RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO, DENYING AN EXTENSION OF VESTED REAL PROPERTY RIGHTS FOR THE
LITTLE CHIEF LODE

RECITALS
1. Lyle Reeder ("Applicant") has applied to the Pitkin County Board of County Commissioners
("BOCC') pursuant to Section 4-140-30 o£the Land Use Code ("Code") to extend the vested rights for
three years to construct a 1,000 square toot cabin on a parcel within the Rural/Remote zone district.
2. The property is located in Van Horn Park above the Hunter Creek Valley, and is described as the
Little Chi&Lode, USMS 6624.
3. The property is zoned Rural/Remote and contains 9.8 acres.
4. The BOCC denied the Applicant's request for 1041 hazard review, conceptual submission and
special review approval £or a cabin site within the Rural/Remote zone district, pursuant to Resolution No.
018-2001. The BOCC subsequently found a taking as a result of'the denial and remediated the taking
pursuant to Resolution No. 034-2001.
5. Condition #17 of Resolution 034-2001 states, "This approval and takings remediation shall be
valid for two years from this date (February 14, 200]) and thereafter any development on the property
must comply with these conditions and any subsequent changes to the County Land Use regulations."
6. The BOCC heard this application at a duly noticed public hearing on May 28, 2003 at which time
evidence and testimony were presented with respect to this application.
7. The BOCC finds that the proposed extension of vested rights does not provide any significant
benefit to the County and is, tbere£ore, inappropriate.
8. The BOCC further finds that there is no compelling reason for the County to "extend" the vested
rights, given that a statutory vested right was not established as a result o£the original approval being
granted as a takings remediation, and that the approval is still valid, subject to changes in the Code.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby deny an Extension of Vested Property Rights £or the Little Chi&Lode.
