Snowmass Longmont LP ("Applicant") has applied to the Community Development Director of Pitkin County ("Director's to establish an Activity Envelope for future development of a single-family residence. 2. The parcel contains 0.55 acres and is a non -conforming size parcel in the AR -10 zone district. 3. The parcel is located at 104 North Little Texas Lane and is more specifically described as Lot 2, Little Texas Subdivision. 4. The Lot contains a 708 square foot cabin built in 1950. The applicant is proposing to demolish the cabin which has been condemned due to a fire. 5. In 1993 the BOCC granted a 1041 Hazard Review and General Submission approval pursuant to BOCC Resolution No. 93-165. In 2004 a 1041 Hazard Review and Conceptual Submission was approved pursuant to Administrative Decision No. 75-2004. The 1041 Hazard Review Site Plan was never recorded. The 2004 approval has lapsed, pursuant to Sec. 2-20-160(d) of the Land Use Code ("Code"). 6. The Director finds that the proposed activity envelope is consistent with the applicable requirements of the Code, as follows: A. The parcel is a non -conforming size parcel in the AR -10 zone district. Pursuant to Sec. 9-20-10 one single family dwelling unit is permitted on the substandard size parcel. B. The activity envelope primarily contains slopes of less than 30%. Areas with slopes in excess of 301/o and 45% qualify as minor slope anomalies pursuant to Sec. 7-20-20(cx3) of the Code and were likely created in the construction of the driveway and cabin. C. A Slope Evaluation prepared by Golder Associates Inc. dated January 12, 2018 assessed the lot and provides recommendations for future development. Historical drainage patterns can be maintained as confirmed by SGM in an Engineering Report dated January 3, 2018. A drainage and erosion control plan will be required with the building permit. D. The Activity Envelope is beyond 100' from the Roaring Fork River high water line. E. No development will occur within the Roaring Fork River floodplain. F. The wildfire hazard is rated as low and can be mitigated. G. The lot is not within any mapped wildlife habitat areas. H. The Applicant proposes to locate the on-site wastewater treatment system ("OWTS") on the northeastern side of the Activity Envelope away from the Roaring Fork River. At Site Plan Review the Environmental Health Department will further review the specific OWTS location and design. 1. The lot is located within the mapped Scenic View Protection Area (SVPA) as viewed from Upper River Road. Any proposed development will be reviewed pursuant to the SVPA standards at Site Plan Review. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. The conditions of this Administrative Decision shall replace the conditions of Resolution No. No. 93- 165 and Administrative Decision No. 75-2004. 3. Prior to submission of a Site Plan Review application, the Applicant shall be required to submit to Community Development for recordation the Activity Envelope Plan. These approvals shall be a condition precedent to finalization and recordation. The Activity Envelope Plan shall be amended as follows, prior to recordation: A. Depict the effective floodplain boundary and the 2015 proposed floodplain boundary. 4. Prior to submission of any building permit applications, the Applicant shall be required to submit for approval an application for Site Plan Review, pursuant to Secs. 2-30-20 and 7-10-50 of the Code. With the Site Plan Application, the Applicant shall demonstrate compliance with recommendations provided in the Slope Evaluation prepared by Golder Associates Inc. dated January 12, 2018. 5. Prior to, or with a building permit application for the new residence, the Applicant shall obtain a demolition permit to remove the condemned cabin. 6. With a building permit application for the new residence, the Applicant shall: A. Submit a copy of this recorded Administrative Decision and the recorded Activity Envelope and Site Plan. B. Obtain an address number from Pitkin County Addressing C. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable. D. Submit a Site Specific Geotechnical Study with findings and recommendations. E. Submit a drainage and erosion control plan and accompanying drainage report demonstrating that historical flow patterns and runoff amounts will be maintained. Flows shall not be concentrated onto steep slopes. F. Submit an Access Permit Application for any proposed improvements to the driveway. The application shall include the following: 1) Compliance with the current Road Maintenance and Management Plan. 2) Engineering of all culvert crossings. 3) Approval of the Aspen Fire Protection District. 4) Provide details on all tum arounds and parking locations. G. Submit a detailed landscape and revegetation plan for disturbed areas with appropriate native vegetation and seed mixes. H. Submit a tree removal and mitigation plan if any trees with larger than 6" DBH are to be removed. I. Submit a detailed exterior lighting plan with the corresponding fixture cut sheets. Exterior lighting shall comply with the lighting code. J. Submit representation of the exterior indigenous earth tone materials or colors. K. Submit a driveway/access permit application, which shall be approved by the Planning Engineer and the Aspen Fire Protection District. L. Obtain an On -Site Wastewater Treatment System ("OWTS") Construction Permit from Environmental Health to construct an OWTS. The system shall be located within the Activity Envelope, and must comply with the setback requirements from surface and groundwater sources. A qualified professional engineer must design the system. Administrative Decision No.LIL-2018 Page 3 M. Submit a fireplace/woodstove permit application, if applicable. Prior to building permit issuance, the Applicant shall pay the applicable road and employee housing impact fees. 8. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the perimeter of the envelope. The fencing shall remain in place until a Certificate of Occupancy is issued for the residence. 9. No development, including well, OWTS, grading, excavation, fill placement, berming, landscaping, entry or ranch gates, construction parking and staging, and vegetation removal or disturbance, shall occur outside of the approved activity envelope, except to comply with the required wildfire mitigation or an approved weed management plan. Any new utility lines shall be buried and placed within the approved activity envelope. 10. The Site Plan, including but not limited to access, adequate area for turning around of fire equipment, installation of an approved fie sprinkler system (if so required by the Fire Marshall) and provision of an adequate water supply for firefighting shall be approved by the Aspen Fire Protection District. Fire equipment access and turn around requirements may be varied due to the limited lot size and road widths. 11. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) Brush, debris, and non-omamental vegetation shall be removed within a minimum 10 -foot perimeter around the structure. 2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels for a minimum of a 30 -foot perimeter around the structure. 3) Spacing between clumps of brush and vegetation within the 30 -foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. 4) All branches from trees and brush within the 30 -foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. 5) Tree crown separation within the 30 -foot perimeters shall have a minimum of 10 feet between the edges of the crowns. 6) All branches that extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. 7) The density of fuels within a 100 -foot perimeter of the structures shall be reduced. 8) All deadfall up to a 100 -foot perimeter shall be removed. 9) No new conifer trees shall be planted within 10 feet of a residence. 10) No flammable mulches shall be placed within two feet of a residence. 11) The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. Administrative Decision NoALL-2018 Page 4 B. Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing debris. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Additional wildfire mitigation standards: 1) Vents shall be screened with corrosive resistant wire mesh with mesh 'A inch maximum. 2) Roofs and gutters shall be kept clear of debris. 3) Yards shall be kept clear of all litter, slash, and flammable debris. 4) All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 15 feet away from any structure. 5) Non -saltwater swimming pools or ponds shall be accessible to Fire Department vehicles. 6) Fences shall be kept clear of brush and debris. 7) Wood fences shall not connect to the structure. 8) Fuel tanks shall be installed underground with an approved container. 9) Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above- ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 -how fire -resistive construction on the exterior side of the walls. 10) Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. 11) Addresses shall be clearly marked with 4 -inch non-combustible letters and shall be visible and installed on a non-combustible post. 12) New utility lines shall be buried within the activity envelope. 12. The Applicant shall comply with the County's Noxious Weed Management Plan. 13. All plants used for landscaping and revegetation shall be native species. Areas disturbed by construction shall be re -vegetated within one growing season of the project's completion. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the residence. 14. The Applicant shall comply with the following conditions to mitigate impacts on wildlife: A. Native vegetation shall be maintained outside of the activity envelope. B. Contractors shall be prohibited from bringing their dogs on-site. C. Landscaping shall not include nut, berry or fruit producing trees or shrubs to minimize an attractant to bears. D. Trash/garbage shall be kept in an approved bear resistant container or enclosure as required by the County's Wildlife Protection Ordinance. Administrative Decision No.L-2018 Page 5 E. All outside doors shall utilize only solid round handled doorknobs unless another type is required by the applicable building code for disabled accessibility purposes. F. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. G. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1. Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2. Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3. Mesh or woven wire fences are prohibited, except when used for protection around isolated trees or clumps of trees. 15. No development in excess of 30" above or below natural grade shall occur within the setbacks of the parcel, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms within the setbacks shall not exceed four feet from the most restrictive grade. Any development that does not comply with these restrictions and that is located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 16. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. 17. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 18. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code § 2-20-170 and C.R.S. § 24-68-105. You are correct that the encasement of the waterline where it encroaches on the minimum setback is allowable by code. As long as the system is compliant with all of the setbacks outlined in the regulations, I believe you are fine. If you cannot meet the setback requirements (i.e. 100' to the river) then we have an issue that will take further discussion. Regulation states that you cannot expand the use of a non-compliant system. My other concern is access to the site for the installation of the system. My understanding is that you will have to cross several properties with large vehicles to install the system. I would want letters from the property owners stating you have access to install and if necessary, access for maintenance. Because our clients have some pending contract deadlines for purchase of the property and would like a good understanding of what will be possible for developing the site, we wanted to share our fall back plan in the event we are not allowed to place the OWTS on the lower bench. See attached for a rough sketch (rami has seen this as well). We would need to develop this further, but it shows a potential location for the OWTS with no new well on site. If we cannot locate the OWTS down below, our client would need to use the neighbor's well and we could place the OWTS in the approximate location of the existing cabin. I'd probably look at reconfiguring as a bed to reduce the overall footprint. We may also look at moving the driveway to the eastern property line and sharing driveway space with Lot R (to the east) which would open up a little more available space. Although not shown on this sketch, the 100' setback from the well on the western property does not reach the Lot 2 property line. There are two challenges to overcome that would need engineered solutions: 1. We would probably need to place at least a portion of the soil treatment area where the existing cabin is. I assume we'd need to excavate down to undisturbed soil and fill back up with sand. On the plus side, I doubt that cabin has a very extensive deep foundation. 2. We would be bringing the water line along the road from the property to the west and would have difficulty maintaining the required 25' setback to the STA. Per footnote 2 in Table 6.28-1, we'd have to encase the water line in a PVC pipe/sleeve where that 25' setback couldn't be achieved. Please let us know if you see any fatal flaws to this approach. Our clients still prefer the submitted plan with a new well on the middle bench and the OWTS down below, but we wanted to make sure that Plan B would be generally acceptable before too many contract deadlines pass. They lose their earnest money at the end of this week, so any feedback you can provide today/tomorrow would be greatly appreciated. Property Owners within 300 Feet I. EXISTING CONDITIONS Attachment 3 and 4, the Survey and Existing Conditions Map, depict the topography, utilities, buildings, roads and driveway. The lot is bordered by the Roaring Fork River to the south, the Melberg single-family dwelling to the west, River Road to the north and a vacant lot to the east. The subject site is zoned AFR-10. The AFR-10 zone permits a house containing up to 15,000 square feet of floor area as a use by right. Houses in Little Texas typically contain between 3,000 and 4,500 square feet of floor area because of the limited lot sizes. Attachments 3 and 4 show there are four different sections of the lot. Approximately 5,000 square feet of land is located adjacent to the Roaring Fork River on ground with slopes of less than 15 percent. Just to the northeast of the river front land is a bank with slopes varying between 30 and 50 percent. The top of the bank is characterized by slopes between 30 and 45 percent. The lower part of the bank is steeper. The area above the top of the slope is relatively flat. There is an existing old cabin located within the flat area above the slope. To the north of the flat area are slopes in excess of 30 percent. Attachment 5 is a copy of the Melberg -Pate 1041 Site Plan which is recorded at Plat Book 24, Page 75. Tom and Lindy Melberg acquired their property from Pate. The topography of the Melberg property is quite similar to the subject site. Attachment 3 shows the building envelope on the Melberg property is located in the relatively flat portion of the site. However, the Melberg building envelope extends approximately 18 feet below the top of the bank. The extension of the Melberg building envelope below the top of the bank allowed for the house on the site to be developed with a lower level which daylights below the top of the bank. The house steps slightly down the hill which reduces the bulk of the house as viewed from across the Roaring Fork River. 4 II. BACKGROUND The Pitkin County Assessor's records indicate that the existing cabin on the subject property was built in 1950. Development of the cabin pre -dates the County Building Department records. The Applicant is seeking to demolish the existing cabin and replace it with a new single family dwelling unit. The .55 +/- acre lot is a legally created non -conforming lot located in the AR -10 zone district. The house is a legally created structure in the zone given the date of construction, 1950. The house was condemned after a fire. The Pitkin County Board of County Commissioners (BOCC) approved Resolution 93-165 on September 28, 1993 (see Attachment 6). The Resolution granted the applicant 1041 Environmental Hazard Review and General Submission approval to the Sturm property. Attachment 7 is a copy of the 1990 Lot 2 Existing Conditions Map, Little Texas Subdivision with a note prepared by Pitkin County Planner, Tim Malloy. Tim's note which is dated 9/28, the date of the BOCC hearing, reads "slopes in excess of 30 percent to be removed from building envelope prior to recordation." The primary land use issue in the 1993 land use review was the applicant's request for the building envelope to extend over the top of the bank on slopes in excess of 30 percent. As depicted on Attachment 5, in 1993, the applicant requested approval to extend the building envelope approximately 21 feet below an overhead utility line. The request to extend the building envelope on slopes in excess of 30 percent was denied by the BOCC as reflected by condition # 1 in Resolution 93-165 (see Attachment 6). In 2004 the Community Development Director approved Administrative Decision No. 75-2004 which granted approval for the Sturm 1041 Hazard Review and Conceptual Subdivision (Attachment 8). Attachment 9 is a copy of the 2004 Sturm 1041 Hazard Review Site Plan which was never recorded. The building envelope on Attachment 9 was slightly modified in the land use review process by Condition 1 which reads as follows. 1. Prior to submission of any earthmoving, access or building permit applications, the Applicant shall submit a 1041 Hazard Review Site Plan to the Community Development Department for approval and recording. The mylar copy of the site plan must be signed by the owners prior to submittal for recording. Prior to recordation, the site plan shall be amended as follows: A. Eliminate the portion of the building envelope that encroaches onto slopes in excess of 45 % in the southwest corner of the envelope. B. Delineate the lines beyond which the southwest wall of the house and deck on the subject parcel will not extend, based upon the site of the adjacent Melberg house. The 2004 land use approval lapsed on September 29, 2007 and the Applicant is seeking a new land use approval. III. PROJECT DESCRIPTION Attachment 10 is the proposed Activity Envelope Plan. The Applicant is requesting Activity Envelope review approvals to establish an Activity Envelope which encompasses a driveway, water well, landscaping, house and patios on the upper bench of the property. The envelope also encompasses a proposed utility line which links the upper bench to the lower bench. Matt Webster of SGM addresses vehicular access, proposed location of the water well, Onsite Waste Water Treatment System (OWTS) and utility corridor in his May 21, 2017 letter (Attachment 11). The OWTS is proposed to be located on the lower bench at a minimum of 50 feet from the Roaring Fork River mean identifiable high water mark. There is precedent for locating an OWTS on the lower bench to meet water well to OWTS setback standards. Pitkin County has approved the placement of a utility corridor traversing a steep slope when there is not another viable option (see Woody Creek Subdivision/PUD effluent line). The Applicant will be seeking Site Plan Review approval in the future. Any structure will be setback at least 5' from the west (rear) and east (front) yards. The Applicant will pursue rear and front yard setback variances following the Site Plan review approval process. Landscaping will be developed in the setbacks which is why the Activity Envelope extends to the west and east property lines. The proposed house will be carefully sited during Site Plan Review to respect and preserve Tom and Lindy Melberg's upstream and upvalley views. IV. LAND USE CODE REVIEW This section of the application demonstrates compliance with the following Land Use Code standards identified by the Community Development Department in the Pre -Application Conference Summary in Attachment 2. Land Use Standards appear in bold followed by the Applicant's responses to the standards. ■ Section 2-30-20(g) Activity Envelope and Site Plan Criteria for Approval ■ Section 7-10-50 and 60 Activity Envelope and Site Plan ■ Section 7-20-10 Site Preparation and Grading; ■ Section 7-20-20 Steep and Potentially Unstable Slopes ■ Section 7-20-30 Water Courses and Drainage ■ Section 7-20-40 Floodplain Hazards ■ Section 7-20-60 Wildfire Hazards — mapped low wildfire hazard area ■ Section 7-20-70 Wildlife Hazards — elk highway crossing on southern portion of parcel ■ Section 7-20-80 River and Stream Corridors and Wetlands and ■ Section 7-20-130 Landscaping and Vegetation Protection ■ Section 2-20-170 (d) Vested Property Rights rd Activity Envelope and Site Plan Criteria for Approval Section 2-30-20(g) (g) Criteria for Approval (1) General In addition to the criteria in subsections (2) through (20) below, an application for administrative review shall be approved if it complies with (a) all applicable provisions of this Land Use Code, (b) all applicable Land Use Policies listed in Sec. 1-60, and (c) all prior development approvals applicable to the subject property. The Applicant will address the specific applicable sections of the Code identified by the Community Development Department in the Pre -Application Conference Summary Sheet in Attachment 2. The Applicant will comply with the applicable provisions of the Land Use Code (LUC) and Land Use Policies and all prior approvals that are applicable. Activity Envelope Section 7-10-50 & 60 (a) The intent of this Chapter 7 is to allow activities and development to take place where they comply with the provisions of this Land Use Code and with the Pitkin County Comprehensive Plan for the area. Compliance will generally involve avoidance of "Constrained Areas" through the identification of an "Activity Envelope," as well as approval of a Site Plan. For purposes of Chapter 7, "Constrained Areas" include all areas included in each of the following categories, as defined and regulated by this Land Use Code: (i) Areas of Statewide Interest listed in C.R.S. 24-65.1-101 et. seq.), (ii) steep and potentially unstable slopes, (iii) water courses, drainage channels, and areas subject to erosion, (iv) floodplain hazard areas, (v) geological hazard areas, (vi) severe or low to moderate wildfire hazard areas, (vii) wildlife habitat areas, (viii) river and stream corridors and wetlands (ix) irrigated lands for food or crop production, (x) historic preservation areas, and (xi) archeological resource areas. (b) The Site Plan process incorporates an "Activity Envelope" approach in which the County staff works with the applicant to determine which portions of the site (if any) would permit the proposed activity or development to be conducted in compliance with this Land Use Code and in conformity with the Comprehensive Plan for the area. In general, this process will involve both a determination of (i) which portions of the site are not available for development because of the existence of Constrained Areas, and (ii) of the remaining portions of the site, which areas would accommodate the activity or development so as to minimize impacts on surrounding properties, maximize compliance with the requirements of the development standards in this Chapter 7, and maximize compliance with the Comprehensive Plan goals and objectives. (c) In general, the defined Activity Envelope for development of primary uses shall be large enough to accommodate the proposed principal use of the property and traditional permitted accessory structures, infrastructure (roads and septic systems), and uses, but should not be significantly larger than the area needed for such structures. In the case of a site with few Constrained Areas, the defined Activity Envelope may include more than one potential building site for a new single family home. The defined Activity Envelope may include non-contiguous areas (including separate areas for septic fields, landscaping, driveways to public roads, mitigation measures required in connection with any provision of this Chapter 7, and/or areas to be disturbed only during construction on the property — including staging areas and materials storage areas). Construction of trails will not require an Activity Envelope analysis except as required by Sec. 7-20-50. (d) Clearing, grading, grubbing, earthmoving that exceeds fifty (50) cubic yards, or changes in the natural drainage of the site shall occur only after an Activity Envelope has been defined and all applicable local, state and federal permits have been obtained. In addition, Site Plan Approval is required if these activities will occur on a property within a Scenic View Protection Area. (e) Activity Envelope and Site Plan Review for a Stream Restoration Project shall adhere to all development standards in 7-20-40 and 7-20-80 and shall be reviewed by the BOCC as set forth in Table 2-1. (f) Once an Activity Envelope has been defined, the natural grade, topography, vegetation and drainage of areas outside the defined areas shall not be disturbed except as specifically permitted in this Land Use Code. Prior to any development activity on the parcel, the boundaries of the Activity Envelope shall be identified with construction fencing, and such fencing shall remain in place until development has been completed. (g) While it is preferable to obtain approval of an Activity Envelope as part of the Site Plan approval process, applicants who are not prepared to submit a Site Plan for a specific structure may request approval of an Activity Envelope separately. Prior to the issuance of a Development Permit, the applicant shall be required to apply for and obtain approval of a Site Plan confirming that the proposed development is consistent with the defined Activity Envelope and with other standards in this Land Use Code not considered at the time the Activity Envelope was defined. (h) The standards in this Chapter 7 shall be used (i) to identify the Activity Envelope on a property, (ii) to review and approve the Site Plan for proposed development, and (iii) to regulate development within the Activity Envelope pursuant to the Site Plan. Development Standards in this Chapter 7 which are to be reviewed as part of Activity Envelope and Site Plan review are set forth in Table7.1. Attachment 10 is the proposed 2017 Lot 2 Little Texas Activity Envelope Plan. All the above requirements were considered when developing the Activity Envelope Plan and the proposal complies with these requirements. The Applicant has evaluated the applicable constraints listed above and has addressed them when necessary or applicable. The natural grade, topography, vegetation and drainage of areas outside the Activity Envelopes will not be disturbed except as specifically permitted in the Land Use Code. Attachment 10 depicts the location of the proposed OWTS which will be located a minimum of 50' from the mean identifiable high water mark of the River. Prior to any development activity on the property, the boundaries of the Activity 0 Envelope will be identified with construction fencing and the fencing will remain in place until development is complete. The applicant will comply with the requirements of this section of the Code. Site Preparation and Grading Section 7-20-10 (a) Grading and Fill Placement Grading and filling on a site shall take place only within a defined Activity Envelope. All grading and fill placement that exceeds fifty (50) cubic yards shall be indicated on the Site Plan. All grading and filling on the site will take place only within the designated Activity Envelope. Any grading and fill exceeding 50 cubic yards will be indicated on the Site Plan submitted with the Access and Earthmoving permit. The Applicant is not proposing to change the grades of the lot. A detailed grading plan will be submitted with the Earthmoving Permit and Access permit application. (b) Clearing, Grubbing, and Vegetation Removal Clearing or grubbing of land, or removal of vegetation shall take place only within an approved Activity Envelope, except removal of noxious weeds and 10 or fewer dead or diseased trees of a caliper of 6" d.b.h. or greater within a 12 month time period that create a hazard may occur outside of an Activity Envelope. Disposal of dead or diseased trees shall be in accordance with the Land Management Department's policy. Trees removed that contain active mountain pine beetles shall not be stored for firewood. Each Site Plan shall document compliance with the requirements of this Sec. 7-20-10(b) and Sec. 7-20-130. Clearing or grubbing of land or removal of vegetation will all take place within the approved Activity Envelope, except as provided for weeds and dead or diseased trees as specified. The Applicant will comply with all these requirements. (c) Tree Removal and Mitigation Each tree with six (6) inches or larger diameter at breast height (D.B.H.) that is removed within the Activity Envelope shall be replaced with one (1) or more trees with total D.B.H. at least equal to the caliper(s) of the tree(s) removed, to the maximum extent practicable. Any tree that (i) is diseased, or (ii) is required to be removed pursuant to the provisions of Sec. 7-20-60, as those requirements may be varied by a wildfire expert approved by the County, may be removed and no replacement shall be required. All revegetation shall also comply with the Pitkin County Revegetation Guidelines. Required replacement trees that do not survive for at least one (1) year after installation shall be replaced at the owner's expense, and the County may require financial security for such replacement pursuant to Sec. 7-20-130(b)(7). 7 The proposed development will comply with all the above requirements regarding the removal or replacement of trees and re -vegetation. (d) Protection of Natural Terrain The County Planning Engineer or Community Development Director shall suggest and may require design and construction techniques that lessen or mitigate any physical and visual damage caused by the proposed activity or development to Constrained Areas or to the natural terrain, stream vegetation, and other natural features of the landscape within the Activity Envelope. Techniques shall include, but are not limited to: (1) Revegetation Revegetation and reforestation utilizing native or similar horticultural material, to be completed during the first planting season after construction; where vegetation is removed, it shall be replaced with vegetation that will reach similar density and height to that removed within two (2) years following conclusion of construction. (2) Topsoil Removing and saving topsoil prior to any grading or excavating and replacement for revegetation. (3) Weed Prevention Weed prevention, thistle management, and prohibition of non-native plants, which may include reducing animal damage to vegetation cover, as determined by the United States Soil Conservation Service Soil Survey. (4) Utility Installation Locating and installing utilities in a manner minimizing damage to the natural environment and scenic quality. (5) Erosion, Sedimentation, and Stormwater Management (a) Land uses shall: (1) Not cause erosion problems and, if practicable, retain all soil on site; (2) Minimize disturbance of natural vegetation and soil cover; (3) Ensure that all cuts and fills are adequately designed and vegetated to control erosion as well as stability of the slope area; (4) Ensure that natural drainage patterns are preserved and protected from increased water flows that subject existing channels and adjacent areas to increased erosion; and (5) Preserve natural vegetation and soil cover within those buffer distances adjacent to rivers, streams, lakes, reservoirs and wetlands/riparian areas established in Sec. 7-20-80. (b) Mitigation measures identified in an approved erosion, sedimentation, or stormwater management plan shall remain in place until revegetation is viable. Site development will comply with all the above requirements for site preparation and grading including re -vegetation, topsoil, utility installation, weed prevention, erosion, sedimentation and/or storm water management and the disturbance of natural vegetation. Steep and Potentially Unstable Slopes Section 7-20-20 The following provisions shall apply whenever steep slopes or potentially unstable slopes occur within the Activity Envelope, but do not apply when the Activity Envelope have been defined to avoid such areas. (a) Slope Delineation Slopes shall be delineated within the Activity Envelope with two (2) foot contour intervals. Slopes between each two (2) foot contour in each of the following categories shall be designated by a distinct graphic pattern. (1) Slopes that are fifteen (15) percent or greater, but less than thirty (30) percent; (2) Slopes that are thirty (30) percent or greater, but less than forty-five (45) percent; (3) Slopes that are forty-five (45) percent or greater. (b) Forty-five (45) Percent or Greater Gradient Attachment 4, the Little Texas Lot 2 Existing Conditions Map depicts slopes in the designated categories. The proposed utility line will traverse steep slopes from the upper bench to the proposed OWTS on the lower bench. Pitkin County approved the development of the Woody Creek Subdivision PUD's effluent line which crossed steep slopes above the Roaring Fork River. Attachment 12 is a Geological Evaluation of Site for Single Family Residence, Lot 2, Little Texas Subdivision, Pitkin County Colorado prepared by J. Dan Powell, PhD., Registered Professional Geologist. Dan Powell concludes in his letter that the lot is well suited for almost 9 any kind of construction. He recommends standard foundation design and avoiding adding excess water proximate to the top of the slope. Water Courses and Drainage Section 7-20-30 (a) Applicability The water resources standards in this Sec. 7-20-30 are applicable to all development. (b) Encroachment or Channeling Encroachment or channeling activities in a river, stream (including intermittent streams), pond, wet meadow, or wetland are also subject to the requirements of Secs. 7-20-40 and 7-20-80 of this Land Use Code, as well as all other applicable state and federal statutes and regulations (including, but not limited to the U.S. Army Corps of Engineers permitting requirements of Section 404 of the Federal Clean Water Act). The Applicant will not encroach upon or channel any rivers, streams or ponds. (c) Drainage (1) General Activities and development shall provide for: (a) Maintenance of historical flow patterns and runoff amounts to reasonably preserve the natural character of an area and prevent property damage attributable to runoff rate and velocity increases, diversions, unplanned ponding and/or storm water runoff; (b) The unimpeded flow of natural water courses and ditches; (c) Adequate drainage for all low points; (d) A drainage system designed to account for an entire drainage basin capable of accommodating runoff from a proposed development and, where applicable, the runoff from areas adjacent and upstream; (e) Maintenance of drainage systems; and (f) On-site treatment of stormwater by use of best management practices designed to detain and allow infiltration of runoff prior to discharge to any water body. (2) Runoff Volumes Runoff volumes and peaks within a development site and in areas affected by runoff from a development site shall not exceed the runoff levels attributable to the undeveloped site as determined by a professional engineer licensed in the State of Colorado. 10 Drainage to the adjacent Roaring Fork River will not be changed and the existing vegetation will be preserved to the extent possible. Historically flow patterns and runoff amounts will be maintained. Please refer to engineer Matt Webster's letter (Attachment 11) which addresses the issues in this section of the Code. The drainage plan will be designed to meet all these requirements and the project will be in compliance. (d) Groundwater Activities and development shall not result in the introduction of any contaminants to groundwater, or interfere with any recharge area or aquifer. The Applicant will comply with this standard. (e) Irrigated Areas Activities and development shall: (1) Not adversely affect the adequacy of water supplies available for the irrigation of agricultural lands; and (2) Not adversely affect the exercise of any existing and decreed irrigation water right. (f) Irrigation Ditches Activities and development shall: (1) Access Provide for access to irrigation ditches by ditch owners and to the public if a ditch is to be, or is part of the Pitkin County Open Space and Trails System or other public property. (2) Preventing Leakage Ensure that no building shall be constructed immediately downhill of a ditch unless the ditch can be placed in a culvert, lined, or otherwise treated to avoid leakage of water downhill towards the building. (3) Avoid Flooding Design land uses to avoid flooding problems from flood irrigation. (4) Avoid Seepage 11 Place basements and soil absorption on-site wastewater treatment systems in locations where they will not be impacted by flood irrigation or seepage from irrigation ditches. (g) Sedimentation Activities and development shall: (1) Control During Construction Provide adequate sedimentation control throughout all phases of development. (2) Sedimentation Retain sediment produced by soil disturbances on site where the disturbance occurs and prohibit run-off into any water body, wetlands, or riparian area. (3) Revegetation Revegetate clearing and grading as soon as possible, but in no event longer than one growing season after conclusion of development on a site. (h) Water Quality (1) All land uses shall comply with those setbacks required by Sec. 7-20-80 and those setbacks required by Table 5-1. (2) Activities and development shall comply with all state and federal statutes and regulations concerning the protection and enhancement of water quality (including but not limited to the requirements of all state and federal permitting programs). (3) Activities and development shall be consistent with maintenance of the Stream Classifications for the Roaring Fork River watershed, as identified in Section 208 of the Roaring Fork Watershed Management Plan, and shall comply with state regulations pertaining to maintenance of those classifications. (i) Efficient Water Use Activities and development shall emphasize the most efficient use of water, including, to the extent permissible under law, the re -cycling and reuse of water. The Applicant will comply with the preceding standards. Please refer the letter from Matt Webster addressing engineering issues (Attachment 11). 12 Floodplain Hazards Section 7-20-40 Attachment 4, the Little Texas Lot 2 Existing Conditions Map depicts the "effective" limits of the 100 -year floodplain based upon 1986 mapping. The floodplain is addressed in Matt Webster's letter, Attachment 11. The proposed development including the location of the proposed OWTS is outside of the proposed floodplain. Wildfire Hazards Section 7-20-60 The proposed improvements are within a low wildfire hazard area. The Applicant will comply with the Code standards for low wildfire areas. Wildlife Habitat Areas Section 7-20-70 The parcels are not within mapped deer or elk critical habitat. River Stream Corridor and Wetlands Section 7-20-80 (a) Riparian and Wetland Areas and Buffers (1) Protected Features Each Site Plan shall identify each of the following features on the property. (a) "Blue line" perennial streams shown on U.S. Geological Survey maps of the area; and (b) Intermittent streams or streambeds known or apparent from field study, with the exception of man-made waterways such as ditches and water features. (d) Isolated, natural wetland and riparian areas. (2) Minimum Setbacks All activity and development shall maintain a minimum setback from the protected features identified in subsection (1) above. (a) All activity and development after the 5th of July, 2006 shall maintain a riparian area/wetland buffer of at least one hundred (100) feet, measured horizontally from the identifiable high water line of each feature identified in subsections (a)(1)(a) and (b) above. This one hundred (100) foot setback may be reduced to between one hundred (100) feet and a minimum of fifty (50) feet upon demonstration by the applicant that such reduction shall not result in water quality degradation, stream bank erosion and/or a reduction in the quality of riparian or wetland habitat pursuant to standards in Section 7-20-80(4). 13 (b) All activity and development after the 5th of July, 2006 shall maintain a buffer of a minimum of twenty-five (25) feet from isolated wetlands and/or riparian areas identified in (a)(1)(c) above. The OWTS that will service the property is subject to many relevant setbacks that constrain the property including a 100' setback from the proposed domestic well, 10 foot property line setbacks and a 25' setback from cut banks. The Applicant is seeking to reduce the 100 foot setback from the Roaring Fork River to 50' in order to install the OWTS on the lower bench at the base of the slope. Matt Webster addresses this in his Engineering Report in Attachment 11. Matt does not advise varying the 25' setback from cut banks due to potential slope stability concerns as it is not best to introduce significant water into the soil at the top of the bank. Due to the setbacks constraining the site, the Applicant is proposing to locate the OWTS on the lower bench. As allowed in Table 6.28-1 of the Pitkin County OWTS Regulations, footnote 4 provides for a minimum 50' setback if the 100' setback cannot be achieved and no reasonable alternative area exists for component installation. Based upon the proximity to the River and likelihood of high groundwater, Matt has assumed that a sand filter mound would be constructed and that secondary treatment would be required for the system. The size of the system has been estimated based upon a conceptual site plan which includes a sufficient activity envelope for construction of the system. The sizing is based on assumed soil conditions, based in part on the soil profile obtained from a site two lots downriver from the subject where a similar system was recently designed and constructed. This nearby OWTS in Little Texas also required a setback variance from the 100 foot River setback and the variance was granted by the Pitkin County Environmental Health Department. A site specific soils evaluation will be completed prior to design and permitting of the OWTS for the subject property. As noted in attorney Anne Marie McPhee's December 21, 2017 letter in Attachment 13, Angelica Sturm, the current owner of the lot has applied for an exempt well permit on the lot to serve the proposed house. The property is currently connected to a well on a neighboring parcel, but the owner of Lot 2 and the Applicant have concerns about the conditions of the well and the connecting pipelines. Landscaping and Vegetation Protection Section 7-20-130 As required, all development on the subject property will comply with the Pitkin County Landscape Guidelines. The Applicant will preserve existing vegetation to the maximum extent possible. The Planting Plan will comply with the intent and requirements of the Pitkin County Land Use Code and Landscape Guidelines, including restrictions on removal of natural vegetation, and requirements for revegetation. The applicant will comply with the requirements of the Code and any applicable conditions of approval pertaining to landscaping and vegetation. 14 Vested Property Rights Section 2-20-170 (d) This land use application if approved will constitute a Site Specific Development Plan. The Applicant requests a three year vested property rights term. Summary This letter of application has described the subject site, past approvals and proposed the 2017 Lot 2 Little Activity Envelope which meets the applicable criteria and standards of the Pitkin County Land Use Code. Angelica and Bill Sturm ("Applicant") have applied to the Pitkin County Community Development Director ("Director") for 1041 Hazard Review and Conceptual Submission approval to establish a building envelope in which to replace an existing single family residence. 2. The parcel is located at 102 Little Texas Lane, is referred to as Lot 2, Little Texas, and is more specifically described in Exhibit A. The property is zoned APR -1 0 and contains 0.5 acres. 4. The BOCC granted 1041 hazard review and general submission approval in 1993, pursuant to Resolution No. 93-165. The 1041 site plan was not recorded. The vested rights for the 1993 approval have expired. 5. The Director finds that the proposed building.envelope avoids the 100 year floodplain and that the wildfire hazard can be mitigated. 6. The Director further finds that the building envelope is primarily located on slopes of less than 15%, but that this area is not large enough to develop the floor area that is permitted by the underlying zoning. Given that the slope is not subject to instability and that development on the slope in excess of 30% would not increase visual impacts, the Director finds .that expansion of the envelope onto slopes in excess of 30% and less than 45% is acceptable. THE DIRECTOR DOES HEREBY APPROVE the Sturm 1041 Hazard Review and Conceptual Submission, subject to the following conditions, which shall run with the land and be binding on all successors in interest: Prior to submission of any earthmoving, access, or building permitapplications, the Applicant shall submit a 1041 Hazard Review Site Plan to the Community Development Department. for approval and recording. The replacement residence is exempt from growth management up to 5,750 square feet of floor area. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of the building envelope and install construction fencing around the perimeter of the building envelope. The fencing shall remain in place until a Certificate of Occupancy is issued for the residence. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. For a distance of 10' around all structures, maintain vegetation at a height of 6" or less with mowed grass, low growing perennials or hardscape. Woody vegetation shall not be planted within this perimeter. B. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a. minimum of 60' around all structures. C. Spacing between clumps of brush and vegetation within 30' of all structures shall be a minimum of three times the height of the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. D. Monarch St., Suite 104 Aspen, CO 81611 RE: Lot 2, Little Texas - Engineering Report Dear Glenn: This report addresses Civil Engineering aspects of the proposed development of Lot 2, Little Texas Subdivision (104 North Little Texas Lane), Woody Creek, CO, in support of the land use application being submitted to Pitkin County. The applicant is seeking Activity Envelope Plan Review approval for the site. The property currently contains an existing cabin that will be removed prior to redevelopment. The applicant is proposing to build a new four-bedroom residence of approximately 3,500 sf to 4,000 sf. We have evaluated proposed site access, site grading and drainage, utilities, water supply and onsite wastewater treatment. A conceptual site plan is attached showing the currently proposed development concept. Site Access The property is accessed via North Little Texas Lane which is 0.2 miles south of the Woody Creek fire station on Upper River Road. North Little Texas Lane is approximately 10' wide with steep slopes on either side and is used to access three properties: Lot P, Lot 2 and Lot R of the Little Texas Subdivision. Although North Little Texas Lane does not meet County access standards, we have discussed the need for potential improvements with Catherine Christoff (Pitkin County Planning Engineer) and Parker Lathrop (Aspen Fire Marshal), and they have agreed that no improvements to North Little Texas Lane will be required. Widening the road would require significant disturbance to slopes and likely the addition of retaining walls. Lot 2 has a constrained area available for development, so the Fire Marshal is not expecting a fully compliant fire truck turnaround. However, a 16' -wide driveway can be constructed on site from North Little Texas Lane to the proposed location of the residence. An auto court in front of the house and garage will provide some additional space for emergency vehicle movements and staging for operations. Site Grading, Drainage and Erosion Control Lot 2 consists of two relatively flat benched areas bounded to the south by the Roaring Fork River, separated by two steep slopes (>30%), with River Rock Lane traversing the north end of the property. The steep slopes limit the majority of the proposed development to the flat bench in the middle of the property. This part of the property slopes gently to the southwest toward the river. Redevelopment of the property will increase impervious area compared to existing conditions. Per County Code Section 7-20-30, historic flow patterns and runoff amounts will need to be maintained. Runoff from development can be routed to the middle of the benched area and routed through a drainage detention basin or drywell. The majority of the disturbed area is currently covered in meadow grasses. Disturbed areas not planned for hardscape installation should be revegetated with a Pitkin County approved seed mix or other approved vegetation. A few larger trees will likely be removed during site development. Tree mitigation per County Code will be required for the removal of any trees greater than 6" in diameter. Floodplain We have reviewed the currently effective and proposed 100 -year floodplain limits for the property. Proposed development is well outside the effective 100 -year floodplain limit. The proposed floodplain mapping shows the 100 -year floodplain limit extending further into the property, but still does not conflict with any proposed development. Site Utilities Existing site shallow utility services have been reviewed, including electrical, natural gas and telephone services. Information on site utilities has been obtained from discussions with the local utility companies and available survey data. Holy Cross Energy serves the area with electric service. Single-phase power is available from an existing transformer on neighboring Lot R. The transformer has capacity to serve the proposed redevelopment of Lot 2. A new service line would be routed along North Little Texas Lane. CenturyLink provides phone service for this area. Ample phone lines exist to serve the proposed redevelopment. Natural gas service from Black Hills Energy is available in this area Comcast provides cable TV and internet service in this area. Domestic Water Supply The site currently has access to domestic water from a well on Lot P (to the west). However, the applicant wishes to develop their own domestic well on Lot 2 due to concerns about the condition of the existing well and the connecting pipelines. A well permit application has been submitted to the State. We have reviewed the site with a local driller and determined a viable location for the new well. The well would be drilled in the vicinity of the existing cabin after demolition of the cabin. Drilling access requires a large, flat space with room to discharge spoils. We have kept the proposed well location off the slope just south of North Little Texas Lane and away from tall trees along the western property line (see photo below). In preliminary discussions with County staff, the prospect of placing the well on the lower bench by the River was raised. However, this area is within the 100' setback from the existing onsite wastewater treatment system (OWTS) for Lot P. The OWTS is subject to many relevant setbacks on this site. There is a 100' setback from the proposed domestic well. Ten -foot property line setbacks apply and there is a 25' setback from cut banks. Although some area outside the well setback does exist within the middle bench of the property, it is within 25' of the top of bank of the steep slope that runs down toward the river. In addition to environmental concerns related to surfacing of effluent, placing the soil treatment area close to the top of bank is not advisable due to slope stability concerns, i.e., it would be best not to introduce significant water into the soil at the top of the bank. The current proposal anticipates locating the OWTS on the lower bench. This would need to be constructed within the 100' river setback (but outside the 50' setback line). In Table 6.28-1 of the Pitkin County OWTS Regulations, footnote 4 provides for a minimum 50' setback if the 100' setback cannot be achieved and no reasonable alternative area exists for component installation. Based on the proximity to the river and likelihood of high groundwater, we have assumed that a sand filter mound would be constructed and that secondary treatment would be required for the system. The sizing is based on assumed soil conditions, based in part on the soil profile obtained from a site two lots downriver where a similar system was recently designed, permitted and constructed. A site-specific soils evaluation will be required prior to design and permitting of the Lot 2 OWTS. Geological evaluation of site for single-family residence, Lot 2, Little Texas Subdivision, Pitkin County, Colorado. I have completed the geological appraisal of the subject property/building site for the required HB 1041 hazard review. The property is in the SW,, M4-, Section 16, T. 9 S., R. 85 W., 6th PM, about seven (7) miles north of Aspen, Pitkin County. The subject lot stretches from the east bank of the Roaring Fork River, eastward across a narrow, youn er river terrace, thence upward and over a west -facing 30 -ft. -high slope ?35%) onto the surface of an older, upper river terrace. The lower and upper river terraces are entirely composed of rounded, 'river -deposited boulders, cobbles, and gravel ih a matrix of porous sand. The sand is largely made�.up.. of decomposed rock fragments.' Sandy soil containing minor amounts of humus and clay mantles the whole upper terrace level. Soil on the slope is slightly more argillaceous. Bed- rock is not exposed anywhere on the property, or in the subdivision, but it is probably Mancos Shale, as noted in areas immediately adjacent to the subdivision. However, terrace gravels are at least 12 feet thick on the lower terrace level and 42 feet thick on the upper terrace level. The slope between the two terrace levels is presently colonized by vegetation, mainly mature Gambel's oak and serviceberry, with immature cottonwood near the base of the slope. Despite its steepness, the slope angle is less than the angle of repose for the terrace gravels, and is naturally stable. The anticipated building envelope for, the residence will include up to one-half of the upper part of the slope, from its crest downward about 15. feet, as well as an adjacent part of the flat, upper terrace level. Soil, subsoil, and underlying terrace material are practically uncompressible, exhibit excellent internal (matrix) porosity and drainage, and contain small amounts'of.non-swelling clay. Consequently, standard foundation designs should be adequate for the substrate. However, if the upper part of the slope is excavated for construction, care should be taken that foundation (stem walls and footers) be designed to resist subsoil water drainage. Particularly, excess water from the upper levels should no be allowed to erode the base from beneath the footers. Regarding continued slope stability, after construction, surface water run-off should be minimized adjacent to and below the building. Further, existing natural vegetation should be maintained where feasible, on the slope. This will preclude excess watering of the natural xerophytic plants. Page 2 Despite the porous soils and substrate, the granitic composition of at least 30 percent of the terrace gravels might subject the site to slight emanations of radon gas. Adequate subfloor ventilation or gas shielded foundation walls should be provided to assure acceptable levels of radia- tion within the home. In conclusion, the homesite and building envelope are well suited for al- most any kind of construction, provided that the above recommendations are followed. Constrained sites have been capable of accommodating a septic system and water service. If this property were to be serviced by a shared well, could the upper bench accommodate the septic? Some of the homes in this area are served by a shared system. Should it be determined that no alternative building site exists for the septic, the applicant shall submit a detail construction plan and revegetation plan that outlines how the utility cut down the steep slope will be constructed to minimize impacts to the slope, and be revegetated. Additionally the septic design shall specifically address the potential for high groundwater levels on the lower bench. Prior to recordation of the Activity Envelope, the applicant shall depict both the effective floodplain boundary, and 2015 preliminary floodplain boundary. These boundaries should also be included on the Site Plan that will be recorded in the future. I After reviewing the application, I propose the following conditions: The applicant shall supply a drainage and erosion control plan and accompanying drainage report demonstrating that historical flow patterns and runoff amounts will be maintained. If the development disturbs one acre or more, a Colorado Department of Public Health and Environment permit for stormwater discharges associated with construction activities shall be applied for and obtained prior to issuance of a building permit. Historically, the side yard setbacks between neighboring properties in Little Texas have been 10 feet. In this application it appears to me the applicant is requesting a 5 foot side yard setback. I believe the activity envelope should be reduced to the historical 10 foot side yard setbacks. I would also want to acknowledge and applaud the applicate for their commitment to preserve the Melberg view planes to the river. In the previous granted "1041" building envelope, the deck was extended past the demarcation line and I would like for this issue to be addressed for I believe it did not adhere to the intent of building envelope. My final thought on the application is the county's reluctance to grant disturbances on slopes greater than 30.45 percent. This rule is a one size fits all and should be waived for the Little Texas community for the soil is a stable river rock bedding and will not slide or move if disturbed. Presently 10 homes out of 16 properties in Little Texas have walk out basements without any negative impacts. In fact, the allowance of having walkout lower levels is environmentally friendly for the house is situated in the ground which effectively keeps the house cooler in the summer and warmer in the winter. It also encourages a lower profile of a house for our community.
