Jose F. Machuca and Jenni S. Sibrian (hereafter referred to as "Applicants") have applied to the Community Development Director of Pitkin County, Colorado ("Director") for Activity Envelope and Site Plan Review to redevelop the property with a new single-family residence and accessory building. 2. The parcel is located at 0293 North Bill Creek Road. The Legal Description is more specifically described in Exhibit A. PID#: 2463-341-02-004. 3. The parcel is approximately 54,086 square feet, is in the RS -30 zone district, and is non -conforming in size. 4. The parcel was created prior to June 12, 1978 and was developed with a legal single-family residence; therefore, the residence may be replaced with up to 5,750 square feet of gross floor area exempt from GMQS, pursuant to Sec. 6-30-110 of the Land Use Code. 5. The parcel received 1041 Hazard Review and General Submission approval pursuant to Hearing Officer Determination No. 31-2003 (Reception No. 488788). A 1041 Site Plan was recorded in Book 67 on Page 97 (Reception No. 492246). These approvals have lapsed pursuant to Sec. 2-20-160(f). 6. The Application was referred to the Crystal River Caucus, the Environmental Health Department, the Planning Engineer, Carbondale & Rural Fire Protection District and the Colorado Parks and Wildlife (CPW). Comments have been incorporated into conditions The Director finds that the Activity Envelope and Site Plan comply with the applicable provisions of the Land Use Code ("Code"), as follows: a. The residence and customary accessory uses are located within an Activity Envelope that avoids slopes in excess of 30%. b. The wildfire hazard is rated as Low and can be mitigated. c. Trees removed for development will be replaced pursuant to Sec. 7-20-10(c). Native species will be utilized for revegetation and landscaping. The Applicant has provided a Landscape Plan that addresses the removal and replacement of trees. d. The proposed development complies with Section 7-20-30 as it avoids water courses and drainages, and is not within a 100 -year floodplain. e. The Activity Envelope avoids the 100' River Setback pursuant to Sec. 7-20-80. f. The parcel is within the Scenic View Protection Area as seen from Highway 133. The residence and accessory building are located on the flat area previously developed with a single-family home and accessory building. There is no vegetation located within the Activity Envelope. The residence is approximately 525' from the Highway and there is existing vegetative screening between Highway 133 that will not be disturbed. The residence will not break a ridgeline as viewed from Highway 133. Indigenous earth tone materials will be used for the residence and roofs will have a non - reflective composition. 8. Public notice was published on May 23, 2019 and mailings were sent to property owners within 300' of the subject property on May 15, 2019. The Public Notice was posted on the property on May 30, 2019. No objections were received within 30 days. Pitkin County, CO Administrative Decision No.!5S-2019 Page 12 APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successor in interest: The Applicants shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any future building permit applications, the Applicants shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The parcel received a topographical Front Yard Variance from 30' to 25'. The Applicants shall comply with the Board of Adjustment Resolution 04-2019. 4. The conditions of this Administrative Decision shall replace the conditions of Hearing Officer Determination No. 31-2003 (Reception No. 488788). 5. The Applicants shall obtain a building permit for the accessory building (shed) partially constructed on the property no later than 90 days after approval of this Decision. 6. No structural development, with the exception of fencing, in excess of 30" shall occur within the setbacks of the Lot. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any external development located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. The Activity Envelope located within the setbacks shall specify that it is for landscaping, grading and access with the exception of the conditions of approval in BOA Resolution No. 04-2019. The Applicants shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 8. At building permit application, the Applicants shall: a. Complete a fireplace/woodstove registration form with the Community Development Department, if necessary. b. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. All natural drainage patterns shall be maintained. c. Submit a construction management plan for review and approval by the Planning Engineer. d. Submit a tree removal and mitigation plan if any trees with larger than 6" DBH are to be removed. e. Submit a detailed exterior lighting plan with the corresponding fixture cut sheets. Exterior lighting shall comply with the lighting code. Administrative Decision No. �02019 Page 13 f. Submit representations of the exterior indigenous earth tone materials or colors. g. Submit a driveway/access permit application, which shall be approved by the Planning Engineer and the Aspen Fire Protection District. h. Provide proof of an adequate water supply (in terns of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable. i. Pay the applicable road and employee housing impact fees. 9. Regarding Wildfire, the Applicants shall comply with the following Low Wildfire Hazard conditions: (A) DEFENSIBLE SPACE The areas around all structures shall incorporate wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1. Brush, debris and non -ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around all structures. 2. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). 3. Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. 4. All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. 5. Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. 6. All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 7. The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 8. All deadfall up to a one hundred (100) foot perimeter shall be removed. 9. No new conifer trees shall be planted within ten (10) feet of a residence. 10. No flammable mulches shall be placed within two (2) feet of a residence. 11. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. Administrative Decision No. 522 -2019 Page 14 (B) Roofing Materials, unless otherwise exempted under the 2003 IRC: Class A covering or Class A Assembly as defined by the currently adopted Building Code. ii. No wood shakes or shingles. iii. All other adopted Building Code compliant methods and materials permitted. 10. The Applicants shall comply with the following general conditions regarding wildlife: A. Manipulation of vegetation outside of the Activity Envelope is prohibited. B. Mesh or woven wire fences are prohibited outside the Activity Envelope. C. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in width (top view), and shall have at least eighteen (18) inches between the lower two (2) rails. D. Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. E. Fruit bearing trees and shrubs shall be prohibited within the Activity Envelope. This does not include pre-existing native trees and shrubs. F. Trash/garbage shall be kept in an approved bear resistant container or enclosure. These containers shall be accessible to and use at all times by contractors on site. G. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and be at least ten (10) feet from the ground suspended between two (2) trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seed. H. Pet food shall not be left outside. 1. All outside doors shall utilize solid round handled door knobs. No development shall occur outside the approved activity envelope with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described above. No structures shall be permitted outside of the approved activity envelope. Applicant shall be required to obtain an Earthmoving Permit for any work outside the approved envelope. 12. No calculations for height, bulk, setback, size, Floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit review. Structures represented in the application might not be permitted under building and zoning regulations. 13. The Applicant shall comply with the applicable codes and requirements of the Carbondale and Rural Fire Protection District, including but not limited to access, adequate area for turning around of fire equipment, installation of an approved fire sprinkler system and provision of an adequate water supply for firefighting. 14. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site. The fencing shall remain in place until issuance of a Certificate of Occupancy. 15. ATTACHMENT A Parcel ID # 246334102004 March 5, 2019 Pitkin County Community Development 530 E Main St, Suite 205 Aspen, CO 81611 Re: Activity Envelope and Site Plan Review for Parcel ID # 246334102004 Dear Community Development Director: Please accept this letter as Jose Machuca's (hereinafter the "applicant") request for an Activity Envelope and Site Plan approval for his property located at 293 N Bill Creek Road in Carbondale. As required in the Pre -Application Conference Summary, this letter provides an explanation of the request, background information on prior approvals and permits, and addresses compliance with the Code Sections listed in the Pre -Application Conference Summary, dated January 22"d, 2019. Background Information: The applicant purchased the property in December 2017. The property had previously been developed with a residential trailer with two additions, a carport, and a shed. The existing residence had deteriorated to the point that it was uninhabitable and unfit for renovation. In the fall of 2018, the applicant deconstructed the residence and carport (permit # 0028.2018.PDMO) and installed a new Onsite Wastewater Treatment System designed to serve 5 bedrooms in a home less than 6,000 SF (permit # 0030.2018.POWT). It is the desire of the applicant to construct a new residence with attached garage in roughly the same location as the previous residence and carport. Please see Attachment G for Proof of Ownership. Existing Conditions: The parcel is to the east of Highway 133 and Crystal River. The site is relatively flat where the proposed Activity Envelope is located. To the west of the proposed Activity Envelope the grade drops approximately 40' down to Crystal River. The site is zoned RS -30 (Resource — 30 Acre) and is used as a residence. There are existing trees and shrubs to the east, west, and south of the proposed Activity Envelope and are to remain. There is an existing shared well that provides water service to the property. Electrical service is provided by utility poles that run along the east side of the property. Land Use Code Sections to be Addressed: Per the pre -application conference summary, the following Land Use Code (LUC) sections are to be addressed as part of this Land Use Application (LUA): Sec. 2-30-20(g) Activity Envelope and Site Plan Criteria for Approval; Sec. 7-10-50 & 60 Activity Envelope and Site Plan: The prior development, a single-family residence, was used as a basis for establishing the proposed residence location. The work proposed as part of this LUA will comply with the above sections of the LUC. Bill Creek Road Pitkin County, Colorado Jose, Project No. C1371 ALL SERVICE septic, LLC performed a subsurface investigation and completed an onsite wastewater treatment system (OWTS) design for the subject residence. The 1.3 -acre property is located outside of Carbondale, in an area where OWTSs and wells are necessary. The legal description of the property is Lot 32, Lower Sewell Tracts. Parcel ID: 2463-341-02-004 SITE CONDITIONS A mobile home is currently present on the property. In 2006, the Thomas Ditch which ran upgradient of the property blew out and washed away the northern portion of the property, along with the existing OWTS (septic tank and drywell) serving the residence. The hillside was re -built and damage to the property mitigated. The proposed development will include a 5 -bedroom, single-family residence and a new OWTS. A private well is located on the southern portion of the property. A minimum 50 -foot setback will be maintained to the proposed septic tank and minimum 100 -foot setback to the proposed soil treatment area (STA). The Thomas Ditch was placed in a culvert at the time the property was mitigated. The proposed soil treatment area (STA) will be placed in the filled area on the northern side of the property. The area is relatively flat but drops steeply to the west toward the Crystal River, just beyond the activity envelope. The subsurface was investigated on April 13, 2018 by digging one soil profile test pit excavation (Test Pit). A mini -excavator was used to excavate the test pits. A visual and tactile soil analysis was completed by Carla Ostberg' at the time of excavation. ' Carla Ostberg holds a Certificate of Attendance and Examination from the CPOW Visual and Tactile Evaluation of Soils Training. Page 2 The materials encountered in Test Pit #1 consisted of light brown, sandy loam with cobbles and rocks exceeding 50% to a maximum depth explored of 8.0 -feet. No bedrock or groundwater was encountered. A tactile analysis of the soils was taken from Test Pit #1 at 3 -feet below grade. The soil formed a ball and a ribbon less than 1 -inch in length before breaking. Soil structure shape was single grain, soil structure grade was moderate to loose, and consistence was loose. The texture of the soil was gritty. Base soils are classified as Soil Type 2, Sandy loam. With rock content exceeding 50%, this soil is classified as Soil Type 0. Additionally, the soils in the area of the proposed STA have been imported. An over -excavated, unlined sand filter is proposed. There will be a minimum of 3 -feet of sand in the filter beds. A long term acceptance rate (LTAR) of 1.0 gallons per square foot will be used to design the OWTS, in accordance with Pitkin County OWTS Regulation, Table 6.28-7. A design flow of 750 GPD will be used. The sewer line from the residence must have a minimum 2% grade to the septic tank and include a double -sweep clean out. The installation must include a 1500 -gallon, two-compartment septic tank with an effluent filter on the outlet tee, followed by a 500 -gallon, single -compartment pump chamber with an Orenco® Flow Inducer and PF3005 pump. With this tank configuration, either concrete or poly may be utilized. We have enclosed specification for both options. Access should be considered when choosing between concrete and poly septic tank. Additionally, stability of the hillside should be considered. We have provided a "steep hillside installation" guide for the poly tank for reference. Pump floats should be set to dose approximately 75 gallons each pump cycle, allowing 3 gallons for drain back. The control panel for the pump must be located within line of sight of the septic tank. We recommend Valley Precast out of Buena Vista be contracted for start-up of the pumping system. A 1.5 -inch diameter Schedule 40 pump line must be installed from the pump to an Orenco® automatic distributing valve (ADV), model 6402. This pump line must have a minimum 1% grade for proper drain back into the tank after each pump cycle. The ADV must be placed a high point in the system and be placed in an insulated riser with access from grade. Screened rock must be placed below the ADV to support the ADV and to assure the clear pipes existing the ADV remain visible for future inspection and maintenance. Effluent will be pressure dosed to two over -excavated, 9' x 42' unlined sand filters with a minimum of 3 -feet of sand filter material. There must be at least 6 -feet of undisturbed soil between the beds. Sand filter material must be clean, coarse sand, all passing a screen having four meshes to the inch. The sand must have an effective size between 0.25 and 0.60 mm. The uniformity coefficient must be 4.0 or less. Material meeting ASTM 33, for concrete sand, with one percent or less fines passing 200 mesh sieve may be used. Pipes used to disperse the effluent must be surrounded by washed coarse screened gravel or crushed stone. All of the gravel or stone must pass a 2'/2 -inch screen and must be retained on a %-inch screen. The manifold must be 1.5 -inches in diameter. Laterals must be 1.5 -inches in diameter with 5/32 -inch diameter orifice holes facing down, spaced 3 -feet on center. We recommend Orenco® Orifice Shields be placed under each orifice. Laterals will be set 2 -feet from the edge of the sand filter and be separated by 2.5 -feet. Each 1.5 -inch diameter lateral must end in a sweeping ell facing up with a ball valve for flushing. A soil separation fabric should be placed over the gravel layer followed by approximately 1 -foot of topsoil or other suitable soil able to support vegetative growth. The component manufacturers are typical of applications used by contractors and engineers in this area. Alternatives may be considered or recommended by contacting our office. REVEGETATION REQUIREMENTS An adequate layer of good quality topsoil capable of supporting revegetation shall be placed over the entire disturbed area of the OWTS installation. A mixture of native grass seed that has good soil stabilizing characteristics (but without taproots), provides a maximum transpiration rate, and competes well with successional species. No trees or shrubs, or any vegetation requiring regular irritation shall be placed over the STA. Until vegetation is reestablished, erosion and sediment control measures shall be implemented and maintained on site. The owner of the OWTS shall be responsible for maintaining proper vegetation cover. OPERATION INFORMATION AND MAINTENANCE The property owner shall be responsible for the operation and maintenance of each OWTS servicing the property. The property owner is responsible for maintaining service contracts for manufactured units, alternating STAs, and any other components needing maintenance. Geo -fabrics or plastics should not be used over the STA. No heavy equipment, machinery, or materials should be placed on backfilled STA. Livestock should not graze on the STA. Plumbing fixtures should be checked to ensure that no additional water is being discharged to OWTS. For example, a running toilet or leaky faucet can discharge hundreds of gallons of water a day and harm a STA. If an effluent filter or screen has been installed in the OWTS, we recommend this filter or screen be cleaned annually, or as needed. If the OWTS consists of a pressurized pump system, we recommend the laterals be flushed annually, or as needed. The homeowner should pump the septic tank every two years, or as needed gauged by measurement of solids in the tank. Garbage disposal use should be minimized, and non -biodegradable materials should not be placed into the OWTS. Grease should not be placed in household drains. Loading from a water softener should not be discharged into the OWTS. No hazardous wastes should be directed into the OWTS. Mechanical room drains should not discharge into the OWTS. The OWTS is engineered for domestic waste only. ADDITIONAL CONSTRUCTION NOTES If design includes a pump, weep holes must be installed to allow pump lines to drain to minimize risk of freezing. The pump shall have an audible and visual alarm notification in the event of excessively high water conditions and shall be connected to a control breaker separate from the high water alarm breaker and from any other control system circuits. The pump system shall have a switch so the pump can be manually operated. Page 5 Excavation equipment must not drive in excavation of the STA due to the potential to compact soil. Extensions should be placed on all septic tank components to allow access to them from existing grade. Backfill over the STA must be uniform and granular with no material greater than minus 3 -inch.
