Rivers Family Trust ("Applicant") has applied to the Community Development Director of Pitkin County ("Director") pursuant to Section 3-190-080 of the Pitkin County Land Use Code ("Code"), for a minor amendment to a development permit to designate a "driveway improvement area" and to permit grading outside of the building envelope. Condition #4 of Administrative Decision No. 042002 prohibits development outside of the building and pond envelopes, which would include improvements to the driveway. However, improvements to the driveway were anticipated and represented during the previous review processes. Therefore, the Applicant is requesting to amend the Administrative Decision to permit driveway improvements within the designated area. 2. The property is located on Castle Creek Road, just south of its intersection with Conundrum Creek Road, and is described as Lot 2, LIES 113. 3. The lot is zoned AFR-10 and contains 13.35 acres. 4. The Director approved a Minor Plat Amendment pursuant to Administrative Decision No. 042002 to relocate the building envelope. The Board of County Commissioners allocated 5,000 square feet of floor area in the 2002 growth management competition for additional floor area, pursuant to Resolution No. 081 2002. The amended plat has not yet been recorded. 5. The Director finds that the request is consistent with the requirements of the Land Use Code. APPROVED by the Director, subject to the following conditions: The Applicant shall prepare an amended plat in accordance with Section 5.40 of the Land Use Code, which shall designate the revised "building envelope," a "pond envelope" around the existing detention ponds, and the "driveway improvements area." The plat shall be titled "First Amended Plat of Lot 2, HES 113." The plat shall also be submitted in digital format suitablefor integration into the County's GIS system. 2. REFERRAL COMMENTS: Comments from the Castle/Maroon Creek Caucus are addressed with the staff comments below and are attached for reference. STAFF COMMENTS: Pursuant to Section 3-190-080 of the Land Use Code, a subdivision exemption for a minor plat amendment is pennitted, subject to compliance with the following standards. A minor amendment is limited to technical or engineering considerations first discoveredduring actual development. The amendment increases or does not affect the degree of compliance with Code standards; Staff Comment: The proposed amendment increases compliance with the current Code by establishing a building envelope, within which all development will occur with the exception of the existing access road and detention ponds. The previously approved "building site"only identified the location of the residence while the location of other development on the site was not specified. In addition, the amended building envelope will avoid slopes in excess of 30%, while the "building site" included slopes in excess of 30%. The Caucus supports the proposed relocation of the envelope. The Applicant notes that there are three neglected and sediment -filled detention ponds on the property on the south side of the driveway (outside of the proposed building envelope) and requests the ability to improve the ponds in the future. Staff supports the applicant's suggestion to designate a separate accessory envelope around the ponds to accommodate improvements to the ponds. Any such development will require an eartlunoving permit from the County, which must be approved by the County Engineer and the Wildlife Biologist. 9 0 The Caucus notes concern with light pollution; the development will be required to comply with the County's exterior lighting regulations. .2. The amendment is being made to a recorded plat, which has been approved by Pitkin County; Staff Comment: The plat of HES 113 was approved by the BOCC in 1981 and is recorded in Plat Book 12 at Page 18. 3. The amendment is consistent with representations made during the conceptual and detailed subdivision reviews, whichever is applicable. Staff Comment: The proposed amendment is not inconsistent with representations made. There is no change in the approved density of one single family dwelling unit and accessory structures. RECOMMENDATION: Staff recommends approval of the Rivers Family Trust Minor Plat Amendment, based on compliance with the standards noted above and subject to the attached Administrative Decision. Pre -Application Conference Summary 0 0 0 Subdivision Exemption for a Minor Plat Amendment Lot 2, H.E.S. 113 Rivers Family Trust GENERAL This application is being submitted for a Subdivision Exemption for a Minor Plat Amendment pursuant to Section 3-190-080 of the Pitkin County Land Use Code. The application is submitted on behalf of the Rivers Family Trust, owner of Lot 2, H.E.S. 113. This property is part of a two -lot subdivision approved by the Board of County Commissioners on September 25, 1981. The plat is recorded in Piat Book 12 at Page 18. Conditions of approval were granting of utility easements; kenneling, fencing or control of dogs; and the requirement of a positive drainage plan and engineered foundation plan being submitted prior to the issuance of a building permit. When this property was originally subdivided and platted, a Building Site was delineated approximately in the middle (north to south) of the eastern third of the property, 30 feet away from the property line with the CJS Forest Service. The dimensions of the current Building Site are160 feet by 250 feet. At the time of approval, a Building Site was generally considered the area in which the building itself weuid be located and did not contemplate that all development related to the structure (well. septic tank, leach field, parking, etc.) or construction related disturbance (grading, landscaping) would be required within that Building Site. Also, it appears that detailed topography was not required as part of the approval process as there is no record of any topographical survey information being provided with the original subdivision application. In developing the plan for this home, a topographical survey was prepared. It was determined that a substantial portion of the approved Building Site had slopes greater than 30% It was also determined that the dimensions of the Building Site were such that there was no possible way to include a well and an ISDS within the specified Building Site. As mentioned above, such an inclusive nature of a Building Site was not customary at the time of approval. The applicant is hereby requesting to amend the plat to define a Building Envelope that would provide adequate space to incorporate ail of the above activities. Further, to move the proposed Building Envelope approximately 100 feet to the south so that all greater than 30% slopes are excluded from the developable area. The eastern edge of the proposed Building Envelope will remain 30 feet from the eastern property line. Additionally, there are three rather neglected and sediment -filled detention ponds now on the property. Although not located within the proposed Building Envelope, the applicant would like to reserve the right to improve these detention ponds in an effort to improve the associated riparian areas, enhance wildlife habitat, and to provide a water source to enhance the ability of the Aspen Volunteer Fire District to fight fires in this area. As part of this work, the applicant proposes to further screen the ponds from the access road with native vegetation. If required, an additional envelope could be created around the ponds to delineate the extent of the impacted area or the Building Envelope could be re -drawn to include this area. It should be noted that the location of the new house within the proposed Building Envelope is not substantially different than where it would be in the existing Building Site. The house is still located at a great distance uphill from Castle Creek Road and well shielded from the road by an aspen forest. The proposed location would bring the house closer to the existing access road reducing the amount of additional driveway needed 0 0 CRITERIA This application is to be reviewed under Section 3-190-080 of the Land Use Code which permits a minor amendment for technical or engineering considerations first discovered during actual development. As noted above, detailed topographical information was not available until it was requested by the applicant prior to design development of the house, Also, the distinction between a Building Site and a Building Envelope did not become apparent until well into the design process and after informational meetings with County staff. Section 3-190-080 lists three criteria that an application must meet to be granted approval. The criteria and the applicant's responses are: A. The amendment increases or does not affect the degree of compliance with Code standards. Response: The proposed amendment increases the degree of compliance with the Code. As noted above, the proposed Building Envelope would include all development on the property except for the access road and the detention ponds. This is in compliance with the current edition of the Code whereas the existing Building Site would allow for limited development such as a well or ISDS outside of that Building Site. Also, the proposed Building Envelope is completely free of slopes greater than 30% as now required. B. The amendment is being made to a recorded plat which has been approved by Pitkin County. Response: The proposed amendment is being made to the plat of a Board -approved subdivision as recorded in Plat Book 12 at Page 18 in the records of the Pitkin County Clerk & Recorder. C. The amendment is consistent with representations made during the conceptual and detailed subdivision reviews whichever is applicable. Response: The proposed amendment is consistent with the representations made during the original subdivision process. There is no change from the approved density of one single-family residence with appropriate accessory structures. The development will comply with all conditions of approval as noted on the recorded plat. The applicant believes that the amendment is being requested to address technical and engineering considerations as noted above and that the amendment satisfies the specific criteria listed in the Code. The following issues were discussed: Page 1 of'] 1. The establishment of a building envelope and its shift 100 feet to the south to avoid 30% slopes seems a good solution. 2. We are very cautious concerning the dredging of the ponds and feel that this should only be allowed with a specific permit (an earth moving permit) and under the watchful eye of the County Engineer and the County Wildlife Biologist. 3. We would also like to insure that the Pitkin County exterior lighting code is strictly adhered to, that is it be downcast and shielded. Although it states in the application that the house is well shielded from the road by Aspen trees, such is definitely not the case in the wintertime. Also houses with lots of big windows cause a considerable amount of light pollution in this very unpopulated valley. A case in point is the del Baso house. A very beautiful house. However at night its lights are omnipresent.
