HomeMy WebLinkAboutWilloughby Ponds Public Comment - Horn Davis Hom PLANNING & REAL ESTATE CONSULTING December 5, 2018 Board of County Commissioners 530 East Main Street Aspen, Colorado 81611 Re: Willoughby Ponds Trust Minor Amendment to a Development Permit, Subdivision Exemption for a Lot Line Adjustment and Minor Plat Amendment, and Activity Envelope and Site Plan Review of Lot 6 Dear Board Members, Ponds LLC is the owner of a single family dwelling until located at 109 Willoughby Way (Lot 1, Tract 1 Troyer-Trousdale Subdivision, parcel ID # 2737-072-241-001) which is located north and across Willoughby Way from Willoughby Ponds Subdivision Lot 6 (2737-072-06-006). Ponds LLC ("Neighbor") is represented by Garfield & Hecht and Davis Horn Incorporated in this letter. The Neighbor's house has excellent south facing views of Aspen Mountain. Willoughby Ponds Subdivision Lot 6 is located in the foreground of Aspen Mountain. The Willoughby Ponds Trust ("Applicant") has worked cooperatively with the Neighbor to insure the proposed house and associated landscaping is planned to minimize impacts to the Neighbor's views of Aspen Mountain. The Applicant has sited the house as depicted by the Lot 6 Activity Envelope and Site Plan L-4 (Attachment 1) to keep the house generally to the east of the Neighbor's view plane. The Neighbor supports the Applicant's proposed Lot 6 Landscape Plan L-6 (Attachment 2). New trees are not proposed within the Neighbor's Aspen Mountain view corridor. The Applicant has agreed to a Restricted Planting Area outside of the approved Activity Envelope on amended Lot 6. If new landscaping is proposed within the Restricted Planting Area in the future, the owner of Lot 6 shall mail notice of the plan to the owner on record of 109 Willoughby Way prior to obtaining any necessary approvals or permits for the work. The Applicant has further committed that any future landscaping within the Restricted Planting Area shall not exceed 25' in height. The intent of the Neighbor's and Applicant's efforts is to insure the protection of the Neighbor's Aspen Mountain views.
