Applicant's justification for the proposed variance is as follows: 1. Topographical and physical characteristics of the property prevent placement of the proposed closet elsewhere, due to the steep (approx. 30%) grade of the lot at the front of the residence, and the extreme expense and difficulty in redesigning the residence to accommodate the closet elsewhere, being practical difficulties and undue hardship for the owner. 2. A natural placement of the proposed closet would be within the original excavation at the site, at the rear, as requested. It will have less visual impact from this location, and will largely be hidden from view due to the topography of the site. Moving the location of the closet elsewhere would cause undue hardship to the owner, since the roof area would need to be redesigned and largely rebuilt.As proposed, the closet would have a simple, flat roof, just as is over the contiguous master bathroom area. 3. The parcel of land to the rear of the residence is over 100 acres.It is very unlikely that the variance will have any impact on the use and enjoyment of the neighboring parcel to the rear. 4. Placement of the closet at the front of the residence will interfere with passive solar features of the design of the residence. 5. However, I would like to voice my objection in writing. As we have not seen the specifics or submission of plans, the objection is on general grounds.I have seen the house already built on that lot and find it difficult to believe that anything so massive meets the zoning regulations. I am a homeowner in the Starwood Subdivision, though not an immediate neighbor of the Wolosoffs.However, I am familiar with the Wolosoff's property and construction which is in progress thereon, and have recently walked around the Wolosoff property. I am familiar with the area where the Wolosoffs are proposing to construct a closet on to the master bedroom of the house.It is obvious to me that the proposed addition would have little, if any, visual impact, and would not interfere with any of the other Starwood property owner's views. Based upon my personal observation of the site, the fact that the proposed location of the closet would have little, if any, impact on the neighboring properties, and the fact that the topography of the property as I viewed it would obviously create great practical difficulties for locating the closet elsewhere, I strongly recommend approval of the Wolosoff variance application. Gull confirmed with the applicants that the proper notification signs had been posted. Tom Melberg 86-22 Lot 4, Little Texas Subdivision, requesting a 13' frontyard setback variance, a 13' sideyard setback variance to the north and a 10' sideyard setback variance to the south for a residential addition.Tom Melberg was there to represent self. The owner did not have definite plans available but wanted to get variance request "out of way". Gull requested limits for the Board's review.The setbacks restrict expansion of the cabin, which is now necessary with growth of fami.y.Historically, the cabins in this subdivision has been extended to within 5' of the lot lines, therefore, his request to be 5' from the lot lines, he felt, was within reason. This did not match the request submitted, therefore creating a problem with the legal notice placed in the newspaper.The application as written was not clear on th e amount requested an d Seegers scaled the drawing to get the proposed setback footage. Melberg stated he did not plan to apply for a building permit at this time, but wotild desire a 5' blanket setback variance. .4. t The lot is 22,000 sq.ft. and extremely narrow.This description could fall under a lot zoned R-15.Lukes advised the applicant that he would not be comfortable with 5 feet from the property line, but would encourage using appropriate zoning such as R-15, and stay within 10' on the sideyard setbacks. Lukes moved to grant the variance request as advertised due to downzoning.Zanin second the motion.A vote was taken and all were in favor. James & Dorothy Wolosoff 86-23 Tract R-28, Starwood Two, requesting a 6'9" rearyard setback variance for addition to existing structure.Barry Edwards was the attorney representing the owners, along with the contractor, Steve Hansen.Ellie Brickham was there to present the Starwood Homeowners Association.There were two letters from adjacent property owners, Strand stating an objection to the request and Saslove stating his support. Brickham advised the Board that a variance would not be necessary as she had researched the matter, due to the fact that the part of the house in question fell within the AF-1 zone.The remainder of the house was within the RS-20.Seegers stated she would investigate that situation, but upon first reading felt Brickham was correct.Edwards requested a finding to insure that the applicant would not have to return before the Board. Therefore, Throm moved that the application be tabled pending such determination.Bill Lukes second the motion.A vote was taken and all were in favor. Zanin moved to adjourn the meeting and Throm second the motion. Meeting was adjourned.
