ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITHIN
COUNTY, COLORADO, GRANTING A REZONING OF THE ASPEN HIGHLANDS
SHI AREA FROM AFR40 TO AF-SHI
Ordinance #96-1:3
RECITALS
1. The Aspen Skiing Company (ASC) has submitted an application to rezone the Aspen
Highlands Ski Area from AFR40 to AF-SKI (as described in Exhibit "A" attached).
2. The A.SC has submitted a proposed Master Plan for the ski area in accordance with the
provisions of the AF-SKI zone district.
3. The Pitkin County Planning and Zoning Commission reviewed this application at their
regularly scheduled public meetings on June 21, 1994 and November I5, 1994. Based on evidence
and testimony presented with respect to the Master plan at those meetings, the Planning
Commission recommended that the Board of County Commissioners approve the proposed
rezoning and Master Plan subject to conditions.
4. The Board of County Commissioners finds that the proposed rezoning is consistent with the
intent of the AF�SKI zone district and Land Use Code Policy Section 2-5, which state,
"The AF-SKI, Agricultural/Forestry Ski zone district is intended to provide locations for ski
areas and the orderly and efficient planning and review of ski areas. The AF-SKI
designation should be applied to lands which are used for downhill and cross-country skiing
and a variety of other uses permitted or approved by a Federal or similar agency, such as
grazing, hunting and passive recreational uses. Development activity on such lands shall be
contingent upon the adoption of a master plan. The AF-SM designation should be applied
only to ski areas which are consistent with the Land Use Code policy for Development or
Expansion of Ski Areas (refer to Section 2-5)."
"Section 2-5: Development or Expansion of Ski Areas. It is the policy of the County to
favor the upper mountain expansion of existing skiing areas or new skiing areas without
