Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substan- tial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED that the applicant's request for a 75' frontyard setback variance and a 15' rearyard setback variance. Additional conditions or restrictions:A power of attorney be given and recorded with application to Harold Reed from Joan Duprey. Moore and Vincent K. Burnhart, owners of Lot #3, Crystal River Park Subdivision, wish to have the following statement before the Board as we are unable to attend the meeting. INFORMATION AT HAND From the Aspen/Pitkin Regional Building Department, we understand that the variance requested provides for a building envelope of 70' from front to rear and 100' laterally.The envelope extends to within 15' of the front and rear lot lines; to within 40' of the side line of Lot #1 and to within 60' of the side line of Lot #2. From Harold Reed, representing the Applicant, we have received an unsigned, undated, 10' to the inch, pen and ink outlined drawing of a house and attached garage in its proposed position on Lots 1 & 2.As shown on this drawing, the total length of the house and garage is 110'.It extends to within 50' of the side line of Lot #2. This drawing indicates as well a 10' width deck along the rear of the house, apparently some 8" steps, or 48", above ground level. REQUEST AN OBJECTION We request that a 60' setback from the side line of Lot #2 be maintained; that any requested lateral extension of the building envelope be made in Lot #1. In the absence of any assurance on the part of the principal in this matter, Mr. Roderick V. Smith, that a minimum 10' width of deck along the rear of the house will be maintained in an actual structure and that the rear wall of the house proper will be set back 25' from the rear line of the lots [i.e. 15' setback plus 10' deck]we must object to the minimal 15' variance requested. Konea Raye Piffer, c/o Charles Larry Piffer 86-24 0353 N. Thomas Rd,, Carbondale, requesting a 45' sideyard setback variance for an addition to the residence and construction of a barn.The Piffers were there to represent self.There were several letters from adjacent property owners, each stating they had no objections.All of these were read into the record and placed in the file. Piffer pointed out features, property lines and existing structures on the property.Dobrovolny understood the need for a variance for the house addition, however he questioned the need for a variance to build the barn.To "flip-flop" the barn would place the structure in the irrigation area, whereas the proposed area would blend the structure with existing trees.Placing the structure in the cow pasture would cause it to "stick out". The proposed barn would conform to height restrictions.The property is almost 8 acres (7 of which is actual land).Seegers asked the Board to address the existing structure that exists in the setbacks presently and then address the fact that the owners want to place another structure within the setbacks.Seegers felt the applicants were one of the few with the ability to meet the required setback requirements and the Board should review the allowance of continuing additions in the setbacks.Mrs. Piffer presented to the Board some photos as presented to PAZ to better help the members visualize the structures in question. The house was built approximately 25 years ago and has been downzoned.Shaffran was in favor of the proposed placement of the barn for aesthetic purposes.Pearson felt on issue was the adjacent property owners did not oppose, however, an issue to be dealt with was the fact it could be built within the required setbacks.The barn would be used for horses at one end and vehicle storage on the other.Seegers felt there were Bptions to the rear of the property. Dobrovolny felt the reasoning for the residential addition, which was to cover up "ugly loose ends", was not a hardship criteria the Board could deal with.He could justify the proposed location of the barn due to the operation of the property. Shaffran moved to grant the 30' sideyard setback variance for addition to residence, not to exceed 14 feet from the footprint of the existing building and that the barn request be rejected. Miller second the motion.A vote was called for and all were in favor. Joan Duprey and Roderick Smith 86-25 c/o Harold Reed, Lots 1 & 2, Crystal River Park S/D, requesting an 85' frontyard setback variance and a 15' rearyard setback variance for a proposed construction site of a new residence. There were two telephone conversations transcribed and placed in the file, stating questions and possible objections, along with architectural concerns, to the requested variances.Gull read those to the members. The property was downzoned to AF-1.John Ostwald was there to unofficially represent homeowners association.He brought up the issue of subdivision covenants which create setbacks of 25-10-10. Reed pointed out features of the property and how the proposed location would best suit the views.The house is placed to make best possible use of the solar potentials. With the present proposal, the house would appear to be 25' from the front.This would conform to the covenants and the Board would be willing to agree to that amount.Reed informed that Board that the further the house is moved toward the rear of the property, it impairs the view of the neighboring house.Gull, due to the comments from the adjacent property owners, was more comfortable with 15' in the rear,which would allow 25' in the front. .. j Dobrovolny moved to grant a 75' frontyard setback variance and a 15' rearyard setback variance due to downzoning.Bob Miller second the motion.A vote was taken and all were in favor. Since the property was under a contingent contract, and Reed was not representing the actual owner of the property, it was requested by the Board members that it be documented into record that the current owner, Joan Duprey, grants power of attorney to Harold Reed.
