RECITALS:
1. Pursuant to Title 29,Article 1,part 2,Colorado Revised Statutes,as amended(the
"Intergovernmental Relations Statutes")and Article XIV,Section 18 of the
Colorado Constitution,governments may contract with one another to provide any
function,service or facility lawfully authorized to each of the contracting units and
any such contract may provide for the joint exercise of the function,service or
facility,including the establishment of a separate legal entity to do so.
2. Both Pitkin and City are governments authorized to enter into agreements
pursuant to C.R.S. §29-1-203 for purposes including the provision of any,
function,service, or facility lawfully authorized to each;and
3. Pitkin County hereinafter called("the Landowner")is the owner of certain real
property known as the Pitkin County Library hereinafter called("the Property").
4. The Stormwater Management BMP Operations and-Maintenance Plan hereinafter
called("the Plan")has been approved by the City,and provides for management of
storm water within the confines of the Property.
5. The City requires through implementation of the Plan from the Landowner that on-
site storm water management/BMPs as shown on the Plan be adequately
constructed,operated,and maintained by the Landowner, its successors and assigns
through execution of a Stormwater Best Management Practices Operations and
Maintenance Agreement.
6. The BOCC finds that it is in the best interests of the citizens of Pitkin and the City
of Aspen to enter into this Intergovernmental Agreement and to agree to the
provisions of the Stonnwater Best Management Practices Operations and
Maintenance Agreement(attached as Exhibit"C")in order to insure the health
and welfare of the citizens of the City and Pitkin County.
7. The BOCC finds that it is in the best i4terests of the citizens of the City and Pitkin
County to adopt this resolution as an emergency resolution.

1.0 Overview
1.1 Purpose
This plan has been developed to provide basic information for the successful operation,
Inspection and maintenance of the storm water system for 120 North Mill Street.
•

It is recommended that scheduled inspections and maintenance of the water quality
treatment system be contracted out to private companies experienced in the operation and

detention basins,grass lined swales and piping.
If inspections and maintenance are not contracted out,the owner or owner's representative
will be responsible to ensure the storm water system functions properly.
2.0 Site Description
The Pitkin County Library is located on Lot 3 of the Rio Grande Subdivision,having the
physical address of 120 North Mill Street. Lot 3 contains 24,922 square feet of area(0.572
acres). The Library is a two story brick building with a basement and the building footprint
covers approximately 14,166 square feet(0.0038 acres)of the lot. Also,there is an
additional 5,591.5 square feet of impervious area on the lot made up of concrete sidewalks
and alleys. The remainlng area is pervious consisting of manicured grass, mature trees and
areas against the building where bushes and flowers are planted.
3.0 Stormwater Best Management Practices (13MU*"s)
There are eight sub-basins associated with this operations and maintenance plan,see
Figure 1. Water quality treatment BMP's have been designed to treat drainage specifically
generated from each sub-basin in order to meet the criteria presented in the Urban Runoff
Management Plan(URMP). The following sections describe each sub-basin and water
quality treatment BMP designed for each sub-basin.
3.1 Sub-basin 1
Sub-basin 1 has been divided into two drainage patterns,each using'their own water quality
treatment BMP. Sub-basin 1.1 uses a rain garden to treat drainage generated on new
concrete sidewalks. Sub-basins 1.2 uses a grass buffers to treat drainage generated on
new concrete walkways.
Sub-basin 1.1 has a total drainage area of 1,710.5 square feet,with 632.1 being
impervious. The drainage pattern for this sub-basin is from northeast to southwest,with
discharge being onto the landscaped area between the main walkway to the Library and the
North Mill Street public right-of-way sidewalk. This landscaped area is the best place for a
BMP to treat drainage generated on the Impervious area associated with this sub-basin and
a rain garden is the best BMP type. There are three and one-half trees in this sub-basin

gave a reduction credit of 200
Guglielmo)of the impervious area discharging to this landscaped area. With the tree
canopy credit and the reduction credit the effective 153
square feet,which calculates to 9%imperviousness. At 9%imperviousness,the water
quality nevn|umomn000|atodwiththisoub-baoin calculates to be 4 cubic feet. The
bio-retention BMP for this sub-basin has a capacity of 4.5 cubic feet.
Sub-basin 1.2 has a total area of 606.7 square feewith 144.6 square feebeing new '
concrete placed as partoftho6u|enmP|uzo/RioGrmndeGm The
impervious area drainage path Is from the northeast to the southwest. Discharge from the
impervious area is onto a grass landscaped area. There are three existing trees in the
landscaped that provide a tree canopy credit of 239 square feet,which is more than the
impervious area. Water quality treatment for this sub-basin is not required as long as the
trees remain.
3.2 Swb'bmw|m1A
Sub-basin 1A, being a pervious area,willcunUnmethanxisUn drainage pattern flowing into
the east Mill Streegutter. Water quality treatment for this area will not be required.
3.3 Sub'bmaim1B
Drainage generated on the existing south facing roof is captured in the existing roof gutter
system and discharged to the surface through two existing downspouts. The downspouts
discharge Into a new drainage swale. The drain | discharges into a smallbio-
detention mma. A grass paver system,developed by TrueGrid Systems has been installed
beneath the swale and blo-detention area. A sub-drain collection system Is installed
beneath the swale and detention area to Capture and convey drainage infiltrating through
the swale and bio-detention area tothe infiltration bed.see Figure 1.
The infiltration bed was designed and constructed to retin the water qualitynaptunovo|ume
determined for sub-basin IB,which is 25 cubic feet. The swale has the capacity to convey
0.32 cfs and detain a volume of 14.4 cubic feet of drainage in the grass paver system. The

system and 4.0 cubic feet of drainage in the depressed area. All combined,the swale,
detention area and infiltration bed hh cubic feet of drainage. It Is
estimated the 100-year design storm generates a flow rate of 0.18 cfs in sub-basin 1B.and a
total volume of 115 cubic feet of drainage. Infiltration into the proposed grass paifer system
is rapid and excess drainage generated by the 100-year design storm not retained in the
swale,detention basin and infiltration bed will discharge through the overflow drain installed
in the infiltration bed,under sheet flow conditions. The grate for the area drain has the
ability to discharge at a maximum rate of 0.28 cfs. Since discharge from the infiltration bed
is from a filtered system, a clogging factor was not used in the calculations to determine the
discharge flow rate for the grate. Any overflow drainage from the infiltration bed follows the
existing conditions drainage pattern for sub-basin 1 and discharges to Mill Street at design
point 1.1.

sidewalk,discharges to the grassed area of sub-basin 1A,eventually reaching the 8 inch
drain inlet at the northwest egress door to the Library. There are 6 trees in sub-basin 2A
that provide a canopy credit of 319 square feet,which reduces the effective imperviousness
to 71%and the water quality capture volume to 13 cubic feet. This volume of drainage is
treated by the sand filter system contained in the water quality treatment vault located in
sub-basin 2C at the east end of the north alley,see FIgure 1
• 3.5 Sub-»as|o2,2B
Sub-basin 2 and 2B are the main'roof area of the Library and the Library's north sloping
roof. Drainage from these basins Is captured in roof drains and conveyed through the
Library's internal storm drain piping to a sump pump located in the crawl space of the
Library. From the sump pump drainage is pumped to a sub-sUrface water quality treatment
BMP,a sand filter, located at the east end of sub-basin 2C. The waterquality capture
volume for these two sub-basins Is 230 cubic feet,
3.6 Sub-basin 2C
The collectifor the water quality capture volume associated with sub-basin 2C
utilizes a trench drain to capture drainaat tht end of the north alley. A 2 inch
discharge pipe connects the trench drain to a 4X2 inch reducer,which connects the 2 inch
pipe to new 4 Inch piping. The 4 inch piping is connected to the existin4 inch piping
connected to the drain located in front of the northwest egress door. The existing 4 inch
pipe from the northwest egress door drain discharges into the pump sump located in the
crawl space of the Library.
The 2 inch diameter pipe connected to the trench drain has the capacity to conveyoUghdy
more than the required water quality capture volume calculated for sida-basin 2C,which is
46 cubic feet. Excess flows over the water qualivolume discharges at the
northwest corner of the alley into the North Mill Street curb and gutter system, as it is
currently under existing conditions,. Since detention is not a requirement,discharge over
the water qu |dy capture volume to the City's existing storm system meets the requirements
of the Urban Runoff Management Plan(URMP).
At the east endof sub-basin 2C a sand filter ilocated in the existidriveway to the Rio
Grande Parking Facility. The size of the water quality treatment vault has inside
dimensions of 8.5 feet in width x 15.0 feet in length X 6 feet in depth. The vault has
approximately 5.67 cubic yards of C33 sand placed as a filter material. The required sand
filter area is 67.11 square feet,the vault has 98.85. The hydraulic head is 3 feet above the
sand filter. The top of the vault is traffic rated and with one 34 inch diameter manhole and
one 24 inch diameter manhole. Both manhole accesses have solid lids with frames. A 4
inch dieter perforated PVC pid drain system enveloped in 3/4 inct screened
gravel has been placed beneath the sand filter. Discharge from the sand filter vault is
controlled using a 5/16 inch diameter orifice drilled into a cap. The cap has been placed
over the discharge end of the sub-drain collection system.

Sub-basin~~~made~,~'the proposed~new roof systems~'the Library expansion, —
addition tothe existing eastern sloping roosystem. Improvements for the expansion
included adding approximately 4,500 square feet of new roof,in addition to a deck and
planters on the lower south roof of the expansion. There are 3 roofs associated with the
expansion,with the highest being at the north side of the Library,the next highest being the
middle portion of the expansion and the lowest being at the south side of the Library. The
lower southerly roof has a green roof system installed over a portion of it. The volume
capacity of the proposed green roof is 1.72 inches per square foot,which calculates to a
storage ca ''-nityfnrthegveonmnfoyotemofi34cubiofe*t. The water quality capture
volume calculated for all of the three proposed roof systems and the existing easterly facing
sloped roof Is 126 cubic feet.

water depth per square foot will be installed between the proposed pavers and the

which meets the requirements of the WOCV for the area covered by the patio pavers.

4.6 Trench and Area Drains In all Sub-Basins

5.0 Record Keeping •
Inspection and maintenance logs shall be kept indicating the inspection/maintenance
schedules outlined in Section 4.0 has been conducted. These logs shall be made available
to the City of Aspen upon request. It is the Owner's/Owner's Representative/Maintenance
Contractor's responsibility to develop forms to log inspection results and maintenance
requirements.

TRUEGRID—Maintenance Guide
TRUEGRID typically requires very little maintenance.Most silt and sediment will decay and pass naturally
through the system as tested and documented in the Brattebo and Booth 2003 study'.Here are some
maintenance suggestions to ensure high permeability for the life of your TRUEGRID site.
Leaves&Garbage:
Leaves and/or garbage should be raked,air blown or vacuumed being careful not to remove the gravel.Small
particles will decay naturally and pass through the system.
Mud or Sediment:
TRUEGRID may be hosed down with water or carefully power washed to move excess mud or sediment
through the system.Care should be taken to not wash gravel out during this process.
Snowplowing:
TRUEGRID can be plowed using standard truck-mounted snowplow blades with small riser skids on the corners
of the blades to keep the bottom of the blade off the surface of the grid by roughly 1".
Tree or plants watering: •
• Adjacent trees.or plants next to or part of the TRUEGRID site can be watered directly through the permeable
TRUEGRID system either manually or with irrigation.TRUEGRID paving helps protect the tree roots from
damage from heavy vehicles and traffic.

Abstract •
This study examined the long-term effectiveness of permeable pavement as an alternative to traditional impervious
asphalt pavement in a parking area,Four commercially available permeable pavement systems were evaluated after
6 years of daily parking usage for structural durability,ability to infiltrate precipitation,and impacts on infiltrate water
quality.All four permeable pavement systems showed no major signs of wear.Virtually all rainwater infiltrated through
the permeable pavements,with almost no surface runoff.The infiltrated water had significantly lower levels of copper
and zinc than the direct surface runoff from the asphalt area.Motor oil was detected in 89%of samples from the
asphalt runoff but not in any water sample infiltrated through the permeable pavement.Neither lead nor diesel fuel
were detected in any sample.Infiltrate measured 5 years earlier displayed significantly higher concentrations of zinc and
significantly lower concentrations of copper and lead.

EXHIBIT "A" FOR STORMWATER OPERATIONS ON
PROPERTY KNOWN AS THE PITKIN COUNTY LIBRARY

THIS TERGOVERNMENTAL AGREEMENT (the "Agreement") is made this erg) day of
Udl , 2016 by the COUNTY OF PITKIN, STATE OF COLORADO,by and
through its Board of County Commissioners, whose address is 530 East Main Street, Aspen,
Colorado, 81611 ("Pitkin")and the City of Aspen. Colorado ("City")by and through its Counsel,
whose address is 130 South Galena St., Aspen, Colorado, 81611, collectively the ("Parties").
NOW, THEREFORE, in consideration of the mutual promises and agreements of the parties and
other good and valuable consideration,the receipt and sufficiency of which is hereby
acknowledged,the parties agree as follows:
1. This Agreement is entered into pursuant to, inter alia, C.R.S. § 29-1-201, et seq., and
Article XIV, Section 18 of the Colorado Constitution.
2. Term. The term of this Agreement perpetual unless otherwise canceled.
3. City's Obligations. See Exhibit"C"
4. Pitkin's Obligations. See Exhibit"C" (Appendix A to Stormwater Operations and
Maintenance Agreement)
5. Assignability. This agreement is not assignable by either party.
6. Modification. This Agreement may be changed or modified only in writing by an
agreement approved by the respective Boards of the Governments and signed by
authorized officers of each party. This Agreement constitutes the entire Agreement
between the parties and all other promises and agreements relating to the subject of this
Agreement, whether oral or written, are merged herein and/or attached hereto.
7. Severability. Should any one or more sections or provisions of this Agreement be
judicially adjudged invalid or unenforceable, such judgment shall not affect, impair,,or
invalidate the remaining provisions of this Agreement,the intention being that the
various sections and provisions hereof are severable.
8. Notice. Any notice required or permitted under this Agreement shall be in writing and
shall be hand-delivered or sent by registered or certified regular mail,postage pre-paid to
the addresses of the parties as follows. Each party by notice sent under this paragraph
may change the address to which future notices should be sent. Electronic delivery of

WHEREAS,the Landowner is proceeding to build on and develop the property;and
WHEREAS,the stormwater management MP Operations and Maintenance Plan for the properly identified herein
has been approved by the City,herein alter called the"Plan",which is attached hereto as Appendix A and made part
hereof;as approved by the City,provides for management of stormwater within the confines of the Property through
the use of stonnwater management or Best Management Practices(BMPs)facilities;and
WHEREAS,the City and the Landowner,its successors and assigns,agree that the health,safety,and welfare of
the residents of City of Aspen,Colorado and the maintenance of water quality require that on-site stomtwatcr
management/BMP facilities be constructed and maintained on the Property;and
WHEREAS,the City requires,through implementation of the Plan from the Landowners dated
and attached hereto,that on-site stormwater mahagenent/BMPs as shown on the Plan be
adequately constructed,operated,and maintained by the Landowner,its successors and assigns.
NOW,THEREFORE,in consideration of the foregoing premises,the mutual covenants contained herein,
and the following terms and conditions,the parties hereto agree as follows:
I.Construction of IMP facility by Landowner.The on-site stumnwatcr managenent/13MP facilities shall be
constructed by the Landowner,its successors and assigns,in accordance with the plans and specifications
approved by the City and identified in the Plan.
2.Duty of Operation and Maintenance of Facility.The Landowner,its successors and assigns,including any
homeowners association,shall adequately operate,inspect.and maintain the stomtwatcr management/ MP
facilities as acceptable to the City and in accordance with the specific operation,inspection,and maintenance
requirements noted in the Plan. Adequate operation and maintenance is herein defined as good working condition
so that these facilities are performing their design functions.

3.Duty of Documentation. The Landowner,its successors and assigns,shall document inspections,maintenance,
and repairs performed and provide said documentation to the City or its representatives upon request.
4.Right of Entry on Property. The Landowner,its successors and assigns,hereby grant permission to the City,
its authorized agents and employees,to enter upon the Property at reasonable times and upon presentation of
proper identification,and to inspect the stonnwater ntanagentent/BMP facilities whenever the City deems
necessary.The purpose of inspection is to follow-up on suspected or reported deficiencies,to respond to citizen
complaints,and/or to assure safe and proper functioning of the facilities.The City shall provide the Landowner,
its successors and assigns,copies of the inspection findings and a directive with timeline to commence with the
repairs if necessary.
5.Failure to Maintain. In the event the Landowner,its successors and assigns,fails to construct,operate mid
maintain the stonnwatermanagement/BMP facilities in good working condition acceptable to the City,the
City,its authorized agents and employees,may enter upon the Property and take whatever action(s)deemed
necessary to correct deficiencies identified in the inspection report and to charge the costs of such construction
or repairs to the Landowner.It is expressly understood and agreed that the City is under no obligation to install,
construct,or routinely maintain or repair said stormwater management/BMP facilities,and in no event shall this
Agreement be construed to impose any such obligation on the City.
6.Reimbursement by Landowner.In the event the City pursuant to this Agreement,performs work of any nature,
or expends any funds in performance of said work for labor,use of equipment,supplies,materials,and the like,
the Landowner,Us successors or assigns,shall reimburse the City upon demand,within thirty(30)days of
receipt thereof for all actual costs incurred by,the City hereunder.
7.Duty to Inspect by City.The City,its employees or representatives,shall inspect the stonnwater
management/IMP facilities at a minimum of once every three years to ensure their continued and adequate
functioning.
8.Release of City. The Landowner,its executors,administrators,assigns,and other successors in interests,shall
release the City,its employees and designated representatives from all damages,accidents,casualties,
occurrences,or claims which might arise or be asserted against said City,employees,and representatives from
the construction,presence,existence,operative or maintenance of the stormwaler managemenVBMP facilities
by the Landowner or City. In the event that a claim is asserted against the City,its elected officials,City
Officers or employees,the City shall promptly notify the Landowner and the Landownershall defend,at its own
expense,any suit based on the claim. If any judgment or claims against the City's employees or designated
representatives shall be allowed,the Landowner shall pay all costs and expenses regarding said judgment or

• APPROVING A BMP OPERATIONS AND MAINTENANCE PLAN AND
AGREEMENT FOR STORM WATER OPERATIONS FOR PROPERTY
KNOWN AS PITKIN COUNTY LIBRARY.
WHEREAS, there has been submitted to the City Council an
Intergovernmental Agreement between Pitkin County and the City of Aspen that 1
has been signed by Pitkin County, a true and accurate copy of which is attached •
hereto as Exhibit"A", and;
WHEREAS, pursuant to Title 29, Article 1, part 2, Colorado Revised
Statutes, as amended (the "Intergovernmental Relations Statutes") and Article
XIV, Section 18 of the Colorado Constitution, governments may contract with one
another to provide any function, service or facility lawfully authorized to each of
• the contracting units and any such contract may provide for the joint exercise of
• the function, service.or facility, including the establishment of a separate legal
entity to do so, and;
WHEREAS, Both Pitkin and City are governments authorized to enter into
agreements pursuant to C.R.S. & 29-1-203 for purposes including the provision of
any function, service, or facility authorized to each, and;

WHEREAS, Pitkin County is the owner of certain real property known as
the Pitkin County Library located within City limits, and;
WHEREAS, the City of Aspen requires Stormwater Bls,TP Operations and
Maintenance Plans and Agreements for development and redevelopment of,
property within the City's limits, and therefore required same for the
redevelopment of the Pitkin County Library project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO,
That the City Council of the City of Aspen hereby approves the •

or any other rights, immunities,and protections provided by the Colorado Governmental
Immunity Act,C.R.S.24-10-101,et seq., as from time to time amended or otherwise

10.,Binding Rights and Obligations. The rights and obligations of the parties under this
Agreement shall be binding upon and shall inure to the benefit of the parties and their

6,Reimbursement by LandowncrJn the event the Citypursuant to this Agreement,performs.workof any nature,
or expends any funds in performance of said work for labor,use of equipurent,supplics,materiels,and the like,
the Landowner,its successors or assigns,shall reimburse the City upon demand,within thirty(30)days of
- receipt thereof foroil actual costs incurred by.the City hereunder.
7.Duly to Inspect by City.The City,Its employees or representatives,shall Inspect the slonuwater
management/IMP facilities ata mini muruof once every three years to ensure their continued arid adequate
functioning.
8.Release of City. The Landowner,Its executors,administrators,assigns,and other successors in interests,shall
release the City,its employees and designated representatives from all damages,accidents,casualties,
occurrences,or claims which might arise or be asserted against sold City,employees,and representatives from
the construction,prescnce,existence,operative or maintenance of the stormwaicrmanagement/BMP facilities
by thel.andowmeror City. In the event that a debuts asserted against the City,its elected officials,City
Officers or enrployces,tlre City shall promptly notify the Landowner asdtheiandownerahall defend,at Its own
expense,any suit based on the claim. ifmsyjudgntent or claims against lire City's employees or designated
representatives shall be allowed,the Landowner shall pay all costs and expenses regarding said Judgment or
claim.'
