Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hazdship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfaze and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. Pitldn County Account -,. - MINUTES Pitkin County Board of Adjustment Apri12, 1996 Members Present: Michael Cooper Shira Geller Paul Rudnick Rod Dyer Ellie Brickham Bill Lukes Staff: Joanna Schaffner, Zoning Officer Vicki Chavka, Acting Secretary Lukes opened the meeting, indicating that Geller would vote on the first case, Rudnick on the second, Geller on the third. Case #96-08. Alex Kaufman. Lot 1 Cheek Subdivision. Lukes introduced the case which requests approval for a FAR variance of 40 square feet where a maximum of 7227 square feet is allowed fora 1.364 lot in the R-30 zone district, for the construction of an airlock on an existing sine-family residence. Schaffner explained that the applicant wants to drop walls under the existing front porch roof which would add approximately 40 sq. ft. She indicated she had received a letter from an adj acent property owner. Lukes read the letter from John W. Kronin, Jr., into the record, which stated that Kronin had no objections to the proposed glass enclosure and the requested variance. Ted Guy, as the current architect for the Kaufman residence, was present to request the variance. He stated that he had found the original plans to be lacking an airlock at the main entry, the azea in question is already under roof, it is not visible from the street, an energy savings benefit would be gained, and there would be no impact on the neighbors. He showed a photograph indicating where the airlock would be placed. Public comment was solicited, none was offered. Lukes questioned the basis on which a vaziance could be granted. Gideon Kaufman, attorney for the applicant, suggested that a hardship had been discovered in terms of the design of the house that created an energy drain on the house. Geller recalled a variance in Mtn. Valley that had been granted for the same reason. Jeff Dickinson, Energy Consultant, indicated that it is common practice to have an airlock to conserve energy. • - Dyer stated that he saw no reason not to grant the variance, but needed a reason to grant it. Lukes supported the fact that minimal space would be added to achieve the energy savings. Cooper moved to approve the FAR variance of 40 sq. ft. where a maximum of 7227 sq. ft. is allowed fora 1.3641ot in the R-30 zone district, for the construction of an airlock on an existing single-family residence as per plans submitted. Dyer seconded. Motion passed 5-0. Case #96-06, Steve and Lvnne Cordova. Lot 7 Crystal River Pazk. Lukes introduced the request for approval fora 4' north side yazd setback vaziance, where 15' is required, for the construction of asingle-family residence. Schaffner stated that Crystal River Park is a BOCC approved subdivision, requiring no 1041 or planning reviews. The property is bisected by a ditch with very lazge trees that the applicant is trying to avoid harming. An adjacent property owner, Mazk Mueller, told her that he felt that if the house were tilted a little bit more to the south the vaziance would not be necessary, which he would prefer, but he had no strong objections to the request. Steve Cordova presented an adjusted survey and conveyed his main concern about any problem with the distance between the house and the drainage. He conceded that the adjustment corrected the encroachment on the lot line and that he would like to withdraw his application. Lukes suggested that the application be tabled, in case a need for the variance were to be found as the project progressed. Lukes requested public input, none was forthcoming. Lukes moved to table the application until the May 1996 meeting. Cooper seconded. Motion passed unanimously. Case #96-07, Yvo Eneering, Lot 8 Holland Hills Subdivision. Lukes introduced the request for approval fora 92' arterial highway setback vaziance, where 200' is required as measured from the Highway 82 right-of-way, for the construction of asingle-family residence a • Schaffner indicated that this was a typical arterial highway setback, recalling the Boazd's approval of a very large berm at the foot of the property, stating that the applicant complies with all yard setbacks, but that the 200' setback requirement would not allow the applicant to build. Engering said that the berm did not yet exist, that he wanted to do all the work (berm and house) at the same time. No members of the public were present. Lukes expressed concern about the visibility of the proposed structure due to it being two stories with a pitched roof. The Boazd reviewed the blueprints for elevations. Cooper asked Engering if he would be willing to irrigate the berm. Engering responded yes. Dyer moved to grant approval of a 92' arterial highway setback vaziance, where 200' is required as measured from Highway 82 right-of- way, for the construction of a single- family residence in accordance with the plans shown due to downzoning with the proviso that the owner will provide irrigation and landscaping of the berm as shown on the plans. Brickham seconded. Schaffner questioned the timeframe for the irrigation. Dyer amended the original motion adding "prior to issuance of a Certificate of Occupancy". Brickham re-seconded. Motion passed 5-0. Rudnick moved to approve the minutes of the Mazch meeting, Cooper seconded, unanimously approved. A discussion ensued regazding making appropriate motions, with the conclusion being drawn that it is best to make motions for approval of vaziances, denying them if need be. If a motion fails it would be permissible for a Board member to frame a new motion regarding the same case. If no new motion is offered the case would be closed. Meeting adjourned at 6:15 PM.
