Remarks: Application Type:Activity Envelope Site Plan ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING THE CRAIG ACTIVITY ENVELOPE & SITE PLAN REVIEW Administrative Decision No. 12-2020 RECITALS 1. Michael B Craig ("Applicant') has applied to the Pitkin County Community Development Director ("Director") requesting Activity Envelope and Site Plan Review approval to construct a single family residence in the location where a cabin existed previously. 2. The parcel is located at 2024 Woody Creek Road and is more specifically described in Attachment A. 3. The parcel contains 43,615 square feet and is a non -conforming size parcel in the RS -20 zone district. 4. In 1949, a cabin built on a neighboring parcel was relocated on the subject parcel. In 2014, the cabin was demolished due its state of disrepair. 5. The Application was referred to the Attorney, Aspen Fire Protection District, Planning Engineer, Zoning, Environmental Health, and the Woody Creek Caucus. Comments were received from the Planning Engineer, and the Zoning Officer, and have been incorporated into the following findings and conditions of approval. The Woody Creek Caucus reviewed and supported the application. 6. The Applicant provided notice of the application to the adjacent property owners. No objections or comments were received. 7. The Director finds that the request complies with the applicable provisions of the Land Use Code ("Code"), as follows: A. The parcel contains slopes in excess of 30% and 45%. The Activity Envelope has been selected to primarily utilize the areas with grades less than 30% where the parcel has already been graded for the existing development. A small area in excess of 45% within the proposed Activity Envelope is the result of previous grading associated with installation of the OWTS tank and qualifies as minor slope anomaly pursuant to Sec. 7-20-20. B. The parcel is mapped within a potential debris flow area. The Applicant engaged Daniel E. Hardin, P.E. of H -P Kumar to analyze the potential impact of debris flow on structures within the Activity Envelope. In the resulting HP -Kumar report dated November 17, 2016, it was noted that the mouth of a drainage area was located approximately 400 feet east of the proposed building site with the potential to impact the parcel. 1-lowever, as stated in the report, "any debris flows from the drainage would have to make a relatively sharp turn to the west in the vicinity of Woody Creek Road and then travel about 100 years down the road. It is our experience that when debris flows are forced to change direction quickly the remaining flow will tend to be mostly a mud flood or muddy water." The report further provides design recommendations to mitigate the potential "mud flow" hazard. C. The parcel is accessed from Woody Creek Road by an existing gravel driveway. The Applicant is proposing to realign the driveway further east in order to increase sight distance. The parcel is mapped within mule deer winter range, to the standards in Sec. 7-20-70. The hazard can be mitigated pursuant to the Impacts to wildlife can be mitigated pursuant The property is within the scenic view protection area ("SVPA") as seen from Woody Creek Road. The proposed single-family residence has been located at the foot of a large hill which reduces the scenic impacts as viewed traveling westbound on Woody Creek Road. In order to avoid the structure projecting above a ridgeline or silhouetting against the sky, the Applicant proposes a single story structure that will not exceed an elevation of 7609.5 feet above sea level. The Applicant has represented that limiting the elevation of structures to 7609.5 feet above sea level will ensure that they will not project above a ridgeline. The proposed floor area is approximately 1,050 square feet. Indigenous earth tone materials or colors will be used on exterior surfaces, and future roofs will have a non -reflective composition. 8. The Director further finds this application was submitted and found complete prior to the adoption of BOCC Ordinance No. 040-2019, and, therefore, is not subject to the provisions of Sections 4-30-60, 7-10-50(h) and 7-20-160. The Applicant is not a proposing renewable energy sources at this time. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Within 60 days of the date of this approval and prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development an Activity Envelope and Site Plan in accordance with Land Use Code Section 2-30-20(g) and Application Manual Sections 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 3. The parcel is exempt from Growth Management for up to 5,750 square feet of floor area. The single- family residence will contain a total of approximately 1,048 square feet of floor area. 4. With a building permit application, the Applicant shall: A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable; B. Demonstrate compliance with the debris flow hazard mitigation recommendations provided in the HP -Kumar report dated November 17, 2019. Include an engineered plan that outlines the design parameters used to size the mitigation structures; C. Provide a copy of an issued County ROW Permit to construct improvements associated with the new driveway access point within the Woody Creek Road ROW; D. Submit an Access Permit for the proposed access improvements. The application shall include: 1) Reclamation plan for the existing driveway; 2) Compliance with the current Road Maintenance and Management Plan; Administrative Decision No. LZ, -2020 Page 3 3) Compliance with all requirements of the Aspen Fire Protection District; 4) Details on all turn arounds and parking locations. E. Complete a fireplace/woodstove registration form with the Community Development Department, if necessary; F. Demonstrate adequate drainage for all low points. If the proposed work disturbs more than 1,500 square feet, the Applicant shall submit engineering documents for storm water detention facilities designed by a professional engineer licensed in the State of Colorado demonstrating historical flow patterns and runoff amounts will be maintained. If the development disturbs one acre or more, a Colorado Department of Public Health and Environment permit for storm water discharges associated with construction activities shall be applied for and obtained prior to issuance of a Permit; G. Provide adequate engineering for any retaining walls over four (4) feet in height and/or any improvements to walls over four (4) feet in height. All retaining walls shall be a maximum of seven (7) feet tall; H. Submit a detailed landscape plan and revegetation plan for disturbed areas. All disturbed areas shall be revegetated with native grasses and/or shrubs. If removal of any tees with 6" or larger diameter at breast height is proposed for purposes other than required wildfire hazard mitigation, provide a tree removal and mitigation plan; I. Submit a detailed exterior lighting plan with the corresponding fixture cut sheets; J. Submit representation of the exterior indigenous earth tone materials or colors. 5. Prior to issuance of any building permits, the Applicant shall pay the applicable road and employee housing impact fees. 6. Prior to final inspection for the single-family residence, the Applicant shall provide a letter from a professional engineer licensed in the State of Colorado that states the as -built condition is consistent with the recommendations proved in the HP -Kumar report dated November 17, 2019. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Decision. The exterior materials shall utilize indigenous earth tone materials or colors and the roofs shall have a non -reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflectivity, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 8. It has been represented that limiting the elevation of structures to 7609.5 feet above sea level will ensure that they will not project above a ridgeline. The single-family residence shall not project above a ridgeline or silhouette against the sky. The Applicant shall comply with the following standards for Development in a Low Wildfire Hazard Area: Administrative Decision No. (Z -2020 Page 4 A. Defensible space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): a) Brush, debris and non -ornamental vegetation shall be removed within a minimum ten - foot (10') perimeter around all structures. b) All branches from trees and brush within 30 feet of all structures (or to the property line) shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels fi•om around trees and brush. c) Tree crown separation for coniferous trees shall be at least 10'. Tree crowns for aspen may touch and interconnect, as long as ladder fuels have been removed from beneath trees. d) Flammable mulches are not allowed within 2' of all structures. Aspen trees shall be at least 10' from the house. e) Up to 5 evergreen trees are allowed within 30' of all structures, but should be limbed to 10' and shall not have any flammable fuels underneath the trees. These trees shall be separated by at least 20', unless clumped together (no more than 3 trees in a clump) in which case the clump shall be separated by at least 30' from another clump or individual tree. f) No trees shall be within 15' of any window. g) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. h) All deadfall up to a one hundred (100) foot perimeter or the property line shall be removed. i) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: a) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. b) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. c) Protrusions above the roofline, such as parapets, shall be prohibited. d) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. e) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Maintenance and Miscellaneous Requirements Administrative Decision No. fl, -2020 Page 5 a) Roofs and gutters shall be kept clear of debris. b) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth (i/4) inch maximum. c) Any outbuilding shall adhere to the same wildfire requirements. d) Yards shall be kept clear of all litter, slash and flammable debris. e) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. f) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. g) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. h) Swimming pools and ponds shall be accessible by the local fire district. i) Fences shall be kept clear of brush and debris. j) Wood fences shall not connect to other structures. k) Fuel tanks shall be installed underground with an approved container. 1) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. m) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. n) Addresses shall be clearly marked with four (4) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. o) Utilities shall be extended underground. 10. The Applicant shall comply with the applicable codes and requirements of the Aspen Fire Protection District, including but not limited to access improvements, turning around of fire apparatus, and installation of an approved fire sprinkler system. 11. The Applicant shall comply with the following to mitigate impacts on wildlife: A. Construction workers are prohibited from bringing dogs on-site. B. Fencing shall comply with the following, except for fencing immediately adjacent to the buildings to contain pets or livestock: 1) Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 54 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3) Mesh or woven wire fences are prohibited, except when used for protection around isolated trees or clumps of trees. C. Avoid landscaping with fruit, nut, or berry producing trees and shrubs. Administrative Decision No. 1& -2020 Page 6 D. Trash/garbage shall be kept in an approved bear resistant container or enclosure during and after construction. E. Access shall be provided to the Colorado Parks and Wildlife for trapping, tagging, studying, or otherwise managing wildlife. F. Bid feeder, including hummingbird feeder, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. G. Horse grains, pellets, and cookies shall be stored in bear resistant containers. 12. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corner of the activity envelope and install construction fencing around the perimeter of the envelope. The fencing shall remain in place until a Certificate of Occupancy is issued for the structure. 13. The Applicant shall comply with the County's Noxious Weed Management Plan. 14. All plants used for landscaping and revegetation shall be native species. Areas disturbed by construction shall be re -vegetated within one growing season of the project's completion. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the residence. 15. No development in excess of 30" above or below natural grade shall occur within the setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 16. No development, including grading, excavation, fill placement, berming, landscaping, construction parking and staging, vegetation removal or disturbance, well or on-site wastewater treatment system, shall occur outside of the approved activity envelope, except to comply with the required wildfire and noxious weed mitigation. 17. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building pewit. Any structures represented in the application may not be permitted under building and zoning regulations. 18. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 19. Statutory vested rights for the approvals referenced herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on Mo.rC�J 941 2023.
