This OWTS Construction Permit is pproved on the ' ition com lian with the engineer design as submitted with the application and the specifications
cited above. Changes must be tproved is rtment and th in er prior to construction.
This system will consist of a 200 a n single compartment tank followed by a 2000 gallon FAST secondary treatment tank.
This will then discharge into a split basin which will equally distribute the effluent to each of the 3 field areas. The splitter
basin must be accessible from grade. Each area of the field will consist of 2 trenches connected serially, each with 24 "Quick
4" chambers. The trenches must be separated by at least 6 feet of undisturbed soil. A total of 144 chambers will be used for
a total absorption area of 1422 square feet.
If changes to the grade of the field area are done, a new design reflecting those changes will be required.
This Permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this
Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for
the final inspection with a minimum of 48 hours notice.
Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS
Regulation.
This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in
accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation.
THIS PERMIT IS EXPRESSLY CONDITIONED UPON COMPLIANCE WITH ALL REQUIREMENTS OF THE PITKIN
COUNTY OWTS REGULATION, INCLUDING BUT NOT LIMITED TO THOSE CONDITIONS SPECIFIED ABOVE.
Plans and specifications for the proposed OWTS have been reviewed and are considered satisfactory. Permission is hereby
given to the property owner(s) to perform the work indicated in accordance with the Pitkin County OWTS Regulation. This
Permit will expire 1 year from the date of issuance unless construction on the system has commenced. An "as -built" drawing
must be submitted and alrovedefore final approval of the system will be issued.

Subsurface Investigation and Onsite Wastewater Treatment System Design

ALL SERVICE septic, LLC performed a subsurface investigation and an onsite wastewater treatment
system (OWTS) design for the subject residence. The property is located outside of Woody Creek, in
an area where OWTS and wells are necessary.
SITE CONDITIONS
A single-family residence presently exists and is utilizing a separate OWTS, although will be
demolished. A barn with an attached CDU is being proposed. The CDU will have approximately
1000 square feet (SF). There is an existing drain field that will be abandoned. The proposed drain
field area is relatively flat, and vegetation consists of a moderate cover of grasses. Water is provided
by a spring, (also serving the main residence) which is located to the east of the proposed drain field.
SUBSURFACE
The subsurface was investigated by digging one profile pit and three percolation holes, as indicated. The
materials encountered in the profile pit consisted of 1 -foot of a clayey root zone, underlain by sandy clay
to the maximum depth explored of 8 feet. Groundwater or bedrock was not encountered. Three
percolation holes were dug, in the area of the proposed drain field, as indicated. Percolation rates
ranged from 10 to 20 minutes per inch (MPI). A 15 MPI rate will be used to design the OWTS.
DESIGN SPECIFICATIONS
The OWTS design is based on 8 -bedrooms and an average sewage load of 1600 GPD. The
installation must include a 2000 -gallon, single -compartment, precast concrete septic tank, to be
followed by a 2000 -gallon FASTTM secondary treatment tank. Tank alternatives may be considered.
Six gravelless chamber trenches, using `Quick -4' InfiltratorTM chambers, must be installed as

indicated. Each trench must have 1 row of 24 chambers, for a total of 1422 square feet (SF) of
infiltrative area, and 144 total chambers. A flow splitter basin, brought to grade must be installed to
distribute effluent.
Construction must be according to the Pitkin County Environmental Health and Natural Resources
Department OWTS regulations, the OWTS Construction Permit provided by Pitkin County
Environmental Health and Natural Resources Department, and this design.
OPERATION INFORMATION AND MAINTENANCE
The surface of the drain field should be seeded upon completion. Vegetation is an important factor in
drain field performance. Erosion control should be practiced prior to and during re -vegetation. Geo -
fabrics or plastics should not be used over the drain field. No heavy equipment, machinery, or
materials should be placed on backfilled drain field. Livestock should not graze on the drain field.
Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWTS.
For Example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day and
harm a drain field.
The homeowner should pump the septic tank every two years and clean the effluent filter as needed.
Garbage disposal use should be minimized, and non -biodegradable materials should not be placed
into the OWTS. Grease should not be placed in household drains. Loading from a water softener
should not be discharged into the OWTS. No hazardous wastes should be directed into the OWTS.
Mechanical room drains should not discharge into the OWS. The OWTS is engineered for domestic
waste only.
ADDITIONAL CONSTRUCTION NOTES
If design includes a pump, air release valves and weep holes should be installed to allow pump lines
to drain to minimize risk of freezing. Excavation equipment must not drive in excavation of drain
field due to the potential to compact soil. Extensions should be placed on all septic tank components
to allow access to them from existing grade. Precast concrete tanks and distribution boxes should be
used, unless plastic or fiberglass is required. Access to all tank compartments and distribution devices
is optimal.
INSTALLATION OBSERVATIONS
ALL SERVICE septic, LLC, and the county must view the OWTS during construction. The OWTS
observation should be performed before backfill, after placement of chambers and distribution pipes.
Septic tanks, distribution devices, pumps, dosing siphons, and other plumbing, as applicable, must
also be observed. ALL SERVICE septic, LLC should be notified 48 hours in advance to observe the
installation.

LIMITS:
The design is based on information submitted. If soil conditions encountered are different from
conditions described in report, ALL SERVICE septic, LLC should be notified. All OWS construction
must be according to the county regulations. Requirements not specified in this report must follow
county regulations. The installer should have documented and demonstrated knowledge of the
requirements and regulations of the county in which they are working.

I . Daryl Anderson ("Applicant") has applied to the Community Development Director (hereafter
"Director") for 1041 Hazard Review approval to establish a building envelope with vested rights.
2. The Lot is located at 0080 Buttermilk Road and is specifically described in Exhibit A.
3. The property is zoned AR -10 and contains approximately 4.5 acres.
4. The Applicant submitted a complete application prior to July 6, 2006, therefore, the application is
being considered pursuant to the 1994 Land Use Code, as amended.
5. The Director finds that the wildfire hazard within the envelopes can be mitigated, and that the
request is in compliance with the Code.
THE DIRECTOR DOES HEREBY APPROVE the Anderson 1041 Hazard Review subject to the
following conditions, which shall run with the land and be binding on all successors in interest:
The Applicant shall adhere to all conditions and material representations made in the application
and public meetings except as amended herein.
2. Prior to submission of any future building permit applications, the Applicants shall be required to
submit for approval by the County Attorney and Community Development Site Plan in accordance
with 1 -and Use Code Section 5-70-040, which shall depict the envelopes. The above referenced
approvals shall be a condition precedent to finalization and recordation.
3. Prior to issuance of any building permits for the new residence, the Applicant shall:
A. Complete a fireplace/woodstove registration form with the Community Development
Department, if necessary.
B. Submit a drainage and erosion control plan for review and approval by the County
Engineer.
C. Submit a construction management plan for review and approval by the County Engineer
showing the locations of staging, material storage and employee and construction traffic
parking.
D. Pay the applicable road and housing impact fees.
E. Provide proof that the existing residence has been removed/demolished.
F. Provide a letter of compliance from the Buttermilk Metro District regarding water service
to the parcel.
4. The Applicant shall comply with the following to mitigate impacts on wildlife:
A. Dogs shall be leashed or kenneled.

B. Fencing outside of the building envelope shall comply with the wildlife fencing
standards in the Land Use Code.
C. Instal I and use an approved bear -proof trash container as required by the County.
D. Maintain native vegetation outside of the building envelope.
E. Avoid fruit -bearing trees and shrubs in any landscaping.
The Applicant shall comply with the following landscaping and wildfire defensible space mitigation
standards as can be accomplished within the boundaries of the property:
A. From the edge of any structure, or deck projection, for a distance of 15', vegetation shall be
less than 6" in height, with the exception of if the Applicant desires to maintain or plant one
or more ornamental trees, in which case vegetation shall be less than 6" for 15' beyond the
drip line of the expected mature size of the trees.
B. Beyond the 15' area, and up to 45' from the edge of any structures down the slope, and 35'
cross slope and up slope maintain grasses to less than 6", and thin and cluster brush and
trees. Lower limbs of trees and bushes shall be pruned to %z the height of the trees, or 10%
whichever is less. Clusters of trees and bushes or shrubs shall be separated from each
other, and from those beyond the perimeter by a distance of 2'/z times the height of the
mature vegetation. The diameter of clusters at their crown shall not exceed 2 '/i times the
height of the mature vegetation.
C. All thinned snowberry, serviceberry or chokecherry stumps must be painted with Garlon,
(or equivalent) herbicide to prevent aggressive re -sprouting.
D. All branches which extend over the roof eaves shall be trimmed and all branches within 15
feet of the chimneys shall be removed.
E. All deadfall within the 60 -foot perimeter shall be removed.
F. The Applicant shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
6. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roofs shall be constructed with a Class A roof covering on a Class A assembly as defined
in the International Building Code (TBC) Section 1505.2. Wood shake/shingle roof
coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they
comply with the following:
I . All roof coverings shall be noncombustible materials and installed on a
Class A roof assembly.
2. All roof coverings shall have a surface that shall facilitate the natural
process of clearing the roof.
3. All roof designs shall facilitate the natural process of clearing roof debris.
Protrusions above the roofline, such as parapets, shall be prohibited.
4. Roofs shall be installed as required by the adopted building code and shall
have a minimum slope of 1:48.
5. All roof designs, coverings or equivalent assemblies shall be specifically
approved by the Fire Marshall prior to submittal of a building permit
application.

1. Projections at the roofline (which includes, but are not limited to: eaves,
cornices, soffits and roofs over open decks) shall be sheathed with
materials approved for one-hour fire -resistive construction;
2. For projections below the roofline (including, but not limited to: exterior
balconies, decks, porches, and bay windows which extend over a flat or
sloped surface), the open space between grade and the underside of
projections below the roofline shall be enclosed by solid, vertical walls.
These walls shall be constructed with materials approved for one-hour
fire -resistive construction on the exterior side of the wall, and shall
extend from the top of grade to the underside of the floor decking or
walls of the projection, AND:
3. Any porch or deck or projection shall be void of vegetation below it, and
areas below such projections shall be protected from accumulation of
vegetation materials by placement of a vegetation barrier covered with
rocks or gravel, or by coverage with concrete or stone. Walls underneath
projections shall be constructed with materials approved for 1 hour
fireresistive construction on the exterior side of the wall.
C. Any windows shall be tempered glass. Doors on this side (if any) shall be non-

G. Vents shall be screened with corrosive resistant wire mesh with mesh 1/4 inch maximum.
H. Firewood/wood piles shall be stacked on a parallel contour a minimum of 15 feet away
from the structure.

J. Wood fences shall not connect to the structure.
K. Any outbuildings or additional structures shall adhere to the same standards as structures.
L. Fuel tanks shall be installed underground with an approved container.

from the structure with standard defensible space vegetation mitigation around any above-
ground tank. Any wood enclosure around the tank shall be constructed with materials
approved for 2 hour fire -resistive construction on the exterior side of the walls.
N. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher
placed in a visible and accessible location.
0. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible
and installed on a non-combustible post.
P. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away
from any structure.
Q. Swimming pools shall be accessible to Fire Department vehicles.
R. Any fire department recommendation for individual structure water supply and storage
shall be accessible to fire department vehicles from the exterior of the structure through a

Fire Department approved mechanism (such as a fire hydrant). The amount of storage
capacity shall be determined by the fire protection district.
S. New utility lines shall be buried.
T. Roofs and gutters shall be kept clear of debris.
7. No development, including grading, excavation, fill placement, berming, landscaping, entry or
ranch gates, and vegetation removal or disturbance shall occur outside of the approved building
[and/or] access envelope except for wildfire mitigation. Construction, staging, parking, utility
and driveway extension and maintenance shall occur within approved building envelope, or
access envelope.
S. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the
corners of the building envelope and install construction fencing around the perimeter of the
building envelope. The fencing shall remain in place until issuance of Certificate of Occupancy.
No vegetation shall be damaged or removed outside the building envelope.
9. Any areas disturbed outside the building envelope must be revegetated with native vegetation
according to a revegetation plan submitted by the Applicant and approved by the County prior to
issuance of a Certificate of Occupancy,
10. The exterior of the residence shall be finished in the natural earth tones of the immediate
vicinity, as represented in the application. Roof and siding materials shall be non -reflective.
Color and material samples shall be provided to Community Development for approval prior to
issuance of building permits.
H. At time of building permit submittal a landscape plan shall be submitted and approved by
Community Development prior to issuance of a building permit. A specific visual mitigation
plan for the southern retaining wall for the main residence and the retaining associated with the
access shall be submitted as part of the landscape plan. Included in the plan shall be retaining
wall design and coloration, as well as methods for minimizing the visual impacts.
12. The Applicant shall comply with the requirements of the Aspen Fire Protection District
13. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land

Re: West Buttermilk LLC Special Review for a Caretaker Dwelling Unit
and Site Plan Review

SUMMARY" OF RELEVANT PARTS OF APPLICATION: The applicant is seeking
approval of a detached CDU with GMQS Exemption and Vested Rights and Site
Plan Review.
DISCUSSION: A site visit was conducted on September 4, 2007 by Nancy
MacKenzie and Michael Kraemer from the Community Development Department.
Glenn Horn was on site representing the owner.
The Pitkin County Environmental Health & Natural Resources Department has
reviewed the details of the West Buttermilk LLC application under the authority of
the Pitkin County Land Use Code and the Pitkin County ISDS Regulation and
has the following comments.
ADEQUATE PROVISION FOR WATER NEEDS: 1-60-310:
Identification of a property's water supply is necessary for siting of an onsite
wastewater treatment system ("OWTS") due to setback requirements. The
application indicates that this parcel is served by the Buttermilk Metro water
system, which is typical in this area. The Metro District is responsible for
determining if the District has enough water to serve the project. Administrative
Decision No. 09-2007of the Community Development Director of Pitkin County
requires a letter of compliance from the Buttermilk Metro District regarding water
service to this parcel prior to issuance of any building permits. This Department
has the same requirement prior to issuance of an OWTS permit.
SEWAGE TREATMENT: 1-60-320:
There is an existing OWTS installed in October 2003 under this Department's
Permit #03061 which was sized for 4 bedrooms. It serves the current residence,
which is proposed to be demolished and replaced with a 1,000 sf CDU. The
OWTS has one 2,000 gallon septic tank and gravity feed to a gravelless chamber
bed with six rows of fourteen chambers for a total of 1,302 sf of area. During the
site visit the location of the bed was obvious but not the tank, since no lids to the
septic tank were visible.
Due to the recent installation of this system, it would be possible to reuse this
system for a new caretaker dwelling unit of <2,000 sf and no more than 4
bedrooms under the following conditions:
A new OWTS permit must be obtained for this system to serve the new
CDU. To secure that new permit:
1. The tank must be located and pumped.
2. All components of the system must be inspected by an engineer
knowledgeable in septic system design to insure the integrity of the
components of the system and that the system is functioning as designed.
This shall include exposing the distribution box and the inlet ends of the
pipes. Observation pipes were not visible during the site visit and these
must be located or re -installed. The system must meet all setback
distances as required in the Pitkin County OWTS regulations.
The development intent for this parcel is to construct up to a 14,000 sf house, in
addition to the 1,000 sf CDU. No visible constraints on this parcel for locating a
new OWTS were observed during the site visit. There were no observed irrigated
areas, irrigation ditches, rivers, streams, ponds, gulches, wetlands or riparian
habitat. However, the driveway, slopes, CDU and the area taken up by a 14,000
sf main house will limit a suitable area for siting the soil absorption component of
the OWTS for the main house.' This Department strongly recommends that the
applicant prepare the OWTS design for the main house in consort with siting of
the CDU and the OWTS for the CDU.
For example, previous soil data for this parcel indicated a 40 mpi percolation rate for the soil.
A six bedroom 14,000 sf house will require an area 48 ft X 100 ft for the absorption area. This
size assumes six 3 -ft wide trenches, 6 ft apart and a 50% reduction allowed for use of a
gravelless chamber system.
