The Martinez family attended two public meetings on the request, had diagrams of the lot and home at each meetiung (with no opposition) and provided a thirty page set up manual for this home. I have enclosed the January 2, 1997 Plans Approval, the Permit Record and the Permit Application from Pitkin County. The Martinez family has deposited $3,500 with Capital Housing in Grand Junction for this new home, and had scheduled the removal of the old home by the Capital Housing this week. The new home is sitting in Grand Junction ready to be moved to Lary Glen. I understand that Lot 58 installed a new mobile home last summer with a six foot setback, and the Martinez family is asking for the same variance. I am requesting the opportunity to appear on behalf of the Martinez family and seek approval for a'six foot set back on placement of the trailer on Lot 61. I understand that the next meeting of the Board is on February 13, 1997, at 7:30pm. I am able to appear on that date. Adger on behalf of Pedro Martinez. You may recall that the BOCC required that Lazy Glen adopt minimum standazds, which it did last summer. Also, by letter dated August 15, 1996, you informed the Lazy Glen Homeowners of the County'd requirements, including a 10-foot setback limit. It is my understanding that, contrary to the applicable requirements of Pitkin County and the Lazy Glen Homeowners Association, Mr. Martinez has been granted a variance from the 10-foot side yard set rack requirement, to relocate a new home in Lazy Glen Mobile Home Pazk. If this is the case, it appears to be contrary to the requirements which you specifically requested that the Homeowners Association adopt and enforce. Perhaps there is a misunderstanding on what has actually occurred. In order to assist us in reaching an understanding regazding this situation, please provide me with whatever written information you may have regarding applications submitted by Mr. Martinez to Pitkin County for a side yazd setback variance from 10 feet to 6 feet in order to locate a new home on Lot 61 in the Lazy Glen Mobile Home Park. It is not clear if this included approval of a setback variance, and perhaps that is where the confusion resides. Finally, please let me know if you informed Mr. Martinez at the flme of County approval that he also needed approval from the Lazy Glen HOA. Both parties aze interested in resolving this matter as soon as possible, so I would appreciate your cooperation in providing me with this information as soon as you can. Fmm a fire suppression perspective, [ would recommend against reduced spacing. From a fire prevention angle, replacing the existing trailers would be more efTective. [wilt accept reduced spacing for these applitarNons based nn the concept that fire prevention is much more effective than fire suppression. The concerns that the Fire Distrlct}iAit aR Roar the effects of close spacing between trailers. As the distance degreases, the cJtattce Of a fire in one, spreading to the adjacent trailers increases: 7ltere also is'a related danger if' the close spacing prevents firefighters from gaining access do all sides of the trailer to attack the fire. 'T'his said, there are already a number of lots in the Lazy Glen Park that are at Least this close and others which have fences all the way amund them, hampering access. From a review of the applications, there is probably a greater danger from the existing trailers due to their alleged poor aandition. if the current trailers arc in such poor shape, it would appear that upgrading the trailers would reduce the chance of a tiro occurring in those units, possibly spreading to the adjacent units. 't'here ate no fire codes that prevent such spacing. The only requirements that generally show up arc increased hydrant tTows to meet the demand of multiple units burning. Since the TJFC has not been adopted by Yitkin County, those rcyuircments are not mandatory, only suggestions. Lazy tiler does have dry hydrants in the park but no hydrant system. Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following fmdines: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. C'se #96-23 J Francisco Martinez Lot 59 ~ Glen Application Withdrawn C age #9(_._74, Aspen Village Homeowners Association. .0 5 Aspen Village Lukes introduced the request for a T side yazd setback variance, where 10' is required, for the placement of a mobile home. Richazd Jackson was present as the representative of the Homeowners Association and stated the new trailer would sit in the same location as the one being removed. This location was chosen so that the wooded azea at the back of the lot and the viewplane from the other homes would remain undisturbed. The new home would be 2' wider and 16' longer than the old one. John Hayes, the owner of 39 Aspen Village, asked how faz from the reaz lot line the trailer would be placed, was told that it would be more than 10', and indicated his acceptance of that proposal. No other members of the public were present to comment. Discussion ensued regazding potential alternative placement and the distance between structures on the lot. Cooper moved to approve a 7' side yazd setback variance, where 10' is required, for the placement of a new mobile home, due to the unusual narrowness and shallowness and shape of this piece of property. Brickham seconded. Cooper, Brickham, and Geller voted aye; Lukes and Rudnick voted nay. Motion failed 3-2. Lukes moved to approve a 5' side yazd setback variance, where 10' is required, for the placement of a mobile home, due to the narrowness and irregulaz shape of the lot. Cooper seconded. Motion passed unanimously. Lukes indicated that, with the addition of Wheeler, the voting would now rotate between the alternates, with Geller voting on the next case, then Rudnick, etc. Lukes introduced the request for approval for the constmction of an identification sign adjacent to Highway 82, 78.5 squaze feet (which includes both sides of the sign) being requested, where 6 square feet is allowed. Schaffner showed a revised plan that reduced the size of the sign to a total of 56.58 squaze feet, therefore the variance request is for 50.58 squaze feet. The location of the sign would be that of the current sign, as anon-conforming pre-existing location. Steve Seyffert and Dick Bradley were present as representatives of the Inn at Aspen. Seyffert explained that the colors and logo of the Inn had recently been changed, and that 70% of their customers, asfirst-time guests, need the increased visibility of the proposed sign to recognize the entrance to the Inn to safely negotiate the turn off of Highway 82. The remainder of their clientele is "drive-by" and visibility and recognition of the sign is crucial to that aspect of their business. Seyffert indicated that the sign would be lit by two 75 watt lights from the ground on either side of the sign. There were no members of the public to comment on this case. Cooper commented that the stretch of Highway 82 fronting the Inn at Aspen is one of the most dangerous stretches in terms of entering/exiting the highway. Wheeler moved to approve the application as submitted, based on apre-existing condition and a reduction in the height from 7' to 4'. Cooper seconded. Wheeler, Cooper, Geller, and Brickham voted aye. Lukes voted nay. Motion passed 4-1. Lukes introduced the request for approval fora 20' reaz yazd setback variance, where 50' is required, on a 35 acre parcel. Schaffner said that the pazcel had received 1041 approval with an approved building envelope, that the property is an awkwazd shape with extremely steep cliffs, and the building pretty much needs to go where it's proposed. Steve Elliott and Glenn Horn were present and reiterated that because of the steep cliffs there really is no other location to place the structure. Hom noted that the BOCC had approved the footprint in which the building must go, which is more restrictive than a building envelope. No public comment was forthcoming. Schaffner reminded the Boazd that Lazy Glen is currently zoned as an SR zone and that an effort is underway to rezone it. The applicant has represented that there aze no new mobile homes being manufactured today that aze as small as the one being removed, and, with the small-sized lot, some sort of variance would need to be approved in order to accommodate a new mobile home. Luker read a letter from Steve Howazd, the Chief of the Basalt & Rural Fire Protection District, stating his support of fire prevention (having a new mobile home) as being more effective than fire suppression (greater distances between structures), noting the greater danger from the existing trailers due to their poor condition, and that an upgrade in trailers would likely reduce the chance of fire occurring. Howazd added that there aze currently no fire codes adopted by Pitkin County that prevent tight spacing. Luker stated his concern that the Lazy Glen Homeowners have much to accomplish prior to their desired rezoning, one of which is to upgrade the fire hydrant system. He suggested tabling this application until cleazer guidelines aze available. Wheeler referred to the size of the proposed trailer (1196 squaze feet) as opposed to the existing trailer (768 squaze feet) and said he would feel more comfortable if the requested FAR were closer to the existing squaze footage. Jose Martinez was present and conveyed that he had not yet purchased a new trailer, that his daughter had experienced health problems due to the condition of the existing trailer, and that he believed that the proposed trailer was the smallest available. Wheeler reiterated that he would entertain granting variances for a new mobile home that was smaller and closer to the existing FAR based on safety issues. He asked that staff reseazch the sizes of mobile homes available on the mazket today. He agreed that tabling the application until size information was available would be a good idea. Luker moved to table the application until the next special or regulaz meeting of the Boazd of Adjustment, whichever occurs first. Cooper seconded. Motion passed unanimously. ######################################################################## Brent Gazdner Smith, Rob Baxter, and Jim Wazd were present representing the Aspen Skiing Co.. They indicated that the BOCC had just approved the construction of a radio tower that would require a height variance, that time was of the essence to begin construction, and that the public noticing requirements were such that they were requesting a special meeting of the Board of Adjustment to be held October 15, 5:15 PM, in the Pitkin County Library meeting room. The trio gave a preliminary overview of the project and received approval for the special meeting. Wheeler expressed his concern about routinely absent Boazd members. It was felt that regulaz attendance is important and that those who do not regulazly attend should be removed from the Boazd. Lukes noted that it would not be necessary to replace a razely- participating member at this time as the current number of Boazd members is adequate. Meeting adjourned at 7:50 PM.
