Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO APPROVING THE HUNTER SPECIAL REVIEW AND GMQS EXEMPTION FOR AN ATTACHED CARETAKER DWELLING Administrative Decision No. c`iR -2019 RECITALS Rita Hunter ("Applicant") applied to the Community Development Director of Pitkin County, Colorado, for approval of an attached Caretaker Dwelling Unit ("CDU"). 2. The lot is located at 675 Brush Creek Road, and is legally described as Lot 1, Block 2, Filing 1, Brush Creek Subdivision. The parcel identification number is 264328202006. The property is zoned AR -10. 3. The Applicant provided notice of the application to adjacent property owners as required pursuant to Sec. 2-20-100(a) of the Land Use Code on April 11, 2019. The public notice sign was posted on the property on April 11, 2019. No objections were received within 30 days from the date the notice was mailed. 4. The Application was referred to the Aspen Pitkin County Housing Authority ("APCHA"). No comments were received from the neighbors. APCHA recommends approval of the CDU, subject to recordation of a deed restriction. 5. The Director finds the attached CDU complies with applicable standards of the Land Use Code as amended found at Subsections 2-30-30(h), 4-30-50(f)(1)(2), 6-30-40(c): a. The property currently has two existing off-street parking spaces and other existing adequate parking as well; b. The proposed CDU does not cause the total allowable floor area of the property to exceed the allowable floor area of 5,750 as established and codified in Table 5-1. A of the Land Use Code for the AR -10 zone district; c. The proposed floor area of the CDU is 1,057.6 square feet and the net liveable is 989.2 square feet. The existing floor area on the property is 3,678.5 square feet; with the CDU the floor area will be less than 5,750 square feet. d. The proposed CDU addition is compliant with the height limit maximum standards of Pitkin County. 6. The Director finds the attached CDU complies with the applicable standards of the Land Use Code related to Exempt Development Activities Section 7-10-30(b) and Scenic View Protection 7-20- 120(cx4xb): a. The lot contains slopes in excess of 30% and is within a mapped severe wildfire hazard area. b. The CDU will be constructed above the existing garage and storage areas, which is attached to the principal dwelling. c. No encroachment or ground disturbance will take place on slopes in excess of 30%. d. Pictures provided in the application and a staff site -visit both confirm the proposed CDU does not project above the ridgeline and cannot be viewed from Brush Creek Road. Admin. Dec. Both renderings provided to Community Staff and a site visit confirm the propsed CDU addition adhere to the Pitkin County indigenous colors standards onsite and in the surrounding Brush creek subdivision area. THE DIRECTOR DOES HEREBY APPROVE the Hunter Special Review and GMQS Exemption for an attached CDU, subject to the following conditions: The CDU shall not exceed 1,000 net livable square feet, which shall count toward the total allowable floor area for the lot. The kitchen shall contain the following, as defined in the Aspen/Pitkin County Employee Housing Guidelines: a minimum of a two -burner stove with oven, standard sink, and a refrigerator plus freezer. The oven must be able to bake and broil and be at least 5 cubic feet; the sink must measure at least 14" W x 16" D x 5.25"H; refrigerator must be at least 5.3 cubic feet and include at least a .73 cubic foot freezer. The floor plan for the CDU shall be submitted to the Housing Office for review. 2. Prior to issuance of building permit, the Applicant shall, by deed restriction, guarantee that the caretaker unit: a. Shall not be required to be rented; b. Shall not be sold or otherwise conveyed or separated from the original parcel regardless of the ultimate form of ownership of the caretaker unit; c. Shall be limited to occupancy by not more than two adults and related children, who qualify as (and have been found by the Housing Office to be) employees of the community under such guidelines as may be from time to time established, or members of the owner's immediate family, even though they may not qualify as employees of the community; d. Shall be rented for terms not less than 6 months if rented. 3. Housing Office staff shall be entitled to conduct an inspection of the CDU for compliance with the above -referenced requirements. 4. The caretaker dwelling unit restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a dwelling unit and must meet otherwise applicable Code requirements. 5. The provisions of this regulation are for the purpose of providing a voluntary CDU on a legally created lot or parcel in the County. Any unit approved under this provision of the Pitkin County Land Use Code shall not be used for mitigation of employee housing requirements as established elsewhere in said Code. 6. The CDU shall comply with the following requirements for roofing materials: a. Class A covering or Class A Assembly as defined by the currently adopted building code. b. No wood shakes or shingles. c. Roofs with less than a 3:12 pitch are not permitted in Low, Medium, or Severe Wildfire Hazard Areas unless they comply with the following: (1) All roof Admin. Dec. (2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. (3) Protrusions above the rooline, such as parapets, shall be prohibited. (4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. (5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. d. Roof vents shall be screened with corrosive resistant wire mesh, with mesh one- fourth ('/4) inch maximum. 7. The Applicant shall create and maintain a wildfire defensible space around all buildings/structures (property boundaries may limit a property owner's ability to comply): a. Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around all structures. b. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). c. Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. d. All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. e. Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. f. All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. g. The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. h. All deadfall up to a one hundred (100) foot perimeter shall be removed. i. No new conifer trees shall be planted within ten (10) feet of a residence. j. No flammable mulches shall be placed within two (2) feet of a residence. k. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. 8. Galena St. 3rd Floor Aspen, CO 81611 970-920-5093 Dear Suzanne, This summary letter is provided to assist in the explanation of our request to construct a Caretaker Dwelling Unit (CDU) at 675 Brush Creek Road. Section 2-30-30(H) The purpose of this project is to build a CDU that will allow for multi -generation living on the property. The current owner, Rita Hunter, will be the occupant of the CDU, while her daughter, Christy Garfield, will move into the main residence with her husband and daughter. This project will create housing for a senior citizen, will rehabilitate an existing residence without increasing growth impacts, and will make use of the latest home building techniques to minimize energy consumption. As such, the project is in keeping with the County Land Use Policies. The project will be harmonious with the surrounding area. Notification has been given to the Brush Creek Municipal District. They have indicated that adequate water and public services exist for this project, and have stated that architectural review will occur after approval of the project by Pitkin County. An ongoing assessment of the current septic system has led to the design and approval of a newly proposed OWTS system capable of facilitating the proposed 2 bedroom unit CDU in addition to the existing 4 (defined) bedrooms of the main residence. The permitting approval for the described system is recorded with Pitkin County Environmental Health as Permit #: 0042.2018.POWT. Section 4-30-50 The CDU is proposed to be constructed above the existing garage and storage areas, which is attached to the principal dwelling. Table 4.1 shows that at CDU is a permitted use with Special Review for properties zoned AR -10. Two off-street parking spaces are already located on the property and an overall site plan, existing and proposed floor plans, and existing and proposed conditions to the massing additions to the site are provided per drawings V.1.001 through A.4.003 within the Special Review / GMQS-CDU 24 x 36 Package. Additionally, a Floor Area / Net Livable Diagram & Numerical Breakdown Sheet labeled as Z.1.001 is additionally provided. Section 6-30-40 The project is exempt from Growth Management Quota System GMQS as it is a CDU attached to the principal dwelling in a zone shown by table 4.1 where CDU's are permissible. APPLICANT: Rita Hunter LOCATION: 675 Brush Creek Road Lot 1, Block 2, Filing 1, Brush Creek Village Subdivision ZONING: AR -10 LOT SIZE: 2.5 acres SUMMARY: Caretaker Dwelling Unit: According to Section 4-30-50(f)(1)&(2), Caretaker Dwelling Unit, in the RS - 160, RS -35, RS -30, RS -20, AR -10, AR -2, R-30, R-15, R -15A and R-6 zone districts, one CDU shall be a permitted accessory use if provided that: (a) It is attached to a single-family home ("principal dwelling"); (b) The lot or parcel on which it is located conforms to the minimum lot area requirements for each dwelling in the zone district in which the caretaker dwelling unit is located, as shown in Table 5-1 of the land use code; (c) The caretaker dwelling unit shall not exceed one thousand (1,000) net livable square feet on lots or parcels that are thirty thousand (30,000) square feet or greater in lot area, and seven hundred (700) net livable square feet on lots or parcels that are less than thirty thousand (30,000) square feet in lot area; the unit is proposed at 995 sf; (d) The floor area of the caretaker unit shall be included in the total allowed floor area for the lot or parcel of land (e.g., if the CDU is seven hundred (700) square feet, the maximum total area of the primary residence and other included accessory structures shall be seven hundred (700) square feet less than what would apply without the CDU); (e) Two (2) off-street parking spaces shall be provided for each caretaker dwelling unit. Hunter Special Review for a CDU Page 1 (f) The applicant shall by deed restriction or other permanent commitment running with the land guarantee that the caretaker dwelling unit: (1) Shall not be required to be rented; (2) Shall not be sold or otherwise conveyed or separated from the original parcel regardless of the ultimate form of ownership of the caretaker unit; (3) Shall be limited to occupancy by (i) not more than two (2) adults, and related children, who qualify as (and have been found by the Housing Office to be) employees of the community under such guidelines as may from time to time be established, or (ii) members of the owner's immediate family, even though they may not qualify as employees of the community. (4) Shall be rented for terms not less than six (6) months if rented. (g) The Caretaker Dwelling Unit restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a dwelling unit and must meet otherwise applicable requirements of the County Land Use Code. (h) The provisions of this regulation are for the purpose of providing a voluntary Caretaker Dwelling Unit on a legally created lot or parcel in the County. Any unit approved under this provision of this Land Use Code shall not be used for mitigation of employee housing requirements as established elsewhere in this Land Use Code. The kitchen must also meet the definition as stated in the Aspen/Pitkin Employee Housing Guidelines for Caretaker Dwelling Units below: Kitchen — For Accessory Dwelling Units, Caretaker Dwelling Units and all other deed -restricted units, a kitchen must include, at a minimum, a two -burner stove with oven, standard sink, and a refrigerator plus freezer. The oven must be able to bake and broil and be at least 5 cubic feet; the sink must measure at least 14"WX16"DX5.25"H; refrigerator must be at least 5.3 cubic feet and include at least a .73 cubic foot freezer. STAFF RECOMMENDATION: APCHA recommends approval of the CDU if it complies with the following and a deed restriction is completed and recorded prior to building permit approval: 1. The unit meets the conditions stated above; 2. If the unit is rented, it must be rented to a qualified employee of Pitkin County as stated in the Guidelines; 3. As this discussion is a working dialogue with the ownership, we have attached multiple options to show the intent of the home will remain in the earth tone ranges and natural materials usages consistent with the natural environment and existing surrounding conditions. Wood siding, glazing, and stucco finishes (all existing and consistent with the current conditions at 675) are intended to comprise of the primary materials pallete.
