The revisions are based on a new mound elevation for the proposed drain field from our previous design, dated July 28, 2003, under Job No. 15870W. The previous design should be discarded to avoid confusion. Our firm investigated subsurface conditions on July 24, 2003. SITE CONDITIONS The property is located in a rural area in Pitkin County, where OWS are required. The proposed drain field area has a 1% slope to the southwest and has a moderate cover of native grasses. The residence is served water by a community well located 100+ feet to the north of the proposed drain field. The proposed drain field location is within the 100 -year flood plain. PROPOSED CONSTRUCTION A two-bedroom residence with a total living area of less than 2000 square feet (SF) exists on the property as indicated on Figures 1 and 2. A cesspool exists on the site and is to be abandoned. The OWS was sized based on 2 bedrooms and 300 Gallons Per Day (GPD) using Pitkin County Environmental Health Department (PCEHD) loading of 75 gallons per day per person. The sewage loading with a peak factor of 1.75 is 525 GPD. This loading includes washing machines and a garbage grinder. SUBSURFACE CONDITIONS A subsurface investigation was performed by digging one profile pit and three percolation holes, 24 to 26 inches deep, at the locations indicated on Figure 1. Subsurface materials encountered in the profile pit consisted of 6 inches of sandy topsoil, underlain by gravelly sand with alluvial cobbles to the maximum depth explored of 6 feet. Ground water was encountered at 6 feet. Percolation tests indicate percolation rates of 8 Minutes Per Inch (MPI) to 20 MPI. The average percolation rate is 12 MPI. Typically concrete sand can be used as the ISDS sand filter. Our office should approve the sand filter material prior to hauling it to the site. The percolation rate of ISDS sand is 28 MPI. The OWS design is based on an average sewage load of 300 GPD and a percolation rate of 28 MPI. The installation must include one 1500 -gallon, two-compartment, precast concrete septic tank with an effluent pump in a Biotub6rm pump vault and a mounded gravelless chamber -bed drain field. The drain field must have 3 rows of 9 chambers each for a total of 27 chambers and 418.5 SF of infiltrative area. The proposed drain field area is located within the 100 -year flood plain, therefore; the septic tank must be anchored in the ground to prevent flotation and there must be a minimum of 4 feet of separation between existing grade and the bottom of the absorption system in the event of a flood. Pump specifications are included as Figure 5. Vehicle movement over the drain field area during construction should be kept at a minimum to minimize compaction of the receiving soils. The bottom of the bed should be scarified with a pick, shovel, or backhoe bucket teeth prior to the addition of ISDS sand and chambers. The surface of the field should be seeded after installation of the fields. A native seed mix should be sown at the drain field to re -vegetate the surface. These mixes do not require irrigation and may develop a growth 10 to 15 inches high. No automatic sprinkler system should be installed over the field. OPERATION AND MAINTENANCE The owner must. realize an OWS is different from public sewer service. The owner must be aware of, and assume responsibility for, ongoing maintenance of the system. In the absence of a monitoring pro- gram, the septic tank should be pumped every two years or more frequently if needed. Effluent filter and screened vaults, as applicable, are to be cleaned during pumping or as needed. There are daily considerations such as not putting plastic or other non -biodegradable materials into the septic system. Garbage disposal use should be minimized to reduce the frequency of pumping. Water use must be monitored so toilets are not allowed to run when seals malfunction. To illustrate the point, a running toilet can use in excess of 1000 GPD. An additional 1000 GPD loading may flood and irreparably harm the system. We caution against the installation of a water softener. The hydraulic loading from the backwash of a water softener is detrimental to an OWS and a separate drywell should be constructed for the backwash waste., if a softener is installed. No landscaping or plastic can be used over the field, which will reduce performance of the field. Chemically treated water from a swimming pool or spas should not be introduced to the OWS. The design of the OWS is based on the treatment of domestic sewage only. No industrial or hazardous wastes should be introduced into the OWS. LIMITATIONS A contractor who is experienced in its installation must install an OWS design. Our investigation, layout, design and recommendations are based on data submitted. If subsurface conditions different from those described in this report are encountered, we should be notified to evaluate the change on the proposed OWS. If the health department modifies this design, we should be contacted to evaluate the impact on the performance of the OWS. Nancy has been working closely with Selden and has been treating Holly professionally and firmly. The enforcement work is paying off and after a year there is movement to fix the system. Nancy will continue to be Holly's primary contact and will be responding to her latest attempts to gain an extension or relief from the type of system required. The approach, endorsed by Selden, is to continue to hold the set deadline for October construction and work with the Hamilton Family as progress is completed. Selden and I were going to meet with the BOCC in executive session, but decided this is purely operational at this time and does not warrant BOCC involvement. I made no commitments to Holly other than to say her October construction schedule seemed reasonable and that I would look into Nancy's analysis of Mo -DAD septic systems. Please respond to Holly's letter in writing. You are still her primary contact and should continue to be unless there is clear unprofessional behavior, which I do not perceive. Certification does not constitute an endorsement of this product. Individual local health department regulations may be more stringent that the referenced Guidelines. N. The Division shall certify any system employing new technology for sub surface discharge without holding a public hearing pursuant to subparagraph B.1. when the system bears. the National Sanitation Foundation Standard 40 Certification or meets an equivalent testing program's standards. I talked to your engineer, Seth, about the Mo -Dad system, around June 24th. It appeared that,he was under the impression that the Mo -Dad system did not require a soil .absorption area and that it could discharge directly in the Crystal River. I explained that the Mod -Dad is not certifies to discharge directly into a body of water. If the effluent is discharged subsurface, there is no reduction in absorption area size. For these reasons, I did not accept the Mo -Dad for this type of application. To discharge directly in the Crystal River, the application must first get local approval, and then be forwarded to the Division for issuance of a permit in compliance with all applicable regulations of the Water Quality Control Commission. This would probably require weekly testing of the effluent that is being discharged in the Crystal River, another additional cost. I questioned Seth as to why you would want to design this into your system. You have said cost is a concern. Adding the Mo -Dad unit will add to your cost; it will not give you any reductions. I told Seth that if he had any different information that I was unaware of, he sho get it to me. As long as the system is designed and installed according to State and Pitkin County code, and the setbacks between the septic system and physical features comply with the Pitkin County Individual Sewage Disposal Regulations, water quality should not be impacted and the environment would not be harmed. I did explain the permit process to Seth, your engineer. This department must be called to inspect the soil profile hole during the time of highest seasonal ground water and the profile hole must be in the location of the proposed absorption area. Seth told me that; profile holes were dug and that ground water was 3.5 feet below the surface --a week or two after the highest seasonal , ground water. At the request of your system engineer, I observed the holes the following day: He told me that the absorption area might be relocated. I reminded him that a new profile hole and perc tests must be done in the new location and that this department must be called for an inspection. I urged him to do, this immediately since it was already past the time of highest seasonal ground water. Be advised this department has not received a call to observe soil data . from a new location. To avoid further delay, the design should be based on the two bedrooms, which you currently have. The.deadlines as set forth in my July 7, 2003 letter to you have not changed. The permit. application must be submitted by July 17, 2003. At that point the Environmental Health Department can assess what progress has been made with the system design. We were advised that no changes Would be required to existing septic system, Environmental Health only had to review system to document a previously undocumented Waste System. Carla Block, after site visit signed off on permit application indicating that the system would have to eventually be replaced. June 2002 - Nancy Mackenzie attended our site — requested that a new ISDS be installed within one year. My understanding was that a system was not required by law —1 requested that a hard copy be provided which mandated that a new system be installed. I did not receive any information from Environmental Health supporting their request. I advised Nancy at that time, that financially we would not be able to install a system within one year, but our intention was to build a garage/studio out of the flood plain and at that time, we would be willing to install a new septic system that would take care of both Aructures. - September 2002 - Work completed. Certificate of Occupancy issued. - March 2003 — Economic slowdown — we determined to sell our home. End of May 2003 — Prospective buyer completing due diligence on our home informs our realtor that we have to install a new septic system — letter issued to us by Environmental Health May 29h, 2003 after the fact, refers to an internal document that we had never seen. This legal letter was highly inflammatory and advised that our system would not be allowed to operate past July 3'd, 2003 and we would be charged $50.00 per day for non-compliance. The residence appeared to be served by a 'cesspool' with no holding tank. The drain field is probably between the house and the river. No documentation was obtained from homeowner, or county, on the leach field location or on its performance. CHURCH was not retained or hired by homeowner. 0 Page 1 May 29, 2003 Holly Hamilton 19 Antelope Drive Redstone, CO 81623 Re: The Anderson/ Hamilton Residence septic system 19 Antelope Drive Redstone, C'O 81621 Dear Ms. Hamilton, Kent Wise, a potential buyer for the property you own._ located at 19 Antelope Drive in Redstone, Colorado, contacted the Environmental Health Department on May 27, 2003. Mr. Wise inquired about the status of the septic system for the residence, which prompted our department to research the parcel file. In connection with your application for a building permit in the summer of 2002; the Pitkin County Environmental Health Department inspected the septic system on your property to determine if the system was functioning, how it was sized, and the location of the system. The inspection was conducted in July of 2002 by Nancy MacKenzie,'a representative of the Environmental Health Department (`EHD"), and revealed that a cesspool existed approximately 50 feet from the Crystal River. Cesspools are prohibited in the state of Colorado pursuant to § 25-10- 112(4), 8 C.R.S. (2002). In addition, provisions of the Pitkin County Individual Sewage Disposal System Regulations prohibit use of systems like your own. See Pitkin County ISDS Regs. §§ 6.28.090, 6.28.500, 6.28.380. Your system is especially problematic due to its proximity to the Crystal River. Ms. MacKenzie documented the cesspool to be approximately "4 feet above the present level of the river, during a very dry season." She also researched soil conditions of two parcels upstream from your property and found both indicated high ground water and very fast percolation rates. Given the age of your system on your property, the proximity to the river, the potential for failure and possible environmental and public health impacts, Ms. MacKenzie informed you that the system would need to be replaced. I also performed a,personal site visit on May 28, 2003, which revealed that the water level in the Crystal River may well be connecting via groundwater to your existing system. Although a subsurface investigation will be required to verify groundwater influence, you should be aware that Pitkin County ISDS Regulation § 6.28.380 requires that a minimum four -foot separation must exist between ISDS facilities and groundwater. Notwithstanding these serious problems, the EHD signed off on the Certificate of Occupancy for your residence after you verbally agreed that the system would be replaced within a reasonable time. A memo prepared by Ms. MacKenzie dated 7/3/02 states that you agreed to submit an application for a new septic permit and replacement of the system within a year. Consistent with your verbal agreement, EHD expects submission of a properly prepared application to replace the cesspool with a compliant system no later than July 3, 2003. Please be advised that should you fail to submit a permit by that date, further use of your system shall be prohibited. Moreover, pursuant to statute, you may be liable for penalties of up to $50 per day for use of a non-compliant system. See § 25-10-113(2), 8 C.R.S. (2002). EHD has endeavored to allow you adequate time to address your system and will continue to work with you to bring it into compliance. She was told that she needed her septic system inspected to be sure it was working properly since we had no permit on file. The house was build about 1962, pre -septic permit files in Pitkin County . Router Rooter scoped the sewer pipe from the house to what they assume is a cistern. Duane Piffer, local installer knowledgeable about systems in Redstone confirmed to Holly that cisterns were common in the early 1960's. There is no septic tank between the house and the cistern. I did a site visit on 7/1/02. The cistern is about 50 feet from the river. The whole area is about 4 feet above the present low level of the river, during a very dry season. Vegetation in the area is cottonwood trees and new saplings indicating a moist area. I reviewed the septic files for the two lots up stream. Both indicated that ground water and very fast perc rates and down stream wells were problems in this area. I told Holly we would sign off on her CO, based on her filling out an application for a new septic permit. Our permit will require that they install a new septic tank by this late fall that will be between the house and the cistern as a temporary measure. The septic tank should be designed to be incorporated into a new system. Before high water next spring the second phase of the new system shall be installed. It must be designed to be above the flood plain and must be located the required distance from the well and other physical features as required in the regulations.
