AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY,COLORADO,GRANTING AN EASEMENT TO HOLY CROSS ENERGY
ON THE PITKIN COUNTY SERVICE CENTER PARCEL TO FACILITATE A BUS
ELECTRIFICATION PROJECT PROPOSED BY THE ROARING FORK
TRANSPORTATION AUTHORITY("RFTA")
ORDINANCE NO. Q/I1 -2019
RECITALS
WHEREAS,Pursuant to 30-35-301 C.R.S.,the Board of County Commissioners("BOCC")of
Pitkin County,Colorado a Home Rule County is authorized to make and publish ordinances for
carrying into effect or discharging the powers and duties conferred upon such counties by law
and as seems necessary, and
WHEREAS,Pursuant to Section 2.8.1 of the Home Rule Charter("HRC"),the BOCC is
authorized to take official action by Ordinance for certain matters where action is prescribed
pursuant to the Colorado Revised Statutes as amended,and
WHEREAS,Pitkin County is the owner of certain real property legally described as the Pitkin
County Public Works Property, Subdivision Exemption Plat of the Pitkin County Service Center
recorded in the Pitkin County records in Book 58,Page 11.
WHEREAS,The BOCC desires to grant an easement as described in Exhibit"A"(Parcel A
Electric Easement)as attached hereto,to Holy Cross Energy to facilitate a bus electrification
project that RFTA is proposing.
WHEREAS,The Board finds that adoption of this ordinance is necessary for the immediate
preservation of the public health,safety and welfare of the citizens of Pitkin County and
therefore declares this ordinance and legislation to be effective immediately upon adoption.
NOW,THEREFORE,BE IT ORDAINED by the Board of County Commissioners of Pitkin
County,Colorado that it hereby adopts an Easement(as described in Exhibit"A"attached
hereto)to Holy Cross Energy on the Pitkin County Service Center Parcel to Facilitate a Bus
Electrification Project proposed by RFTA,and authorizes the Chair or the Chair's designee to
sign the Ordinance and upon the satisfaction of the County Attorney as to form,execute any
other associated documents necessary to complete this matter.

ELECTRIC EASEMENT
A 10 foot wide strip of land lying in the southeast one-quarter (SE1/4)of Section 34,Township 9 South, Range 85
West,of the 6th Principal Meridian,County of Pitkin,State of Colorado,being a portion of Pitkin County Public Works
Property,SUBDIVISION EXEMPTION PLAT OF THE PITKIN COUNTY SERVICE CENTER,Pitkin County Records,
lying 5 feet on each side of the following described line:
COMMENCING at the southeast corner of said Pitkin County Public Works Property; thence S58°55'12"W, 298.05
feet along the southeast line of said Pitkin County Public Works Property to the Point of Beginning;
thence N35°29'34"W,27.80 feet to the Point of Terminus.
The sidelines of said 10 foot wide strip are to be lengthened or shortened to terminate on said southeast line.
Parcel A contains 278 square feet,more or less.
For the purpose of this description, bearings are based on said plat of SUBDIVISION EXEMPTION PLAT OF THE
PITKIN COUNTY SERVICE CENTER.
