Changes must be approved by this Department and the engineer prior to construction. This system was originally approved under ISDS Permit 88076. In 2011, the property was transferred and OWTS Use Permit 0019.2011.powu was issued. It was discovered that although the system was functioning properly, there was insufficient tank capacity to serve 9 bedrooms even though proper county permits were issued through the development of the residences. The existing tanks will be abandoned and two new 2000 gallon single compartment tanks will be installed with an effluent filter on the outlet of the second tank. The engineer has recommended that the tanks be tested for water tightness prior to backfilling. The effluent line from the new tanks will tie into the exiting line. The existing absorption area will remain in place and concrete manhole risers will be installed on the two existing distribution boxes for access from grade. This Permit must be kept on-site during installation. The engineer must do a final inspection of the installation and submit an "as -built" letter to this Department within 30 days of the final inspection, unless a longer period of time has been agreed upon, in writing. This Department must also be called for the final inspection with a minimum of 48 hours notice. Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS Regulation. This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. This work was completed under Pitkin County Environmental Health and Natural Resources Department Permit foran OWTS No. 0001.2012.powt. The observations made by SGM of the OWTS installation have been completed pursuant to plans and specifications prepared by SGM, Inc. The OWTS improvements for this property included the removal of the existing septic tanks and sewer piping, the installation of two new 2,000 gallon septic tanks and realigned the 4 -inch PVC collection system, the installation of an effluent filter, and the installation of distribution box access manholes over existing distribution boxes. Improvements to the absorption field were not required by Pitkin County with this project. During a site visit on July 7, 2012 an SGM representative observed the construction and installation of the septic tank and distribution box manholes. Although the alignment of the piping and septic tank locations were field fit to avoid site features and existing utilities the observations during the construction process indicated that the portions of the system under construction were being installed in a manner consistent with SGM plans and Pitkin County code. After the septic tanks were installed, Aspen Diggers tested the tanks for watertightness prior to backfilling. Pitkin County inspectors were present during this test. The attached record drawings show the field revisions to the original design. Upon final completion of the installation of the collection system and effluent filter, Hansen construction confirmed that these elements were installed per Pitkin County code. SGM did not observe the installation of the piping system or effluent filter. The design is in support of a building permit application to Pitkin County for the interior remodel which will require that an OWTS Construction Permit Application be submitted to the Pitkin County Environmental Health & Natural Resources Department. Current plans for the property include an interior remodel of an existing residence. There is an existing OWTS on the property. BACKGROUND AND SITE CONDITIONS The subject site is a 77 acre lot. There is an existing main residence on site with a detached caretaker's dwelling unit (CDU). However, the wastewater service from the CDU connects to the main residence with one combined discharge to the OWTS. The original OWTS was constructed in 1988-1989. On May 6, 2011, an OWTS Use Permit was issued by Pitkin County in conjunction with the sale of the property. The Use Permit was submitted by Licensed Inspector Tim Petz. The use permit indicates that the original design included two (2) 1,000 -gal septic tanks and an absorption field consisting of deep gravel trenches with an area of 2975 square feet. The system was determined to be functioning properly, although it was noted that the tanks are buried approximately 10 feet below grade. And although the system was designed to serve 7 bedrooms but has been serving 9, all proper permits were obtained as part of the development process. The Use Permit from the County recommended adding additional tank capacity to comply with current regulations for a 9 bedroom residence. Adding an effluent filter to the tank outlet also was recommended. The two existing tanks are located in a landscape berm along the south side of the driveway as it approaches the main residence. The line runs from the tanks down the driveway, crossing the driveway in the area of the gate, then crossing back to the open meadow southeast of the largest pond (see attached site plan). Cleanouts have been found and brought back to surface level by the contractor. The contractor verified that flow was accepted into each distribution pipe and that the distribution boxes were sufficiently level to direct flow evenly between pipes. Based on limited as -built information (two hand -drawn sketches are all that is available) and the direction of the pipes leaving the distribution boxes, the approximate location of the existing absorption field is shown on the attached site plan. As noted in the Use Permit, there is no indication of any signs of failure or surfacing effluent. PROPOSED CONSTRUCTION The remodel of the main residence and CDU will not result in the addition of any bedrooms, i.e., the bedroom count will remain at 9. There will still be a single discharge point for flows from both the main residence and CDU. RECOMMENDATION For this remodel, with no bedrooms added to the total count for the main residence and CDU, we recommend adding septic tank capacity to bring total capacity into compliance with current regulations. However, continued use of the existing tanks is not recommended due to the location and age of the existing tanks, the depth of cover over the tanks, and the difficulty in adequately assessing the condition of the tanks, adding an effluent filter or providing on-going maintenance and inspections. It also would be somewhat challenging to add a third tank in the general vicinity of the two existing tanks due to the extensive landscaping in the area. Therefore, the best course of action is to install new septic tanks and abandon the existing tanks. Based on current regulations, required tank capacity for 9 bedrooms is 3375 gallons. Required tank capacity for 10 bedrooms is 3750 gallons. We understand that your preference at this time is to install enough tank capacity for 10 bedrooms to accommodate potential future bathrooms, although only 9 bedrooms will be allowable at this time based on this OWTS permit. Sewer Pipe: Sewer pipes should be 4 -inch SCH 40 PVC pipe installed with a minimum slope of 2%. Joints should be solvent welded. Cleanouts are required 1) at the stubout from the building, 2) at spacing not to exceeding 100 feet, and 3) upslope of two or more bends closer than ten feet in the sewer pipe. Bends in the sewer pipe are not to exceed 45 degrees. The pipe should be properly bedded per the typical trench detail presented on the design drawings. The plumbing plans for the remodel include a new sewer line exit point. The septic tank should: 1) be located down gradient of the home, 2) be buried no deeper than three feet, and 3) be at a location accessible for siphoning and maintenance at the tank. 'The second septic tank shall contain an Orenco Systems, Inc. Biotube® effluent filter at the tank outlet. The tanks and lids must conform to County OWTS regulations. The tanks shall be installed with watertight access risers and bolt down lids. The outlet from the second tank should be connected to the existing waste line at a convenient location between the new septic tanks and the existing distribution boxes. Schedule 4.0 PVC pipe connections shall be used. Tanks shall be watertight with a water tightness test performed by the contractor. Push gaskets for the inlet and outlet pipe can be used for burial depths up to 4 feet. Cast -in-place gaskets must be used for tanks with burial depths of greater than 4 feet. Discharge Piping: The discharge piping from the effluent outlet to the distribution boxes shall be 4 -inch diameter SCH 40 PVC pipe with solvent welded joints. A minimum pipe slope of 20/�6 is required. The pipe should be properly bedded per the typical trench detail presented on the design drawings. Distribution Box: Pitkin County has asked that access to the existing distribution boxes be provided from the surface. To that end, we have indicated two 4' -diameter concrete manhole risers with lids to be added. Absorption Field: Currently, no modifications or additions are planned for the absorption field, nor are any required based on the Use Permit issued on 5/6/2011. However, we would like to note that if the total bedroom count for the main house and CDU ever exceeds 9, the absorption field would need to be brought into compliance with current OWTS regulations. Although indications are that the existing field is a deep gravel field with limited potential for surface activities to negatively impact the performance of the field, we recommend that no automatic sprinkler system be installed over the existing absorption field and that vehicular traffic should be kept off the absorption field. INSTALLATION OBSERVATIONS The installation of the OWTS (i.e., septic tanks for this project) is to be observed by the design engineer. A final observation will be required prior to placing the OWTS into service. OPERATION AND PREVENTATIVE MAINTENANCE SCHEDULE The goal of an operation and maintenance schedule is to observe the operation, and perform minor maintenance to the onsite wastewater system to allow for proper, long- term functioning of the system. Septic Tanks: The scum and sludge accumulation in the septic tanks should be monitored yearly. Once the cumulative scum or sludge thickness reaches 25% of the chamber depth, the entire chamber should be pumped. A pumping frequency of 1 to 3 years at design flows should be anticipated. The effluent filter at the septic tank discharge should be cleaned (hosed off) at the time of pumping or as needed. Absorption Field: The surface area around the field is to be observed monthly for signs of failure such as lush vegetation growth or effluent ponding. Liquid levels within each field section are to be observed through the observation pipes, and levels recorded. General: System users must realize an onsite wastewater system is different from public sewer service. There are daily considerations such as not putting plastic or other nonbio-degradable material into the system. Water use should be monitored so toilets are not allowed to run when seals malfunction. Allowing fixtures to flow continuously to prevent water lines from freezing is not recommended. Although the proposed system can accommodate variable flows, spreading water use over several hours and eliminating peak flows is recommended. To illustrate the point, a malfunctioning toilet can consume in excess of 1000 GPD. Excessive daily loading could flood and irreparably harm the OWTS. SGM cautions against installation of a water softener. The chemical and hydraulic loading from the backwash of a water softener may be detrimental to the OWTS and a separate drywell should be constructed for the backwash waste, if a softener is installed. No landscaping or plastic can be used over the field, which will reduce performance of the field. The design of the OWTS is based on the treatment of domestic sewage only. Swimming pool or spa water is not to be discharged flows into the OWTS. The proposed OWTS design is based on the flows noted in the report. Increased flows may hydraulically or organically overload each respective OWTS, causing premature failure. LIMITATIONS Our investigation, layout, design, and recommendations are based on data submitted. If conditions considerably different from those described in this report are encountered, SGM should be called to observe the conditions. If proposed construction is changed, SGM should be notified to evaluate the effect of the changes on the wastewater system. All construction is to be in accordance with the OWTS regulations. Pipe type and size, burial requirements, septic tank construction, and other specifications, which are not depicted in our report, are to conform to the requirements of the OWTS regulations. The installer of the system is to be licensed by the Pitkin County Environmental Health & Natural Resources Department and have demonstrated knowledge of the OWTS regulations and requirements. In the course of said investigation, we have discovered some land use problems associated with the garage/caretaker dwelling unit (CDU) and the agricultural outbuilding which must be resolved in order to remodel the main house in a timely manner. Our goal is to work with the County to resolve all outstanding land use issues so you can redevelop the property as you have explained to me. It should be noted that you may occupy and enjoy the main house, CDU and agricultural outbuilding in. their current condition. However, the proposed remodel provides Pitkin County the opportunity take a close look at the land uses on the property which are out of compliance with current building, fire and land use codes as well as improvements which may have been overlooked by the County when the property was developed. The key land use issues are summarized in Attachment A. Attachment B is a detailed explanation of the issues which may interest you. Attachment C is table which documents the calculation of non -permitted floor area which exists in the Garage/CDU. I am available to discuss this letter. The main house was legally constructed and contains approximately 14,080 square feet of enclosed floor area. 2. An additional 2,050 +/- square of floor area of the main house is located under overhangs and is not enclosed with walls. This space may be reconfigured and enclosed within the house without any land use review. While 1,040 square feet of floor area of the garage/Caretaker Dwelling Unit (CDU) building was legally constructed (as evidenced by a 1990 Certificate of Occupancy), it appears that approximately 990 square feet of floor area on the second floor of the CDU was constructed without a building permit and is "illegal." Refer to Attachment C for a calculation of the excess floor area. 4. It appears Pitkin County will require the "illegal" floor area in the garage/CDU to be removed or in the alternative approximately 990 square feet of floor area located under the overhangs of the main house may be "transferred" to the garage/CDU. We are working with the County to resolve the issues regarding illegal space. 5. The CDU will be limited to 1,000 square feet in size. It may be possible to convert some of the extra space in the garage/CDU building to a bedroom and bathroom for use by guests or staff, but Pitkin County must approve the reconfiguration of the space. The converted space cannot be part of the 1,000 square foot CDU. The County will review the design to insure that the bedroom and bathroom are not easily accessible to the CDU. The third building on the property, the agricultural outbuilding, appears to have been built without any building permits (since the County has no record of any permits) and is therefore illegal. Although the outbuilding has been there for at least 11 years and has never been red tagged by the County despite inspections of the property as late as 2006 (when playhouse was inspected), the County has told us in initial discussions that the outbuilding will need to be removed. Although the County has not inspected the outbuilding yet, the building is constructed on a steep slope and the slope may need to be properly restored 2 ATTACHMENT B DETAILED EXPLANATION OF LAND USE ISSUES Legal Status of Existing Structures This section summarizes the legal status of the existing structures. Main House The main house was legally developed. Pitkin County issued a certificate of occupancy on June 22, 1990 for a house containing 11,435 square feet of floor area. Floor area was measured according to a different definition in 1990 than is used today. Janver Derrington of Charles Cunniffe's office has measured and drawn the house to determine the amount of floor area pursuant to the current Pitkin County Land Use Code. According to Janver's measurements and calculations the house contains approximately 14,080 square feet of floor area. Approximately 2,050 square feet of floor area is covered deck space in excess of the eight feet of exempt overhang space. Pitkin County will permit the floor area under covered deck space to be enclosed provided that the current quantity of floor area is not exceeded. Minor changes to the building footprint as depicted in Anna's Conceptual Redevelopment Options 1 and 2 will be permitted. A land use review will not be required. It will be possible to submit building plans without a land use review. Garage/Caretaker Dwelling Unit (CDU) There are two major issues affecting the garage/CDU; 1. The size of the dwelling unit; and 2. Overall size of the structure. Although the issues are interrelated, they are addressed separately below. Size of the Dwelling Unit (CDU). The garage/caretaker dwelling unit was legally developed. However, it does not appear that the existing improvements are consistent with the certificate of occupancy which was issued on December 12, 1990. There remains some uncertainty regarding what was approved for this structure and whether the existing improvements were legally permitted. The current status of this building is uncertain, however Lance Clarke, Pitkin County Planning Director, would like to resolve land use issues and bring the building in to code compliance without involving the Board of County Commissioners. The December 12, 1990 certificate of occupancy specifies approval of a garage and 1,040 square feet of additional floor area. In 1990 garage space was not included in the floor area definition. Therefore, the 1,040 square feet of floor area does not include garage space. Janver is in the process of measuring the garage/CDU and preparing precise floor area calculations. These calculations will be done by the end of this week. Janver estimates the garage is comprised of 1,090 square feet of floor area and the CDU is comprised of approximately 2,030 square feet of floor area. The CDU contains approximately 990 square feet of floor area more than what has been permitted by Pitkin County (refer to Attachment C for calculation). Since the CDU deed restriction was recorded on December 1, 2000, Pitkin County increased the permitted size of CDU's from 700 square feet of "net livable space" to 1,000 square feet of livable space. "Net livable space" is a defined term which varies slightly from floor area. Pitkin County will require the CDU to be reduced in size to 1,000 square feet of net livable space. It is not clear when the County will require the reduction in space to occur. I will seek to have the space reduction be a condition of the issuance of a certificate of occupancy for the main house. Such a condition may be acceptable, however Pitkin County may require the space reduction to occur prior to a building permit for the main house. This is an issue to be resolved. It is unclear how the additional space in the garage/CDU was created (990 square feet) and whether it is legally created. A building permit for the garage/CDU was issued some time in 1989. The permit is not in the County records. There is a note on the building plans which says the dwelling unit is supposed to be limited to two bedrooms and that the space on the second floor above the garage should not become an additional bedroom. In January of 1990, the builder sought a change order to expand the CDU to contain 1,800 square feet of floor area. The change order was denied pursuant to a letter dated January 12, 1990. It appears that the CDU was expanded at some point without the benefit of a building permit. The owner of the property recorded a deed restriction for the CDU in November of 1988 (reception # 305587). The 1988 deed restriction required the unit to comply with Pitkin County's Category 1 (low income) income, and price restrictions. The unit must be rented at all times to a local employee whose income does not exceed the Category 1 (low income) guidelines. The unit is referred to as a fully deed restricted affordable housing unit. The dwelling unit was deed restricted to comply with requirements imposed upon the Owl Creek developer as part of the County land use review process. I found this deed restriction in the Housing Office's files which were provided to me by Cindy Christensen (County Housing Official). The title company mistakenly did not include this deed restriction in the list of title exceptions. In 1999, Archer Bishop, the owner of the property at the time, submitted a land use application to Pitkin County to change the 1988 deed restriction referenced above to a "modern" CDU deed restriction. Pitkin County approved Bishop's request based upon the following three conditions. 1. Bishop would pay a $ 290,000 cash payment to Pitkin County in lieu of providing a fully deed restricted employee housing on the property. C! L E 2. Bishop would remodel the existing dwelling unit to reduce the size in compliance with CDU size limitations which limited CDUs to 700 square feet of net livable space. 3. Bishop would record a new CDU deed restriction prior to the issuance of a building permit to remodel the existing dwelling unit to comply with current County regulations. On December 14, 1992, Bishop paid $ 290,520 to the Pitkin County Housing Office to satisfy condition # 1. Bishop recorded a modern CDU restriction on December 28, 2000 (reception # 45001), however there is no record of a building permit or certificate of occupancy being issued for the remodeled CDU. In 2007, the Housing Office conducted a compliance audit of Owl Creek lots to determine if any lots were out of compliance with the housing deed restrictions. The compliance audit determined that although Bishop had made the $ 290,520 payment, there was no record of the dwelling unit being modified or changed to a modern CDU. The audit states the 1988 deed restriction would not be released until the dwelling unit was modified as required by condition # 2. Size of the Structure. It appears that a prior owner developed space on the second floor of the garage/CDU without obtaining a building permit. It is not clear exactly how much floor area was built on the second floor without a permit. It appears approximately 990 square feet of floor area was built without the obtaining approval from Pitkin County. We will have a better estimate of the illegally built space after Janver completes his floor area calculations. Pitkin County will require the removal of floor area located in the garage/CDU which was illegally constructed. In the alternative, Lance Clarke (Pitkin County Planning Director), has initially approved the concept of legalizing the "bandit space" in the garage/CDU by reducing the floor area in the main house in the event we cannot demonstrate that the floor area in the garage/CDU was legally built. He will reluctantly permit the transfer to occur but would prefer to resolve the issue by demonstrating that it was legally constructed. Lance will not consider the "transfer of floor area" to be a significant change to a non -conforming structure" which would trigger a review by the Board of County Commissioners. However, Lance will require us to submit plans :for the structure and a report from a structural engineer attesting to the structural integrity of the building. He will also require thorough building inspections to verify proper construction. Agricultural Outbuilding The agricultural outbuilding contains approximately 727 square feet of floor area. There is no record a building permit being issued for the agricultural outbuilding, nor is there a certificate of occupancy for the building. Pitkin County will require the removal of the building. It is not clear when the building will have to be removed, but we will request that the removal be linked to the issuance of a certificate of occupancy for the main house. 5 19 Summary & Next Steps n We need to discuss the findings in this letter and evaluate our strategy from this point forward. In the event we cannot demonstrate that all of the floor area in the garage/CDU is legally constructed you will be faced with the following choice. • Demolish approximately 990 square feet of floor area in the garage/CDU and continue with the remodel of the main house; or Reduce the size of the main house by approximately 990 square feet of floor area. This space may be "transferred" from areas under the overhangs which are not enclosed. Pitkin County will require the agricultural outbuilding to be razed because it was illegally constructed. Agricultural buildings are not permitted on individual lots in Owl Creek because there is a common agricultural parcel.
