Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substan- tial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED that the applicant's request for a 13' frontyard setback variance, a 13' sideyard setback variance to the north and a 10' sideyard setback variance to the south for a residential addition. ' i PUBLIC NOTICE NOTICE OF PUBLIC HEARING BEFORE THE PITKIN COUNTY BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to Pitkin County Zoning Resolution of June 5, 1955, as amended, a Public Hearing will be held in the County Commissioners Room, Pitkin County Court House, Aspen, Colorado, (or at such other place as the meeting may then be adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the County Zoning Resolution. All persons affected by the proposed variance are invited to appear and state their views, protests, or objections.If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. James & Dorothy Wolosoff, represented by Hansen Construction, Tract R-28, Starwood Two, requesting a 6'9" rearyard setback variance for addition to existing structure. PITKIN COUNTY BOARD OF ADJUSTMENT REGULAR MEETING SEPTEMBER 30, 1986 Members Present:Evan Gull, Chairman Joe Zanin Bill Lukes Bob Throm Kandi Shaffran Alternates Present:Bob Miller Melinda Pearson Spero Niarhos Building Department:Peggy Seegers, Zoning Official Evan Gull called the regular meeting to order.Lukes motioned to accept the minutes from the previous meeting and Pearson second the motion.All were in favor. Gull confirmed with the applicants that the proper notification signs had been posted. Tom Melberg 86-22 Lot 4, Little Texas Subdivision, requesting a 13' frontyard setback variance, a 13' sideyard setback variance to the north and a 10' sideyard setback variance to the south for a residential addition.Tom Melberg was there to represent self. The owner did not have definite plans available but wanted to get variance request "out of way". Gull requested limits for the Board's review.The setbacks restrict expansion of the cabin, which is now necessary with growth of family.Historically, the cabins in this subdivision has been extended to within 5' of the lot lines, therefore, his request to be 0' from the lot lines, he felt, was within reason. This did not match the request submitted, therefore creating a problem with the legal notice placed in the newspaper.The application as written was not clear on the amount requested and Seegers scaled the drawing to get the proposed setback footage. James & Dorothy Wolosoff 86-23 Tract R-28, Starwood Two, requesting a 6'9" rearyard setback variance for addition to existing structure.Barry Edwards was the attorney representing the owners, along with the contractor, Steve Hansen.Ellie Brickham was there to present the Starwood Homeowners Association.There were two letters from adjacent property owners, Strand stating an objection to the request and Saslove stating his support. Brickham advised the Board that a variance would not be necessary as she had researched the matter, due to the fact that the part of the house in question fell within the AF-1 zone.The remainder of the house was within the RS-20.Seegers stated she would investigate that situation, but upon first reading felt Brickham was correct.Edwards requested a finding to insure that the applicant would not have to return before the Board. Therefore, Throm moved that the application be tabled pending such determination.Bill Lukes second the motion.A vote was taken and all were in favor.
