Changes must be approved by this Department and the engineer prior to construction. The existing tank will remain with the addition of an effluent filter. Condition of the tank will be checked and approved by the engineer. An additional pump vault will be installed. Effluent will be pumped to a deep gravel system with a minimum 7.5 feet of 1 %_ " screened rock. 1 foot of % " washed rock will sit above the screened rock in the area the effluent lines will run. The system will have a minimum of 1 foot of native soil for cover. If additional perc tests are conducted and the design is modified, changes must be submitted to this Department, in writing, and approved prior to installation. There must be a minimum setback of 10 feet from any component of the system to the property line, 20 feet from house to the absorption field, and 100 feet from the field to any well. This Permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for the final inspection with a minimum of 48 hours notice. Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS Regulation. This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. THIS PERMIT IS EXPRESSLY CONDITIONED UPON COMPLIANCE WITH ALL REQUIREMENTS OF THE PITKIN COUNTY OWTS REGULATION, INCLUDING BUT NOT LIMITED TO THOSE CONDITIONS SPECIFIED ABOVE. The field has been installed in substantial compliance with our design drawings, as has the effluent pump and chamber. No significant changes to the design drawings have been made, and we do not believe that separate "as -built" pians are warranted. The original design plans accurately show the location of the septic tank, effluent pump chamber, and absorption field. There is one concern which should be monitored by the owner, and that is the condition of the natural slope to the northeast of the absorption field. This area should be monitored regularly, and any sign of unusual seepage should be immediately reported. While we have not yet been on-site to view the condition of the absorption field during the high run-off period currently underway, we will be able to make a site visit this week. They are waiting for the pump and floats, controls, etc. We changed the pump, and also the piping size and the spacing of the perforations. This was due to a recommendation from the pump supplier, who is very Orenco knowledgeable, that the pump I selected was not the best type for this particular application. I pay attention when these guys talk, as I do not pretend to know everything there is to know about pumps! I have sent revised drawings to Eric, who will get them to Duane Piffer. I am copying you with the same drawings, so you know what is happening. If we can get the pump and controls soon, I do not expect a problem getting the system installed on-time. If the pump and controls do not arrive, we may be late. This would be my fault, because I could not immediately respond to the pump change recommendation. I noted the following: 1. The excavation is 8 -feet plus deep, and bottom appears fairly level. a. This will provide for 7.5 -feet of screened rock below the distribution bed. b. The top of the distribution bed will be at, or slightly above native ground level. c. This will allow for mounding over the field, which will help prevent people from driving on top of the field. 2. The excavation has fairly straight sidewalls on the south-west, east and north-east sides. (Road side, adjoining lot side and side toward creek, respectively). 3. The north-west side is rough, and sloping, due to the older field that they encountered. 4. The excavation is too close to the property line on the south-west side, parallel to the road. a. I advised Eric, who is to advise Duane, that this needs to be brought back to the 10 -foot property line setback as shown on the plans. This shall be done with native soils, compacted to at least 90%. b. This must be inspected as it happens. 5. The excavation is a little closer to the steep edge going down to the stream on the north-east side. I am considering options here, to prevent the softening of the slope, and emergence of effluent on the slope. 6. 1 will keep all advised as to the approach to take on this side. 7. 1 have advised Eric that a roughly rectangular field, 13 -feet wide and 50 -feet long, is the basis of the calculation. 8. Larger than this is O.K., so long as we do not intrude into the 100 -foot well offset, or crowd the 10 -foot property line offsets, or the steep slope on the north-east. 9. There must be at least 4 -feet of compacted native soils placed between the new field and the existing field. This soil separation must extend all the way down to the bottom of the new absorption field, and possibly beyond, if the existing field is deeper than the new field. 10. 1 did not perform any additional percolation tests, the ground was totally saturated with rain and snow. Eric had prepared two additional percolation test holes, but they were "slushy" and I did not believe we would get a markedly different percolation rate than what is designed for, since this is the level at which we took a soil sample, and had the gradation and hydrometry tests run. 11. 1 have sent some photos separately. 12. Eric will not begin placing gravel until I can resolve my concerns about the north-east face of the excavation, where it is close to the slope down to the creek. Thanks, Carter T. Carter Page, P.E. It was the expectation of this Department that a complete OWTS Construction Permit application would be submitted by September 15, 2008. As you know, a new OWTS Construction Permit is required to authorize repair of the failed system on the property. We have not received any application for repair of the current system, which we also understand is improperly sized, as it is serving an additional bedroom in the basement of the residence. The basement was finished without a Pitkin County Building Permit. We have provided you with a reasonable amount of time to address the OWTS issue on your property The approaching winter months now necessitate that immediate action be taken. The purpose of this letter is to advise you that, pursuant to Sec. 6.28.170(E) of the County"s OWTS Regulation, we are taking steps to schedule a hearing with the County's Health Officer to obtain a cease and desist order for use of the OWTS on the property on the grounds that it is: (i) not in compliance with the Individual Sewage Disposal System Permit previously issued for the property, (ii) not functioning in compliance with the County's OWTS Regulation, and (iii) constitutes a hazard to public health and the environment. I understand that you have cured some of the Notice by moving the yard fence onto your property, removing one illegal shed and you have applied for permits for the two remaining sheds. I also understand that you have been communicating with Nancy MacKenzie of Pitkin County Environmental Health and Natural Resources regarding the status of the septic field. I understand that Mrs. MacKenzie required that you remove the earth over the manifold system for inspection. I recall that you told me you were reluctant to do this and Mrs. McKenzie then suggested that you have the manifold inspected via in -pipe video. To date neither of these inspections has taken place as you have not taken the necessary steps. I have been recently informed that you have hired Mr. Carter Page of Gamba & Associates, Inc. to design a new septic field because, according to what Mr. Page tells us, the current septic field is allegedly in unsatisfactory condition (crushed manifold pipes and gravelless chambers) and will not pass the Pitkin County inspection. Unless otherwise concluded via inspection we consider this septic field to be a "failed system" that needs immediate replacement. Your hiring an engineer to design a new septic field supports this conclusion. Having an engineer design a new septic field is an appropriate first step towards replacing the field. However, in order for the County to issue a permit for the new septic field we must know how many bedrooms and bathrooms are in the house. The house originally received its C.O. with 2 bedrooms, one bathroom and an unfinished basement. I now understand that there is a possibility that the basement has been finished and that it now contains a bedroom and a bathroom, bringing the total for the house to 3 bedrooms and 2 bathrooms. This possibility is supported by the fact that the house is currently listed for sale by Mason and Morse as having 3 bedrooms and 2 bathrooms. In this case, the new septic field needs to be designed to accommodate these additions. In order for the County to process your pending septic permit, we will need to verify, via inspection, how many bedrooms and bathrooms are in the house. If we find that the "unfinished" basement has been finished you will be required to apply for and obtain building permits for work performed. As part of that process you have two options for the inspections related to issuing those building permits: 1) obtain notarized affidavits from a Colorado State licensed carpenter, plumber and electrician attesting that the work was performed to all pertinent Building Code standard and from a state licensed engineer if structural changes were made, or 2) remove sufficient dry wall so County inspectors can view/inspect the piping, electrical and framing of the areas finished/installed without permits. You may make this decision with County Building Department staff. In summary, in order for you to conclude curing the Notice of Violation against this property please do the following: 1) Replace the failed septic system: a) Apply for and obtain a Pitkin County septic permit for a septic system designed to accommodate the number of bathrooms and bedrooms currently in the house. b) The septic permit process includes an inspection of the house by County staff to establish the number of bedrooms and bathrooms. Please keep in mind that if your lot will not accommodate a septic field of sufficient size for the number of bedrooms and bathrooms currently in the house you will be required to reduce the number of bedrooms and bathrooms to the number originally present when the house received its C.O. 2) The failed septic system must be replaced and successfully inspected by Pitkin County no later than October 30'h, 2008. In order to accomplish this please submit your complete septic application, based on a professionally produced design, to Pitkin County Environmental Health and Natural Resources by September 15'h, 2008. Arrange for the house inspection establishing the number of bedrooms and bathrooms to be completed by September 15, 2008. 3) Submit for and obtain building permits for the work done in the originally unfinished basement area by October 30, 2008. 4) Conclude obtaining permits for the two sheds by September 15'h, 2008. Dear Carla: This letter is an addendum to the Onsite Wastewater Treatment Systems application for the Eric Petterson home at 0222 Bobcat Lane, Redstone, Colorado. As you may be aware, there is an existing OWTS system in place on the property. According to the previous permit issued, and the "as -built" drawing provided, the existing system consists of a 1,000 -gallon concrete septic tank (two compartments) and a 30 -unit Infiltrator (Quick4??) field. The system was permitted and installed under the previous owner, Glen Harsh. Apparently, the previous owner had not delineated the area of the absorption field, and parking occurred over the field. As a result, some of the Infiltrator chambers were crushed. Some time after Eric Petterson purchased the property, problems with the OWTS began to appear. Excavation(s) in the area of the absorption field revealed the crushed chambers. Some quantity of washed gravel was placed in the area of the crushed chambers as a repair measure or as a makeshift drywell. No permit was obtained for this work. We were hired by Eric Petterson to repair the absorption field and bring the system into compliance with Pitkin County regulations. Accordingly, a new profile hole, and three percolation test holes were excavated, on September 151, 2008. We made a site visit the following day, after the percolation test holes had been soaked, and observed the profile hole conditions, and conducted percolation testing. We observed the excavation and noted the following: 1. There was no observed water, nor any sign of mottling, to a depth of 8 - feet below existing ground. 2. There was no observed bedrock or large boulders to a depth of 8 -feet below existing ground. 3. The soil in the profile hole was fairly uniform in color and appearance from the ground to the bottom. The soil was generally wet -appearing, due to recent rains. 4. There were small rocks and cobble exposed on the walls and bottom of the profile hole. 5. Color was mostly dark brown, with some areas of reddish soil and rock. Petterson OWTS — addendum to the Permit Submittal. Wednesday, October 8'h, 2008 Page 1 of 4 6. A 4 -inch diameter perforated SDR -35 pipe was set in the profile hole. We believe that the perforated pipe will provide an easy way to confirm that there is no water present to a depth of 8 -feet below existing ground. The pipe is still in place, and will be visible in the area staked for the absorption field. Three new percolation test hole were also dug, unfortunately, portions of the existing Infiltrator chamber bed system were encountered, and the percolation test holes may have also encountered some of the gravel previously placed. Results of the percolation test were highly variable. Test hole number 1, at the southern end of the proposed field, would not hold water, regardless of the volume discharged from the garden hose, or the time that it was left running. During the active measuring phase of the percolation rates for the other two holes, a garden hose was left in hole number 1, running with a fully open hose bib. Percolation hole number 1 never held any appreciable volume of water, and what little water it held drained out immediately upon removal of the hose. No percolation rate has been established for this hole. Percolation hole number 2 was located more towards the middle of the proposed absorption field, and had a percolation rate of 42 -minutes per inch, based on the slowest rate in that hole. This value is similar to the average 40 -minutes per inch rate reported in the Hepworth- Pawlak report Number 197-602 of November 28, 1997. Percolation hole number 3 was the northern -most percolation test hole. It had a reported percolation rate of 4 -minutes per inch. Because of the variability of the percolation rates, and the presence of existing Infiltrator chambers and a possible gravel field of unknown extent, we are requiring that two additional percolation tests be performed on the soil at the depth of the proposed absorption field, after all existing Infiltrator chambers have been removed. The plans note that the extent of the gravel field will be identified, to the degree possible, and, if necessary, changes to the field depth, and the composition will be made after the second set of percolation tests have been completed. The existing septic tank is believed to be a Copeland 1,000 -gallon, two-compartment concrete tank. The minimum tank size for the two bedroom residence, with garbage grinder, would be 703.125 -gallons (2 x 2 x 75 x 1.5 x 1.25 x 1.25). The plans note that either: 1. The tank volume mark must be found and exposed for inspection. 2. The internal tank dimensions must be measured in the field, and the actual volume calculated. Any volume greater than the minimum 704 -gallons will be adequate for this residence. Peiterson OWTS — addendum to the Permit Submittal. Wednesday, October 8'h, 2008 Page 2 of 4 Also, the plans note that an effluent filter must be added to the outlet of the existing septic tank, so that the system can comply with the current Pitkin County regulations. We require a PolyLok PL -122 effluent filter, with 1/16 -inch filter slots be installed. We recommend, but do not require, that a "SmartFilter" filter alarm be installed. The available space for the absorption field is limited by the well offset, the property line offset, a storage shed, a steep slope on the northern extent of the field, the existing driveway and the building offset. The field is roughly rectangular, with dimensions of approximately 56 -ft. by 13.5 -ft. However, the northern end of the field narrows down considerably, and so placing Infiltrator chambers in the available area, and not intrude into the driveway or other setbacks would be nearly impossible. Therefore, we have elected to install a deep -gravel absorption field, with two perforated distribution pipes fed from a dosing pump to be installed in a manhole, near the septic tank. Following an earlier meeting, the issue was raised of the third bedroom in the basement of the residence. As a bathroom with a shower, and an egress window is in the basement, we agree with Pitkin County's evaluation that the room must be considered a potential bedroom, regardless of any other statements to the contrary. Accordingly, we have revised our plans and calculations for a 3 -bedroom residence. Because the available space dictates that a deep gravel field be constructed, and because the 3 -bedroom design means that this gravel field will be at least 7.75 -feet below the distribution piping, the owner has advanced the existing profile hole to a depth of 12 -feet (plus) below native soil. From the bottom of this excavation, we extracted a representative sample of the soils, approximately 2 -gallons, in a plastic bucket. The bucket was immediately taken to HP Geotech, with instructions to perform a gradation and hydrometer test to determine the proportions of gravel/sand, silt and clay in the sample. We received the results of this test yesterday, and agree with HP Geotech's evaluation of the soils at the bottom of the excavation as being a Sandy Loam. The range of percolation rates associated with this type of soil is from 1 1 -minutes per inch to 20 -minutes per inch. As stated above, our design is based on a single percolation test result, of 42 -minutes per inch. In order to both comply with State and Pitkin County regulations, and also to minimize the amount of soil that must be exported from the site, and the amount of gravel that must be brought in, we propose the following: A. Excavate to the design depth of the field, at the current design percolation rate of 42 - minutes per inch. B. Conduct at least two new percolation tests, at the bottom depth of the field, to confirm the appropriate percolation rate for the field. C. Revise the design calculations, both for the overall field size, and also for the deep gravel formula, to correspond to the accepted percolation rate. D. Place the separation fabric around the entire perimeter of the field, to the depth indicated in "C" above. Petterson OWTS — addendum to the Permit Submittal. Place the remaining 6 -inches of washed gravel over the perforated pipe segments. H. Lay the separation fabric over the entire surface of the field. I. Backfill with native soil to a level at least 2 -feet above the native soil in the immediate area, to protect the perforated pipe from crushing, and to discourage driving over the field. Our drawing indicates there is a bed of gravelless Standard size (3 ft X 6 ft) Infiltrator units 5 units wide by 6 units long, for a total area of 15 feet by 36 feet. His locate indicated that part of the driveway, a landscaped berm, a portion of the berm that the shed is sitting on and a portion of the shed are all located on top of the absorption field. 1)I have asked Eric to immediately stop parking on the portion of the driveway that is over the absorption bed. The area of the bed is to have a barrier so that there is no more traffic in this area. 2) 1 have a concern because the bermed shed is located on the manifold piping area of the absorption bed. The construction and weight might have broken the piping. I have requested that this area of the absorption field be exposed and inspected by me to verify that the piping is intact. 3) After the shed is removed, the gravel berm under the shed must be removed and the area brought done to grade. The landscaped berm does not have to be removed. It must be gradually sloped down over the absorption bed to prevent water from ponding on top of the absorption field. 4)Once the driveway gravel is removed from the top of the bed it must be replanted with grass. We discussed the advantage of seeding the area with the appropriate type of grass that does not require watering once it is established. I reminded Eric that the Notice of Violation requires this to be accomplished by August 3, 2008. To date neither of these inspections has taken place as you have not taken the necessary steps. I have been recently informed that you have hired Mr. Carter Page of Gamba & Associates, Inc. to design a new septic field because, according to what Mr. Page tells us, the current septic field is allegedly in unsatisfactory condition (crushed manifold pipes and gravelless chambers) and will not pass the Pitkin County inspection. Unless otherwise concluded via inspection we consider this septic field to be a "failed system" that needs immediate replacement. Your hiring an engineer to design a new septic field supports this conclusion. Having an engineer design a new septic field is an appropriate first step towards replacing the field. However, in order for the County to issue a permit for the new septic field we must know how many bedrooms and bathrooms are in the house. The house originally received its C.O. with 2 bedrooms, one bathroom and an unfinished basement. I now understand that there is a possibility that the basement has been finished and that it now contains a bedroom and a bathroom, bringing the total for the house to 3 bedrooms and 2 bathrooms. This possibility is supported by the fact that the house is currently listed for sale by Mason and Morse as having 3 bedrooms and 2 bathrooms. In this case, the new septic field needs to be designed to accommodate these additions. In order for the County to process your pending septic permit, we will need to verify, via inspection, how many bedrooms and bathrooms are in the house. If we find that the "unfinished" basement has been finished you will be required to apply for and obtain building permits for work performed. As part of that process you have two options for the inspections related to issuing those building permits: 1) obtain notarized affidavits from a Colorado State licensed carpenter, plumber and electrician attesting that the work was performed to all pertinent Building Code standard and from a state licensed engineer if structural changes were made, or 2) remove sufficient dry wall so County inspectors can view/inspect the piping, electrical and framing of the areas finished/installed without permits. You may make this decision with County Building Department staff. 11 In summary, in order for you to conclude curing the Notice of Violation against this property please do the following: 1) Replace the failed septic system: a) Apply for and obtain a Pitkin County septic permit for a septic system designed to accommodate the number of bathrooms and bedrooms currently in the house. b) The septic permit process includes an inspection of the house by County staff to establish the number of bedrooms and bathrooms. Please keep in mind that if your lot will not accommodate a septic field of sufficient size for the number of bedrooms and bathrooms currently in the house you will be required to reduce the number of bedrooms and bathrooms to the number originally present when the house received its C.O. 2) The failed septic system must be replaced and successfully inspected by Pitkin County no later than October 30`h, 2008. In order to accomplish this please submit your complete septic application, based on a professionally produced design, to Pitkin County Environmental Health and Natural Resources by September 15`h, 2008. Arrange for the house inspection establishing the number of bedrooms and bathrooms to be completed by September 15, 2008. 3) Submit for and obtain buildin� permits for the work done in the originally unfinished basement area by October 30', 2008. 4) Conclude obtaining permits for the two sheds by September 15`h, 2008. I had the office reviewed by an electrician, and he had a few changes that he wanted to bring the office into compliance (the ground needed to be "floated", and some other things- don't ask me though, Im not an electrician!). We had that done, and now the only thing left is to have the electrician sign the affidavit. The electrician also reviewed the basement, and he indicated everything looked good. We also had a plumber review the basement, and he said that the washing machine "dump" into the septic pipes was not to code. He indicated that he could reconfigure the "dump" to bring it into compliance, but it would take some work. He indicated that he was pretty booked up, but that he should be able to address the washing machine issue likely next week (we had him come out about a week and a half ago). I can only conclude that the basement was unfinished at the time of final inspection, as is noted on the final inspection form. Mr. Harsh's letter confirms that work was done without permit, so it looks like the improvements need to be legalized. I am attaching some affidavits that you can use for this process. I will list our options as follows and if you can give me a yes or no to each option as to whether a permit is required that will help us determine what we will do. 1. replace the rockwork under the front deck with pre -formed landscaping blocks (small 6x8x8 blocks available at local outlets) stacked up similar to existing rock. 2. replace the rockwork under the front deck with concrete block faced with cultured stone. 3. replace the rockwork at the driveway with pre -formed landscaping blocks stacked up similar to existing rock. 4. replace the rockwork at the driveway with concrete block faced with cultured stone. 5. replace the rockwork at the driveway with concrete block (to hold in road base) faced with sloping soil/sod. 6. apply cultured stone to the house foundation wall. 7. install stone or pre -formed pavers for walkways from driveway to house and around house. So this is the reason Eric has been trying to get out of exposing components of the septic field. Eric also told the engineer that there is an 'office' in the basement AND a bathroom. The original septic permit and the CO for the building where for 2 bedrooms and 1 bath upstairs and an unfinished basement. I told the engineer that we would have to design the septic field for the correct number of bedrooms. The building department must get involved in inspecting the basement since there are no permits for this work. At that point we can determine if it is just a powder room in the basement or a % or full bath that would make the 'office' a potential bedroom. The area of the bed is to have a barrier so that there is no more traffic in this area. 2) 1 have a concern because the bermed shed is located on the manifold piping area of the absorption bed. The study was conducted in accordance with our agreement for geotechnical engineering services to you dated October 6, 1997. The data obtained and our recommendations based on the proposed construction and subsurface conditions encountered are presented in this report. Proposed Construction: The proposed residence will be a two story wood frame structure over a full basement. Basement floor will be slab -on -grade. Cut depths are expected to be up to about 8 feet. Foundation loadings for this type of construction are assumed to be relatively light and typical of the proposed type of construction. The septic disposal system is proposed to be located about 35 feet to the east of the center of the building envelope. If building conditions or foundation loadings are significantly different from those described above, we should be notified to re-evaluate the recommendations presented in this report. Site Conditions: The site was vacant and covered with about 1 foot of snow at the time of our field work. The ground surface is relatively flat with a slight slope down to the southwest. There is a very steep slope down to Kline Creek to the north of the building area. The lot is vegetated with tall aspen and evergreen trees, grass and weeds. Subsurface Conditions: The subsurface conditions at the site were evaluated by excavating one exploratory pit in the building area and one profile pit in the septic disposal area at the approximate locations shown on Fig. 1. The logs of the pits are presented on Fig. 2. The subsoils encountered, below about 1 foot of topsoil, consist of 1 to 11/2 feet of silty to clayey sand and sandy clay overlying relatively dense sandy gravel with cobbles and boulders. Results of swell -consolidation testing performed on a relatively undisturbed sample of sandy clay, presented on Fig. 3, indicate moderate to relatively high compressibility under conditions of loading and wetting. Perched groundwater was observed seeping into Pit 1 at a depth of 51h feet at the time of excavation and the soils were moist to wet below water level. Foundation Recommendations: Considering the subsoil conditions encountered in the exploratory pits and the nature of the proposed construction, we recommend spread footings placed on the undisturbed natural gravels designed for an allowable soil bearing pressure of 3,000 psf for support of the proposed residence. Due to the perched shallow groundwater encountered in the building area, excavation dewatering may be needed for construction of the basement. Footings should be a minimum width of 16 inches for continuous walls and 2 feet for columns. Loose and disturbed soils encountered at the foundation bearing level within the excavation should be removed and the footing bearing level extended down to the undisturbed natural gravels. Exterior footings should be provided with adequate cover above their bearing elevations for frost protection. Placement of footings at least 42 inches below the exterior grade is typically used in this area. Continuous foundation walls should be reinforced top and bottom to span local anomalies such as by assuming an unsupported length of at least 10 feet. Foundation walls acting as retaining structures should be designed to resist a lateral earth pressure based on an equivalent fluid unit weight of at least 45 pcf for the on-site sand and gravel as backfill, excluding topsoil and oversized rock. Floor Slabs: The natural on-site soils, exclusive of topsoil, are suitable to support lightly loaded slab -on -grade construction. The upper silty to clayey sand soils are compressible upon loading. To reduce the effects of some differential movement, floor slabs should be separated from all bearing walls and columns with expansion joints which allow unrestrained vertical movement. Floor slab control joints should be used to reduce damage due to shrinkage cracking. The requirements for joint spacing and slab reinforcement should be established by the designer based on experience and the intended slab use. A minimum 4 inch layer of free -draining gravel should be placed beneath basement level slabs to facilitate drainage. This material should consist of minus 2 inch aggregate with less than 50 % passing the No. 4 sieve and less than 2 % passing the No. 200 sieve. All fill materials for support of floor slabs should be compacted to at least 95 % of maximum standard Proctor density at a moisture content near optimum. Required fill can consist of the on-site soils devoid of vegetation, topsoil and oversized rock. Underdrain System: Free water was encountered above the anticipated building excavation depth during our exploration. It has been our experience in mountainous areas that local perched groundwater can develop and groundwater levels can rise during times of heavy precipitation or seasonal runoff. We recommend below -grade construction, such as retaining walls and basement areas, be protected from wetting and hydrostatic pressure buildup by an underdrain system. The drains should consist of drainpipe placed in the bottom of the wall backfill surrounded above the invert level with free -draining granular material. The drain should be placed at each level of excavation and at least 1 foot below lowest adjacent finish grade and sloped at a minimum 1 % to a suitable gravity outlet. Free -draining granular material used in the underdrain system should contain less than 2% passing the No. 200 sieve, less than 50 % passing the No. 4 sieve and have a maximum size of 2 inches. The drain gravel backfill should be at least 11/2 feet deep. Surface Drainage: The following drainage precautions should be observed during construction and maintained at all times after the residence has been completed: 1) Inundation of the foundation excavations and underslab areas should be avoided during construction. 2) Exterior backfill should be adjusted to near optimum moisture and compacted to at least 95 % of the maximum standard Proctor density in pavement and slab areas and to at least 90% of the maximum standard Proctor density in landscape areas. Free -draining wall backfill should be capped with about 2 feet of the on-site, finer graded soils to reduce surface water infiltration. 3) The ground surface surrounding the exterior of the building should be sloped to drain away from the foundation in all directions. We recommend a minimum slope of 6 inches in the first 10 feet in unpaved areas and a minimum slope of 3 inches in the first 10 feet in pavement and walkway areas. 4) Roof downspouts and drains should discharge well beyond the limits of all backfill. Percolation Testing: Percolation tests were conducted October 30, 1997 to evaluate the feasibility of an infiltration septic disposal system at the site. One profile pit and three percolation holes were dug at the locations shown on Fig. 1. The test holes (nominal 12 inch diameter by 12 inch deep) were hand dug at the bottom of shallow backhoe pits and were soaked with water one day prior to testing. The soils exposed in the percolation holes are similar to those exposed in the Profile Pit shown on Fig. 2 and consist of 1 foot of topsoil and 1 foot of silty to clayey sand overlying sandy gravel with cobbles and boulders. The percolation test results are presented in Table II. The percolation test results indicate an infiltration rate of between 30 and 60 minutes per inch with an average of 40 minutes per inch. The percolation rates were based on the last two readings of the test. Based on the subsurface conditions encountered and the percolation test results, the tested area should be suitable for a conventional infiltration H -V UEOTECH Glenn Harsh November 28, 1997 Page 4 septic disposal system. The system should be based in the sandy gravel soils beneath the topsoil and upper clayey sands. Limitations: This study has been conducted in accordance with generally accepted geotechnical engineering principles and practices in this area at this time. We make no warranty either expressed or implied. The conclusions and recommendations submitted in this report are based upon the data obtained from the exploratory pits excavated at the locations indicated on Fig. 1, the proposed type of construction and our experience in the area. Our findings include interpolation and extrapolation of the subsurface conditions identified at the exploratory pits and variations in the subsurface conditions may not become evident until excavation is performed. If conditions encountered during construction appear different from those described in this report, we should be notified at once so re-evaluation of the recommendations may be made. This report has been prepared for the exclusive use by our client for design purposes. We are not responsible for technical interpretations by others of our information. As the project evolves, we should provide continued consultation and field services during construction to review and monitor the implementation of our recommendations, and to verify that the recommendations have been appropriately interpreted. Significant design changes may require additional analysis or modifications to the recommendations presented herein. We recommend on-site observation of excavations and foundation bearing strata and testing of structural fill by a representative of the geotechnical engineer. The property is impacted by the following hazards: • Mapped elk winter range; mapped within 1/4 mile of elk critical habitat, winter concentration area, and severe winter range; mapped bighorn sheep habitat across Hawk Creek and southeast above the subdivision • Medium and severe wildfire hazard; • Mapped alluvial fan; • Slopes of greater than 15%. APPLICANT: Michael Wall REPRESENTATIVE: Rhonda Bazil LOCATION: Lot E-11, Redstone Ranch Acres Subdivision No. 3; Bobcat Lane ZONING/LOT SIZE: The property is zoned AFR-10 and contains 0.45 acres, therefore, it is nonconforming with respect to size. SITE DESCRIPTION: The building envelope is located on a flat bench adjacent to Bobcat Lane. The lot drops steeply down to Kline Creek below the bench. The vegetation on the lot includes ponderosa pine, aspen and spruce. ACCESS: Access from Highway 133 is provided via Antelope Lane and Bobcat Lane. REFERRAL COMMENTS: Comments are attached as Exhibit B, and are incorporated throughout this memorandum. STAFF COMMENTS 1041 HAZARD REVIEW Wildfire: The property is mapped in a low wildfire area. Vince Urbina of the Colorado State Forest Service visited the site and rated the hazard as severe, because of the existing fuel density. Mr. Urbina clarified that the hazard within the building envelope would be rated as medium if the envelope was set back from the top of slope, since the upper bench is flat and the vegetation is less dense. The applicant 1 O �D subsequently agreed to relocate the envelope, and staff forwarded the application to the Hearing Officer for review, since a full 1041 review was no longer required. Urbina states that the hazard can be mitigated by implementing the following defensible space measures: Establish and maintain a clear 10 foot perimeter where vegetation can be maintained at 6 inches or less. No woody vegetation should be planted within this perimeter, and firewood or other combustible materials shall be stored outside of this perimeter. Thin the trees within a 30' perimeter around all structures, which includes the trees on the embankment. Remaining trees shall have a minimum of 10 feet between the edges of the tree crowns, and the lower limbs of these trees shall be removed to a height of 10 feet to eliminate ladder fuels. Remove all deadfall material within 100 feet. Bill Gavette of the Carbondale and Rural Fire Protection District adds that access to the property is generally adequate via Bobcat Lane, however, "a short section of Bobcat Lane is quite steep in grade and could make access difficult under some weather conditions". Mr. Urbina notes that the road does not have dual access/egress and has woody vegetation along both sides of the road, which should be thinned. The applicant will be required to comply with the mitigation standards in Section 3-80.70(C). Wildlife: The property is within mapped elk winter range, and is adjacent to mapped elk winter concentration area, severe winter range and critical habitat, and is also adjacent to mapped bighorn sheep winter range, summer range, and overall range. Kevin Wright of the Division of Wildlife states that the parcel is adjacent to elk and bighorn sheep winter range, but there is little use within the subdivision due to existing disturbance and homes. Wright notes that the riparian habitat along Kline Creek is valuable to a variety of species and that the large ponderosa pine provides valuable perch sites for large raptors/owls. Wright recommends that the residence be set back from the top of the slope to limit bank erosion and to preserve the riparian area, and recommends the following mitigation measures: • Only one dog is permitted on the property, and the dog shall be kenneled. The kennel shall be constructed prior to issuance of a Certificate of Occupancy. • Maintain native vegetation outside the building envelope, particularly the large ponderosa pine along the creek. • The residence shall not extend over the steep embankment down to the creek. • All trash/garbage shall be kept in approved bear proof garbage containers. Michael Villa, Pitkin County's Wildlife Biologist, agrees with Mr. Wright's recommendations. Geologic: The property contains slopes in excess of 30% and is within a mapped alluvial fan, however, the building envelope is located on a flat bench and is not affected by debris flow. Nicholas Lampiris recommends site specific soils investigations, which should include a setback from the top of slope, and positive landscaping to conduct surface water away from the site. Summary: Based on the referral comments, and in order to lessen the potential fire hazard, to limit bank erosion and to preserve the riparian area, staff recommends and the applicant has agreed to set the envelope 10 feet back from the top of slope. To maintain the size of the envelope, this shift will locate the envelope F) N within the required 30 foot front yard setback. Roger Sherman, owner of the adjacent lot E-3, notes that the buildable area is extremely narrow and that he would like the residence to be located as far back on the lot as possible to reduce the impact of the residence on the road and the neighbors. Mr. Sherman's letter is attached as Exhibit C. However, staff supports the encroachment of the building envelope into the setback in order to locate the residence in the safest possible location. A variance from the Board of Adjustment will be required for any structure within the required setback; the well and septic system must both be located within the building envelope, but may encroach into the setback without a variance. CONCEPTUAL SUBNIISSION Water & Sewer: The applicant has drilled a well and proposes to install a septic system. The location of the well is not shown on the site plan. Mary Wood, Environmental Health Officer, notes that the well and the septic system must be located within the building envelope, and that it appears that the well is outside of the envelope. If the well is adjacent to the building envelope, staff recommends amending the envelope to include the well; otherwise, staff will allow the well to be located outside of the envelope. The leach field must be located a minimum of 100 feet from their well and from any neighboring wells, and must also comply with the required setbacks from any surface water or ground water, including Kline Creek. The type and size of the septic system will be determined by site specific soil data and the size of the home and the number of bedrooms. Ms. Wood recommends that an area of undisturbed soil be maintained between the leach field and the top of slope. Parkin : The applicant is required to provide two off-street parking spaces. Mr. Sherman is concerned that two spaces are not adequate since Bobcat Lane is not wide enough to accommodate parking on the side of the road. RECOMMENDATION: Staff recommends that the Hearing Officer approve the Wall 1041 Hazard Review and Conceptual Submission, subject to the following conditions: The applicant shall submit an amended site plan to the Community Development Department for recording, prior to submission of any building permit applications. The site plan shall also be submitted in digital format for integration into the County's GIS system. The site plan shall be modified as follows: A) Amend the signature block for the Pitkin County Hearing Officer. B) The building envelope shall be amended on the site plan to be set back 10 feet from the top of bank and 20 feet from the front property line. The well location shall be shown on the site plan. C) Include the following 1041 hazard waiver on the site plan: "Applicant acknowledges that he/she has been informed by Pitkin County of the existence of 1041 environmental hazard areas that might affect the property, any improvements, and the use and occupancy thereof." D) All conditions of approval shall be noted on the site plan. 2. A variance from the Board of Adjustment will be required for any structure within the required setback. Prior to issuance of a septic permit, the applicants shall provide documentation to the Environmental Health Department as to the location of the well, its compliance with the setback 0 �D requirements, and the quantity/quality of the water. The well must be located within the building envelope, unless the Environmental Health and Community Development Departments approve a location outside of the envelope. 4. A septic permit shall be obtained from the Environmental Health Department, prior to issuance of a building permit. The septic system must be located within the building envelope and must comply with the setback requirements from surface and groundwater sources. A fireplace/woodstove permit shall be approved by the Environmental Health Department prior to issuance of a building permit. 6. The applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A) Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. B) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structure, which includes the trees located on the embankment. However, the ponderosa pines on the embankment shall not be removed. C) Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. D) All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. E) Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. F) All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. G) The density of fuels within a 100 foot perimeter of the structure shall be reduced. H) All deadfall within the 100 foot perimeter shall be removed. I) Low vegetation shall be maintained within a 10 foot perimeter around all structures. J) The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 7. The applicant shall comply with the following additional wildfire mitigation standards: A) The building envelope shall not be located in draws, canyons or on slopes greater than 30%. B) Roof construction shall be Class A, non-combustible material with no flat roofs. C) Vents shall be screened with corrosive resistant wire mesh with mesh'/4 inch maximun. D) Roofs and gutters shall be kept clear of debris. E) Yards shall be kept clear of all litter, slash, and flammable debris. F) All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. G) Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more than 6 inches. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire -resistive construction on the exterior side of the walls. O) Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. P) Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible and installed on a non-combustible post. Q) Utility lines shall be buried.
