Vos Caudill, Pitkin County, CO RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, APPROVING THE JOSEPH AND DEBORAH SCHOEBERLEIN ACTIVITY ENVELOPE AND SITE PLAN REVIEW APPROVAL Resolution No. 100 - 2020 RECITALS 1. Joseph Schoeberlein ("Applicant") applied to the Community Development Director ("Director") for Activity Envelope/Site Plan Review approval to construct a single fancily residence on an undeveloped lot. The Director opted to refer the application to the BOCC for review as permitted by Sec. 2-30- 20(i), due to the visibility of the lot and height of the residence, and in response to concerns raised by the neighbors. 2. The lot is located on Gateway Road, and is described as Lot 1, Block 3, Gateway of Snowmass Mesa, Filing #2. 3. The lot is zoned R-30 and contains 1.01 acres. 4. The lot is located within a subdivision that was approved prior to June 12, 1978; therefore, the lot is eligible for a growth management exemption of up to 5,750 square feet of floor area, pursuant to Sec. 6- 30-100. 5. The Board of County Commissioners (BOCC) granted Activity Envelope and Site Plan review approval to construct a single-family residence on the lot pursuant to BOCC Resolution No. 041-2008. The BOCC found there were no alternate building siteson the lot where the proposed residence could not project above the ridgeline as seen from Snowmass and Capitol Creek Roads, and that the proposed development's height and bulk had been designed to avoid, to the maximum extent practicable, the visibility of buildings from Snowmass and Capitol Creek Roads. The vested rights for the Activity Envelope and Site Plan approval expired in 2011, and the approval lapsed in 2018. 6. The BOCC considered the application at a duly noticed public hearing on October 14, 2020, at which time evidence and testimony were presented with respect to this application. 7. The BOCC finds that the proposed activity envelope and site plan is consistent with the applicable requirements of the Code, as follows: A. The activity envelope avoids slopes in excess of 30% and the small areas of slopes in excess of 30% qualify as minor slope anomalies pursuant to Sec. 7-20-20(c)(3) of the Code. B. The wildfire hazard is rated as severe, and can be mitigated pursuant to the provisions of Sec. 7-20- 60(c) of the Code. C. The activity envelope is located within mule deer winter range and bear human conflict area, where development is permitted pursuant to Sec. 7-20-70, subject to mitigation. D. The lot is within a mapped Mancos Shale area; development is permitted pursuant to Sec. 7-20- 50(f) of the Code, subject to mitigation. E. The solar panels on the roof of the residence and garage as well as the existing south-west facing driveway, will comply with Sec. 7-20-160 of the Code. F. The Pitkin County Road Management and Maintenance Plan requires a 16-foot wide driveway, which may be reduced if there is a good cause. To lessen disturbance, the Applicant agreed to widen the driveway to 16-feet along a little more than half of its length, with a transition to 12-feet RECEPTION#: 669921, 10/28/2020 at 11:33:24 AM, Pgs 2 of 22, Janice K. Vos Caudill, Pitkin County, CO Resolution No. _100- 2020 Page 2 of 8 _closer to the residence in order to preserve the hillside and avoid placing retaining walls alongside the proposed driveway. 8. The BOCC finds that there are no alternate building sites on the lot where the house could be placed .. so it does not projectabove the ridgeline as seen from Snowmass and Capitol Creek Roads, and that the -proposed development's height and bulk have been designed to lessen, to the maximum extent practicable, the visibility of buildings from Snowmass and Capitol Creek Roads NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it _does hereby approve the Schoeberlein Activity Envelope and Site Plan Review, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. This Resolution replaces BOCC Resolution No. 41-2008. 2. The Applicant shall adhere to all material representations made in the application or in public meetings and shall consider those representations to be conditions of approval, unless amended by other conditions. 3. The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved herein. The exterior materials (facade and roofing) for the residence shall have natural earth tone colors that blend with the colors of the surrounding landscape and shall be non -reflective.• Samples of exterior materials shall be reviewed and approved by Community Development prior to building permit application. The residence shall be substantially consistent with the elevations and photo simulations attached as Exhibits A and B. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 4. Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The Activity Envelope and Site Plan shall be amended as follows, prior to recordation: A. Label the driveway widths on the Activity Envelope and Site Plan B. Label the residence and garage building heights 5. The lot is exempt from Growth Management up to 5,750 square feet of floor area. 6. Prior to building permit issuance, the Applicant shall pay the applicable road and employee housing impact fees. 7. With a building permit application for the residence the Applicant shall: A. Submit a letter of intent to provide water service from Gateway to Snowmass Mesa/Gateway Metropolitan District community water system. B. The Applicant shall supply adequate drainage for all low points. If the proposed work disturbs more than 1,500 square feet, the Applicant shall submit engineering documents for stormwater detention factilities designed by a professional engineer licensed in the State of Colorado, demonstrating that historical flow patterns and runoff amounts will be maintained. Vos Caudill, Pitkin County, CO Resolution No. 100 - 2020 Page 3 of 8 Environment permit for stormwater discharges associated with construction activities shall be applied for and obtained prior to issuance of a permit. C. The Applicant shall provide adequate engineering of any retaining walls over four (4) feet in height and/or any improvements to walls over four (4) feet in height. All retaining walls shall be a maximum of seven feet (7') tall. D. Submit a driveway/access permit application to improve the existing driveway, which shall be reviewed and approved by the Planning Engineer and the Roaring Fork Fire & Rescue Authority (RFFRA). A Board of Adjustment approval may be required if the grade change within the setback is more than 6'. The application shall include: 1) Compliance with the current Road Maintenance and Management Plan, 2) Compliance with all requirements of the Fire Department, 3) Driveway plan and profile, and 4) Details on all turn arounds and parking locations. E. Submit and comply with all conditions of the current Pitkin County Construction Management Plan Requirements Manual. A construction management inspection will be required prior to the first building inspection. F. Submit an Onsite Wastewater Treatment System construction permit application to Environmental Health. G. Submit a detailed landscape plan with appropriate species. H. Submit a detailed exterior lighting plan with the corresponding fixture cut sheets. Exterior lighting shall comply with the lighting code. I. Subunit representations of the exterior indigenous earth tone materials or colors. J. Complete a fireplace/woodstove registration form with the Community Development Department, if necessary. 8. Landscaping shall be substantially consistent with the landscaping shown on the site plan. Areas disturbed by construction shall be re -vegetated within one growing season of the project's completion. 9. The Applicant shall comply with the following standards for Development in a Severe Wildfire Hazard Area: A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) The area within 15' of the structure and the furthermost projection of combustible construction shall be of primarily noncombustible hardscape surfaces, low growing perennials, flowerbeds, cut grass and deciduous, well -trimmed and irrigated plants. Woody vegetation should not be planted within this area. 2) Beyond 15' and up to 65' downslope of and 35' on contour from the structure and the furthermost projection of combustible construction or to the property line, maintain natural and/or irrigated grass at less than 6" and thin existing trees and brush into individuals or clusters. Oak, serviceberry, junipers, sage and brush shall be thinned and clustered. Limbs of trees shall be pruned to ''A the height of the tree or 10' whichever is less. No brush or shrubs which when mature shall be tall enough to act as ladder fuels shall be installed or marinated around the trees. Vos Caudill, Pitkin County, CO Resolution No. 100 - 2020 Page 4 of 8 and from those beyond the 65' area by a distance of 2 %z times the height of the mature vegetation. The diameter of a cluster shall be limited to 2 %z times the height of the mature vegetation. Thin and remove lower branches of brush or shrubs within clusters or individual plants to eliminate ladder fuel. Treat cut ends with an herbicide to prevent resprouting. .-3) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 4) All deadfall up to a one hundred (100) foot perimeter shall be removed. 5) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. Roof Venting: 1) Soffit venting shall be located in the outer 1/3' portion of the overhang. 2) Attic, soffit and other roof venting shall be of non -corrosive metal mesh with maximum %" • openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other: One hour rated material or any material underlain by 5/8" Type X gypboard or equal, or "Type IV" Heavy Timber materials, per the currently adopted building code. E. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline: 1) Construction with noncombustible or one (1) hour rated material, or material with flame spread <25 (tested to ASTM E84 and listed for exterior use), or 2) Conventionally framed deck with waterproof surface and underside protected with 5/8" Type X gypboard or equal (decking as "a" above), or 3) "Type IV" Heavy Timber materials: joist and beams minimum 6"xl0", columns minimum 8"x8", decking minimum 4" in depth, or decking as "a" above; or equivalent log construction, or 4) Enclose projection vertically to ground with one hour fire resistive materials. Decking as "a" above. F. Railings: Railings must be constructed of noncombustible or "Type IV" Heavy Timber materials. RECEPTION#: 669921, 10/28/2020 at 11:33:24 AM, Pgs 5 of 22, Janice K. Exterior of the Structure, Including All Walls: 1) One (1) hour fire resistive rated materials, or 2) 5/8" gypboard underlying combustible materials, or 3) Cement stucco, minimum 3/a" thickness. 4) All glazing to be tempered glazing; and 5) Doors to be metal or wood 1 3/4" thick minimum. H. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and constructed with materials approved for one (1) hour fire -resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. I. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Any outbuilding shall adhere to the same wildfire requirements. 3) Yards shall be kept clear of all litter, slash and flammable debris. 4) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 5) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 6) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 7) Swimming pools and ponds shall be accessible by the local fire district. 8) Fences shall be kept clear of brush and debris. 9) Wood fences shall not connect to other structures. 10) Fuel tanks shall be installed underground with an approved container. 11) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire -resistive construction on the exterior side of the walls. 12) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 13) Addresses shall be clearly marked with four (4) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non-combustible post. J. The Applicant shall comply with the applicable codes and requirements of the Roaring Fork Fire & Rescue Authority (RFFRA) referenced in the August 10, 2020 Wildfire Hazard Report (Exhibit C). These include but are not limited to access, adequate area for turning around of fire equipment, installation of an approved fire sprinkler system and provision of an adequate water supply for firefighting. 10. The Applicant shall comply with the following conditions regarding wildlife: A. Manipulation of vegetation outside of the activity envelope is prohibited, except as necessary to comply with the wildfire hazard mitigation measures. B. Fences shall comply with the following standards: 1) Mesh or woven wire fences are prohibited outside the Activity Envelope. RECEPTION#: 669921, 10/28/2020 at 11:33:24 AM, Pgs 6 of 22, Janice K. Vos Caudill, Pitkin County, CO Resolution No. _100- 2020 Page6of8 2) Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in width (top view), and shall have at least eighteen (18) inches between the lower two (2) rails. 3) Wire fencing must be three (3) strands or less. The top wire should be a twelve -point -five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. C. Dogs shall be kenneled within 50' of the residential buildings or leashed under human supervision when outside a required kennel. Contractors shall be prohibited from bringing their dogs on -site. D. Landscaping shall not include nut, berry or fruit producing trees or shrubs palatable to bears. E. Trash/garbage shall be kept in an approved bear resistant container or enclosure as required by the County's Wildlife Protection Ordinance. F. Outside doors shall utilize only solid round handled doorknobs unless another type is required by applicable building code for disabled accessibility purposes, or is approved by Colorado Parks and Wildlife as bear -proof. G. Bird feeders, including hummingbird feeders, shall be hung away from any deck or window, and shall be at least 10' from the ground suspended between 2 trees or posts. All seed feeders shall include a seed catchment pan to catch discarded seeds. Bird feeders should be removed from April through November. 11. No development shall occur outside of the approved activity envelope, with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described in #8. 12. The roof mounted solar panels shall comply with Secs. 7-20-160 of the Code, including but not limited to the following: A. The roof mounted solar energy collectors and other ancillary development (racking assembly, balancing system, utility boxes, etc.) shall have a "matte" finish or be of a non -reflective material/color. Equipment that is painted shall be maintained. B. Solar energy collectors shall not protrude above the ridge of the roof. C. The new residence shall have a minimum of thirty-five (35) percent of total roof space constructed for solar gain and be wired pursuant to the Pitkin County Building code for the construction of solar energy collectors. 13. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy is issued for the structures. 14. No structural development in excess of 30", with the exception of fencing, shall occur within the setbacks of the parcel. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 16. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. 17. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2-20-170 and C.R.S., § 24-68-105. Thank you for the opportunity to comment on the project at this time. Doing so has helped us to understand the project in a more complete manner. Driveway Access. The following standards shall be met in providing a compliant driveway access to the buildings on the property: • Driveway access shall terminate at a point no less than where all parts of the exterior of the buildings can be reached using a 150' hoseline; • Driveway of .0-200' in length shall be a minimum width of 12 feet; • Vertical clearance shall be a minimum of 13'6"; • Grades shall be limited to no more than 10%; a 2% deviation above 10% is permissible over a distance of </= 250'; • Curves and turns in the driveway shall have a minimum 30' inside radius; • If the driveway exceeds 150' in length, an approved turn around is required at the termination; • The driveway shall be H2O rated capable of withstanding the weight of a 70,000-pound truck. The Gateway Subdivision Water Supply has a compliantt water system to serve this property. An additional water supply for Firefighting is not required. Wildfire Hazard Mitigation. Based upon location and topography, this property is considered to be in an area of Severe Wildfire Risk. Pitkin County has outlined various requirements that shall be satisfied during the construction process. • Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): o Brush, debris, and non -ornamental vegetation shall be removed within a minimum 10-foot perimeter around the structure; o Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30-foot perimeter around the structure; o Spacing between clumps of brush and vegetation within the 30- foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. A Class A Roof Assembly (preferred) or the use of Class A Roofing Materials is required for all new structures. Pitkin County offers the following guidelines: o Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the building code. Wood shake/shingle roof coverings are prohibited. Protrusions above the roofline, such as parapets, shall be prohibited; o Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48; o All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. Fire Sprinkler System. As the property is located in a Severe Wildfire Hazard Area, a Fire Sprinkler System shall be required: • The system shall be installed in accordance with NFPA 13D, current edition, and the following amendments: o A 1 1/2" Fire Department Connection (FDC) is required; o An exterior Horn/Strobe shall be installed above the FDC (-10') and in the vicinity of the FDC, facing the street; o Any Attic or Crawl Spaces used for storage or energized mechanical equipment shall be sprinkled; o The garage shall only be sprinkled if energized mechanical equipment is in this space; o A 20' minimum water supply shall be provided. Fire Alarm System. For all Single -Family Dwellings, a Fire Alarm System with the following devices shall be supplied: • Smoke Detectors are required in every bedroom and in the adjacent hallways. They shall be interconnected such that when one device activates, all the devices will go into a local alarm mode; • Heat Detectors are recommended for all mechanical rooms; RECEPTION#: 669921, 10/28/2020 at 11:33:24 AM, Pgs 20 of 22, Janice K. Vos Caudill, Pitkin County, CO Roaring Fork Fire Rescue Authority 1089 JW Drive Carbondale, CO 81623 970.340.7040 roaringforkfire.org ARING FORK FIRE RESCUE SCOTT THOMPSON FIRE CHIEF • If there are to be fuel burning appliances in the buildings, Carbon Monoxide Detectors shall be centrally located outside of each separate sleeping area in the immediate vicinity of the bedrooms or sleeping rooms and on each level of the residence. All rooms with fuel burning appliances shall have a Carbon Monoxide Detector. If the mechanical room is less than 50 Sq. Ft., the Carbon Monoxide Detector shall be located outside of the room adjacent to the door of the room. All Carbon Monoxide Detectors shall be interconnected and initiate a General Alarm that is relayed to Aspen Dispatch to initiate a Fire Department response. Please consult Pitkin County Ordinance Section 11.38 for further guidance on the use of Carbon Monoxide Detectors; • A Fire Sprinkler Flow Switch is required. Upon initiation, the switch shall activate a General Alarm and send notification to a Central Monitoring Agency; • It is recommended that the Fire Alarm System be fully monitored to best protect the property in the owners' absence. Fire Extinguishers. During construction and in the completed structures, a minimum 5# ABC Fire Extinguisher shall be installed along the path of exit egress on every floor. It shall be mounted at a height of 48" above the finished floor. Inspections. The following inspections shall be performed prior to the issuance of the Certificate of Occupancy. • Driveway access and Pullouts, if required, are to be inspected at some point early in the construction; • Fire Sprinkler System. A Rough In Inspection of the system shall be required before the pipe is covered. For copper pipe systems all heads, pipe, hangers and bracing shall be present and a compliant Hydrostatic Test shall be in place. A constant pressure of 200 PSI on the system without leaks for a minimum of 2 hours will constitute an approved Hydrostatic Test. For CPVC pipe systems, the Rough In Inspection shall be performed with only the pipe, hangers and bracing installed. No heads shall be installed at this time. Upon approval of this inspection, the heads may be installed and a hydrostatic test as above performed. For "Red Pipe" systems the rough in inspection is normally just an inspection of the layout prior to being covered. The Hydrostatic Test is conducted at another time as per the Manufacturer's Specifications and witnessed by the Fire Department. The Final Test and Inspection consists of confirming appropriate trim installation, a Flow Switch and Tamper Switch Tests and operation of the Fire Pump (if present) for 10 minutes. The Flow Switch activation shall initiate a General Alarm, the Horn/Strobe and Central Monitoring notification. The Tamper Switch shall only activate a Supervisory Alarm • Fire Alarm System. Two inspections are required to certify a compliant Fire Alarm System. A Rough In Wire Inspection shall be conducted before the alarm wire is covered. A Final Test and Inspection is to be performed at the completion of the project. • Life Safety Inspection. At the time of the Fire Sprinkler and d Fire Alarm Final Test and Inspection, a general Life Safety Inspection will be conducted to ensure that all fire protection equipment and devices are present and operable and that there are no life safety hazards evident.
