The Applicant's property is the Star Mesa Bradford Parcel and is zoned RS -20 PUD. It contains 36.31 acres, per the County Assessor's records, and is more fully described on Exhibit A hereto. 3. The CDU proposed by the Applicant will be limited to no more than 1,000 net livable square feet of floor area. The Applicant will deed restrict the detached CDU pursuant to Subsection 9-110-041(C)(2)(c). 4. The property previously received Special Review approval for a 500 sq. ft. Employee Dwelling Unit ("EDU") within an agricultural building under BOCC Resolution No. 86-60 (Book 514, Page 737). The deed restriction for the EDU was never recorded. The agricultural building that was to house the EDU is now being converted to a residence. 5. The property recently received 1041 approval "at building permit." See Book 71, Page 48. 6. Applicant has provided an Affidavit of Mailing to confirm compliance with the Land Use Code's notice requirements for Special Review of a detached CDU. No objections to the CDU were received by Community Development within the time period allowed under the Land Use Code. 7. The application was referred to the Pitkin County Housing Office. The Housing Office recommended approval under specified conditions contained in this Determination. 8. The Director finds that the detached CDU complies with applicable standards of the Land Use Code found at Subsections 3-210-020 and 9-110-041(C)(2). THE DIRECTOR DOES HEREBY APPROVE the Payne Gulch LLC request for a detached CDU, subject to the following conditions: The detached CDU shall not exceed 1,000 net livable square feet of floor area. The kitchen for the CDU shall contain at least a two -burner stove with oven, standard sink, and at least a 6 cubic foot refrigerator plus freezer. A minimum of • one off-street parking space shall be provided for each bedroom in the CDU and for each bedroom in the principal residence. 2. The deed restriction for the CDU shall be obtained by Applicant and recorded prior to issuance of a building permit for the CDU. 3. Upon completion of the CDU, but prior to issuance of the Certificate of Occupancy, Housing Office staff shall be entitled to conduct an inspection of the CDU for compliance with the above -referenced requirements. 4. The CDU shall be constructed within the 1041 building/development envelope designated on the 1041 Hazard Review Site Plan for the property recorded at Book 71, Page 48, and shall be subject to all of the terms and conditions noted on such site plan. BOCC Resolution No. 86-60 is hereby revoked in its entirety and shall be of no further force or effect with respect to this property. 6. Applicant shall adhere to all material representations made in the application. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. BACKGROUND: According to Section 9-110.041(C) of the Pitkin County Land Use Code, a Caretaker Dwelling Unit in the R-30, AFR-2, AFR-10, RS -20, RS -30 and RS -160 zone districts are allowed up to 1,000 square feet as long as the following conditions are met: a. The floor area of the caretaker unit shall be included in the total allowed floor area for the lot or parcel of land. b. There shall be provided one off-street parking space for each bedroom within the principal dwelling and one off-street parking space for each bedroom in the caretaker unit. c. The applicant shall, by deed restriction or other permanent commitment running with the land, guarantee that the caretaker unit shall not be required to be rented; not be sold or otherwise conveyed or separated from the original parcel regardless of the ultimate form of ownership of the caretaker unit; be limited to occupancy by not more than two adults and related children, who qualify as (and have been found by the Housing Authority to be) employees of the community under such guidelines as may be from time to time established by said authority; be rented for terms not less than six months if rented. The caretaker dwelling unit may be occupied by members of the immediate family (as defined in Section 8-1), even though they may not qualify as employees of the community. d. The caretaker dwelling unit restriction may be removed by the property owner upon approval of the Coininunity Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a dwelling unit and must meet otherwise applicable Code requirements. The provisions of this regulation are for the purpose of providing a voluntary unit (or units) on a legally created property in the County. Any unit granted under this provision of the Code shall not be used for mitigation of employee housing requirements as established elsewhere in this Code. RECOMMENDATION: Staff recommends approval of this request under the following conditions: 1. The unit is less than 1000 square feet. 2. Conditions a through d stated above are met. 3. The kitchen contains at least a two -burner stove with oven, standard sink, and at least a 6 - cubic foot refrigerator plus freezer. 4. The deed restriction shall be recorded prior to building permit approval. 5.
