This sale was not included in the petitioner's comparables and it would have affected his findings. My suggestion is there be no change to the assessor's valuation. Board of Equalization, I looked at a number of attached residential sales in the West Aspen area near Cemetery Lane where the subject is located in an effort to find comparable sale data, which was reduced to the 5 comparable sales used. The Subject's 2,656 finished square foot size is in the middle of the comparable sales I used which were in the range of 1,597 to 3,138 square feet. The sales are all attached/condominium type properties so that subject's lot size is not taken into consideration beyond premium adjustment, if warranted. In terms of year of construction, the sales ranged between 1955 and 2006 with the subject having been built in 1996. The effective ages of the sales used range from 1995 to 2007, with the subject's effective age listed as 1995. There are, however, negative conditions present in the subject property as of January 1, 2017, which I considered when making adjustments in the sales comparison grid. The 2015 assessed value was originally $2,505,100 which was reduced to $2,370,000 as a result of my abatement/refund petition. I believe the reason for the stipulated 2016 assessment value reduction was the result of negative condition issues which still have not been addressed according to the owner. As of January 1, 2017, the owner maintains that little was done to the property other than maintenance and cosmetic stuff, such as painting and decorating to the property, in the last couple of years. As an external negative factor, the owner complains about the traffic on Cemetery Lane which he describes as a nuisance. In selecting the comparable sales used, I felt it was most important to find attached residential sales in the subject's immediate area in as close proximity to the subject as possible, that have similar age, utility, size, and garage situation. Luckily, there was an adequate number of sales during the base sale period from which to choose from. The sales used are all within a reasonable distance of the subject. In making my adjustment for time, I used an annual +1.80 percent TASP factor that I derived from linear regression analysis of base period sales in Pitkin County. In the attached Sales Comparison Grid, I looked at 12 sales, other than the subject property, in the West Aspen area focusing on attached residential properties located in and around Cemetery Lane with similar square footage, age, utility, lot sizes, basement size, basement finish, and garage situation. The indicated value range for the subject is $2,375,798 to $2,937,527. Sales 3 and 4 are considered the best sales because of small net adjustment and the fact their indicated values bracketed the subject's indicated value. Sales 1 and 2 are the next best because of small net adjustments and the fact they bracketed the subject's indicated value. Sale 5 is helpful in determining the indicated value for the subject. An annual TASP adjustment of +1.80% was used based on linear regression analysis of properties in the subject's area and price range. The TASP analysis may be seen elsewhere in the report. From my review and analysis of the subject, I estimate the value of the subject property for tax assessment purposes, as of June 30, 2016 to be $2,665,000.
