BENEDICT'S MONASTERY ACTIVITY ENVELOPE AND SITE PLAN REVIEW FOR AN ONSITE SOLAR COLLECTOR Administrative Decision No&'�2018 RECITALS St. Benedict's Monastery (hereafter referred to as "Applicant") has applied to the Community Development Director of Pitkin County, Colorado ("Director") for Activity Envelope and Site Plan Review to construct a 205 KW onsite, ground -mounted solar collector for the power usage on the Property. 2. The Parcel is located at 1012 Monastery Road and is more specifically described in Exhibit A. PID#: 2643-351-08-002. 3. The property is approximately 2,255.85 acres, and is in the RS -30 zone district, and is conforming in size. 4. The property is currently developed with 14 primary buildings that include the gate house, 7 retreat hermitages, Retreat Center House, ranch houses, main Monastery, the eggery and a number of maintenance, hay barns, bams and out buildings. 5. The proposed Activity Envelope of approximately 30,000 square feet sits just behind the main Monastery building to the South and East near the maintenance shed behind a small ridge. The location is a grassy area with some small patches of sage brush (the greenhouse was located in this area previously). The solar collector and accessory components will be located within the envelope that will be fenced. 6. The solar collector is comprised of 5 rows of tables that contain 20 modules (solar panels) per table. The two northern rows contain 7 tables and 140 modules each. The third row from the north contains 6 tables and 120 modules. The forth row from the north contains 5 tables and 100 modules. The fifth row from the north contains 4 tables (and a partial table) and 88 modules. The Application was referred to the Snowmass/Capitol Caucus. The Caucus had no objection. 8. The Director finds that the Site Plan complies with the applicable provisions of the Land Use Code ("Code"), as follows: a. The solar collector and accessory uses are located within an Activity Envelope that avoids slopes in excess of 30%. b. The envelope and PV system are located in a predominantly grassy area with some sage brush patches. It is located directly adjacent to existing development within a previously disturbed area and there are no existing trees within the envelope. c. The envelope and PV system are located behind a small ridge and cannot be seen from Capitol Creek Road or neighboring properties. d. The proposed ground mounted solar collection device is an accessory use to the Monastery. 9. The Director further finds the Solar Energy Collector will be used primarily to offset the onsite energy usage, and complies with Sec. 4-30-50(i). The system was designed by Holy Cross and Sunsense to produce enough energy to match the annual cost of the Monastery's usage. The average annual costs (with taxes and fees) accrued by the Monastery Property is approximately $30,000 a year (based on Administrative Decision Na,�2018 Page 2 2016). The system is designed to generate approximately $30,000 per year in Photovoltaic credit. The solar collection device will be privately owned by the St. Benedict's Monastery. 9. Public notice mailings were sent to property owners within 300' of the subject property on April 9, 2018 and a Public Notice Sign was posted on the property on April 13, 2018. No objections were received within 30 days. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successor in interest: The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. The conditions of BOCC Resolution Nos. 92-382 and 99-73 shall be adhered to except as amended herein. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. 4. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 5. Ground mounted solar energy collectors and other ancillary development (racking assembly, balancing system, utility boxes, etc.) shall have a "matte" finish or be of a non -reflective material/color. Equipment that is painted shall be maintained. 6. Ground mounted solar collectors shall be limited to twelve (12) feet in height. 7. At building permit application, the Applicant shall: a. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. 8. The Applicant shall comply with the following general conditions regarding wildlife: A. Manipulation of vegetation outside of the Activity Envelope is prohibited. B. The fence shall comply with the recommendations of Colorado Parks and Wildlife. The fence will be an 8' tall mesh wildlife fence. C. Access shall be provided to the Colorado Parks and Wildlife for trapping, tagging, studying, or otherwise managing wildlife. D. Trash/garbage shall be kept in an approved bear resistant container or enclosure. These containers shall be accessible to and used at all times by contractors on site. E. Dogs are prohibited during construction. 9. No development shall occur outside the approved activity envelope. No structures shall be permitted outside of the approved activity envelope. 10. By January 30 of each year, the Applicant shall be required to provide an annual energy usage report from Holy Cross to the Community Development Department. In the event the annual photovoltaic production Administrative Decision No5R-2018 Page 3 credit significantly exceeds the annual usage cost by comparison, the Applicant would be required to submit an application for Special Review for a Solar Farm. 11. No calculations for height, bulk, setbacks, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit review. Structures represented in the application might not be permitted under building and zoning regulations. 12. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site. The fencing shall remain in place until final inspection. 13. All areas disturbed by construction shall be re -vegetated with native shrubs and grasses within one growing season of the project's completion. 14. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2-20-170 and C.R.S., § 24-68-105. The ground mounted solar array will be privately owned by St Benedict's Monastery and is sized to produce the equivalent amount of energy that is used on the multiple meters located around the Monastery property. Although the solar array is not "net metered", as it will be interconnected to the Holy Cross grid under the "generation tariff", as the nearest energy user in the vicinity, much of the energy produced will be used by the Monastery. The kilowatt hours produced by the solar array will be purchased by Holy Cross Energy. No energy will be sold by St. Benedict's Monastery to any other user. Existing conditions: As demonstrated on the attached site plan, the activity envelope encompasses an area large enough to accommodate the solar array, plus a code mandated fence, and surrounds the Holy Cross three phase utility interconnection location. The envelope also incorporates access ways to construct and service the photovoltaic system. The proposed activity envelope does not include any geologic hazards and is free from steep slopes, potentially unstable soils, floodplain and significant drainage channels. Standards Report: Sec. 7-10-50: Activity Envelope and Site Plan See 24"X 36"and 11" X17" Activity Envelope and Site Plan Review. Sec. 7-20-10: Site Preparation and Grading Site preparation simply involves mowing the existing grasses and shrubbery. The site will not need to be grubbed or graded in order to construct the solar array. The foundation points of the solar mounting structure will be screwed directly in to the ground with no preliminary excavation required. Sec. 7-20-20: Steep and Potentially Unstable Slopes (cannot be located on slopes > 30%); As demonstrated by the attached topographic survey, slopes within the activity envelope do not exceed 30%. Sec. 7-20-80: River Stream Corridors and Wetlands There are no river stream corridors or wetlands in the proposed activity envelope. Sec. 4-30-50(h): Solar Energy Collector Solar energy collector specification and design are in compliance.
