COMMISSIONERS OF PITKIN COUNTY, COLORADO, APPROVING AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE BOARD OF COUNTY
COMMISSIONERS OF GARFIELD COUNTY, COLORADO AND THE BOARD
OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO
REGARDING THE HOUSING OF PITKIN COUNTY DETAINEES AT THE
GARFIELD COUNTY JAIL
RESOLUTION NO. 015-2021
RECITALS
WHEREAS, Pursuant to Section 2.8.3 (Actions) of the Pitkin County Home Rule Charter
(“HRC”) official action by formal resolution shall be required for all actions of the Board of
County Commissioners (“BOCC”) not requiring ordinance power on matters of significant
importance affecting citizens, and;
WHEREAS, The Board of County Commissioners of Pitkin County under the authority
granted pursuant to C.R.S. Section 29-1-2-1 and Article XIV, Section 10 of the Colorado
Constitution is hereby entering into an Intergovernmental Agreement with the Board of
County Commissioners of the County of Garfield, Colorado.
WHEREAS, The Pitkin County Sheriff’s Office operates a county jail (the “Pitkin County
Jail”), as required by Colorado Statutory law.
WHEREAS, the Pitkin County Board of County Commissioners provides funding for the
operation and maintenance of the Pitkin County Jail.
WHEREAS, the Garfield County Sheriff operates a county jail (the “Garfield County Jail”),
as required by Colorado Statutory law.
WHEREAS, the Garfield County Board of County Commissioners provides funding for the
operation and maintenance of the Garfield County Jail.
WHEREAS, the parties desire to enter into the Intergovernmental Agreement between the
Board of County Commissioners of Garfield County, Colorado and the Board of County
Commissioners of Pitkin County, Colorado regarding the housing of Pitkin County
Detainees at the Garfield County Jail, attached hereto, which provides the specific terms
and conditions by which Garfield County and the Garfield County Sheriff’s Office will
house Pitkin County Inmates in the Garfield County Jail.
WHEREAS, The Board of County Commissioners has determined that the emergency
circumstances that warrant the enactment of this Resolution immediately upon adoption are
based on the Pitkin County Sheriff’s statement that the Pitkin County Jail is no longer safe
and secure for the housing of Pitkin County Detainees and presents a risk to Sheriff’s Office
personnel.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado that it hereby approves An E1 mergency Resolution Of The Board Of County Commissioners Of Pitkin County, Colorado, Approving An Intergovernmental Agreement
Contract No. 067.21 - BOCC

Between The Board Of County Commissioners Of Garfield County, Colorado And The
Board Of County Commissioners Of Pitkin County, Colorado Regarding The Housing Of
Pitkin County Detainees At The Garfield County Jail and authorizes the Chair to sign the
Resolution and upon the satisfaction of the County Attorney as to form, execute any other
associated documents necessary to complete this matter. This Resolution is effective as of the
date of adoption.
