STAFF COMMENTS: Pursuant to Section 3-200.80 of the Land Use Code the Community Development Director may approve a minor amendment to a condition of a development permit. The applicant has discovered during the preparation of house plans and the septic permit that the required setbacks from the well and structures on the site cannot be met if the septic field is entirely located within the building envelope. As shown on the attached drawing, approximately 150 square feet of the septic field will be located outside of the southwest corner of the builelddCom ing ekes Pth the setback e and a small portion ements of the l extend beyond the southeast corner of the envelope. These encroachments outside of the building envelope are minimal, given the limited size of the building envelope, and will not have any additional 1041 impacts. The major areas of 1041 concern were the steep slope and associated wildfire hazard to the east of the building envelope, and riparian and wildlife habitat along Kline Creek (also east of the envelope). Condition No. 4 on the 1041 site plan reads: A septic permit shall be obtained fro the Environmental Health must be located within the building envelope and must comply a partment, prior to issuance o building permit. The study was conducted in accordance with our agreement for geotechnical engineering services to you dated October 6, 1997. The data obtained and our recommendations based on the proposed construction and subsurface conditions encountered are presented in this report. Proposed Construction: The proposed residence will be a two story wood frame structure over a full basement. Basement floor will be slab -on -grade. Cut depths are expected to be up to about 8 feet. Foundation loadings for this type of construction are assumed to be relatively light and typical of the proposed type of construction. The septic disposal system is proposed to be located about 35 feet to the east of the center of the building envelope. If building conditions or foundation loadings are significantly different from those described above, we should be notified to re-evaluate the recommendations presented in this report. Site Conditions: The site was vacant and covered with about 1 foot of snow at the time of our field work. The ground surface is relatively flat with a slight slope down to the southwest. There is a very steep slope down to Kline Creek to the north of the building area. The lot is vegetated with tall aspen and evergreen trees, grass and weeds. Subsurface Conditions: The subsurface conditions at the site were evaluated by excavating one exploratory pit in the building area and one profile pit in the septic disposal area at the approximate locations shown on Fig. 1. The logs of the pits are presented on Fig. 2. The subsoils encountered, below about 1 foot of topsoil, consist of 1 to 11/2 feet of silty to clayey sand and sandy clay overlying relatively dense sandy gravel with cobbles and boulders. Results of swell -consolidation testing performed on a relatively undisturbed sample of sandy clay, presented on Fig. 3, indicate moderate to relatively high compressibility under conditions of loading and wetting. Results of a gradation analysis performed on a sample of the gravel (minus 5 inch fraction) obtained EO Glenn Harsh November 28, 1997 Page 3 runoff can create a perched condition. We recommend below -grade construction, such as retaining walls and basement areas, be protected from wetting and hydrostatic pressure buildup by an underdrain system. The drains should consist of drainpipe placed in the bottom of the wall backfill surrounded above the invert level with free -draining granular material. The drain should be placed at each level of excavation and at least 1 foot below lowest adjacent finish grade and sloped at a minimum 1 % to a suitable gravity outlet. Free -draining granular material used in the underdrain system should contain less than 2 % passing the No. 200 sieve, less than 50% passing the No. 4 sieve and have a maximum size of 2 inches. The drain gravel backfill should be at least 1'/2 feet deep. Surface Drainage: The following drainage precautions should be observed during construction and maintained at all times after the residence has been completed: 1) Inundation of the foundation excavations and underslab areas should be avoided during construction. 2) Exterior backfill should be adjusted to near optimum moisture and compacted to at least 95 % of the maximum standard Proctor density in pavement and slab areas and to at least 90% of the maximum standard Proctor density in landscape areas. Free -draining wall backfill should be capped with about 2 feet of the on-site, finer graded soils to reduce surface water infiltration. 3) The ground surface surrounding the exterior of the building should be sloped to drain away from the foundation in all directions. We recommend a minimum slope of 6 inches in the first 10 feet in unpaved areas and a minimum slope of 3 inches in the first 10 feet in pavement and walkway areas. 4) Roof downspouts and drains should discharge well beyond the limits of all backfill. Percolation Testing: Percolation tests were conducted October 30, 1997 to evaluate the feasibility of an infiltration septic disposal system at the site. One profile pit and three percolation holes were dug at the locations shown on Fig. 1. The test holes (nominal 12 inch diameter by 12 inch deep) were hand dug at the bottom of shallow backhoe pits and were soaked with water one day prior to testing. The soils exposed in the percolation holes are similar to those exposed in the Profile Pit shown on Fig. 2 and consist of 1 foot of topsoil and 1 foot of silty to clayey sand overlying sandy gravel with cobbles and boulders. The percolation test results are presented in Table II. The percolation test results indicate an infiltration rate of between 30 and 60 minutes per inch with an average of 40 minutes per inch. The percolation rates were based on the last two readings of the test. The pie -slice shaped property is along Bobcat Lane and has the wide end near the road. This is in Section 29, T 10 Sv R 88 Wv of the Sixth PM, within the Redstone 7 1y2 minute quadrangle, Pitkin County, Colorado. The building envelope is between the road and the steeper portion of the lot at the rear, where a small stream flows. The lot is covered with aspens, with an occasional pine, and native grasses. The steeper portion of the lot is a twenty foot steep bank down to the floodplain of the small stream. The Aspen/Pitkin Environmental Health Department has reviewed the details of the Wall application under the authority of the Pitkin County Code, Title II, Land Use Code and has the following comments. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2-170 and 3-110.4: "It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if service is available." This Department needs adequate information on the quantity of water available. This can be done from tests of wells present on-site by a water engineer's or well driller's report. The applicant should ensure that the water quality is acceptable by having it tested by a lab such as the Snowmass Water and Sanitation District or Aspen Consolidated Sanitation District. Water of acceptable quantity has been obtained in other lots in this area. According to the applicant, a well has already been drilled on this property. If the location that is believed to be where the well is located is correct, it appears that it may be outside of the building envelope. Pitkin County Land Use Code requires that the well site be within the building envelope. The possibility exists that the well is not within the building envelope. It is recommended that low water landscaping (xeriscaping) be used and that the timing of any sprinkler systems be decreased for low water plants. The Colorado State University Cooperative Extension office can be contacted for more information on xeriscaping. A condition of approval for this application is the receipt of information documenting that the location of the well(s) meet setback requirements and can be placed within the building envelope and that quantity/quality of the well water are adequate. Without meeting these requirements a sewage disposal system permit and building permit can not be issued. SEWAGE TREATMENT AND COLLECTION: Sections 2-180 and 3-110.5: "It is the policy of the County to ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connections to such systems shall comply with the sewage disposal guidelines of Pitkin County's Individual Sewage Disposal System Regulation." Lots in the Redstone Ranch Acres area are served by individual sewage disposal systems. All such systems installed within Pitkin County require septic permits issued by the Environmental Health Department, and must comply with the County's sewage disposal regulations. To receive a septic permit, the applicant will need to submit a septic permit application and appropriate fee with a completed soil data information including percolation test results and profile hole information, as well as site plan and building floor plans. it must be possible to design an adequate sewage disposal system before a building permit can be issued. The Aspen/Pitkin Environmental Health Department will design the system for the applicant as part of the permit fee, if an engineered system is not required. We will do a site visit, advise the applicant about the best location for the system and provide a system design. We will determine if an engineered system is needed based on soil test results. An engineered system is required if any one of the following conditions exists: a percolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of the groundwater table or bedrock less than four feet below the bottom of the proposed absorption system; or a slope in excess of 30%. Prior to initiating any tests at the site, the applicant should contact this office. Since the location of the Wall's existing well or any existing neighbor's wells was not provided, it is unknown at this time if setback requirements between sewage disposal system components and these wells can be met. A site visit was conducted on November 15, 1996 at which time it is believed that the Wall's well is located in the area just north of the building envelope, but this information would have to be confirmed. The location of any neighboring wells is still unknown. Our records show that perc rates in the Redstone Ranch Acres have been within a range of 5 to 60 minutes per inch which would mean that either a conventional or engineered system could be possible. Site specific soil data will have to be obtained. The Wall's will need to adhere to minimum horizontal setback requirements for placement of sewage disposal system components which can be difficult on some lots. They will need to locate the leach field site a minimum of 100 feet from their well and from any neighboring wells and this distance may be required to be farther depending on the size of the home and number of bedrooms or rooms of similar size. As was before mentioned, the locations of wells is not known, so meeting the setback requirements 3 M� may be a determining factor on the location of the field, size of the field ( therefore, possibly the size of the home), or even if it is possible to put a field in. Provided, are a few examples of setback distances from wells, and absorption area sizes based on a mid-range perc rate of 30 mpi. The size of absorption area would be different if the perc rate is different. The example sizes are from the current regulation in 1996. If the sewage disposal system is permitted under a different regulation, the requirements may be different. For a home that is less than 2,000 square feet with 3 bedrooms or rooms of similar size, the absorption area required would be 863 sq. ft. and the distance from the well would have to be 100 ft. If the home is the same size, but has 4 bedrooms or rooms of similar size, the absorption area would have to be 1,150 sq. ft. and again, the distance to the well would have to be 100 ft. For a home of between 2,000 - 6,000 sq. ft. with 3 bedrooms or rooms of similar size the absorption area required would have to be 1,150 sq. ft. and the distance from the well 100 ft. If there are 4 bedrooms or rooms of similar size, the absorption area would have to be 1,534 sq. ft. and the distance from the well 132 ft. If the home has 5 bedrooms or rooms of similar size, the absorption area would have to have 1,917 sq. ft. and the distance from the well 160 ft. There is a very steep slope that drops off at the back of the building envelope. There should be an area of undisturbed soil left between the leachfield and where the hill starts to drop off. A chart of minimum horizontal distances between sewage system components and pertinent physical features has been included with these comments. All setback requirements must be maintained. At the time of the site visit, the ground was covered with snow, so it was not possible to determine if there were any ditches present as well as other pertinent physical features. The sewage disposal system must be located within the building envelope. The area for the leach field should be located in an area of no traffic, planted with dry land grass, and should not be watered. It is desirable to locate the system downhill from the house so that the system can operate by gravity. The applicant should refer to the Pitkin County Sewage Regulations for detailed information, or call our office to discuss this site. if the well permit states that the sewage disposal system must be of the non- evaporative type where the water is returned to the same stream system in which the well is located, a completely lined field, such as an evapo-transpiration bed, is not allowed unless the applicant contacts the Colorado Division of Water Resources and a new well permit is in place or a plan of augmentation is created. A condition of approval for this application is the receipt and approval of the sewage disposal permit by the Environmental Health Department before a building permit can be issued. The sewage disposal system must be located within the building envelope. WATER QUALITY IMPACTS: Sections 2-140 and 3-70.5 and 3-70.10: "It is the policy of the County to preserve and protect its present water resources, recognizing the County's semi -arid character and that significant transmountain and transbasin diversions and the vested rights of senior appropriators in the basin have materially curtailed the availability of an already scarce water resource. To this end it is the policy of the County that no land use be initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense of established water -dependent agricultural activities; or which would result in increased salinization of water resources, loss of minimum stream flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources. It is also the policy of the County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by meadows and wetlands." The Environmental Health Department is charged with preserving and protecting the quality of Pitkin County's water resources. Since a large percentage of the population is dependent upon water from wells, elimination of groundwater pollution, and protection of aquifers and their drainage areas are of utmost importance. Surface water and groundwater contamination can also be caused by inadequate setback distances from sewage disposal systems to proximate wells, rivers, creeks, ponds, and reservoirs. Minimum horizontal distances between components of a sewage disposal system and physical features must be in accordance with the Pitkin County Sewage Regulation. This Department reserves the right to require water quality sampling at the homeowner's expense. A condition of approval for this application is: All required distances be maintained between sewage disposal system components and any surface water, ground water, wells, rivers, creeks, ditches, water lines, ponds and reservoirs. AIR QUALITY: Sections 2-130 and 3-602: "Only that development is permitted which will not contribute significantly to degradation of air quality. This project is not expected to contribute significantly to degradation of air quality in Pitkin County. The applicant must file a fireplace/woodstove permit with the Environmental Health Department before the building permit will be issued. The less densely populated parts of the county like Redstone Ranch Acres may have two devices per building: a maximum of one wood burning fireplace and a second device which can be either a gas log fireplace or a certified woodstove. In addition, unlimited numbers of decorative gas appliances are allowed. Coal may not be burned in any device. No wood burning device may be installed in barns or agricultural buildings. A condition of approval for this application is the receipt and approval of the fireplace/woodstove permit by the Environmental Health Department before the building permit can be issued. CONFORMANCE WITH OTHER ENVIRONMENTAL HEALTH LAWS: Section 2-70: "It is the policy of the County to ensure that no use or development of land is permitted which is in violation of the laws of the County, the State of Colorado, or the United States of America."
