Variance Request Existing Conditions The previously developed subject site is located at the northeast corner of the intersection of Sopris Creek Road and East and West Sopris Creek Road, in Pitkin County’s Emma Caucus. Figure A 2020 Existing Conditions Survey, shows the property is 1.986AC or 86,510-SF, it is zoned RS-30 with a maximum GFA of 5,750SF. The grading and drainage run generally undisturbed sloping downward east to west, with the lowest point being Sopris Creek at the western end. The site is terraced into two platforms defined by an existing retaining wall east of center, creating an upper eastern platform with a narrow portion of developable and already disturbed area and a lower western platform mostly undeveloped and almost entirely encompassed by the 100-FT wetland setback. See Figure B, drawing #5 for a diagram indicating the only developable area, roughly 17%. Access to the property is on the southern end through an existing curbcut and gravel driveway accessed from East Sopris Creek Road. The majority of the driveway is on the eastern upper platform which is the narrowest, most developed and developable portion of the site. The driveway connects the two existing buildings in the property. The first is at the southeast corner, a two- story gambrel roof structure with a two-car garage below and a partially finished one-bedroom apartment above, with concrete pads and retaining walls on either end, and an underground OWTS. The second structure is a two-story single-family residence at the northeastern edge of the property straddling both platforms. There are other minor man-made structures such as retaining walls, spigots and concrete pads, as well as a perimeter wood fence spanning most of the eastern and northern property lines. Both existing structures are considered non-conforming as the result of zoning changes which makes the lot substandard in size and the structures to encroach on setbacks The lower western platform is wider and less disturbed with only a portion of the single-family residence and its underground OWTS. Sopris Creek runs north/south for the entire western edge of the property. A wetland has been mapped on the survey east of the creek, as well as the 100-FT setback encompassing the majority of the lower platform. Riparian vegetation edges the creek on both sides, especially on the west side creating a dense buffer between Sopris Creek Road and the property. Background The existing house is a two-level ranch style with 4-bedrooms and a total of 3,000-SF and a 365-SF crawl space. It was built in the 1950’s as a two-level 3-bedroom home. Community Development Department records document a setback variance request and approval from 1987, to add a fourth bedroom (master with bath) within the eastern sideyard and rearyard setbacks, see Figure G. Aside from the master addition on the east side, an elevated living area was added on the west side, see Figure I for location of approved 1987 additions. The earliest records for the existing garage with partially finished 1-bedroom above are from 1979. Case #79-98 was an application for a two-story barn for a livestock operation with a height variance, see Figure J. A Building Permit was issued, Electric Inspection was passed and there is a letter from the Building Department stating adequate setbacks at the time. In 1981, the owners applied for a Special Review to establish an 815-SF additional dwelling unit on the barn’s second level. Apparently, construction began concurrent with the permit process and a 1,000-gallon single-compartment septic system and 12’x50’ STA was approved and built under Environmental Health Department permit #80064. However, the application was eventually denied because the water supply proposed was found to be inadequate as it was the existing shared domestic water well (#44618 from 1971) already connected to the principal dwelling. The ADU was left with the interior only partially finished, connected to the septic system and to the shared well. This structure will be referred to as the garage/proposed CDU for the remainder of the application. The applicant is currently under Land Use Review #P063-19 for Activity Envelope, Site Plan Review, Special Review for a Caretaker Dwelling Unit (CDU), and Restoration without Significant Changes for the main house and garage/CDU. That application addresses existing encroachments on the western wetland setback and how the proposed CDU will be brought to compliance, including removal of the shared well connection. Variance Requests Hardship #1: As described in the existing conditions, as a result of zoning changes there is only a small and unusually narrow portion of the site available for development, see Figure B drawing #5/A1. After careful consideration of current land-use and building codes in the context of existing site constraints, the applicant and consultants have concluded that replacing the single- family residence and remodeling/repairing the garage/proposed CDU are the least impactful courses of action for the already developed site and the only way to fit all development components in the site as it allows a reduced wetland setback of 50-FT per §9-20-50(c)(3). Comparing Figure A 2020 Existing Conditions Survey with Figure B Proposed Site Diagram shows how new impacts are minimized, while fitting all required and proposed development components: a new 2-car garage adjacent to the replacement house, driveway modifications to accommodate the fire truck turn-around and a water storage tank with dry-hydrant as requested by the Fire Department, installation of replacement code compliant OWTS for both structures, remodel/repair of the garage/proposed CDU and required site improvements around both structures. Parcel ID | 246513400022 verso-arch.com 5 | 28 Hardship #2: The proposed strategy best aligns with Pitkin’s goals. Trying to place all components in the small and narrow developable space is not possible and would result in the opposite conditions listed below, and Site Plan approval would most likely be denied. ▪It requires the least amount of grading as only minor modifications around both structures would be required in order to adjust to new conditions and code requirements for access and site stairs. §7-20-10&20 ▪Minimal grading also results in less disturbance to existing trees, vegetation, and water flow patterns. §7-20-30 ▪Reusing existing siting and/or structures results in the greatest separation between them, which is ideal for scenic view protection §7-20-120, for wildlife habitat §7-20-70 and for wildfire mitigation §7-20-60. See Figure L. ▪The main house remaining partially in the lower platform maximizes views of surrounding ridgelines. If relocated, the structure would end up at the upper platform, and therefore 8-FT to 10-FT higher in elevation, §7-20-120. See Figure L. ▪The main house will continue to sit perpendicular to Sopris Creek Rd, which minimizes the visible mass from the road. Otherwise, it would have to be sited parallel to the road, doubling or tripling visible mass. §7-20-120 ▪This orientation is best for solar access, maximizing the benefits of high summer vs low winter sun for passive temperature control and daylighting. Relocating the house would create Hardship #3, ineffective solar orientation. See Figure C Main House Replacement Plans for the proposed, which is designed to be a compact two-level rectangle in order to fit within the existing footprint per §9-20-50(c)(3), reduce setback encroachments, and greatly improve upon structural and energy efficiency. This is achieved by keeping the main rectangular portion of the existing footprint while eliminating bump-outs and infilling indentations and overhangs, which are harder to insulate and protrude further into setbacks. This results in the following modifications and variance requests, which mostly reduce area and improve setback dimensions: Request for rear setback encroachment of 23.5-FT, instead of the current 27.8-FT. This is the result of a volume increase of 5-SF at the lower level while eliminating 75.5-SF of the northern bump out. Plus, a volume increase of 35- SF at the upper level while eliminating 87.5-SF of the northern bump out. See Figure B. Height/volume increase proposed in the rear setback will remain under the maximum 28-FT. Top of ridge would increase by approximately 5-FT, current top of ridge is at 6800.9-FT and the highest point of the new roof is planned for approximately 6805.9-FT. See Figure D, page 13 and 14. Partial encroachment of new HVAC units within the rear setback, approximately 30-IN. The units must be close to the house and no more than 30-FT from the space served. The entire house perimeter is within a setback, except for ±24- LF by the main entry, which need to remain clear of obstructions for access and to allow for a weather protected connection between the house and garage entries with a new <8-FT deep canopy. Currently assuming five (5) 36-IN tall units behind the proposed garage, whose size and location is determined by the setbacks and to fit the required fire-truck turnaround without creating new encroachments on the side with site walls taller than 30-IN to retain the >30% slopes in that area. Once the ventilation system is designed, it may result in a possible reduction of the number of units or selection of smaller ones under 30-IN in height. Reference Figure B. Side setback will decrease by ±10-IN, to 49.5-FT, but remains in compliance with the 30-FT minimum. See Figure E Existing Garage/proposed CDU Floor Plans for the proposed repairs/remodel and the existing encroachments on the eastern side setback. Exterior repairs include replacement windows, site improvements to address drainage and access, siding and roofing repairs, and repair or possible replacement of the upper level entry vestibule. If the CDU is approved, there will also be a modest interior remodel to finish the 1-bedroom apartment and comply with code. The following encroachments will be increased but are allowed per §5-20-100. First, the existing site steps will be reconfigured to meet code and therefore extend further into the setback. Second, the entry deck will be replaced and expanded with code compliant stairs but will be uncovered and less than 30-IN above grade. Below is a summary of the work requiring variances or occurring in the setback: The upper level entry vestibule needs to be repaired or replaced. The scope is not fully defined but will be done in a manner as to not increase non-conformity and meet code. See Figure E and Figure F. The existing gambrel roof height is approximately 2.16-FT over the 20-FT maximum height for accessory structures. The roof will remain the same, the plan is to only repair as required. See Figure F. Handrails for existing deck stair replacement as required per code. Thank you for your consideration of this application. The Applicant believes all information necessary for evaluation is provided and that it demonstrates the scope of work will be the least impactful course of action for the site. Granting the proposed variances will not cause detriment to the public good, nor will it impair the intent or purpose of the Pitkin County Comprehensive Plan and Land Use Code. The variance requests will mostly result in reduction of existing encroachments as described above and documented in the Site Diagram.
