Vos Caudill, Pitkin County, CO AN EMERGENCY ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AMENDING ORDINANCE 02-19 REGARDING THE PURCHASE OF THE SUNFIRE RANCH CONSERVATION EASEMENT ORDINANCE NO. 046 -2020 RECITALS WHEREAS, Pursuant to 30-35-301 C.R.S., the Board of County Commissioners ("BOCC") of Home Rule Counties is authorized to make and publish ordinances for carrying into effect or discharging the powers and duties conferred upon such counties by law and as seems necessary. WHEREAS, Pursuant to Section 2.8.2 of the Home Rule Charter ("HRC"), the Board of County Commissioners is authorized to take official action by Emergency Ordinance for certain matters where action is prescribed pursuant to the Colorado Revised Statutes as amended. WHEREAS, Pursuant to Ordinance 02-19 the BOCC approved the purchase of the Sunfire Ranch Conservation Easement and said Ordinance anticipated at $1,000,000 contribution from GOCO and a $100,000 contribution from AVLT. WHEREAS, the $100,000 contribution from AVLT was reallocated to the TD Ranch Preserve purchase, it is necessary to increase the Open Space budget appropriation for the Sunfire Ranch Conservation Easement by the same amount. WHEREAS, on January 14, 2020 the Pitkin County Open Space Board of Trustees unanimously recommended that the Open Space share of the Sunfire Ranch Conservation Easement Purchase price be increased from $8,900,000 to $9,000,000. WHEREAS, closing on said purchase must occur before year's end to secure the contribution from GOCO. WHEREAS, The BOCC finds that adoption of this ordinance is necessary for the immediate preservation of the public health, safety and welfare of the citizens of Pitkin County and therefore declares this ordinance and legislation to be effective immediately pursuant to HRC Section 2.8.2. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado that it hereby adopts an Ordinance Amending Ordinance 02-19 Regarding the Purchase of the Sunfire Ranch Conservation Easement in the following manner: 1. The prior approval of an expenditure of up to "$8,900,000" is amended to authorize and expenditure of up to $9,000,000 for the Conservation Easement and covenants that will restrict uses on the 1240 acre ranch. 2. The prior approval of an expenditure of up to "10,000" for transaction costs is amended to be "$20,000." 3.
