COUNTY, COLORADO, GRANTING APPROVAL OF THE AUGER MINOR PLAT
AMENDMENT AND SUBDIVISION EXEMPTION FOR CREATION OF AN OPEN
SPACE PARCEL

RECITALS
1. Raymond and Camilla Auger("Applicant")has applied to the Pitkin County Board of
County Commissioners("BOCC") to consider a Minor Plat Amendment and Subdivision
Exemption for the Creation of an Open Space Parcel pursuant to Sections 3-190-050 and
3-190-080 of the Land Use Code.
2. The property is located at 737 North Spruce Street and is more specifically described as Lot
3 of the Cora Lee Subdivision.
3. The property is zoned AFR-10 and contains a total of 3.639 acres.
4. The Applicant intends to convey 1.0 acre of the property to Pitkin County.
5. The Planning and Zoning Commission considered this application on September 3, 2002,
and recommended approval.
6. The BOCC heard this application at a duly noticed public hearing on October 23,2002, at
which time evidence and testimony were presented with respect to this application.
7. The BOCC determined that purchase of the open space parcel is in the common interest of
Pitkin County and its residents.
8. The BOCC has determined that the proposed development meets the criteria established in
Sections 3-190-050 and 3-190-080 and therefore found the proposal to be appropriate.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that it does hereby approve the Auger Minor Plat Amendment and Subdivision
Exemption for the Creation of an Open Space Parcel subject to the following conditions,which
shall run with the land and be binding on all successors in interest.
1. The applicant shall submit a Minor Plat Amendment and Subdivision Exemption plat to
the Community Development Department for approval and recording, within 90 days of
approval. The plat shall prepared in accordance with Code Section 5-40 and shall be
submitted in digital format for integration into the County's GIS system.

2. Further development on the remaining 2.639 acre parcel shall be subject to any other
applicable reviews pursuant to the Land Use Code.
3. The Applicant shall adhere to all conditions and material representations made in the
application and public meetings except as amended herein.
4. Statutory vested rights for the approval contained herein are granted pursuant to the
Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth
in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested
rights granted herein shall expire on October 23, 2005.
