InWOO,event.shall-any structure. including anternae, chimneys, flues, vents, water towers, mechanical equipment, solar equipment, and similarstructuresexceed thirty-eight feet,(38') in.height.04, SuPP 6 224 ponnfir U'JUU U J TO:Board of Adjustment Members FROM:Peggy Seeger, Zoning Official RE:Follow up information on Special Meeting for Floyd & Janelle Watkins DATE:June 30, 1986 The following is being offered for your consideration: 1) The Board of County Commissioners granted the 1041 Special Review for this project.However, they did not address, at any time the height of the structure.Normally, height issues are not addressed by the BOCC. 2) The applicant's representative has not supplied the Board with sufficient information pertaining to the existing grade even though I have repeatedly requested a topo map showing the house and grades. 3) The Uniform Building Code snow load does not require the extensive trusses that are shown, or the extensive floor joists. Floyd & Janelle Watkins 86-12 6090 Lenado Roads Woody Creek, requesting a height variance of 11'-6" on the northern side of the proposed residence and 5'-0" for the east-west ridge line.Janelle Watkins and John Mille, Project Engineer, were there to present their request.Tam Scott was there as Watkin's attorney.Mille explained that the structure was a single family, two-story residence, with 10' ceilings and a 6/12 pitch.The location of the structure was determined during a 1041 review done by the BOCC.He presented plans of the structure, with cross sections to show heights.He felt there were hardships involved beyond the control of the applicant, those being: 1) the location of the building envelope 2) snow loading and the duration of such 3) 24% existing grade within the envelope chosen by the BOCC (wood shake shingles would be used.Mille knows that he will not be able to shed the snow completely.) Mille felt the intent of the law was to protect the view planes of the public.He pointed out on the site plan where the neighboring houses were, the nearest being the Lombardo's, which are 2000 feet away.The property is otherwise surrounded by White River National Forest Service.If the variance is granted, he felt that no views, either now or with future builders, would be blocked. Seegers brought this request before the Board because of the large amount of variance being requested.She presented the construction drawings to the Board so they could see the size of the proposed structure.Janelle Watkins explained that she designed the structure to fit with the contour of the land. Several suggestions were given to the applicants to decrease the amount of height variance necessary.Gull felt that the bulk of the structure was the main problem creating the height problem. Mille explained where the house could sit on the envelope due to the natural features of the lot and the setbacks. Smith stated that the concern in this issue was the design of the structure.He felt that it was not impossible to build a reasonable structure within the constraints of the code.The current concerns were never expressed when the application was submitted with this building envelope during the 1041 review. Smith felt the 10' ceilings to accommodate the furniture was a self-induced hardship.Dobrovolny did not feel that a 24% grade was extreme compared to other buildable lots in the area.Also, the roof pitch was not necessary for snow load if the roof is designed properly, which can be seen through the Aspen/Snowmass Village area.He felt a building could be built on the site. Also the intent of the height code pertains to the limitation of the bulk of the structure.One of the alternate solutions would solutions would destroy several spruce trees on the lot.Janelle explained that it was an honest mistake on her part when doing the design, and questioned if there was a compromise.The Board did not see one. Dobrovolny moved to deny the variance request because a hardship could not be demonstrated. Lukes second the motion.A vote was taken and all were in favor. Meeting was adjourned.
