Main St., Suite#302 P.O. Box 130 Aspen, CO 81611 Glenwood Springs, CO 81602 The Provision of Crystal River Embankment Restoration (the "Contract") dated February 14, 2020 between the Board of County Commissioners of Pitkin County, Colorado (the "County") and Gould Construction(the "Contractor"), is hereby amended as follows: Description of Change: 1. Extension of project term through November 30, 2020 for continued monitoring of vane placement that does not match project surveying and drawings for placement. 2. Incorporation of contingency language for Contractor remobilization in the event that the vane placement proves to be an issue over the monitoring period. 3. Release of project retention upon this Change Orders execution. Reason for Change: 1. Contractor placed protective vane roughly Twenty-Five feet(25') further downstream than surveying and project plans displayed. County may be willing to accept this placement upon further monitoring of river flows during runoff and high-water season. For this reason, the project term is hereby extended through November 30, 2020 for monitoring and potential call-back for remedies. 2. Incorporation of the following contingency language: Pitkin County, assisted by SGM, will monitor the vane placement during runoff to ensure it is adequately protecting the bank bridge abutment without negatively impacting the middle pier. The vane was partially constructed in the private bridge easement and the neighboring landowners will continue to watch for the success of the vane,but may ask to have it moved out of their easement, regardless of Pitkin County and SGM's recommendations and observations. Pitkin County acknowledges that the project is substantially completed aside from the above potential remobilization. For this reason, upon execution of this change order, all project retention held shall be released to Gould in good faith that Gould will remobilize if required due to monitored inadequacies of vane placement or at the request of the adjacent landowners. To request paper or electronic copies from Pitkin County To request delivery from us of paper or electronic copies of the notices and disclosures previously provided by us to you electronically, you should request those documents from Pitkin County under the Colorado Open Records Act by contacting the Pitkin County custodian who sent you the document for signature. To withdraw your consent with Pitkin County To inform us that you no longer want to receive future notices and disclosures in electronic format you may: i. decline to sign a document from within your DocuSign account, and on the subsequent page, select the check-box indicating you wish to withdraw your consent, or you may; ii. send us an e-mail to Helpdesk@provelocity.com and in the body of such a request, you must state your e-mail, full name, Postal Address, telephone number, and account number.
