HomeMy WebLinkAboutMarijuan Licensing Prohibition Attachments AN EMERGENCY ORDINANCE (AS AMENDED)OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,COLORADO, AMENDING TITLE 6 SECTIONS 6.48.070(C) (15)AND 6.49.070(C) (15) AND (16) OF THE PITKIN COUNTY CODE (MARIJUANA REGULATIONS)EXTENDING THE PROHIBITION OF ISSUANCE OF LICENSES IN CERTAIN CAUCUS AREAS UNTIL JULY 15, 2018 AND AMENDING LANGUAGE AS IT PERTAINS TO THE SNOWMASS CAPITOL CREEK CAUCUS AREA ORDINANCE NO. e1/ -2018 Affitek RECITALS: 1. Pursuant to 30-35-301 C.R.S., the Board of County Commissioners ("BOCC") of Home Rule Counties is authorized to make and publish ordinances for carrying into effect or discharging the powers and duties conferred upon such counties by law and as seems necessary. 2. Pursuant to Section 2.8.2 of the Home Rule Charter("HRC"),the Board of County Commissioners is authorized to take official action by Emergency Ordinance for certain matters where action is prescribed pursuant to the Colorado Revised Statues as amended. 3. Pursuant to Ordinance No.002-2015, a moratorium was re-established prohibiting issuance of marijuana licenses in the Snowmass-Capitol, Frying Pan, Woody Creek and • Emma Caucus areas and any marijuana retail store license in the Town of Redstone (Village Commercial District) in the Crystal River Caucus until February 15, 2018. 4. Pursuant to Resolution No.107-2016, the Upper Snowmass Creek Caucus was formed after Ordinance 002-2015 went into effect. 5. Pursuant to Resolution No.037-2015, the Maroon Creek Caucus was formed after Ordnance No. 002-2015 went into effect. 6. The BOCC has determined that in order for all caucus representatives to have an opportunity to take this matter to their respective caucus membership for discussion that • it would be appropriate to extend the prohibition of issuance of licenses in certain caucus areas until July 15, 2018. 7. At the BOCC regular meeting of February 14, 2018, the BOCC amended the ordinance and the language in Title 6 Sections 6.48.070(C) (15)and 6.49.070(C) (15)and (16) by extending the expiration date to July 15, 2018. Additionally, it authorized amendments to language in the same sections to not allow issuance of any retail marijuana store, medical marijuana center or infused products manufacturing facility in the Snowmass Capitol Creek Caucus area. That issuance of any marijuana cultivation facility license shalt be by special review by the Board of County Conunissioncrs and the Snowmass Capitol Creek Caucus. 8. The BOCC finds that adoption of this ordinance is necessary for the immediate preservation of the public health, safety and welfare of the citizens of Pitkin County and therefore,declares this ordinance and legislation to be effective immediately pursuant to HRC Section 2.8.2. NOW,THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that: 1. It hereby confirms, with amendments,an Emergency Ordinance of the Board of County Commissioners of Pitkin County, Colorado, Amending Title 6 of the Pitkin County Codc (Marijuana Regulations) Extending the Prohibition of Issuance of Licenses in Certain 4 Caucus Areas until July 15, 2018 2. Authorizes amendments to Sections 6.48.070(C)(15) and 6.49.070(C) (I5) and (16) (as attached) to not allow issuance of any retail marijuana store, medical marijuana center or infused products manufacturing in the Snowmass Capitol Creek Caucus area. Ellen has Tim Malloy working on something for us as a Master Plan update (not really sure what), but he has a list of issues that we developed at an annual meeting. So far, I have received 18 comments favoring prohibition. I have received one comment(not from Wilcox!)favoring a retail location at Ashcroft, and one opposing a grow facility which involves structures but favoring allowing an outdoor grow facility. Responses have dropped off, so I am not expecting a lot more from the membership. Traditional ranching and farming as practiced in Woody Creek are low-impact land uses that merge with private residential and public areas. The Woody Creek Caucus has consistently discouraged any new or expanded commercial activity in Woody Creek." The Woody Creek Caucus does not consider private use or the legally allowed growing of 6 plants per adult as part of the Marijuana Moratorium. "The distinctions between traditional greenhouses and commercial growhouses are is significant at this time because of the proliferation of marijuana production facilities throughout the area. These operations are commercial by definition and have serious impacts when placed in residential areas. In Woody Creek they are also inconsistent with our long held limitation on commercial expansion." We have recommended size limits for residential greenhouses and that industrial growhouses of any kind be prohibited. We believe open field marijuana grow operations do not fit into traditional agriculture due to the State of Colorado statutes that require security fencing, lighting, and other security measures and the inability to control noxious odors, fertilizer and chemical impacts on water and wildlife, and the increased traffic associated with such a commercial operation. There are further references in the Woody Creek Master Plan (Agricultural Section, Commercial/Public Section, and Preferences of the Woody Creek Community Section) regarding our desire to maintain the Marijuana Licensing Moratorium.
