8' x 12' x 12' deep drywell. A 30 ml PVC liner was
placed on the downhill side of the drywell excavation. Four -inch PVC perforated laterals were placed
in the gravel to distribute effluent. Two -feet of sand was placed in the bottom of the drywell prior to
the placement of gravel.
The OWTS was generally installed according to specifications. This observation is not a guarantee of
workmanship and/or parts and materials. ALL SERVICE septic, LLC should be notified if changes
are made to the OWTS.
LIMITS:
The observation was based on information submitted and our site visit. If conditions are different
from conditions described in this letter, ALL SERVICE septic, LLC should be notified. All additional
OWTS construction must be according to the county regulations. The installer should have
documented and demonstrated knowledge of the requirements and regulations of the county in which
they are working.

ADVANTEX OPERATION AND MAINTENANCE AGREEMENT

VPI Inc. will perform operation and maintenance services for the Onsite Wastewater System serving the subject site
as outlined below:
Control Panel, Pumps and Alarms: During each visit, all electrical components shall be tested for proper
function. Correct control settings will be verified. Operations data from panel will be recorded.
Processing Tank: During each visit, the scum and sludge layers in the processing tank (septic tank) will be
measured. A recommendation for pumping will be made when the scum thickness exceeds four inches, or the
sludge thickness exceeds 24 inches.
Pumping System: During each visit all pumps shall be observed to verify proper performance. The pumps will be
operated manually. The Biotube screen will be removed and cleaned_
Recirculating Filter: The filter will be observed for signs of excess organic build-up or improper performance.
The media will be cleaned as necessary. The system will be observed to verify proper distribution across the media
and distribution laterals will be flushed.
Drain Field: The surface area around the drain field will be observed for signs of failure such as lush vegetation
growth or effluent ponding. Liquid levels within the field will be observed through the observation pipe and levels
recorded.
Items that are not included in this contract include:
1. Corrective and/or repair maintenance if necessary, other than covered under warranty.
2. Effluent sampling and analysis if applicable.
3. The cost of tank pumping.
Alarms: VPI will respond to alarm conditions at no cost during the agreement period.
Service Calls: Service calls will be billed at a rate of $70.00 per hour and $45.00 per hour for travel time. A visit
to the site other than the routine visits provided by this agreement or a system warranty issue will be deemed a
service call. Examples would include (but are not limited to) damage caused by acts of vandalism, failure of tank or
failure of another party's work, i.e_ electrician, plumber, excavator, etc.
The goal of VPI is to observe the operation and perform maintenance for the Onsite Wastewater System to allow for
proper long-term function of the system and compliance with the conditions of the installation permit and
recommendations of the manufacturer.
VPI will perform O&M services as outlined for $265 per visit, with two visits per year ($530 per year). Payment in
full for the first ( 3 ) years is required prior to initiation of the agreement. This agreement period will be for the
( 3 )-year period subsequent to placing the system into operation.

Subsurface Investigation and Revised Onsite Wastewater System Design, Proposed 3 -Bedroom

ALL SERVICE septic, LLC performed a subsurface investigation and an onsite wastewater system
(OWS) design for the subject residence. The property is located outside of Redstone Colorado, in an
area where OWS are necessary. The revision is based on a change in the Pitkin County regulations.
The property is served by a community water service.
SITE CONDITIONS
A single-family, 3 -bedroom residence, having less than 6000 SF is proposed on the property. The
proposed drain field area slopes 15% to the southwest. Vegetation consists of native grasses and
aspen trees.
SUBSURFACE � `0 A
The subsurface was investigated by observing the soil profile to the east the residence. Th
materials observed consisted of 1 foot of a sandy root zone, underlain b silty, clayey sand, with
sparse rocks to the maximum depth observed of 10 feet. Groundwater bedrock was not observed
and is not anticipated. An 18 -foot test pit is required prior to construction of drain field. The
design is based an LTAR of 1.2 gals/day. A gradation analysis is provided.
DESIGN SPECIFICATIONS
The OWS design is based on 3 -bedrooms and an average sewage load of 450 GPD. The installation
must include a 1500 -gallon, two-compartment septic tank and an AX -20 Advantex Unit, followed by
a `drywell' drain field. The drywell must be 8 -ft by 12 -ft, and must be 12 feet deep, for a total area of
576 SF. Perforated PVC laterals, 1/2 to 2 1/2 -inch gravel, and 2 -feet of sand filter material, must be
used in the drywell construction. A 30 -mil PVC liner must be placed on the downhill side of the
excavation prior to placement of gravel. Construction must be according to the county ISDS
regulations, the septic permit provided by Pitkin County Environmental Health Department, and this
design.

ADVANTEX OPERATION AND INSTALLATION
A qualified installer should install The AdvantexTM Units. A two to three year operation and
maintenance contract should be provided by the installer. Additional construction notes are provided on
construction figures attached.
1. The control panel should be mounted in `line -of -site' to tank and AdvantexTM unit.
2. A dedicated 15A service for control breaker (in OSI panel) is required.
3. A dedicated 20A service for P30 and P50 pumps is required (1/2 hp or less).
4. If wires from breaker to panel and/or pumps exceed 75 feet we should be contacted to consider
230 -volt recommendations.
5. Conduit should be used for electrical lines.
6. Electrician must provide phone line, if applicable, and terminate in control panel.
OPERATION INFORMATION AND MAINTENANCE
The surface of the drain field should be seeded upon completion. Vegetation is an important factor in
drain field performance. Erosion control should be practiced prior to and during re -vegetation. Geo -
fabrics or plastics should not be used over the drain field. Livestock should not graze on the drain
field. Plumbing fixtures should be checked to ensure that no additional water is being discharged to
OWS. For Example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day
and harm a drain field.
The homeowner should pump the septic tank every two years and clean the effluent filter as needed.
Garbage disposal use should be minimized, and non -biodegradable materials should not be placed
into the OWS. Grease should not be placed in household drains. Loading from a water softener
should not be discharged into the OWS. No hazardous wastes should be directed into the OWS.
Mechanical room drains should not discharge into the OWS. The OWS is engineered for domestic
waste only.
ADDITIONAL CONSTRUCTION NOTES
If design includes a pump, air release valves and weep holes should be installed to allow pump lines
to drain to minimize risk of freezing. Excavation equipment must not drive in excavation of drain
field due to the potential to compact soil. Extensions should be placed on all septic tank components
to allow access to them from existing grade. Precast concrete tanks and distribution boxes should be
used, unless plastic or fiberglass is required. Access to all tank compartments and distribution devices
is optimal.
INSTALLATION OBSERVATIONS
ALL SERVICE septic, LLC, and the county must view the OWS during construction. The OWS
observation should be performed before backfill, after placement of chambers and distribution pipes.
Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must
also be observed. ALL SERVICE septic, LLC should be notified 48 hours in advance to observe the
installation.

SUMMARY OF RELEVANT PARTS OF APPLICATION: The applicant is requesting Activity

in the Crystal River Park Subdivision. The proposed dwelling will have approximately 3,650
square feet of living area.
DISCUSSION: The Pitkin County Environmental Health & Natural Resources Department has
reviewed the details of the Menardi Activity Envelope and Site Plan Review application under
the authority of the Pitkin County Land Use Code and the Pitkin County Onsite Wastewater
Treatment System (OWTS) Regulation and has the following comments.
Snow cover on the property would have inhibited an effective assessment of the site; therefore,
these comments are based on photographs included in the application, as well as a review of
the OWTS design by All Service Septic dated November 19, 2007.
--- WATER SUPPLY:
This property will be provided domestic water by Redstone Water and Sanitation District.
In connection with any OWTS Construction Permit for the property, this Department will
require a letter from the Redstone Water and Sanitation District confirming they have
sufficient water to supply the development and have agreed to do so.
--- SEWAGE TREATMENT AND COLLECTION:
A proposed OWTS design from All Service Septic, dated November 19, 2007, was included
with the application. Considering site constraints on the property, the engineer has designed a
dry well to minimize the footprint of the OWTS. As of March 8 2008 new OWTS regulations
went into effect which will affect the sizing and requirements for this system.
Under the new OWTS Regulation, a drywell to serve a 3 bedroom home with less than 6,000
square feet of living area and a Long Term Acceptance Rate (LIAR) of 1.2 would result in a
smaller drywell than under the previous regulation; however, secondary treatment is required

when dry wells are used for the absorption system. The engineer will need to consider this
change in the regulations.
All OWTSs installed within Pitkin County require OWTS Construction Permits issued by the
Environmental Health & Natural Resources Department, and must comply with the County's
OWTS regulations. The County cannot issue a Building Permit until an OWTS
Construction Permit has been obtained.

PITKIN COUNTY, COLORADO, APPROVING THE MENARDI ACTIVITY ENVELOPE AND
SITE PLAN REVIEW

RECITALS
I ) Peter and Mary Louise Menardi (hereafter "Applicant") have applied to the Community Development
Director of Pitkin County (hereafter "Director") to establish an Activity Envelope and obtain Site
Plan approval with Vested Rights for a new single-family residence. The parcel is within a designated
scenic view protection area.
2) The property is located at 50 Ruby Mountain Drive, and is described as Lot 19, Crystal River Park
Subdivision, Second Addition.
3) The lot is zoned RS -30 and contains 0.63 acres.
4) The Director finds that the request complies with the applicable provisions of the Land Use Code, as
follows:
A) The activity envelope is primarily located on slopes of less than 30%. There are three areas of
slopes in excess of 30% - at the northeast comer of the lot where the driveway cuts ofrof Ruby
Mountain Drive, to the east of the proposed garage and in the southern corner of the activity
envelope adjacent to the neighbor's driveway. The slopes in these areas are due to the presence of
minor natural or man-made changes in the gradient of a continuous slope, and qualify as minor slope
anomalies pursuant to Sec. 7-20-20(cx3) of the Code.
B) The wildfire hazard is severe, and can be mitigated pursuant to the provisions of Sec. 7-20-60.c of
the Code.
C) The lot is within mapped elk winter range, but according to the Division of Wildlife, the proximity to
previously developed lots and the associated disturbance make it unlikely that there will be any
significant impacts on wildlife.
D) The lot is not within a mapped avalanche hazard area and is below the downslope limit of a
mapped potential rockfall area.
E) The residence is exempt from the Scenic View Protection standards as it is not visible from
Highway 133.
APPROVED by the Director, subject to the following conditions, which shall run with the land and be
binding on all successors in interest:
I . The Applicant shall adhere to all material representations made in the application and shall consider those
representations to be conditions of approval, unless amended by other conditions.
2. Prior to submission of any future building permit applications, the Applicant shall be required to
submit for approval by the County Attorney and Community Development a Site Plan with an
Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual
Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and
recordation of them. The Site Plan shall also incorporate the following changes:

A.' The regrading for the French drain to the west of the garage shall be contained within the Activity
Envelope.
3. The parcel is exempt from the Growth Management up to 5,750 square feet of floor area.
4. Prior to issuance ofa building permit application for the residence, the Applicant shall:
A. Obtain a County access/driveway permit. The Carbondale and Rural Fire Protection District shall
review and approve the permit, and shall specifically approve the reduction in width of the
driveway from 16' to 14' and the adequacy of the turning radius at the entrance of the driveway.
Retaining walls in excess of4' in height shall be engineered.
B. Submit a drainage and erosion control plan for review and approval by the Planning Engineer.
C. Submit a construction management plan for review and approval by the Planning Engineer
showing the locations of staging, material storage and employee and construction traffic parking.
D. Pay the applicable road and employee housing impact fees.
E. Obtain a permit for construction of the on-site wastewater treatment system (OWTS). The system
must comply with the new OWTS regulations adopted 3/8/2008. In connection with the OWTS
permit, the Applicant shall provide a letter from the Redstone Water and Sanitation District
confirming that they have sufficient water to supply the development and have agreed to do so.
F. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes.
5. Areas disturbed by construction shall be re -vegetated within one growing season of the project's
completion.
6. No structural development in excess of 30", with the exception of fencing, shall occur within the
setbacks of the parcel. Landscaping in the form of berms shall not exceed four feet from the most
restrictive grade. Any development located within setbacks mandated by County zoning regulations
shall require a variance from the Board of Adjustment. Approval of an activity envelope within such
setbacks does not assure approval ofa variance.
7. The Applicant shall comply with the following standards for Development in a Severe Wildfire
Hazard Area:
A. Defensible Space: The area around all buildings/structures, limited by property boundaries that
may limit a property owner's ability to comply with this section, shall incorporate landscaping
with wildfire defensible space considerations as follows (note: actual vegetation manipulation to
meet these conditions may not be necessary where the natural vegetation patterns have already
fulfilled these conditions):
1) Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot
(10') perimeter around all structures. The large conifer on the south side of the driveway may
remain, but shall be limbed to 10', and brush shall be removed within a 10' perimeter of the
conifer.
2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a
minimum ofa thirty (30) foot perimeter around all structures.
3) Clumps of shrubby fuels shall be separated by at least 2 times the height of the fuel, as
measured from the edge of the canopy. Clumps should not be larger than 5-T in diameter.
Uphill of the house, clumps may be separated by 1 time the height of the field.
4) Ladder fuels underneath larger clumps of shrubs shall be removed.

5) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen
(15) feet of chimneys shall be removed.
6) All deadfall and dead branches/stems up to an 80' perimeter of all structures (or to property
boundaries) shall be removed.
7) All thinned snowberry, serviceberry, or chokecherry stumps shall be painted with Garlon (or
equivalent) herbicide to prevent aggressive resprouting.
8) No new conifer trees shall be planted within 20' of structures. Deciduous vegetation is
allowed in this area.
9) Within 15' of the structures, vegetation shall be less than 12" tall, except for aspen trees or
installed shrubs that are surrounded by irrigated lawns.
10) Within 10' of the structures, vegetation shall be kept to less than 6" tall, unless it is widely
scattered small planters, forbs, and other irrigated ornamental species.
1 1) The property owner shall he responsible for the continued maintenance of the defensible
space vegetation requirements.
B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted
Building Code. No wood shakes or shingles. All other adopted Building Code compliant
methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they
comply with the following:
I ) All roof coverings shall be constructed of non-combustible materials and installed on a Class
A roof assembly.
2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof
debris.
3) Protrusions above the roofline, such as parapets, shall be prohibited, unless constructed as for
a one-hour fire resistive assembly, as recommended by Art Hougland, Wildfire Expert (letter
attached as Exhibit Q.
4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum
pitch of 1:48.
5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the
Fire Marshal prior to submittal of a building permit application.
C. Roof Venting:
I) Soffit venting shall be located in the outer 1/3rd portion of the overhang.
2) Attic, soffit and other roof venting shall be of non -corrosive metal mesh with maximum ''A"
openings.
D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other:
One hour rated material or any material underlain by 5/8" Type X gypboard or equal, or "Type
IV" Heavy Timber materials, per the currently adopted building code.
E. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline:
1) Construction with noncombustible or one (1) hour rated material, or material with flame
spread <25 (tested to ASTM E84 and listed for exterior use), or
2) Conventionally framed deck with waterproof surface and underside protected with 5/8" Type
X gypboard or equal (decking as "a" above), or
3) "Type IV" Heavy Timber materials: joist and beams minimum 6"x10", columns minimum
8"x8", decking minimum 4" in depth, or decking as "a" above; or equivalent log
construction, or

4) Enclose projection vertically to ground with one hour fire resistive materials. Decking as "a"
above.
F. Railings: Railings must be constructed of noncombustible or "Type TV" Heavy Timber materials.
G. Exterior of the Structure, Including All Walls:
1) One (1) hour fire resistive rated materials, or
2) 5/8" gyypboard underlying combustible materials, or
3) Cement stucco, minimum %" thickness.
4) All glazing to be tempered glazing; and
5) Doors to be metal or wood 1 '/," thick minimum.
H. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and
constructed with materials approved for one (1) hour fire -resistive construction on the exterior
side of the wal is and shall extend from the top of grade to the underside of the Floor decking or
walls.
1. Maintenance and Miscellaneous Requirements
1) Roofs and gutters shall be kept clear of debris.
2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth ('/,)
inch maximum.
3) Any outbuilding shall adhere to the same wildfire requirements.
4) Yards shall be kept clear of all litter, slash and flammable debris.
5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet
away from any structure.
6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more
than six (6) inches.
7) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet
away from the structure.
8) Swimming pools and ponds shall be accessible by the local fire district.
9) Fences shall be kept clear of brush and debris.
10) Wood fences shall not connect to other structures.
11) Fuel tanks shall be installed underground with an approved container.
12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on
a contour away from the structure with standard defensible space vegetation mitigation
around any aboveground tank. Any wood enclosure around the tank shall be constructed with
materials approved for two (2) hour fire -resistive construction on the exterior side of the
walls.
13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher.
14) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be
visible at the primary point of access from the public or common access road and installed on
a non-combustible post.
15) Utilities shall be extended underground.
8. The Applicant shall comply with the following to mitigate impacts on wildlife:

A. Dogs shall be kenneled within 50' ofthe residential buildings or leashed under human
supervision when outside the kennel. Construction workers shall be prohibited from bringing
dogs on-site.
B. Pets shall be fed indoors, and pet food or food containers shall not be left outside.
C. Manipulation of vegetation outside of the activity envelope is prohibited.
D. New fences shall comply with the following:
1) Mesh or woven wire fences are prohibited.
2) Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not
exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in width
(top view), and shall have at least eighteen (18) inches between the lower two (2) rails.
3) Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five
(12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle
strands (which may be barbed) should be located a minimum twelve (12) inches apart and
from the top wire preventing entanglement when mule deer jump over. The bottom strand
should be sixteen (16) inches from the ground.
Fruit bearing trees and shrubs shall be prohibited.
Trash/garbage shall be kept in an approved bear resistant container or enclosure.
9. The Applicant shall comply with the following measures to mitigate for potential rockfall:
1) Final grading and landscaping shall incorporate continuous or overlapping topographical
separations of at least 6' upslope from inhabited structures (berms, overlapping mounds);
2) Stiffening of upslope foundations sufficient to withstand an impact of 600 pounds per square
foot for 6' above final grade, with no significant openings in this interval;
3) If upslope foundations can be angled towards the hazard, stiffening can be reduced to 4' above
final grade and able to withstand an impact of 500 pounds per square foot.
10. No development shall occur outside of the approved activity envelope, with the exception of
vegetation removal necessary to comply with the wildfire mitigation measures described above.
H. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake
the corners of the envelope and install construction fencing around the construction site within the
perimeter of the envelope. The fencing shall remain in place until issuance of a Certificate of
Occupancy.
12. The exterior materials (facade and roofing) for the residence shall have natural earth tone colors that
blend with the colors of the surrounding landscape and shall be non -reflective.
13. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements
have been conducted. These requirements will be considered at the time of building permit Any
structures represented in the application may not be permitted under building and zoning regulations.
14. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
Code, §2 0-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on
Yfi M , 2011.
15. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.
