The engineer must do a final inspection of the installation and submit an "as -built" letter to this Department within 30 days of the final inspection, unless a longer period of lime has been agreed upon, in writing. This Department must also be called for the final inspection with a minimum of 48-hours notice. Minimum horizontal distances between components of the system and physical features shall conform to the requirements of the Pitkin County OWTS Regulation. This Permit is conditioned upon the property owner(s) providing for regular inspection, cleaning, and maintenance of the system by qualified personnel, in accordance with the manufacturer's recommendations and the requirements of the Pitkin County OWTS Regulation. Issuance of this OWTS Construction Permit does not constitute a guarantee, warranty, or representation by the Department that the system will operate properly or will not fail. Issuance of this permit does not imply compliance with Pitkin County building and/or land use regulations, nor guarantee issuance of building and/or land use permits. I\ new CONCRETE "Baffled" Splitter Box will evenly distribute flow to each of the new infiltrator trenches in each of the new systems. Splitter box shall have an access lid extended to within 6" of final grade. Splitter box must be installed on solid cornpacted soils to insure box is set flat and will not settle. All pipe bedding to consist of a minimal of 2" under and 6" over the pipe of native soils with nrvF ximum sized material of 1". Hake trench bottoms and sidewaalls prior to installation of infiltrators. System location to be field determined to reduce tree and vegetation removal, site conditions, and maintain setbacks. Contour the trenches to fit site conditions and the topo of the site. Changes must be approved by the engineer and homeowner. Trenches are to be 10' apart. Minimum depth = 12"; maximum depth = 18" to top of infiltrator. Install access ports/vents on each row of trenches. Use collar on vent as it penetrates the infiltrator to insure pipe does not drop into infiltrator„ Trenches to be with in 0.1" of level across the entire length of each row. Install splash plates under the entry and exit piping at each end of each row of infiltrators. (Splash Plate a 1' Wide and 18" Long). The engineer shall finalize elevations of the tank and trenches in the field. Installation and operation shall be approved by the engineer prior to final acceptance. Owner is recommended to pump the septic tank at 2gyear intervals and change the Biotube. Landscaping and watering us on top of septic field shall be minimized or eliminated. System must meet all Pitkin County ISDS requirements and MWE design standards and must be inspected by iViVVE and Pitkin County prior to Final Approval. Provide adequate notice for inspections. We will both need to inspect the tank installation, distribution piping, new infiltrators, splitter box. The testing was done in addition to and in accordance with our agreement for professional services to Kaegebein Fine Homebuilding, dated January 21, 2014. A profile pit and three percolation test holes had been excavated by others at each test location shown on Figures 1 through 1 E. The subsoils exposed in the Profile Pits were variable and below the topsoil consisted of sandy silt and clay, silty sand and silty sand and gravel with cobbles to the bottom pit depths of 81/2 to 9 feet feet. No free water was observed in the pits and the soils were slightly moist to moist. Percolation test holes were hand dug in the bottom of shallow backhoe pits and soaked with water the day prior to testing. Percolation testing was conducted on April 4 and 8, 2014, by a representative of Hepworth - Pawlak Geotechnical, Inc. The percolation test results are summarized in Table 1 for each of the 6 locations. Based on the subsurface conditions encountered and the percolation test results, the tested areas should be suitable for a conventional infiltration septic disposal system. The project site is shown on Figure 1. The purpose of the study was to develop recommendations for the foundation design. The study was conducted as additional services to and in accordance with our agreement for geotechnical engineering services to Kaegebein Fine Homebuilding, dated January 21, 2014. We previously conducted a rockfall risk assessment to a residence constructed on Homestead 1 and presented our findings in a report dated July 1, 2014. A field exploration program consisting of an exploratory boring was conducted to obtain information on the subsurface conditions. Samples of the subsoils obtained during the field exploration were tested in the laboratory to determine their classification and other engineering characteristics. The results of the field exploration and laboratory testing were analyzed to develop recommendations for foundation types, depths and allowable pressures for the proposed building foundation. This report summarizes the data obtained during this study and presents our conclusions, design recommendations and other geotechnical engineering considerations based on the proposed construction and the subsurface conditions encountered. PROPOSED CONSTRUCTION The proposed residence will be a 2-story, wood frame structure with a total living area of 5,750 square feet and ground floor over a 5'-6" deep crawlspace, and located as shown on Figure 1. As a result of a rockfall risk assessment to Homestead 1, the building location was moved to the southwest part of the building envelope to avoid potential rockfall impact and the original proposed building location was abandoned. The garage floor will be slab -on -grade. Grading for the structure will be relatively minor with cut depths up to about 6 feet. We assume relatively light foundation loadings, typical of the proposed type of construction. J'ob No. 114 019A eetech If building location, grading or loading information changes significantly from that described above, we should be notified to re-evaluate the recommendations presented in this report. SUE' ' CONCN[JAWNS The building site was vacant, irrigated pasture at the time of our field exploration. The proposed boring location had been staked by others near the center of the original building site. The ground surface slopes gently down to the southwest with about 2 feet of elevation difference across the proposed building footprint. Vegetation consists of field grass and weeds. FIELD EXPLORAT1[ON The field exploration for the project was conducted on April 3, 2014. One exploratory boring was drilled at the original building location shown on Figure 1 to evaluate the subsurface conditions. The boring was advanced with 4 inch diameter continuous 'fight augers powered by a truck -mounted CME-45I3 drill rig. The boring was logged by a representative of Hepworth-Pawlak Geotechnical, Inc. Samples of the subsoils were taken with 1% inch and 2-inch T.D. spoon samplers. The samplers were driven into the subsoils at various depths with blows from a 140 pound hammer falling 30 inches. This test is similar to the standard penetration test described by ASTM Method D-1586. The penetration resistance values are an indication of the relative density or consistency of the subsoils. Depths at which the samples were taken and the penetration resistance values are shown on Log of Exploratory l3ori.ng, Figure 2. The samples were returned to our office for review by the project engineer and testing. SUBSURFACE CON 'MEOWS A graphic log of the subsurface conditions encountered at the site is shown on Figure 2. The subsoils, below about %2 foot of topsoil, consist of 2 feet of medium, sandy silt and JobNo. t 14 019A G t i 3 ., clay overlying medium dense, silty sand and gravel with scattered cobbles and possible small boulders to the boring depth of 18 feet. Drilling in the coarse granular soil with auger equipment was difficult due to the cobbles and possible boulders and practical drilling refusal was encountered in the deposit. Laboratory testing performed on samples obtained from the boring included natural moisture content and gradation analyses. Results of gradation analyses performed on small diameter drive samples of the gravel soils (minus 1 % to 2-inch fraction) are shown on Figure 4. No free water was encountered in the boring at the time of drilling and the subsoils were moist. FOUNDATION BEARING CONDITIONS The sandy silt and clay soils, encountered to a depth of 3 feet at the boring, are compressible when loaded and wetted. Lightly loaded spread footings bearing on the silt and clay soils may be suitable for building support with a risk of foundation settlement. Alternatively, footings extended down and placed entirely on the underlying medium dense, silty sand and gravel soils would have a lower risk of settlement and building distress, and aye recommended for the building support. The boring was drilled at the original building location about 100 feet from the current building location and some variation in the subsurface profile should be expected. DESIGN RECOMMENDATIONS FOUNDATIONS Considering the subsurface conditions encountered in the exploratory boring and the nature of the proposed construction, we recommend the building be founded with spread footings bearing on the underlying coarse granular soils or compacted structural fill. Job No. 114 019A G8Stech The design and construction criteria presented below should be observed for a spread footing foundation system. 1) Footings placed on the relatively dense, natural granular soils should be designed for an allowable bearing pressure of 2,500 psf. Based on experience, we expect settlement of footings designed and constructed as discussed in this section will be about 1 inch or less. 2) The footings should have a minimum width of 16 inches for continuous walls and 2 feet for isolated pads. 3) Exterior footings and footings beneath unheated areas should be provided with adequate soil over above their bearing elevation for frost protection. Placement of foundations at least 42 inches below exterior grade is typically used in this area. 4) Continuous foundation walls should be reinforced top and bottom to span local anomalies such as by assuming an unsupported length of at least 12 feet. Foundation walls acting as retaining structures should also be designed to resist lateral earth pressures as discussed in the "Foundation and Retaining Walls" section of this report. 5) The topsoil, silt and clay soils, and any loose or disturbed soils should be removed and the footing bearing level extended down to the natural granular soils. The exposed granular soils in footing area should then be moistened and compacted. Compacted structural fill placed to reestablish design bearing level should consist of a relatively well graded granular soil compacted to at least 98% of standard Proctor density at near optimum moisture content, and extend at least 2 feet beyond the footing edges. 6) A representative of the geotechnical engineer should observe all footing excavations prior to concrete placement to evaluate bearing conditions. FOUNDATION AND RETAINING WALLS Foundation walls and retaining structures which are laterally supported and can be expected to undergo only a slight amount of deflection should be designed for a lateral earth pressure computed on the basis of an equivalent fluid unit weight of at least 55 pcf Job No. 114 019A tech 5 ._ for backfill consisting of the on -site soils. Cantilevered retaining structures which are separate from the residence and can be expected to deflect sufficiently to mobilize the full active earth pressure condition should be designed for a lateral earth pressure computed on the basis of an equivalent fluid unit weight of at least 45 pcf for backfill consisting of the on -site soils. All foundation and retaining structures should be designed for appropriate hydrostatic and surcharge pressures such as adjacent footings, traffic, construction materials and equipment. The pressures recommended above assume drained conditions behind the walls and a horizontal backfill surface. The buildup of water behind a wall or an upward sloping backfill surface will increase the lateral pressure imposed on a foundation wall or retaining structure. An underdrain should be provided to prevent hydrostatic pressure buildup behind walls. Backflll should be placed in uniform lifts and compacted to at least 90% of the maximum standard Proctor density at a moisture content near optimum. Backfill in pavement and walkway areas should be compacted to at least 95% of the maximum standard Proctor density. Care should be taken not to overcompact the backfill or use large equipment near the wall, since this could cause excessive lateral pressure on the wall. Some settlement of deep foundation wall backfill should be expected, even if the material is placed correctly, and could result in distress to facilities constructed on the backfill. The lateral resistance of foundation or retaining wall footings will be a combination of the sliding resistance of the footing on the foundation materials and passive earth pressure against the side of the footing. Resistance to sliding at the bottoms of the footings can be calculated based on a coefficient of friction of 0.40. Passive pressure of compacted backfill against the sides of the footings can be calculated using an equivalent fluid unit weight of 350 pcf. The coefficient of friction and passive pressure values recommended above assume ultimate soil strength. Suitable factors of safety should be included in the design to limit the strain which will occur at the ultimate strength, particularly in the case of passive resistance. Fill placed against the sides of the footings to resist lateral loads Job No. 114 019A caeca' should be compacted tout least 95% of the maximum standard Proctor density at a moisture content near optimum. FLOOR SLABS The natural on -site soils, exclusive of topsoil, are suitable to support lightly loaded slab - on -grade construction. To reduce the effects of some differential movement, floor slabs should be separated from all bearing walls and columns with expansion joints which allow unrestrained vertical movement. Floor slab control joints should be used to reduce damage due to shrinkage cracking. The requirements for joint spacing and slab reinforcement should be established by the designer based on experience and the intended slab use. A minimum 4 inch layer of relatively well graded sand and gravel, such as road base, should be placed beneath interior slabs. This material should consist of minus 2 inch aggregate with at Ieast 50% retained on the No. 4 sieve and less than 12% passing the No. 200 sieve. All fill materials for support of floor slabs should be compacted to at least 95% of maximum standard Proctor density at a moisture content near optimum. Required fill can consist of the on°site soils or a suitable imported granular material devoid of vegetation, topsoil and oversized rock. The upper silt and clay soils are highly moist and could require drying prior to use as backfill material. UNDERDRAIN SYSTEM Although free water was not encountered during our exploration, it has been our experience in the area that local perched groundwater can develop during times of heavy precipitation or seasonal runoff, Frozen ground during spring runoff can also create a perched condition. We recommend below -grade construction, such as retaining walls and crawlspace, be protected from wetting and hydrostatic pressure buildup by an underdrain system. The drains should consist of drainpipe placed in the bottom of the wall backfill surrounded above the invert level with free -draining granular material. The drain should Job No, 114019A Goa test be placed at each level of excavation and at least 1 foot below lowest adjacent finish grade and sloped at a minimum 1 % to a suitable gravity outlet or drywell. Free -draining granular rnaterial used in the underdrain system should contain less than 2% passing the No. 200 sieve, less than 50% passing the No. 4 sieve and have a maximum size of 2 inches. The drain gravel backfill should be at least 1 %Z feet deep. SURFACE DRAINAGE The following drainage precautions should be observed during construction and maintained at all times after the residence has been completed: 1) Inundation of the foundation excavations and underslab areas should be avoided during construction. 2) Exterior backfill should be adjusted to near optimum moisture and compacted to at least 95% of the maximum, standard Proctor density in pavement and slab areas and to at least 90% of the maximum standard Proctor density in landscape areas. 3) The ground surface surrounding the exterior of the building should be sloped to drain away from the foundation in all directions. We recommend a minimum slope of 6 inches in the first 10 feet in unpaved areas and a minimum slope of 2'A inches in the first 10 feet in paved areas. Free -draining wall backfill should be capped with about 2 feet of the on - site silt and clay soils to reduce surface water infiltration. 4) Roof downspouts and drains should discharge well beyond the limits of all backfill. 5) Landscaping which requires regular heavy irrigation should be located at least 5 feet from foundation walls. Aspen Valley Ranch LLC ("Applicant") has applied to the Board of County Commissiorlers of Pitkin County, Colorado ("BOCC") to amend the prior approvals to include the following: A. Amend the historic incentives granted for designation of the Bourg Homestead cabin, barn and potato cellar to the Pitkin County Historic Register. B. Relocate approved but not built agricultural facilities (agricultural equipment building and hay storage) from the Agricultural Facilities Parcel ("AFP") to Homestead 1 to avoid a debris flow area and to separate agricultural functions. C. Obtain approval for a Caretaker Dwelling Unit on Homestead 1. D. Amend and/or establish development envelopes for additional landscaping, ditch relocation, new/expanded ponds, access improvements and new bridges. E. Establish utility corridors throughout the property to accommodate utility lines and facilities, including a central water system. F. Amend the Agreement for Grant and Acceptance of Trail Easement recorded as Reception #583885. 2. The Applicant is also requesting to bury a water storage tank for a central water system for Aspen Valley Ranch within the approved building envelope on Lot 6; and to re-establish the Activity Envelope foi a single family residence and obtain a new vested right for the Werk Cook Parcel. 3. These amendments require the following approvals: A. Amendment to Development Permit B. Activity Envelope and Site Plan Review C. Historic Preservation Benefits D. Special Review and GMQS Exemption for Caretaker Dwelling Unit 4. The property is located on Upper River Road, and is described as Homesteads 1-9 and the Agricultural Facilities Parcel, Aspen Valley Ranch Subdivision Exemption; Lot 6, Aspen Valley Downs Subdivision; and the Werk Cook Parcel, which is more specifically described in Exhibit A. 5. The property is zoned RS-20, with the exception of the Dry Woody Creek Parcels, which are zoned Rural/Remote, and a 2 acre portion of the Agricultural Facilities Parcel that is zoned Affordable Housing (AH). The property contains approximately 809 acres broken down as follows: A. 485 acres within Aspen Valley Ranch Homesteads 1-9 and the Agricultural Facilities Parcel. B. 245 acres within the seven Dry Woody Creek Parcels; all are restricted as TDR Sending Sites (not included in this application). C. 58 acres within Aspen Valley Downs Lots 6-9 (only Lot 6 is included in this application). D. 20 acres within the Werk Cook Parcel (metes and bounds parcel at mouth of Red Canyon). Resolution No.b(g320.14 Page 2 6. The BOCC approved the Aspen Valley Downs Subdivision, pursuant to Resolution No. 92-90, and the final plat is recorded in Plat Book 28 at Page 90. 10 free market single familylots were subdivided out of the original Aspen Valley Ranch. As part of the approval, two non -development easements were granted on Aspen Valley Ranch: a 76 acre wildlife easement on the south -facing slopes of Triangle Peak and an 85 acre agricultural easement. 7. The BOCC approved Resolution No. 112-2005, which granted Special Review, 1041 Hazard Review, Conceptual Submission and GMQS Exemption for Homesteads 1-9 and the Agricultural Facilities Parcel of Aspen Valley Ranch. The BOCC granted 20 year vested rights with the approval. 8. The BOCC amended the 2005 approval, pursuant to Resolution No. 081-2008. The amendments included: A. Designation of the Bourg Homestead cabin, barn and potato cellar to the Historic Register, and as an incentive for the designation, granting of a GMQS exemption for 5,000 square feet of floor area on the Agricultural Facilities Parcel: 3,500 square feet for the Ranch House and 1,500 square feet for two accessory structui es with bathing facilities. B. Voluntary deed restriction of three dwelling units on the Agricultural Facilities Parcel: one existing/historic and two new, maximum of 10,000 square feet. C. Realignment of the entry road and construction of a new road to the upper mesa (Homesteads 6 & `7 and Aspen Valley Ranch Lots 6-9) and construction of a new "Core Road" on the Agricultural Facilities Parcel. D. Debris flow mitigation on the Agricultural facilities Parcel E. Stream Enhancements on the upper and middle reaches of Red Canyon and Dry Woody Creeks, and ditch improvements in the lower pasture. F. Amendments to the building and development envelopes. 9. The BOCC considered this application at duly noticed public hearings on April 23 and June 11, 2014, at which times evidence and testimony were presented with respect to the application. 10. The BOCC finds that it is appropriate to grant an historic incentive of 1,500 square feet of floor area on the second floor of the Bourg Barn for a locker room in exchange for the 1,500 square feet previously granted for two accessory structures with bathing facilities, which are no longer proposed to be built. 11. The BOCC further finds that it is appropriate to approve the use of two TDRs for an additional 4,150 square feet of floor area for common non-agricultural facilities on the Agricultural Facilities Parcel — 900 square feet on the second floor of the Bourg Barn for a locker room and 3,250 square feet for the Pool House. 12. The BOCC further finds that the relocation of agricultural buildings — the equipment barn and hay barn — from the Agricultural Facilities Parcel to Homestead 1 is acceptable, as it avoids development within the debris flow on the Agricultural Facilities Parcel; the buildings will be clustered, are sited near the entry to the ranch, and will not create additional impacts on wildlife; and the square footage of the buildings will count against the 30,000 square feet of agricultural floor area approved pursuant to Resolution No. 112- 2005. 13. The BOCC further finds that it is appropriate to sterilize the Werk Cook Parcel from development in order to preserve important mule deer and elk habitat, and agrees in exchange to modify the 2011 Trail Easement as requested. Resolution No.0g32014 .Page 3 14. The BOCC further finds that it is appropriate to eliminate the new entry road that was constructed through the lower pasture and the proposed new road on the upper mesa to access Homesteads 6 and 7. Accessing Homesteads 6 and 7 from below rather than above will lessen disturbance the visibility of the driveways. Elimination of the lower road will maintain access around the perimeter of the main lower pasture with only ranch vehicle access through the center of the pasture. 15. The BOCC further finds that the proposed envelope on Homestead 8 to accommodate the on -site wastewater treatment system ("OWTS") avoids the 100' setback from Dry Woody Creek and is necessary to accommodate the OWTS for the proposed 13,000 square foot residence on Homestead 8. 16. The Board further finds that it is appropriate to amend the envelope on Homestead 9 to increase the setback from Dry Woody Creek from 20 feet to 50 feet. 17. The BOCC further finds that the other proposed amendments to building and development envelopes for landscaping, grading, ponds, driveways, utilities, ditch relocation and bridges are appropriate and comply with the applicable provisions of the Code. NOW, THEREFORE, BE IIT RESOLVED by the BOCC that it does hereby approve the proposed amendments, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. The Applicant shall comply with all conditions of BOCC Resolution Nos. 112-2005 and 081-2008, except as amended herein. 3. The following approvals related to the Werk Cook Parcel are hereby rescinded: Planning and Zoning Commission Resolution No. 91-14, BOCC Resolution No. 91-55, and Hearing Officer Determination No. 39-2006. 4. Prior to submission of any development permit applications based on this approval, the Applicant shall be required to submit for approval by the County Attorney and Community Development amended Site Plans. The above referenced approvals shall be a condition precedent to finalization and recordation. The owner must sign the mylar copies of the site plans prior to submittal for recording. 5. Concurrent with recordation of the amended site plans, the Applicant shall record a Covenant in a form acceptable to the County Attorney restricting the Werk Cook Parcel against residential development. 6. Prior to issuance of the first Certificate of Occupancy for any of the buildings on Homestead 1 (residence, caretaker dwelling unit, agricultural equipment building or hay barn), the Applicant shall record an amendment to the 2011 Agreement for Grant and Acceptance of Ti ail Easement and shall complete the construction of the trail to the satisfaction of Pitkin County Open Space and Trails. The Amended.Trail Easement shall be in a form acceptable to the County Attorney, and shall be accepted by the BOCC by Ordinance. The Amended Trail Easement shall include the following elements A. The alignment of the new trail, as shown in Exhibit B. B. The use of the existing alignment along Aspen Valley Ranch Road for physically challenged trail users, as shown in Exhibit B. Resolution No.J p' -2014 Page 4 C. Winter closure of the trails from December 1 through April 30 to protect wildlife habitat. The closure applies to the public, and any Aspen Valley Ranch owners, guests and employees. D. Recognition that the County will prepare and the Open Space and Trails Board will adopt a management plan for the trail. E. Eliminate the requirement for hunters to carry rifles in cases when crossing the property. 7. Construction of the new trail shall be completed by October 1, 2015. In conjunction with the construction of the trail and prior to October 1, 2015: A. The Applicant shall install an interpretive sign or plaque on the trail above the Bourg Homestead and Barn to educate trail users about the history of the property and the buildings. The Applicant shall coordinate with Open Space and Trails regarding the location and design of the sign or plaque, prior to installation. B. If the trail crosses the Red Canyon drainage on the Werlc Cook Parcel, the Applicant shall install a pedestrian bridge across the creek. C. The Applicant shall complete wildlife habitat enhancement along the hillside trail by removing isolated juniper trees and/or pinyon pine trees, subject to review and approval by Colorado Parks and Wildlife. 8. Within 60 days of the date of this approval, the Applicant shall submit an earthmoving permit application for the reclamation of the entry road through the lower pasture (on Homesteads 2, 3 and 4) to a limited use ranch road. The permit application shall show all re -grading and revegetation. 9. The Ranch House is considered the principal residential structure on the Agricultural Facilities Parcel, and as such, may be built to the principal building height of 28 feet. 10. The residential floor area on Homestead 1 shall be limited to a maximum of 5,750 square feet of floor area, as long as the common agricultural facilities for the ranch (agricultural equipment building and liay barn) remain on Homestead 1. If one of the agricultural buildings is removed, then residential floor area of up to 7,000 square feet may be developed on Homestead 1. If both of the agricultural buildings on Homestead 1 are removed, then residential floor area of up to 8,250 square feet may be developed on Homestead 1. The Applicant must surrender one TDR to develop the initial 5,750 square feet of floor area on Homestead 1, and one additional TDR may be used to develop up to 8,250 square feet of floor area (1 TDR = 2,500 square feet). 11. As a replacement historic incentive for the two accessory structures with bathing facilities, which will not be built, a total of 1,500 square feet of floor area is exempt from growth management for use on the second floor of the Bourg Barn for a locker room. 12. At building permit application for the Pool House and to develop the second floor of the Bourg Barn as a locker room, the Applicant shall surrender two TDR Certificates and a copy of the deed(s) evidencing the Applicant's acquisition of the Certificates (if applicable), in order to develop up to 4,150 square feet of floor area (3,250 square feet for the Pool House and 900 square feet in the Bourg Barn). 13. Agricultural buildings are prohibited on Homesteads 2-9. Agricultural buildings on the Agricultural Facilities Parcel and Homestead 1 shall be limited to a total of 30,000 square feet. The agricultural equipment building may contain up to 6,600 square feet, but no other agricultural building shall exceed 5,000 square feet. If the agricultural buildings are removed from Homestead 1, then future agricultural buildings shall be prohibited on Homesteads 1-9. Resolution No.Of9"l -2014 Page 5 14. The hay storage structure on Homestead 1 shall be game proof — side walls shall be constructed of 8' high solid siding or mesh fencing with gates of at least 7' in height. 15. The Colorado Department of Public Health and Environment has determined that the proposed central water system for Aspen Valley Ranch does not currently meet the definition of a public water system ' and is not subject to those regulations. Once the development reaches 15 units or serves more than 25 persons for more than 60 days a year, the water system would be considered a public water system and subject to the State Health Department's regulations. With each building permit application, the Applicant shall provide documentation for review by Environmental Health to demonstrate whether or not the additional development will trigger an application to the State for a public water system. 16. The caretaker dwelling unit on Homestead 1 shall comply with the following: A. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor . plans of the unit shall be submitted to the Housing Office with the deed restriction. B. The kitchen shall contain a minimum of a two burner stove with at least a 5 cubic foot oven that can bake and broil, sink of at least 14"W X 16' D X 5.25"H, and at least a 5.3 cubic foot refrigerator and 0.73 cubic foot freezer. Two off-street parking spaces shall be provided for the unit. The caretaker dwelling unit must have separately accessible utilities. This does not preclude shared utilities. C. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, the Housing Office may inspect the unit. D. The floor area of the caretaker dwelling unit shall be included in the total allowed floor area for Homestead 1. 17. Failure to comply with these conditions of approval may result in revocation of this permit or any subsequent permits related to this property or vested rights associated with this property. The approvals so granted were conditioned upon the execution and recording of a covenant restricting the Property against future development;. Restrictive Covenant pertaining to the Property. Grantor hereby restricts the Property in perpetuity against any and all residential development, as that term is used and defined in the Pitkin County Land Use Code, as the same may be amended from time to time; provided, however, that a portion of the Property may be used for a public trail. 2. Covenant running with the land: binding effect. The provisions of this deed restriction shall constitute a covenant that runs with the title to the Property for the benefit of the BOCC, its successors and assigns and shall be deemed an appurtenance to the title to such land. 3. Permitted uses and activities. As owners of the Property, the Grantor retains the right to perform any act consistent with the Land Use Code to the extent such act is not prohibited or limited by the requirements of this restrictive covenant. These ownership rights include, but are not limited to, the right to exclude any member of the public trespassing on the Property and the right to sell, lease, or otherwise transfer the Property to anyone Grantor chooses. The following shall not be considered residential development: a. fences that comply with the Pitkin County Land Use Code; b. agricultural activities; c. the installation and maintenance of underground utilities; and d. construction and maintenance of a public trail. Nothing herein shall be construed to be an approval by Grantee under the Land Use Code for any purpose. 4. Enforcement and monitoring. This restrictive covenant and its terms and representations shall be fully enforceable by Grantee, its successors, assigns and agents in any action at law or equity or both, to secure compliance, including but not limited to, seeking injunctive relief and/or specific performance requiring the Grantor, its successors or assigns to cease and desist all activity in violation of the terms of this restrictive covenant and to return the Property to its condition prior to any violation. Moreover, Grantee and its successors, assigns and agents shall be permitted access to, and to enter upon, the Property at reasonable times solely for the purpose of monitoring, inspection, and if necessary, remediation in order to enforce and assure compliance with the terms and conditions of this restrictive covenant. 5. Costs and liabilities. Grantor retains all responsibilities and shall bear all costs and liabilities of any kind related to ownership, operation, upkeep, taxes and maintenance of the Property, including but not limited to, costs associated with compliance with this restrictive covenant. Grantee's acceptance of this restrictive covenant shall in no way be construed as an assumption of any duties or liabilities associated with the Property and Grantor acknowledges that by this restrictive covenant, Grantor continues to retain responsibility for any and all duties and liabilities associated with the Property. 6. Incorporation of the Land Use Code. The Land Use Code, as may be amended from time to time, and any terms or definitions contained therein, are hereby incorporated by this reference in their entirety. 7. Modification. The terms of this restrictive covenant can only be modified by an amended covenant executed by both Grantor and Grantee and recorded in the records of the Clerk and Recorder for Pitkin County, Colorado. 8. Venue and jurisdiction. Grantor and Grantee consent to venue and jurisdiction in the District Court for Pitkin County, Colorado for all matters concerning the interpretation and enforcement of this restrictive covenant. 9. Attorneys fees and costs. RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO GRANTING APPROVAL OF THE ASPEN VALLEY RANCH SPECIAL REVIEW, 1041 HAZARD REVIEW, CONCEPTUAL SUBMISSION AND GMQS EXEMPTION Resolution No. 0-2005 RECITALS 1. SGS-Ranch LLC ("Applicant") has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") for approval to develop 8 new single family residences on parcels ranging from 35 to 120 acres, to create a new 35+ acre parcel around the existing ranch house and a 35+ acie Agricultural Facilities Parcel that encompasses the existing agricultural buildings and affordable housing units. The Applicant is requesting approval for a total of 96,750 square feet of floor area for the development, with no more than 3 of the residences containing in excess of 10,750 and up to 13,250 square feet of floor area. The following approvals are requested and required: A. Rezoning of 245 acres of the ranch to Rural/Remote; B. 1041 Hazard Review and Conceptual Submission to establish building envelopes; C. GMQS Exemption and Special Review to establish the parcels as TDR receiver sites (for initial development rights and additional floor area); 2. The property is located on Upper River Road, and is more specifically described in Exhibit A. 3. The property is comprised of two separate parcels that contain a total of 731 acres. The property is zoned RS-20/PUD with the exception of approximately 2 acres of land that is zoned AH. 4. The Pitkin County Planning and Zoning Commission ("Commission") considered the proposed application at a regularly scheduled meeting on May 17, 2005, and recommended approval by a vote of 5-0. 5. The BOCC considered this application at duly noticed public hearings on July 27 and August 10, 2005, at which times evidence and testimony were presented with respect to the application. The BOCC reviewed and approved the Development Agreement on August 24, 2005. 6. The BOCC finds that the proposed building envelopes are located on slopes of less than 30% and avoid the 100 year floodplain and critical wildlife habitat areas; the wildfire hazard is rated as low to medium and can be mitigated; the debris flow hazard can be mitigated; 7. The BOCC further finds the development is consistent with the special review criteria for TDR receiver sites and caretaker dwelling units, and that the proposed development otherwise complies with the applicable provisions of the Land Use Code ("Code"). 8. The BOCC further finds that an extended vested right of 15 years is appropriate because the proposed development promotes the public benefit in a manner consistent with, and which promotes the policies and requirements contained in the Code. The Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any earthmoving, access, ISDS or building permit applications, the Applicant shall: A. Record the Subdivision Exemption Plat. The exemption plat shall identify the public trail easement. B. Submit 1041 Hazard Review Site Plans to the Community Development Department for approval and recording. The owner must sign the mylar copies of the site plans prior to submittal for recording. The Applicant shall amend the site plans as follows, prior to submission for recordation: 1) Include the location and dimensions of building envelope setbacks from property lines, and/or tie in the boundaries of the building envelopes to a permanent marker. 2) Eliminate shading of envelopes. Occupants must not own developed residential real estate or a mobile home in those portions of Eagle, Garfield, Gunnison or Pitkin Counties, which are part of the Roaring Fork River drainage. 3) The Applicant shall provide financial security to assure the removal of any unit if the owner thereof is found to have breached the terms and conditions of the Occupancy Deed Restriction and Agreement. E. Provide documentation to the Housing Office to verify that the current tenants of the employee housing units comply with the provisions specified in condition D2 above. 3. Concurrent with recordation of the 1041 site plan(s), the Applicant shall: A. Record the Protective Covenants, Development Agreement, and revised Occupancy Deed Restriction and Agieement. B. Obtain Irrevocable Certificates of TDRs from the Rural/Remote tracts, and execute and record the deed restriction against further development of the tracts. C. Record the public trail easement, which shall allow pedestrian, snowshoeing and cross-country skiing from the Rio Grande trail across the ranch and the Werk-Cook parcel up Red Canyon to the BLM land. Dogs shall be prohibited. The trail shall be closed from December 1 to March 31 each year. 4. The Development Agreement shall be amended prior to recordation to specify that the following sha• ll vest based on the standards of the Code in effect on the date of approval: floor area entitlements utilizing TDRs; GMQS exemptions granted; maximum floor area and the current floor area definition; minimum and maximum lot size; building height; road and property setbacks; stream setbacks for Lots 4, 8 and 9; grading and placement of fill; and preservation or creation of scenic vicwplanes. 6. Prior to submission of an ISDS permit for each parcel, the Applicant shall provide documentation of a legal water supply and adequate quality and quantity of water to the Environmental Health Department. Wells must be located within the building or development envelopes, or in a location outside of the envelopes that is approved by the Community Development Department. 7. Prior to building permit application for a new residence on each of each of Parcels 1-7 and 9, the Applicant shall submit one executed Irrevocable Certificate(s) of TDRs to allow up to 5,750 square feet of floor area on each parcel, and a copy of the deed evidencing conveyance of the Certificate(s) to the Applicant (if applicable). The Applicant may replace the existing residence on Parcel 8 up to the size of the original unit or 5,750 square feet of floor area, whichever is greater. The Applicant may submit additional TDR Certificates or.may utilize growth management allotments for additional floor area on Parcels 1-9 up to the maximum specified in #12 below. 8. The Applicant shall complete the floodplain/debris flow mitigation berm and clear the Red Canyon and Dry Woody Creek channels as shown on the Schmueser Gordon Meyer plans dated 7/5/05, prior to issuance of any permits for development on Lots 4 or 8, or redevelopment on the Agricultural Facilities Parcel. 9. Prior to submission of any building permits for residences on any of Parcels 1-7 and 9 and a replacement residence on Parcel 8, the Applicant shall obtain an Access Permit to improve Aspen Valley Ranch Road to the "Country Access" standard specified in the Asset Management Plan from the intersection with Upper River Road to the driveway to Parcel 4. The permit shall be reviewed and approved by the County Engineer and the Fire Marshal. 10. Prior to issuance of building permits for residences on Parcels 5, 8 and 9, the Applicant shall obtain an Access Permit to improve the applicable driveways from Aspen Valley Ranch Road to the driveways to the building envelopes on those parcels to the "driveway" standard in the Asset Management Plan, but with a minimum 16' wide driving surface. The permit shall be reviewed and approved by the County Engineer and the Fire Marshal. 11. Prior to issuance of building permits for residences on each of Parcels 1-7 and 9 and a replacement residence on Parcel 8, the Applicant shall: A. Obtain a fireplace/woodstove permit from the Community Development Department. B. Submit a drainage and erosion control plan for review and approval by the County Engineer. C. Obtain a driveway/access permit, which shall be approved by the County Engineer and the Aspen Fire Marshal. D. Obtain a site specific foundation investigation for each of Parcels 5-9. E. Obtain ISDS permits from the Environmental Health Department. The systems must be designed by a registered professional engineer, shall be located within the building or development envelopes, and must comply with the setback requirements from surface and groundwater sources. F. lithe residence exceeds 5,000 square feet, submit a Traffic and Parking Management Plan in accordance with the Asset Management Plan for review and approval by the County Engineer. G. Submit a landscaping plan, for review and approval by the Community Development Department. H. The total floor area of all residences shall not exceed 96,750 square feet. No more than 3 residences may contain floor area in excess of 10,750 square feet and up to 13,250 square feet, provided that the residences on Parcels 6 and 7 shall not exceed 10,750 square feet. Subject to the foregoing, the Applicant shall allocate the allowable square footage of Floor Area for each parcel either at the time of the initial sale of such parcel or upon application for a building permit for a residence on such parcel, whichever first occurs. The Floor Area to be allocated shall be set forth in a document entitled "Allocation of Floor Area" which shall identify the parcel for which the allocation is made, shall be signed by the Applicant and recorded in the office of the Clerk and Recorder of Pitkin County, Colorado. Thereafter, the Allocation of Floor Area as set forth in the recorded document may only be amended by and through an amendment to the Final Approval Resolution processed pursuant to the regulations of the County then in effect. 13. Agricultural buildings are prohibited on Parcels 1-9. Agricultural facilities on the Agricultural Facilities Parcel shall be limited to a total of 30,000 square feet, with no one building exceeding 5,000 square feet. The floor area of the employee units on the Agricultural Facilities Parcel shall not exceed 10,000 square feet, with no one unit to exceed 2,000 square feet. 14. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of each building and development envelope and install construction fencing around the perimeter of the building and development envelopes. The fencing shall remain in place until a Certificate of Occupancy is issued for the residence. 15. No development, including grading, excavation, fill placement, berming, landscaping, entry or ranch gates, construction parking and staging, vegetatton removal or disturbance, septic system and well, shall occur outside of the approved building and development envelopes, except to comply with the required wildfire mitigation. Utility and driveway extension and maintenance shall occur within approved building or development envelopes. 16. Only plant species listed in the Pitkin County Revegetation Guide (or species native to the site) shall be utilized to revegetate areas outside of the building envelopes that are disturbed by construction of access drives and installation of utilities, subject to a revegetation plan approved by the Natural Resources Division prior to issuance of a Certificate of Occupancy. However, if agricultural areas are disturbed, those areas may be planted with agricultural crops that are not included in the Revegetation Guide. 17. Exterior lighting shall comply with the County's lighting regulations in effect at the time of installation. Exterior lighting is prohibited on any facades that face Highway 82 except where necessary to comply with health and safety requirements of the building code. 18. The exterior of the residences shall be finished in earth tones, which blend with the colors of the natural surrounding environment. Roof materials shall be non -reflective. 19. The Applicant shall comply with the following measures to mitigate impacts to wildlife: A. Native vegetation shall be maintained outside of the building envelopes, except for agricultural crops. B. C. Avoid fruit -bearing trees and shrubs in any landscaping. D. Dogs shall be kenneled, with the exception of working ranch dogs when at work. E. All new fencing outside of the building envelopes that is not necessary for livestock retention shall comply with the following: I) Wood fencing shall employ three rails or less, be the round or split rail type, shall not exceed 48 inches in height above ground level and 12 inches in width (top view), and shall have at least 18 inches between two of the rails. 2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42 inches in height. 3) Existing fencing shall be brought into compliance. F. Horse hay shall be fenced at the owner's expense with 8' game -proof fencing and other feed shall be kept in bear -proof containers. 20. The Applicant shall comply with the following wildfire mitigation standards: A. For a distance of 15 feet around all structures establish and maintain vegetation at 6 inches or less, with mowed grass, Iow growing peiennials or some type of hardscape (e.g,, sidewalk, pavers, rock mulch). B. Beyond the 15-foot perimeter and up to 30 feet keep grass mowed to a height of 6 inches or Tess. C. Future landscaping within 100 feet of any structure shall be spaced no closer than 10 feet from the outermost branches. The lower limbs of conifers should be removed up to 10 feet or half the total height of the plant to eliminate ladder fuels. D. Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the International Building Code (IBC) Section 1505.2. Wood shake/shingle roof coverings are prohibited in all wildfire hazard areas. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: I) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the approved building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. E. Vents shall be screened with corrosive resistant wire mesh with mesh ''A inch maximum. F. Roofs and gutters shall be kept clear of debris. G. Yards shall be kept clear of all litter, slash, and flammable debris. 11. The Applicant shall comply with the applicable codes and requirements of the Aspen Fire Protection District Each owner shall install a 20,000 gallon underground water storage tank with a hydrant within the approved envelopes, prior to final inspection of the residence. 22. The Applicant shall comply with the County's Noxious Weed Management Plan. 23. Any development located within setbacks shall require a variance from the Board of Adjustment. RECITALS: A. Developer is the owner of approximately 486 acres of real property situated in the County of Pitkin, State of Colorado, more particularly described in Exhibit A, attached hereto and incorporated herein by this reference. In this Agreement, the property described in Exhibit A shall be referred to as "Aspen Valley Ranch." B. Developer applied to the County for various approvals in order to develop Aspen Valley Ranch as a residential subdivision. C. The Board granted final approval for Aspen Valley Ranch at its regularly scheduled meeting on August 24, 2005. Such "Final Approval" consisted of conceptual submission approval, a growth management quota system exemption, special review approval for the establishment transferable development rights receiving areas, construction of caretaker dwelling units and 1041 hazard review approval. The Final Approval of the Board was embodied in Resolution No. t 1i-2 (the "Final Approval Resolution") which was recorded as Reception No. Sr G24E of the Pitkin County records on the 141 day of Midge ✓' , 2005. D. The Final Approval Resolution included approval to file a Subdivision Exemption Plat and 1041 Hazard Review Site Plan for Aspen Valley Ranch (the "Exemption Plat"). The Exemption Plat was recorded in the public records of Pitkin County at Reception No. ( 17l-- Book "76 , at PageS H - 1 3. NOW, THEREFORE, in consideration of the premises and the terms and conditions herein stated and for other valuable consideration, the adequacy of which is acknowledged by the parties hereto, it is agreed as follows: I. Intent. It is the intent of the parties that this Agreement shall constitute a development agreement as referenced in C.R.S. § 24-68-104 for the purpose of establishing vested property rights as defined therein for a period of fifteen (15) years. 2. Right to Development/Vested Property Rights. (b) The development rights and uses described in this Agreement and/or included in Final Approval Resolution aie vested for a period of fifteen (15) years from the date of Final Approval which, for the purposes of this provision, is October 12, 2005. During the 15-year vesting period ending October 12, 2020, Developer and/or its successors or assigns shall not be subject to any addition, modification or amendment to the Land Use Code or to any other regulation not in effect on the date of vesting vs, hich amends or has the effect of amending any of the following: (1) any provisions of the Land Use Code which restrict or eliminate the growth management exemptions approved in the Final Approval Resolution; or (2) the provisions of the Land Use Code which establish the amount of square footage available through utilization of transferrable development tights; or (3) the regulations, requirements, standards and conditions concerning the following provisions of the RS-20 Zone District in effect on the date of this Agreement (all terms are as defined in the Pitkin County Land Use Code, unless otherwise noted): (i) maximum floor area, or the calculation or definition thereof; (ii) minimum and maximum lot size; (iii) building height; (iv) road, property or stream setbacks for Homesteads 4, 8 and 9; (v) grading and fill placement; and (vi) preservation or creation of scenic view planes. (c) Notwithstanding any other provision of this Agreement, no provision hereof shall be construed to exempt Developer or any future owner or owners of Aspen Valley Ranch from the requirements of Final Approval Resolution, building permits, or other necessary permits or approvals which become applicable subsequent to the approval of this Development Agreement. Nor shall any provision hereof be construed to preclude the application of the Uniform Building Code, Fire Code, Plumbing Code, Electrical Code, Mechanical Code, or other requit ements reasonably necessary for the protection of the public health and safety. 3. Amendment. This Agreement may be amended only by written instrument signed by the County and the Developer. 4. Binding Effect. Grantee desires to accept the Public Trail Easement described herein, subject to the restrictions, and to assume certain responsibilities in connection therewith. NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Grantor and Grantee agree as follows: 1. Grant of Trail Easement. Grantor hereby grants, transfers and conveys unto Grantee for the use and benefit of the general public, by quit claim only and without warranties of title, a non-exclusive easement and right of way (the "Public Trail Easement") over and upon Aspen Valley Road and Dry Woody Creek Road as depicted and described on the Exemption Plat, which lies between the Denver and Rio Grande Trail and River road; and the ten -foot -wide easement area within and upon the Werk Cook Parcel as described on Exhibit B, subject to the restriction and obligations set forth herein. 2. Trail Use Restrictions. Use of the Public Trail Easement by the public shall be limited to hiking daily, between sunrise and one hour before sunset and between April 1 and November 30 ofeach year. The Public Trail Easement will be closed to public use during the winter months, from December 1 of each year to March 31 of the following year Except for the owners of the lots described on the Exemption Plat and the Werk Cook Parcel and the families, invitees and guests of such owners, no horses, dogs, motorized vehicles, firearms or commercial uses shall be allowed within the Public Trail Easement, and users of the Public Trail Easement shall not be allowed to carry firearms. Construction and Maintenance. The Public Trail Easement within Aspen Valley Ranch follows the alignment of existing roadways. Grantor shall not, by the terms of this Trail Easement, be required to improve, realign or upgrade any portion of the roadways as they exist on the date hereof. Grantor shall be obligated to maintain the roadways In a condition that will allow reasonable pedestrian access pursuant to the terms of this Trail Easement. Grantee shall have no responsibility, nor any authority, for the maintenance, repair, replacement or upgrade of said roadways. Nothing herein shall, however, preclude Grantor from undertaking and performing such maintenance, repair, replacement or upgrade to the roadways, including paving, as Grantor, or its successors and assigns, determine is necessary or desirable, so long as such work does not unreasonably restrict the public's use of the roadways intended by this Trail Easement. Grantor shall construct a new trail along the alignment described on Exhibit B within the Werk Cook Parcel. Grantor shall thereafter be responsible for the reasonable maintenance and repair of said trail. Grantor may assign such responsibility to a homeowners' association representing the owners of Homesteads within Aspen Valley Ranch, whereupon Grantor's responsibility for maintenance and repair shall terminate. The Public Trail Easement may be closed temporarily during construction activities or in the event of circumstances which could endanger users of the Public Trail Easement. 4. Grantee's Obligation to Insure. The parties acknowledge that the Grantor is entitled to the benefits, protections and limitations on liability afforded by Colorado law, including C.R.S. Sections 33-41-101 through 105. Grantee agrees to add Grantor (and its successors and assigns in the ownership of Aspen Valley Ranch and the Werk Cook Parcel, or any of them or any part thereof) as additional named insureds on its comprehensive general Liability insurance policy, which insurance shall be maintained by the Grantee to provide protection against liability from claims arising out of the use of the Public Trail Easement. Such insurance shall be carried in amounts not less than the liability limits specified in C.R.S. Section 24-10-114(1), as it may be amended from time to time, and shall provide Grantor and its successors and assigns with thirty (30) days advance written notice prior to cancellation or termination. Grantee shall, upon written request therefor from Grantor or any successor or assign, provide a Certificate of Insurance as verification of compliance with these requirements. 5. Attorneys' Fees. In the event the interpretation or enforcement of this Public Trail Easement should ever become the subject of litigation between Grantor, or its successors and assigns in the ownership of Aspen Valley Ranch and the Werk Cook Parcel, or any part thereof, and Grantee, the substantially prevailing party shall be entitled to an award of its reasonable costs and attorneys' fees incurred in connection therewith, 6. Binding Effect/Amendment. This Public Trail Easement shall be binding upon and inure to the benefit of the parties hereto and the heirs, personal representatives, successors and assigns of Grantor, including all future owners of Aspen Valley Ranch and the Werk Cook Parcel, or any of them. A well was drilled in December, 2013 during low groundwater conditions and a long term pump test was conducted. The well is an excellent well with a sustained pumping rate of at least 35 g.p.m. A preliminary water quality test shows the well meets all Safe Drinking Water Act parameters (see attached Preliminary Report). This Report is being submitted to the Colorado Department of Public Health and Environment (CDPHE) in accordance with the requirements of the capacity development program per CRS §25-1=107, for its review and approval, to allow the Owner of this development, Aspen Valley Ranch AH LLC (ARV AH LLC), to proceed with construction and operation of the community water system. The Owners have directed that the water system be designed to accommodate more than 25 full-time residents. Therefore the system is to be managed as a Community Water System; this Report is submitted in accordance with CDPHE's New Water System Capacity Planning Manual. Proposed Development and Water Requirements The Aspen Valley Ranch contains approximately 900 acres, located in Pitkin County on the right bank of the Roaring Fork River, as shown on Drawing 1 of the Preliminary Engineering Report (PER), Appendix A. It is proposed to develop this Ranch for low density residential use. The system will serve Tess than 15 service connections (of any type), consisting of nine homesteads, a barn, club house, swimming pool building and the existing ranch center. System peak day potable water demands are estimated to be: o In Building O Irrigation o Fire Protection 11,150 gpd 32,000 gpd 1,200 gpm (all residences with sprinklers) A detailed breakdown of estimated water uses is presented in the Conceptual Water System Plan (Plan) included with this Report, as Appendix A. 1 Vicinity Map Figure 1 2 Proposed Water System The proposed treated water distribution system will include two wells, two booster pumps, disinfection, storage, distribution piping and fire hydrants. The overall system is illustrated and described on Drawing 1 in the attached Plan. Key system components are summarized following: Water Su I Wells Iwo wells will be drilled into the Roaring Fork Alluvium. Each well will have a sustainable capacity of 40 to 50 gpm. The water will be delivered to the treatment/pump station for disinfection using chlorination and UV treatment. The wells were located, designed, and tested by Resource Engineering. Their report and water quality analyses are included as Attachment B (also Table 1 in the PER). Treatment/Pump Station. The treatment/pump station will meter and deliver treated water to the distribution system using two 50 gpm high service pumps. A minimum pressure greater than 45 psi will be provided to all home sites. The station will also house the disinfection equipment and all electrical and controls. Distribution System. Water will be distributed via 10-inch, 8-inch and 4-inch mains, with all fire hydrants served by 6-inch branch lines. A 10-inch supply line will connect the distribution system to the water storage tank. As shown on Drawing 1 of the Plan, the higher elevation distribution 10-inch line will be looped for improved hydraulics and reliability. Due to the elevation difference of the development, some homesteads will require service line pressure reducing valves. Water Storage Tank. The water storage tank will be buried concrete and have a capacity of approximately 160,000 gallons. It will provide for operational storage, fire flow demands, and emergency storage. The tank is to be fitted with a hydraulic mixer, and operated so as to reduce average residence time and avoid stratification. Level controls will be included to control filling from the supply wells, with an overflow pipe in case of overfilling. Refer to Appendix C for the geotechnical investigation report detailing the site of the proposed tank. 3 TECHNICAL CAPACITY SOURCE WATER ADEQUACY Source of Water Supply The proposed development will be served by two wells, designed and located by Resource Engineering. Resource has addressed all necessary water rights issues and permitting. Table 1 in the Plan shows the raw water quality testing results of the wells, and is also included later in this Section. Reliability of Water Source Testing has shown that each well can supply a sustained flow of 40 to 50 gpm. See Appendix S. Adequate Protection The ground around the well heads is to be graded to drain away from the well so as to minimize the potential for surface water contamination. Cement grout was placed to seal the well casing pipe in accordance with State criteria. The well heads are adequately protected with a sanitary seal with (locking cap) located at least one foot above the ground surface at the well. There is no evidence of surface contamination of the well water from the water quality analyses that have been completed. The water level is over 73 feet from the surface and the wells are located over 500 ft. from the Roaring Fork River. The storage tank will be a 160,000 gallon completely buried concrete tank with secured access. Screens will be placed over the ventilation openings and overflow discharges, and frost -proof dampers will be installed in the air vents. In case of power failure or other emergency, the tank will be able to provide almost two weeks of in -building supply during non -irrigation periods. The booster pumping and chlorination equipment is to be located in a secured structure. Typically, the pumps will operate in a lead -lag fashion, providing a backup in case one pump is not operational. Sampling points are to be included in the treatment/pump station to monitor water quality. Provisions in the design will allow for a backup generator to be added in the future. 100-Year Flood Plain None of the water supply facilities are located in a 100-year flood plain. A FEMA map of well and pump station locations in relation to the 100 year flood plain is included along with the "100-Year Flood Plain Certification" in Appendix D. 4 INFRASTRUCTURE ADEQUACY Water Quality The Preliminary Report was prepared prior to receiving the well water quality test results. The results show that the raw water meets all State/EPA primary standards for inorganic chemicals. Hardness is of concern; there are no known health relationships — only with washing, bathing difficulty and plumbing encrustation. The EPA value for hardness is not mandatory or enforced. Note that it is not practicable to reduce hardness at the central plant since the system is to provide irrigation water — at relatively high demand rates. It is likely each customer's service will include a water softener for in -home water use (not including the fire suppression system). Condition of Infrastructure There is no existing water system infrastructure (except one new well). All components of the water system are to be new and are to be designed in accordance with CDPHE requirements and constructed by skilled contractors under the inspection of the system Owner, AVR AH LLC, and its engineering representatives. Disinfection of both wells, storage tank, equipment and pipelines will be in accordance with American Water Works Association standards as required by the contract documents for the various projects — and in accordance with design drawings and specifications approved by CDPHE 5 TECHNICAL KNOWLEDGE AND IMPLEMENTATION Operator Certification Per Certification of Water Treatment Plant and Wastewater Treatment Plant Operators, as amended 1996, Article 9 of Title 25, Part 100.8.2 the system, being of a capacity of Tess than 2 mgd and using groundwater with no additional treatment beyond chlorine disinfection, is anticipated to be a Class D facility. The system is required to be operated under the direct responsibility of a Class D certified plant operator. Operator Responsibilities The operator's responsibilities will include the following: ® Check of residual chlorine concentrations at the treatment/pump station and at the far end of the distribution system. Monitor amounts of hypochlorite on site and arrange for required deliveries from the chemical supplier. • Compliance monitoring, reporting and record keeping. Collect samples and arrange for annual water quality analyses. • Monitor service pressures, water meters, and tank and well water levels. Track equipment run times and perform regularly scheduled preventative maintenance. o Maintain appropriate spare parts on site for critical equipment. © Arrange for and oversee contractor services when needed. ® Operate distribution system valves in the event of a pipeline break or leak. Arrange for a pipeline contractor to affect repairs. ® Assist with locating buried distribution system pipelines for excavation contractors. ® Respond to alarm conditions and arrange for appropriate corrective actions. • Communicate with AVR AH LLC administration regarding equipment and support needs. Qualified maintenance personnel will be contracted with to assist the operator with major equipment overhaul and with electrical/control problems. AVR AH LLC will make arrangements with a local pipeline contractor to make emergency repairs to distribution pipeline breaks. 6 Operation and Maintenance Program AVR AH LLC representatives will compile manufacturer's literature describing in detail procedures for the proper maintenance and installation of major equipment. This information will be assembled in three-ring binders along with a written description of the operation procedures of the facilities. Two copies of each O&M Manual are to be compiled; with one to be maintained at the treatment/pump station and one at the AVR AH LLC office (Ranch Center). 7 MANAGERIAL PLAN System Ownership The water rights, water supply wells, storage tank, treatment/pumping station building, distribution piping, and all other appurtenant facilities and assets, including associated property rights are owned or directly controlled by Aspen Valley Ranch AH LLC. It is responsible for the design and construction of all wholesale water system facilities. The responsibility for the water system management and operation will initially belong to the ARV AH LLC, and it will obtain the services of a certified plant operator for the day to day management and operation. ARV AH LLC will assume full responsibility after a sufficient number of houses have been constructed to support the administrative responsibilities and costs of the system. ARV AH LLC responsibilities will include water usage accounting, billing, and payment of system operating expenses (e.g., electrical, insurance, laboratory, contract operator fees, etc.). (No meters are being installed?) It will also be responsible for compliance with the requirements of regulatory agencies for items such as safety, building codes, building permits, etc., as specified by 3.1 of the Design Criteria for Potable Water Systems. The responsibility for the maintenance of disinfection residuals and sample collection as required by the Colorado Primary Drinking Water Regulations will be that of the system operator. The operator and ARV AH LLC are expected to obtain the services of qualified electricians, plumbers, pump installers, and equipment service organizations as may be required to assist with maintenance of the system. System Operation and Management As noted previously, it is anticipated that the system will be a Class D facility and operated under the direct responsibility of a minimum Class D certified plant operator. Startup and Operating Procedures Prior to the beginning of system operations, the tank and pipeline contractor will disinfect the system to AWWA specifications as defined in the Design Criteria for Potable Water Systems. A 10% sodium hypochlorite solution will be mixed with water in the chemical feed pump solution tank. The initial mixture will contain ten gallons of water for each gallon of 10% sodium hypochlorite. The chemical feed pumps will be primed and connected to the injectors. Each well pump control will, in turn, be switched to the on or manual position and the operation of the well and chlorinator will be verified. The chlorine in the supply line to the tank will be monitored. The stroke and frequency controls will be adjusted on each chemical feed pump to obtain a 1.5 mg/I total chlorine reading. The pump controls will then be set to automatic operation and the pumps will alternate at each pump cycle. 8 A log of well water meter readings, chemical feeder settings, chlorine solution concentration and solution tank levels will be kept. After the tank has filled, the shutdown of the pumps and chlorinators will be verified. The pressure pump controls will be switched to automatic operation and the operation verified. Pressure pump cut - in and cutout pressures will be adjusted to provide adequate system pressure. System hydrants will be flushed and chlorine residuals monitored at the remote ends of the system. The contract operator is expected to be present at the startup of the water system and will perform the items noted in Startup and Operating Procedures above. As -built drawings and equipment manuals will be available on site. Routine Maintenance Operation and maintenance will include regular chlorine residual monitoring in the distribution system. Logs of water production, hypochlorite usage, and operational changes will be kept by the operator. Hypochlorite solution tanks will be refilled as required. System maintenance will include annual flushing of fire hydrants and lubrication of pumps as specified by the equipment manufacturers. Chemical feed pump suction lines, discharge lines and injectors will be serviced and/or replaced as necessary to provide for proper flow of the sodium hypochlorite solution. Sampling and Analysis Program A water sampling and analysis program consistent with the Colorado Primary Drinking Water Regulations and directives from the Water Quality Control Division will be instituted when a PWSID is assigned. Safety NIOSH compliant protective devices including gloves and a face shield will be provided in the treatment/pump station due to the sodium hypochlorite being stored. The local fire department will be notified of the chemicals used or stored onsite. Emergency Management Plan In the event of an emergency, ARV AH LLC or its designated representative will contact the system operator. The operator and the ARV AH LLC representative will discuss the emergency and decide on a course of action. The ARV AH LLC in cooperation with the operator would obtain the services of leak detection, water line excavation, plumbing and/or electrical contracting organizations, as needed. In the event of a major water line leak, the operator would consult the as -built system drawings and close the appropriate system valves to limit system water loss until the leak is repaired. 9 During the peak month of usage at full build -out and no reduction in irrigation, the 160,000 gallons of storage tank capacity can supply water to the system for approximately 2 days without additional water from the wells. No standby generator is envisioned during the initial system design; however provisions to add a generator will be incorporated into the system design such that the ARV AH LLC could quickly and economically add a generator if it determines there is a need. Operations and flllaintenarnce Manual An operations and maintenance manual, following the minimum outline from the State of Colorado New Water System Capacity Planning Manual, will be completed and made available to the water system administrator, Owner and to the certified water treatment plant operator. The manual will be completed and placed in service within three months after receiving a PWSID. 10 FINANCIAL CAPACITY Capital and 0 IUl Cost Responsibility All capital costs for construction of the water system facilities are being borne by the developer, ARV AH LLC on a cash basis (no debt). It will also cover the full costs of operating and maintaining the system. The ARV AH LLC will have the ability to finance the expected annual costs to operate and maintain the system. Credit Worthiness The ARV AH LLC is financially healthy. It has access to private capital sources to finance the water facilities. Fiscal Management and Controls This is to be a privately owned system, serving only customers related to the ARV AH LLC. (RESOURCE) analyzed the water quantity and quality for a new well located at 180 W Pasture Lane Woody Creek, Colorado. The pumping test for the well was conducted on January 14th through 15th, 2014, under the direction of RESOURCE. The data for the pumping test was collected by Ray s Well Done Pump Service, LLC (Ray's) and RESOURCE. A water sample from the well was obtained on January 14th, 2014 and submitted to National Testing Laboratories, Ltd. for analysis. SUMMARY The 180 W Pasture Lane Well has a valid monitoring well permit (Permit No. 293077) issued by the Division of Water Resources. The monitoring well permit allows for drilling the well, testing the yield and sampling the water quality. The well has an estimated long-term yield of approximately 40-50 gpm based on a 24-hour pumping test and recovery data. The well water quality shows hard water. However, the water sampled from the well is suitable for domestic uses. WATER WELL Well Construction The well was constructed on January 9, 2014, by Shelton Drilling. The well is approximately 105 feet deep and is constructed with 7-inch steel surface casing to approximately 63 feet. Perforated 5.5- inch steel casing was installed in the boulders, cobbles sand and gravel water producing zone from 80 feet to 105. At the time of the well construction, static water level was 75 feet from the top of casing (TOC) and the estimated well production was 15 — 20 gpm. Pumping Test A pumping test was conducted on January 14th through January 15th for the well. A Goulds 25GS15 pump was temporally installed for the test. The test was conducted for a full 24 hours using a step test approach. In the step test the discharge rate was started at an initial low constant rate of 15 gpm. The discharge rate was increased progressively higher to 20 gpm and then 30 gpm. Each step lasted approximately 30 minutes until the pump was at full capacity. Each step was of sufficient duration to allow dissipation of the well casing storage effects. Therefore, the aquifer was given enough time to stabilize. Data was collected approximately every minute during the step test. A water meter was used to measure the instantaneous flow rate and the volume of water pumped throughout the pumping test. The initial water level was 73.5 feet below the TOC as shown in Figure 1. The initial pumping rate was approximately 15 gpm. The well had a total drawdown of approximately 1.1 feet as shown in Figures 2 and 3. At approximately 4 hours into the test the aquifer began to recharge. The recharge was mostly likely caused by the pump discharge being decreased for a short time or water infiltrating into the aquifer. The drawdown was projected assuming a continuous drawdown. The final water level at the end of the pumping part of the test was projected to be 74.6 feet, leaving approximately 25 feet of water above the pump intake. Over the 24-hour pumping period approximately 43,851 gallons was pumped, resulting in an average pumping rate of 30.2 gpm. Analysis Figures 2 and 3 shows the water level in the well dropped 0.1 ft. when the pump discharge was set at 15 gpm. Similarly when the discharge was set to 20 gpm, the water level dropped another 0.12 ft. When the pump was set at approximately 30.5, the well dropped another 0.4 ft. and then steadily declined until the water level was at 0.78 ft and then the aquifer slightly recharged. The small decline in the aquifer is attributed to the well being drilled in an unconfined alluvial aquifer. The aquifer is extensive and hydraulically connected to Woody Creek and the Roaring Fork River. Figures 4 and 5 depict the water level recovery in the well in the time after pumping ceased. T represents the total time since the pumping test started and T' represents the time since pumping stopped. The well reaches complete recovery at T/T' equals more than 2 (48 hr/24 hr), which means the well recovered faster than the rate at which the well was pumped. This indicates that, at the time of the test, the well completely recharged at a rate equal to or more than the 30.5 gpm average pumping rate. The data from the pressure transducer was analyzed to determine the Transmissivity (T) of the soil surrounding the well and the long term pumping rate (Q) of the well. The transmissivity is a measure of how much water can be transmitted horizontally to the well. The modified Theis method or the Cooper -Jacob Straight -Line Method was utilized to calculate transmissivity. This method was used to calculate the coefficient of transmissivity from the slope of a semi - logarithmic plot of time verses residual drawdown as shown on Figure 2. Using T = 4.1 ft2/min (44,450 gpd/ft.), Q = 4.1 ft3/min (30.2 gpm), s = 1.1 feet, t = 1440 minutes, r, = 0.25 feet (6 inch diameter well), the storage coefficient (S) was calculated to be 0.15 ft./ft. The storage coefficient was used to calculate the long term yield. The drawdown in the well was limited to 2 ft. and one year was used for time to ensure that the long term yield was calculated. Using S = 0.15 ft./ft., T = 4.1 ft2/min (44,700 gpd/ft ), s = 2.0 feet, t = 525,600 minutes (1 year), rW = 0.5 feet (6 inch diameter well), the long term pumping rate (Q) was calculated to be 5.17 ft3/min (38.7 gpm). The long term yield of the well appears to be in excess of the 30 gpm pumping rate achieved during the 24 hour test. RESOURCE estimates the long term yield of the well at approximately 40 to 50 gpm, depending upon how much the aquifer is drawn down. RESOURCE RESOURCE Kevin Patrick Page 4 February 21, 2014 recommends drilling a second well to provide a redundant supply and to allow for pumping at a flow rate that would not push the estimated maximum yield of the well. WATER QUALITY RESOURCE collected one water quality sample from the well water during the pumping test. The sample was shipped by overnight delivery under proper chain of custody to National Testing Laboratories (results attached). The results indicate that the well water meets the basic EPA primary and secondary drinking water standards. However, the well water did reveal a hardness of 230 mg/I, which is considered very hard. Hard water can cause scale to build up on water fixtures and lessen effectiveness of soaps. RESOURCE recommends installing individual water softening equipment as may be desired for each of the individual potable water uses. WATER RIGHTS The existing well was drilled under well permit No. 293077 issued by the Colorado Division of Water Resources (DWR) for a monitoring test well. A production well permit will need to be obtained to allow the well to be used for the AVR water system. The existing test well and the future well are/will be located within Service Area A of the Basalt Water Conservancy District (BWCD). An Area A Water Allotment Contract will be obtained from BWCD to replace the depletions from pumping of the wells. The BWCD Water Allotment Contract will provide the water rights necessary to obtain production well permits from the DWR. Please call if you have any questions or need additional information. This also dictates the need for 100 percent reliability. For this development, all buildings will be required to be sprinkled. Per ISO procedures, this reduces desired outside hydrant demand by 50%. Sprinkler design criteria should not affect distribution pipe sizing or other system design. It will affect customer service line sizing. Although (generally) sprinkler system installers prefer higher pressures, systems can be reasonably designed to function with pressures above 60 psi. Design fire flows are affected by structure size, use, and density. Information from the Aspen Fire Districtis that design hydrant flows should be 1,000 gpm for a 2-hour period. For safety factor (possible higher demand) it is recommended that a 1,200 gpm rate be used for fire protection flow design. This flow requires a residual pressure greater than 20 psi. 1 OVERVIEW The scope of this Master Plan is limited to the potable water system. All pastures, hay fields, and larger open area irrigation water is to be raw water from separate irrigation systems. Water is to be supplied from existing approved ponds and ditches. The lower irrigation system (for all areas below the Core area) may be be supplied from the lower pond, using a pumped pressursystem. Design of building may be integrated with the potable system as the Owner would like to minimize the number of structures on the Ranch — therefore, the two pumping stations may be combined into one building. The proposed Potable Water Master Plan is illustrated on the attached Drawing 1. The water supply will consist of 2 wells, developed in the Roaring Fork alluvium. Development of this source (drilling the wells and water rights issues) is the responsibility of Resource Engineering. Reuslts of their work are: Two similar wells will be developed, located approximately where shown on Drawing 1. Sustainable capacity of each well is 35 gpm or more. Basic water quality is suitable for potable use, requiring only disinfection treatment. Tested water quality results are shown in Table 1. The proposed water supply facilities will consist of: Two submersible well pumps with pitless adapters, each having a capacity of 35 gpm or greater. Well completion details to meet CDPHE criteria. Each well pump will deliver raw water to the central treatment plant/pumping station, using separate 2-inch interior diameter (ID) pipes. WATER TREATMENT/PUMPING STATION This building is to be located as shown on Drawing 1. It may be expanded to also provide for two irrigation pumps. Field reconnaissance determined that the highest reasonably available tank site would be on the previously platted Aspen Downs Lot 6 (which is not to be used for a private residence). The probable high water level (HWL) of this tank is 7,580 ft. The static pressures shown on Table 2 assume this tank site with a 10 ft. operating water level of 7,576 ft. Because of line sizing to accommodate fire flows, actual dynamic pressures will only be slightly lower. These have been sited to provide reasonable accessibility to each proposed structure. Fire hydrant locations are tentative; the Fire Department should review final design and advise as to precise location. Appropriate pipe selection for distribution systems in the mountain areas include ductile iron pipe (DIP) or high density polyethylene (HDPE). If HDPE is used, pipe locate records must be good (as -built drawings and locater wire). Actual pipe selection and piping details will be made during the Final Design Phase. Pipe sizes shown on Drawing 1 are ID. These sizes have been determined as adequate to provide design fire flows simultaneously with average day other demands. STORAGE TANK This system will have relatively high peak demands (as compared to the average daily demand) and can have extremely high fire fighting demands. With the realtively small, constant supply capacity, stored water is mandatory. It is always preferable to deliver peaking water by gravity (pumping not required) which is the situation here. Storage is designed to provide: Peaking Demands. The peak period use which exceeds the supply rate. This volume required is estimated to be 20,000 gallons. Reliability Storage. The system should be designed to supply normal demands with one well out of service. High service pumping capacity will be firm, i.e. adequate with one pump out of service. In the case of one well outage — reliability storage for a 7-day period would be approximately 100,000 gallons during a full occupancy summer peak period. Under average use conditions, or with curtailed irrigation, a volume of 10,000 gallons would usually be adequate. Storage should also be available for area power outage (unless standby power generation is provided). Approximately 80,000 gallons would be adequate for a two day outage during summer months. 80,000 gallons would provide full occupany water for over a week during the winter (no irrigation) season. Fire Fighting. Design fire fighting flow is 1,000 gpm (gallons per minute) for two hours — or 120,000 gallons. Because of the possibility of unusually large residences, the use of 1,200 gpm fire flow is recommended to provide a safety factor. This results in a design fire flow of 144,000 gallons. Summary Standard practice for municipal system design does not assume that a fire and a supply outage will occur at the same time. The recommended tank size is approximately 160,000 gallons. This tank will be approximately 40 ft. outside diameter with a side wall depth of 20 ft. The tank is to be reinforced concrete, complete buried, with the surface restored to the existing shape. An access hatch and vent will be visible. Depending on the selected control system, a nearby antenna may be necessary. Hyman Ave. Aspen, CO 81611 RE: Request for Information; Di inking Water Plans Submittal Aspen Valley Ranch, AH LLC, Aspen Valley Ranch Potable Water System Public Water System Identification (PWSID) No. CO0149124, Pitkin County Dear Mr. Peterson: Colorado Department of Public Health and Environment The Colorado Department of Public Health and Environment (Department), Water Quality Control Division has received and reviewed the plans and specifications, dated March 4, 2014 for the Aspen Valley Ranch, AH LLC, Aspen Valley Ranch Potable Water System. Because the Aspen Valley Ranch does not meet, or will not soon meet, the definition of a public water system as defined by Section 11.3(57) of the Colorado Primal y Di inking Water Regulations (Regulation 11), the Department does not have the authority by Regulation 11 to approve or deny the plans and specifications for const► uction of the water system. Howevei, the Department performed a preliminary review of the plans and specifications to determine general compliance with the requirements of the State of Colorado Design 0 iteria For Potable Water Systems (Design Criteria). At the time Aspen Valley Ranch meets, or would soon meet, the definition of a public water system, final plans and specification for the water system must be submitted to the Department for review and approval in accordance with Sections 11.4(1)(a) and (b). The Department will conduct a review of the submittal (i.e., plans, specifications, capacity assessment) in accordance with the requirements of Regulation 11 and the Design Criteria in effect at that time. The proposed public water system design does not meet the requirements of the Design Criteria and the review process for this project has been placed on hold because of the following issues: 1. According to Section 1.2.3(a) of the Design Criteria, the submittal requires water quality data to be collected or existing data summarized to either confirm the quality of a new source or to justify the selection of a treatment process. For each new groundwater source, a raw water analysis for all applicable MCL parameters for which the supplier of water is responsible for maintaining compliance must be submitted, with at least two full sample sets in different calendar quarters (four quarters of data are recommended). The submittal appears to have included one set of sample results from the proposed aquifer, and the sample results do not appear to include all the required raw water chemical analyses. Please provide two full sets of sample results from different calendar quarters to complete the raw water analysis (for each well if drawing water from different depths). Community systems are required to submit the following raw water chemical analyses: inorganics, nitrate, nitrite, sodium, corrosivity (temperature, pH, alkalinity, calcium, and TDS or conductivity), radioactivity, and organics. Section 1.2.5(a) of the Design Criteria requires that the system demonstrate adequate water rights and permits through the Office of the State Engineer, Department of Natural Resources, Division of Water Resources (DWR). The engineering report indicates there will be two wells with a capacity of 40-50 gpm each. However, only one well permit was provided, and the permit authorized the use of the well to monitoring water levels and/or water quality sampling. To confirm the system has adequate water rights and permits, please provide additional information for the two wells, including the well log and the appropriate permit/application for each of the wells. 3. According to Section 1.2.5(d) of the Design Criteria, for new and updated pumping installations, supporting pump curves and limitations to provide adequate pumping capacity must be piovided. The engineering report indicates the pump station will meter and deliver treated water to the distribution system (including the finished water storage tank) using two 50 gpm centrifugal pumps. To check that the proposed pumps can supply adequate capacity at peak demands against the required distribution system pressure, please provide the system head curve, head computations for design conditions of the pumping system, and pump curves. 4. According to Section 1.2.5(b)(i) of the Design Criteria, identification of treatment goals including regulatory compliance requirements and process goals must be specified in the engineering report. The design proposes to utilize an ultraviolet (UV) reactor for additional disinfection treatment; however, no design parameters or calculations were provided for the UV treatment unit. Please specify if the UV unit will be used for regulatory compliance, and if so, please provide the additional information needed to review the UV unit for compliance with the design criteria listed in Section 4.4.9 of the Design Criteria. 5. In accordance with Section 2.10 of the Design Criteria, sample taps must be provided so that water samples can be obtained from each water source and from appropriate locations in each operating treatment unit and from the finished water. Based on the drawings, no raw water sample taps are provided for the wells. Please provide additional information, such as updated drawings, indicating that raw water sample taps will be provided. 6. According to Section 4.4.1.7 of the Design Criteria, the chlorine solution injector/diffuser must be compatible with the point of application to provide a rapid and thorough mix with all the water being treated. The diawings indicate that the chlorine feed discharges into the clearwell. This type of application does not seem to provide efficient mixing. Please piovide technical information on the application of the chlorine feed point to assure dispersion and thorough mixing of the chlorine within the clearwell. In addition, please specify the location of the chemical feed point for each well as the detail provided in the diawings indicates a single feed line. 7. In accordance with Section 4.4.2.c of the Design Criteria, groundwater systems must be designed for the capability to provide 4-log virus inactivation. Based on information in the submittal, the system has elected to perform triggered source water monitoring with the capability to provide 4-log inactivation of viruses in the event of a triggered source water event. The submittal package did not appear to provide disinfection calculations demonstrating the capability to achieve 4-log reduction/inactivation of viruses for the treatment facility. The calculation provided calculates the detention time provided in the serpentine contact tank (clearwell). Please provide chlorine contact time calculations that demonstrate the capability to achieve 4-log reduction/inactivation of viruses, accounting for the system's peak flow demand, minimum contact time volume with the appropriate baffling factor, pH, and minimum water temperature. 8. In accordance with Section 5.1.1.a of the Design Criteria, where a chemical feed is necessary for the protection of the supply including chlorination, coagulation and other processes required by regulatory requirements (e.g., pH adjustment for lead and copper compliance), a standby unit or a combination of units of sufficient size to meet capacity must be provided to r eplace the largest unit when out of service, and the Department may require that more than one be installed. In accordance with Section 5.1.2 of the Design Criteria, feeders may be manually or automatically controlled, with automatic controls being designed so as to allow override by manual controls, and proportioned to flow. The submittal indicates the chlorine dosing rate is fixed injection adjusted to maintain a 1.5 mg/1 free chlorine residual; however, the design does not discuss how the chemical feed pumps will be controlled (e.g., activated via pressure switch) and how the chemical feed rate is proportioned to flow. Please discuss how the chemical feed pumps will be controlled, and how the chemical feed rates will be determined. 10. In accordance with Section 5.1.10 of the Design Criteria, storage tanks for liquid chemicals must be specified for use with individual chemicals. The Department understands sodium hypochlorite will be used for disinfection; however no equipment specifications were provided fot the chemical storage tank. Please provide information pertaining to the sodium hypochlorite feed tank including volume, material, cover, and secondary containment. 11. Section 7.0.6.a of the Design Criteria requires adequate controls be provided for tank turn over to maintain water quality. Control design must facilitate turnover of water in the finished water storage tank to minimize stagnation and/or stored water age. The design indicates the 160,000 gallon buried concrete storage tank will be fitted with a hydraulic mixer, and operated to reduce the average residence time of the finished water. To check that the stored water age will be managed appropriately, please provide a description demonstrating how the system will plan to manage the water quality in the finished water storage tank. Water storage management for water quality must take into account influent water quality, retention of fire flow, demand management, as well as factors specific to the design and operation of the tank such as fluctuation of the water levels in the storage tank for complete water turnover. 12. In accordance with Section 7.0.7.a of the Design Criteria, all storage structures must be provided with an overflow. The setpentine contact tank (clearwell) does not appear to be constructed with a tank overflow. Please update the design/drawings to include an overflow. 13. In accordance with Section 7.0.7.h of the Design Criteria, the top of the overflow must be a minimum of one foot below the lowest point of the roof structure. Based on the information provided, the separation distance from the underside of the roof of the 160,000 gallon buried concrete storage tank and the top of the inlet of the overflow is 0.83 feet. Please update the design/drawings to provide the minimum of one foot of sepai ation between the top of the overflow and the lowest point of the roof structure. 14. In accordance with Section 7.0.8 of the Design Criteria, finished water stoi age structures must be designed with reasonably convenient access to the interior for cleaning and maintenance, and at least two access openings must be provided above the waterline at each water compartment. The 160,000 gallon buried concrete storage tank appears to have one access point to the tank. Please update the design to include two access points to the interior of the tank for cleaning and maintenance as required by this criteria. As stated in this Section of the Design Criteria, each access opening must be elevated at least 24 inches above the top of the tank or ground surface and be fitted with a solid water and insect tight cover which overlaps a framed opening and extends down around the frame. The frame must be at least four inches high. Each cover must be hinged on one side, and must have a locking device.
