RECITALS
I. On May I",2018,the Planning and Zoning Commission("Commission")held a duly noticed public
hearing,at which time evidence and testimony were presented with respect to Urban Area Growth
Management applications.
2. The Commission reviewed the following application for the 2018 Urban Area GMQS competition for
additional floor area
• Wendy C Hendrickson Family Endowment Trust(Case P004-18): Chris and Wendy

I lendrickson requested 2,6W square feet of additional floor area for construction of a basement
located at 130 Primrose Path which is legally described as Block I, Lot 7. Filing I of the
Meadowood Subdivision
3 There are 10,000 square feet of floor arca available in the Urban Area. The Applicant requested 2,610
V square feet. The Commission accepted the Staff proposed scoring of 14 points.
4. Pursuant to Section 2-30-40 of the Code, the Commission's scores were forwarded by Resolution to
the Board of County Commissioners("BOCC")on May q'°, 2018
\yy' NOW,THEREFORE BE IT RESOLVED to, the BOC C that it does herehy allocate a total of
2,610 square feet of floor area to the Wendy C Hendrickson Family Endowment Trust application
1 This allocation is conditioned upon recordation of a covenant documenting the representations made in
the application for the additional square footage. This covenant shall be rev iewed and approved by the
Community Deyelopment Department and recorded against the property, prior to issuance of a building
permit to utilize the awarded floor area
2. Statutory'vested rights for the approy al contained herein are granted pursuant to the Pitkin Count}
',- Land I Re Code and Colorado Statutes, subject to the exceptions set forth in the Pitkin County I and
Use Code ¢ 4-140 and CRS , § 24-68-105 The statutory N ested rights granted herein shall expire
on Ma} 23"1, 2021.
