HomeMy WebLinkAboutlight.minor.plat.amendmentREADING ON RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO APPROVING THE LIGHT MINOR PLAT AMENDMENT TO MOVE THE BARN ENVELOPE TO THE NORTH MEMORANDUM TO: Board of County Commissioners Regular Meeting- June 11,2003 THRU: Cindy Hduben, Community Development Director FROM: Ezra Louthis, Planner RE: Light Minor Plat Amendment REQUEST: The applicant is requesting to amend the original barn envelope for Tract D of the McCabe Ranch Low Impact Subdivision. The applicant is requesting to move the envelope approximately 50 feet to the Northwest in order to avoid having to cut a mature stand of Oak for the wildfire mitigation. Section 6.1.1, of the Protective Covenants for the McCabe Ranch Subdivision states that the placement of any outbuilding or barn outside the approved location during the original review requires review by the Board of County Commissioners. Thus the relocation of the barn envelope for Tract D requires BOCC approval. APPLICANT: Jim Light REPRESENTATIVE: Larry Yaw LOCATION: Tract D, McCabe Ranch Subdivision ZONING/LOT SIZE: RS-30 PUD/30.76 acres BACKGROUND: On March 15, 1994, the McCabe Ranch Subdivision received Final Plat approval pursuant to Board of County Commissioners' Resolution No. 94-33. During the original review process, the site locations of the building and barn envelopes were sensitive to the surrounding neighbors' views. The neighbor to the West (McBride) expressed concern about the visibility of the building sites in the original subdivision review. Throughout this Minor Plat Amendment Application, Mr. McBride has been notified of the proposed change to the barn envelope. The first proposed barn envelope amendment was unsatisfactory to Mr. McBride, but through subsequent meetings, and changes, Mr. McBride has since written a letter confirming that he is okay with the new proposal with a couple of restrictions (Exhibit A). Mr. McBride has requested that the ridge of the West roof would be no lfigher than 14 feet, and the edge of the West roof be no more than 9 feet. REFERRAL COMMENTS: The application was referred to, but no comments were received from the Snowmass/Capitol Caucus, and the County Wildlife Biologist. STAFF COMMENTS: Minor Plat Amendments: Pursuant to Section 3-190-080 of the Land Use Code, the Community Development Director may approve a minor plat amendment subject to compliance with the following standards. A. The amendment increases or does not affect the degree of compliance with Code standards; Response: The proposed amendment to move the barn envelope will increase compliance with Section 3-80-070 (Wildfire) of the Pitkin County Land Use Code. Additionally, the proposed amendment will preserve an existing stand of oak that screens the house from the subdivision road. B. The amendment is being made to a recorded plat which has been a~vproved by Pitkin County; and Response: The amended plat showing the adjusted barn envelope will be recorded at the Pitkin County Clerk and Recorder. C. The amendment is consistent with representations made during the conceptual and detailed subdivision reviews, whichever is at~plicable. Response: Sensitivity to the neighbors' views was part of the McCabe Ranch Subdivision original review. Throughout this amendment application, the neighbors have been involved in order to be consistent with the original review. Staff has no knowledge that the amendment is not consistenf with other representations made during conceptual or detailed subdivision review. The homeowners architectural committee approved the envelope shift. RECOMMENDATION: Staff recommends that the Board of County Commissioners approve the Light Minor Plat amendment to move the barn envelope to the North on Tract D of the McCabe Ranch Subdivision. John McBride's Letter RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, APPROVING THE LIGHT MINOR PLAT AMENDMENT TO MOVE THE BARN ENVELOPE TO THE NORTH Resolution No. -2003 RECITALS 1. Jim Light ("Applicant"), has applied to the Board o£ County Commissioners of'Pitkin County, ("BOCC"), pursuant to Section 3-190-080 of the Pitkin County Land Use Code ("Code"), to move the existing barn envelope approximately 50 feet to the North. 2. The property is zoned RS-30 PUD and contains 30.76 acres. 3. The property is located in the McCabe Ranch Subdivision and is more specifically described as Tract D, McCabe Ranch. 4. McCabe Ranch received Final Plat approval pursuant to Board of County Commissioners' Resolution No. 94-33. 5. The BOCC generally finds that the request to move the existing barn envelopd 50 feet to the North is consistent with the requirements of'the Land Use Code. NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby approve the Light Minor Plat Amendment to move the existing barn envelope approximately 50 feet to the North subject to the following conditions: 1. The Applicants shall comply with the p[ovisions of Board of County Commissioners' Resolution No. 94-33 unless otherwise replaced or amended by the conditions of this approval. 2. The Applicant shall prepare an amended 1041 Hazard Review Site Plan in accordance with Land Use Code Section 5-40. The amended plat shall be submitted to the Community Development Department for approval and recording, prior to submission of any future building permit applications. 3. The Applicant shall adhere to all material representations made during the application process. 4. The ridge of the West roof shall be no higher than 14 feet. The edge of the West roof shall be no higher than 9 feet. The roof color shall be of dark tone. APPROVED AND ADOPTED on the 11u~ day of June, 2003.
