McCoy Dear Mr. Benson and Stephen Kent, Agent: We represent Dr. Charles Leslie Yates, who is one of the owners of Lot B-10, Redstone Ranch Acres Subdivision. Dr. Yates' property is benefitted by an easement for the septic system which services it (the "Easement"). The Easement is situate on and burdens a 1.436 acre parcel of property owned by you and on which you recently obtained a 1041 Approval. Although the Easement grants a subsurface right, under both the common law and case law in the State of Colorado, you may not use the surface for a use of the surface which has a detrimental affect upon Dr. Yates' rights under the Easement. You have recently fenced the area of the Easement and are utilizing the same for the pasturing of horses. It is Dr. Yates position that such use of the portion of your property burdened by the Easement is inappropriate and in violation of his rights. Attached hereto is a copy of a letter written by Thomas S. Dunlop, Director of the Pitkin County Environmental Health Department (the "Department"), to Dr. Yates' agent, Susan McCoy, to which is appended a copy of the Individual Sewage Disposal System Regulation for Pitkin County, Colorado, presently in effect (the "Regulation"). You will please note that Mr. Dunlop's letter clearly states that the Department does not allow any activity above any component of a septic system thatwill compactthe soil or in any way compromise the function of that septic system. It also does not permit the construction of structures above such a system, such as, by way of example, the installation of fence posts, as that could affect the effectiveness and functionality of the septic system. Specific reference is made to Section 10-1.11 of the regulation which codifies the statements made by Mr. Dunlop in his letter to Ms. McCoy. H OATES, KNEZEVICH & GARDENSWARTZ, P.C. Brad Benson Crystal Farm February 17, 1999 Page 2 By this letter, Dr. Yates demands that you permit no further grazing activity, nor place any structure of any nature on the Easement area because of the damaging affect that the same will cause to Dr. Yates' easement and the existing leachfield situate thereon. Request is additionally made that you remove the fencing which you have placed on the Easement area in a manner which will not further adversely affect the function of the leachfield. If it is determined that the placement of fencing on the leachfield area has damaged the function of the leachfield, Dr. Yates intends to hold you accountable for any damages sustained. We are by copy of this letter advising the Department of the situation. Dr. Yates will ask for enforcement action by that Department in the event that you continue to violate his rights under the Easement by persisting in the activity that we have herein demanded that you cease. In addition, Dr. Yates reserves the right to proceed civilly against you for breach of the terms of the Easement and will do so independently of any action which the Department may take. DataIClientsIYatesVrBenson 2-11-99 November 9, 1987 Mr. Ray Fender Fender Realty, Inc. 0223 State Highway 133 Carbondale, Colorado 81623 Re: On-site Wastewater Disposal System for Lot D-3 of the Redstone Ranch Acres Subdivision Dear Ray: Based on our October 22, 1987 inspection of the soil profile hole excavated on this property it would appear that a conven- tional on-site sewage disposal permit can be issued by this department. The soil profile revealed a well-developed sandy soil to a depth of eight feet. This soil appeared to have moderate to moderately rapid permeability. There was no evidence suggesting that a seasonal groundwater table may be present. Bedrock was not found to this depth. We wish to remind you that percolation tests must yet be conducted to verify permeability before a final construction permit can be issued for any waste- water disposal system. The attached Sections 3, 4, and 5 of the Pitkin County Regulations on Individual Sewage Disposal Systems outline the basic procedures and specifications for the installation of a septic tank and seepage area.
