One 2000 -gallon septic tank and 63 Standard Infiltrator Units have been installed in a bed configuration. Monitoring wells were being installed and backfilling was completed in the afternoon. All PVC at a depth less than 5' was insulated with blue board. All setbacks were maintained per Pitkin County specifications. A new permit has been issued #01089 based on an engineer design by High Country Engineering dated December 8, 2001. 1 will discard any previous designs from our file to avoid confusion. It is very important that this permit is kept on-site during installation and the contractors are aware of the design change. As of April 2001, the Pitkin County regulations require an effluent filter on the outlet of the septic tank. Although this is not specified in the engineer design, it must be installed to comply with current regulations. If you have any questions regarding this permit, please give me a call. The state requires certain parameters for this material. I have highlighted a portion of the permit so the contractor knows the sand must meet these guidelines. I have also talked with Tim Petz and he will write a letter better explaining what kind of sand is needed for the mounds to function properly. The Planning Commission recommended approval on October 6. The staff memo to the Planning Commission, which fully addresses the review criteria, is attached for reference. Only specific issues raised by staff, the Planning Commission or the applicant are addressed below. OWNER: Edward Bertagnolli REPRESENTATIVE: Jeff Bier LOCATION: The parcel is located to the southwest of the "E" lots in the Redstone Ranch Acres Subdivision (Bobcat Lane) in the Crystal River Valley. U.S. Forest Service lands are located to the south, west and northwest (across Highway 133). The building envelope is located on a bench above the Crystal River and the highway, across the highway from the Hays Creek waterfall. ZONING: The property is zoned RS -30 and contains 38.47 acres. COUNTY ATTORNEY COMMENTS: The staff report was reviewed by the County Attorney's Office on 11/24/98. STAFF ANALYSIS OF ISSUES: Building & Development Envelopes: In response to Joanna Schaffner's comment that the,building envelope encroaches into the required 50 foot setback, the Planning Commission agreed to require the building envelope to comply with the 50 foot setback but to allow a "development envelope," which accommodates certain development -- but not buildings -- to extend to within 30 feet of the lot line. Dog Kenneling: The DOW and the County's Wildlife Biologist both recommended that one dog be allowed with a kenneling restriction. The Planning Commission supported the recommendation, but discussed whether it would be feasible to have "seasonal" kenneling restrictions, since the kenneling requirements stems from the proximity to a specific seasonal habitat, such as calving habitat. Mr. Lowsky agreed that it was an idea to pursue, but that the difficulty of enforcement would be increased. RECOMMENDATION: Staff and the Planning Commission recommend that the Board adopt a "motion to approve the Bertagnolli 1041 Hazard Review and Conceptual Submission, subject to conditions." Staff memo to Planning Commission dated October 6, 1998 Application and site plan provided separately RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, APPROVING THE BERTAGNOLLI 1041 HAZARD REVIEW AND CONCEPTUAL SUBMISSION Resolution No. 98 - Edward Bertagnolli ("Applicant") has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") for 1041 Hazard Review and Conceptual Submission approval to construct a new single-family residence and customary accessory uses. 2. The Applicant's lot is zoned RS -30 and contains 38.47 acres. Said parcel is located off of Bobcat Lane in the Crystal River Valley, and is more specifically described in Exhibit A. The Planning Commission reviewed and recommended approval of this application at a regularly scheduled meeting on October 6, 1998. The BOCC reviewed the application at a duly noticed public hearing on December 2. 1998, at which time evidence and testimony were presented with respect to this application. 6. The BOCC finds that the application is generally consistent with the applicable provisions of the Pitkin County Land Use Code. NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby approve the Bertagnolli 1041 Hazard Review and Conceptual Submission, subject to the following conditions which shall run with the land and be binding on all successors in interest: The Applicant shall submit a 24" by 36" 1041 site plan to the Community Development Department for approval and recording, prior to submission of any building permit applications. The site plan shall also be submitted in digital format for integration into the County's GIS system. The site plan shall be modified as follows: Resolution No. 98 - Page 2 A. Include the following disclaimer on the site plan: "1041 environmental hazard areas exist that might affect the property, any improvements, and the use and occupancy thereof." B. The building envelope shall comply with the required 50 foot rear yard setback. A development envelope may be designated with its boundary within 30 feet of the rear lot line, however, no buildings shall be allowed within the development envelope. 2. Prior to submittal of an ISDS permit, the Applicant shall provide documentation of adequate quality and quantity of water from a well to the Environmental Health Department. Prior to submittal of any building permits, the Applicant shall: A. Obtain approval of an ISDS permit from the Environmental Health Department. B. File a fireplace/woodstove permit with the Environmental Health Department, C. Obtain an access permit from the County Engineer. The Applicant may utilize the existing driveway alignment, even though a portion of the driveway exceeds the maximum allowed grade of 12%, in order to minimize additional impact on adjacent slopes and vegetation. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above- ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -resistive construction on the exterior side of the walls. N. Each structure shall have a minimum of one 10 pound.approved ABC fire extinguisher placed in a visible and accessible location. O. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible and installed on a non-combustible post. P. Utility lines shall be buried along the driveway.
