COUNTY, COLORADO, APPROVING THE FILOHA MEADOWS SUBDMSION EXEMPTION

RECITALS
1. Pitkin County ("Applicant") has applied to the Board of County Commissioners of Pitkin County,
Colorado ("BOCC") to subdivide the Filoha Meadows property into two separate parcels: a 50 acre
conservation parcel east of the Crystal Riverand a 13 acre parcel development parcel, that includes the
existing residence and resort cabins located between the highway and the river and the existing
greenhonse and waterwheel located on the east side of the river.
2. The property is zoned RS-30 and contains approximately 63 acres.
3. The property is located on the east side of Highway 133 along the Crystal River md to the south of the
Penny Hot Springs and Hot Springs Ranch, and is more specifically described in Exbibit A.
4. The BOCC approved the acquisition of Filoha Meadows pursuant to Ordinance No. 13-2002. The
property was once part of the Kelly Grange Ranch that also included the Hot Springs Ranch that the
Connty purchased last year. Once the acquisition of Filoha Meadows is complete, the property will
remerge with the Hot Springs parcel and constitute a contiguous 185-acre meadow that is highly visible
from the Highway 133 Scenic Byway and contains critical winter range for big born sheep and elk.
5. The Community Development Director approved a lot line adjustment between the Filoha Meadows and
the adjacent property to the south. The lot line adjustment will mable the County to acquire a portion of
the former Crystal River Railroad Grade as part of the Filoha acquisition. Open Space and Trails
proposes to accommodate seasonal public recreational access along the railroad grade from the north
end of Redstone Boulevard through to the Hot Springs Ranch open space parcel. The lot line
adjustment was recorded in Plat Book 64 at Page 6.
6. The BOCC reviewed the application at a duly noticed public bearing on February 12, 2003, at which
time evidence and testimony were presented witb respect to this application.
7. Tbe BOCC finds that tbe application is consistent with the applicable provisions of the Pitkin County
Land Use Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com~nissioners of Pitkin
County, Colorado, that it does hereby approve the Filoha Meadows Subdivision Exemption, subject to the
following conditions, which shall run with the land and be binding on all successors in interest:
1. The applicant shall submit a Subdivision Exemption Plat to the Com~mnity Development
Department for approval and recording, within 90 days of approval. The plat shall also be
submitted in digital format for integration into the County's GIS system.
2. Further development on the 13 acre parcel shall be subject to 1041 hazard review and any other
applicable reviews pursuant to the Land Use Code.

3. The Applicant shall adhere to all conditions and material representations made in tile application
and public meetings except as amended herein.

A tract of land situated in the SE1/4NW1/4, the NE1/4SW1/4 and the
NW1/4SW1/4NE1/4 of Section 4, Township 10 South, Range 88 West of the 6th P.M.,
County of Pitkin, State of Colorado, said tract of land being more particularly described
as follows;
Beginning at a point on the Eastedy Right of Way line of Colorado State Highway
No. 133 as shown on that plat map as recorded in Plat Book 7 at Page 89 of the
records of the Pitkin County Clerk and Recorder, from whence the North ¼ corner of
said Section 4 beam N.22°10'24"E. 3018.72 feet, said ¼ corner being as USGLO
brass cap found in place; Thence along said Right of Way line N.21°51'00"E. 2.51
feet; Thence along said Right of Way line N.24°57"00"E. 269.28 feet; Thence along
said Right of Way line N.24°01'30"W. 119.30 feet; Thence along said Right of Way
line N.22°25'00"E. 307.70 feet; Thence along said Right of Way line 315.03 feet along
the arc of a curve to the left having a radius of 1206.00 feet, a central angle of
14°58'00'' and subtending a chord bearing N.13°14'44"E. 314.14 feet; Thence along
said Right of Way line N.O3°01'30"E. 200.60 feet; Thence along said Right of Way line
N.06°37'00'~N. 332.29 feet; Thence departing said Right of Way line and along the
North, East, South and Southwesterly lines of Lot 1 as shown on said plat map as
recorded in Plat Book 7 at Page 89 the following courses and distances; Thence

Said parcel of land contains 60.56 acres, more or less.
